created and acquired under the provisions of this act, but they shall custody of, not permanently appropriate said fund, or any part thereof, for any purpose or object, or use the same, except such part thereof as may be necessary to defray the expense of its acquisition, investment, and management, unless duly authorized thereto by a two-thirds vote of the members of such corporation, present at an annual meeting thereof. § 7. The directors of the corporations formed under the provisions Officers. of this act shall elect from their number a president, secretary and treasurer, neither of whom shall be the same person or shall hold any other office in said corporation; and said officers shall together prepare and execute annually a report, which shall be verified by their Annual affidavit, and which shall show the whole amount of real and personal property owned by said corporation, where it is located, or how and when it is invested, the amount and nature of the property acquired during the year immediately preceding the date of said report, and the manner of its acquisition; the amount applied, appropriated or expended during the year immediately preceding the date of said report, and the purposes, objects, or persons, to or for which such application, appropriation or expenditure has been made. Such report shall be presented to said corporation at its annual meeting, and entered in the minutes of its proceedings, and shall, within thirty days thereafter, be filed in the clerk's office of the county in which said college or university is located.

§8. AN ACT to authorize the present surrogate of the county of Warren to sign and perfect certain records of his predecessor in office.

PASSED June 3, 1882; three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The present surrogate of the county of Warren or his Surrogate successor in office is hereby authorized and empowered to sign his to sign name as surrogate to all records and entries upon the books of record etc. in his office which are or have been unsigned by his predecessor or predecessors in office specifying thereon the date of such signing.

§ 2. After such signing by the present surrogate or his successor in office, such records shall have the same force and effect as if the same had been originally signed by such predecessor or predecessors. §3. This act shall take effect immediately.

AN ACT making appropriations for the support of government.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The several amounts named in this act are hereby appropriation. priated and authorized to be paid from the several funds indicated, to the respective public officers, and for the several purposes specified, for the fiscal year beginning on the first day of October, in the year one thousand eight hundred and eighty-two, namely:

FROM THE GENERAL FUND.

EXECUTIVE DEPARTMENT.

For the governor, for salary, ten thousand dollars.

For the lieutenant-governor, for salary, five thousand dollars.

For the private secretary of the governor, for salary, four thousand dollars.

For the clerks, a stenographer and a messenger in the executive department, including the military secretary and messenger, for full compensation, eleven thousand five hundred dollars.

For furniture, blank and other books necessary for the use of the executive department, binding, blanks, printing, stationery, telegraphing and other incidental expenses thereof, four thousand dollars.

For the apprehension of criminals, one thousand five hundred dollars.

For the apprehension of fugitives from justice, one thousand five hundred dollars.

For repairs, furniture and incidental expenses of the executive mansion, two thousand dollars.

For the justices of the supreme court in the second judicial district, not residing in the county of Kings, for additional compensation, pursuant to chapter seven hundred and sixty-five of the laws of eighteen hundred and sixty-eight, five thousand dollars; and for the stenographers appointed under said act, four thousand dollars; said amounts to be paid only from moneys which shall have been or shall be paid into the treasury for taxes levied for the purposes of said act, and in pursuance thereof.

For the expenses of the general terms of the supreme court, three thousand dollars.

For the several judicial district law libraries six thousand dollars.

OFFICE OF THE ATTORNEY-GENERAL.

For the attorney-general, for salary, five thousand dollars. For deputies in the office of the attorney-general, for salaries, eight general." thousand dollars.

For clerks, a stenographer and a messenger in the office of the attorney-general, for salaries, nine thousand dollars.

For furniture, books, binding, blanks, printing and other necessary expenses of the office of the attorney-general, seven hundred and fifty dollars.

For expenses and disbursements of the attorney-general, which shall be allowed to him in lieu of, and in full of all expenses now allowed by law for the year, beginning the first day of January, eighteen hundred and eighty-two, the sum of sixteen hundred dollars, payable quarterly.

For costs of suits, fees of sheriffs, compensation of witnesses, and office expenses, the sum of one thousand dollars, and any balance which may now remain on hand of previons appropriations, and the amount paid shall in each case be certified by the attorney-general. The salaries of the deputies, clerks, stenographer and messenger in the office of the attorney-general shall be fixed by the attorney-general, and he shall have the authority to employ as many deputies and clerks as he may need, and a stenographer and messenger, and to designate their salaries out of the appropriations therefor herein made, but the aggregate of their salaries shall not exceed the total of the appropriations herein made for deputies, clerks, for stenographer and for messenger, and the attorney-general may appoint clerks and a messenger and a stenographer, whose salaries shall commence on the first day of March, eighteen hundred and eighty-two, at the amounts fixed by him, the total whereof shall not exceed the sum of nine thousand dollars hereby appropriated.

OFFICE OF THE SECRETARY OF STATE.

For the secretary of state, for salary, five thousand dollars.

For the department of public instruction, for expenses of holding examinations of applicants for state certificates, two hundred and fifty dollars.

OFFICE OF THE STATE ENGINEER AND SURVEYOR.

For the state engineer and surveyor, for salary, five thousand dollars. For the deputy state engineer and surveyor, for salary, four thousand dollars.

For compensation of clerks in the office of the state engineer and surveyor, to assist in the preparation of railroad reports, two thousand five hundred dollars; and for the expense of printing and binding said reports, five thousand dollars.

The salary of the deputy state engineer and surveyor, the compensation of the clerks above mentioned, and the expense of printing and binding as aforesaid shall be refunded to the treasury of the state by

the several railroad companies of this state, in proportion to their respective gross receipts, pursuant to chapter five hundred twentysix of the laws of eighteen hundred and fifty-five and the several acts of the legislature in relation thereto.

For clerks in the office of the state engineer and surveyor, for salaries, three thousand five hundred dollars.

For furniture, books, binding, blanks, printing and other necessary expenses of the office of the state engineer and surveyor, seven hun dred and fifty dollars.

For clerk hire in the bank department and for furniture, books, binding, blanks, printing and other necessary expenses of the office of the superintendent of the bank department, twelve thousand dollars. The aforesaid salary, clerk hire and other expenses above mentioned shall be refunded to the treasury of the state by the several banks, banking associations and bankers of this state in whose behalf they are incurred, pursuant to chapter one hundred and sixty-four of the laws of eighteen hundred and fifty-one.

INSURANCE DEPARTMENT.
