Resolved, That a warrant payable from the Sinking Fund for the Payment of the Interest on the City Debt be drawn in favor of the Chamberlain in the sun of $198.72 for deposit in the City Treasury to the credit of "Croton Water Rent Refunding Account," for refunding of erroneous and overpayments of Croton Water Rents as per statement submitted.

Refunding of Jury Fees Paid in Cases Settled Before Trial.

The Deputy and Acting Comptroller presented the following report and offered the following resolution:

Honorable Commissioners of the Sinking Fund:

December 1, 1916.

Gentlemen-On various dates the attorneys mentioned in the schedule attached paid as jury fees to the clerks of the several District Municipal Courts of the City of New York the sums stated in said schedule.

Pursuant to section 118 of the Municipal Court Code and in accordance with the directions of the Bureau of Law and Adjustment of the Department of Finance, approved by the Deputy Comptroller, these sums are to be returned to the payors, the actions having been settled or discontinued and not brought to trial.

Said accounts were deposited with the Chamberlain of the City of New York to the credit of the Sinking Fund for the Payment of the Interest on the City Debt. and the refunds will be made from that fund through an account known and designated on the books of this department as Code T 52, Jury Fees Refunding Account. The attached resolution is necessary to reimburse the said account for the amount so paid. Yours very truly.

Refund to Abraham Goldstein of Amount Paid as a Fine. The Deputy and Acting Comptroller presented the following report and offered the following resolution:

Honorable Commissioners of the Sinking Fund:

December 1, 1916.

Gentlemen-In the matter of the People of the State of New York vs. Abraham Goldstein the defendant appealed at a Term of the Appellate Division of the Supreme Court held in and for the First Judicial Department, in the County of New York, on the 20th day of October, 1916, from a judgment of conviction in the Court of Special Sessions of the City of New York on the 17th day of December, 1915, wherein said defendant was found guilty of a misdemeanor in violating subdivision 8 of section 2354 of the Penal Law of the State of New York and fined $100, which was paid and sub

sequently deposited with the City Chamberlain to the credit of the Sinking Fund for the Payment of the Interest on the City Debt.

This appeal was argued on October 20, 1916, and the judgment of conviction was reversed, and it was ordered that the Comptroller of the City of New York refund to said Abraham Goldstein the sum of $100 so paid.

In order to carry into effect the order of the Court a resolution is attached hereto for your adoption. Yours very truly,

Gentlemen-In the matter of the People, etc., on complaint of Samuel Christian against Sam'l Allenkoff, and the People, etc., on complaint of Frederick Wendell against David Rachin, the defendants appealed at a Term of the Court of General Sessions of the Peace, Part I thereof, held in the Criminal Courts Building, New York, on the 16th day of November, 1916, from judgments of conviction in the City Magistrates' Court, City of New York, for the First District, Borough of Manhattan, wherein the defendants were found guilty of disorderly conduct and a fine of $10 was imposed on each defendant, which was paid and subsequently deposited with the Chamberlain of the City of New York to the credit of the Sinking Fund for the Payment of the Interest on the City Debt.

The appeal war argued at a Term of the Court of General Sessions of the Feace, Part I thereof, and by decisions of that Court the judgments of conviction were reversed, and it was ordered that the Comptroller of the City of New York refund to the defendants Samuel Allenkoff and David Rachin each the sum of $10.

I attach hereto a resolution for adoption to carry into effect the provisions of such orders. Very truly yours,

The Deputy and Acting Comptroller presented the following report and offered the following resolution:

December 1, 1916.

Gentlemen-In the matter of the People of the State of New York vs. Paul H. Sommer, the defendant appealed at a Term of the County Court of Kings County held at the Court House thereof in the Borough of Brooklyn, New York City, on the 23rd day of October, 1916, from a judgment of conviction in the City Magistrates' Court, Borough of Brooklyn, 8th District, wherein the defendant was found guilty of vagrancy and a fine of $2 was imposed, which was paid and subsequently deposited with the Chamberlain of The City of New York to the credit of the Sinking Fund for the Payment of the Interest on the City Debt.

The appeal was argued at a Term of the County Court, Kings County, held at the Court House in the Borough of Brooklyn, and by a decision of that court the judgment of conviction was reversed and it was ordered that the Comptroller of the City of New York refund to the defendant Paul H. Sommer the sum of $2.

I attach hereto a resolution for adoption to carry into effect the provisions of such order. Very truly yours,

Refund to the Nassau Electric Railroad Company of Amount Overpaid in Connection with a Franchise to Construct, Etc., a Single Track Surface Rail. way in Georgia Ave., Brooklyn.

The Deputy and Acting Comptroller presented the following report and offered the following resolution:

Hon. Commissioners of the Sinking Fund:

December 1, 1916.

Gentlemen-On October 27, 1916, The Nassau Electric Railroad Company transmitted to this office a voucher-check for $202.89 in payment of the percentage due under the franchise granted it to construct, maintain and operate a single track surface railway in Georgia Avenue, between Liberty and Atlantic Avenues, in the Borough of Brooklyn, which check was deposited November 9, 1916, to the credit of the Sinking Fund for the Redemption of the City Debt No. 1.

By the terms of the franchise, it is provided that the company shall pay to the city, during the first five years of said franchise, an amount equal to three per cent of its actual gross receipts; and from and after that date it shall pay an amount equal to five per cent of said receipts. The first five year period expired March 30, 1916.

The company, in computing the amount due for the year beginning September 30. 1915, as the percentage on its gross receipts amounting to $4,057.74, transmitted to us the sum of $202.89, being five per cent of said gross receipts for the entire year, instead of computing the amount due for the period from September 30, 1915. to March 30, 1916, at three per cent and for the period from March 30, 1916, to September 30, 1916, at five per cent, as provided by the franchise.

As the amount paid, $202.89, is $40.36 in excess of proper percentage amount due under the franchise, said proper amount being $162.53, it is recommended that the amount overpaid, $40.36, be refunded to the Nassau Electric Railroad Company.

The amount paid, $202.89, by the aforesaid company was deposited with the Chamberlain of the City of New York to the credit of the Sinking Fund for the Redemption of the City Debt No. 1.

In order to make refund of $40.36 to the Nassau Electric Railroad Company I attach hereto a resolution for adoption. Yours very truly,

Gentlemen-Fines for violations of the laws with regard to cruelty to animals, etc., have been imposed and collected in the several City Magistrates' Courts and Courts of Special Sessions of The City of New York during the months of September and October, 1916, and paid into the Sinking Fund for the Payment of the Interest on the City Debt.

Pursuant to law said fines are payable to the several societies indicated. An enumeration of such fines so paid is as follows:
