men and assistant mine foremen in the Anthracite mines, first and second grade certificates for mine foremen in the Bituminous mines, shall be granted by the Chief of the Department of Mines to each applicant who has passed a successful examination. The certificates shall be in manner and form as shall be prescribed by the Chief of the Department of Mines, and a record of all certificates granted shall be kept in the Department. Each certificate shall contain the full name, age and place of birth of the applicant, and also the length and nature of his previous service in the mines. Before the certificates aforesaid shall be granted to mine foremen, assistant mine foremen, foremen of first grade and foremen of second grade certificates, each applicant for the same shall pay the sum of three dollars to the Chief of the Department of Mines. The money so received, less the cost of issuing and recording certificates, shall be turned over in due form to the State Treasurer.

Section 8. The Chief of the Department of Mines shall keep in the Department a journal or record of all inspections, examinations and work done under his administration, and copies of all official communications; and is hereby authorized to procure such books, instruments, and chemicals, or other tests, as may be found necessary to the proper discharge of his duties under this act, at the expense of the State. All instruments, plans, books and records pertaining to the office shall be the property of the State, and shall be delivered to his successor in office.

Section 9. The Chief of the Department of Mines is hereby empowered to name an assistant, at a salary stenographer and of sixteen hundred dollars per annum; two clerks, each at a salary of fourteen hundred dollars per year; one stenographer, at an annual salary of ten hundred dollars, and one messenger at a salary of nine hundred dollars per year: And provided further, That the salaries of the Chief of the Department of Mines, his assistants and messenger, shall be paid out of the State Treasury, on the warrant of the Auditor General.

Section 10. The Chief of the Department of Mines shall, at all times, be accountable to the Governor for the faithful discharge of his duties imposed on him by law, and the administration of his office and the rules and regulations pertaining to said Department shall be subject to the approval of the Governor.

Section 11. No person who is acting as a land agent, or as a manager, viewer or agent of any mine or colliery, shall, at the same time, serve as Chief of the Department of Mines under the provisions of this act.

Section 12. All acts or parts of acts inconsistent with this act be and the same are hereby repealed.

AN ACT

To amend section four of an act, entitled "An act to establish a Department of Agriculture and define its duties, and provide for its proper administration," approved March thirteenth, Anno Domini one thousand eight hundred and ninetyfive; increasing the salaries of the chief clerk, stenographer, and messenger of the Department of Agriculture.

Section 1. Be it enacted, &c., That the fourth section of an act, approved the thirteenth day of March, Anno Domini one thousand eight hundred and ninety-five, entitled "An act to establish a Department of Agriculture and to define its duties, and provide for its proper administration," which reads as follows, to wit: "Section 4. There shall be one Deputy Secretary, who shall be appointed by the Governor, for the term of four years, at a salary of three thousand dollars a year, who shall also be Director of Farmers' Institutes. The other officers of the Department shall be appointed by the Governor, for the term of four years, and shall be an Economic Zoologist, a Commissioner of Forestry, a Dairy and Food Commissioner who shall have practical experience in the manufacture of dairy products, and State Veterinarian who shall be a graduate of some reputable veterinary college, who shall receive an annual salary of twenty-five hundred dollars each. The Dairy and Food Commissioner shall, under the direction of the Secretary, perform the duties prescribed by an act approved May twentysixth, one thousand eight hundred and ninety-three. The Governor is hereby authorized to appoint one chief clerk of the Department at an annual salary of sixteen hundred dollars, one stenographer at a salary of eight hundred dollars a year, and one messenger at a salary of six hundred dollars a year; and the Dairy and Food Commissioner, the Commissioner of Forestry, and the Economic Zoologist shall each have a clerk, who shall be appointed by the Governor, and who shall serve under the direction of the respective commissioners aforesaid, and receive a salary of fifteen hundred dollars a year each," shall be and the same is hereby amended to read as follows: Section 4. AN ACT

For the loan of arms and accoutrements to the different contingents, within the State of Pennsylvania, of the Society of American Veterans of the Philippine and China Wars.

Section 1. Be it enacted, &c., That the Adjutant General of the State of Pennsylvania be authorized to issue, from time to time, to the regularly constituted contingents of the Societies of the Spanish-American and China Wars in the State of Pennsylvania, such arms and accoutrements as may be in his control, belonging to the State, as may not be necessary for the arming of the National Guard, on said contingents entering into bonds for the safe-keeping of such arms and return of same when called for by the Adjutant General.

Section 2. Said arms and accoutrements shall be furnished on requisitions from commanders of contingents, and each requisition shall state the number of active members in the contingent, and the arms shall be distributed in proportion to the number of active members in each contingent: Provided, Not less than sixteen stand of arms shall be furnished to any one contingent.

Section 3. The Adjutant General shall have the right to call in said arms, from any or all contingents to which the said may have been issued, at any time, and any contingent disbanding, or in which the active mem

bers do not exceed at least sixteen, shall return the arms furnished them, to the Adjutant General.

The bond, provided in the first section of Conditions of the this act, shall be signed by at least one member of the contingent receiving the arms, or by two or more sufficient sureties, conditioned for the safe-keeping and return of said arms when called for by the Adjutant General or at the disbanding of the contingent, and shall be in the aggregate ten dollars for each rifle furnished to the contingent.

AN ACT

Relating to change of polling-places, and authorizing the county commissioners to change the same.

Be it enacted, &c., That it shall be lawful for the county commissioners of any county of this Commonwealth, at any time at least three weeks prior to any general, municipal, township or special election, for any reason that may seem proper to the county commissioners, upon a petition of at least ten qualified electors of any township election division, to change the polling place of said township or election Change of pollingdivision: Provided, however, That the said county Proviso. commissioners may, in their discretion, direct that an election be held to settle the question as to where the said polling place shall be located.

AN ACT

Providing for the establishment of a State Highway Department, by the appointment of a State Highway Commissioner and staff of assistants, and defining the powers and duties thereof; authorizing the State Highway Department to co-operate with the several counties and townships, and with boroughs in certain instances, in the improvement of the public highways and the maintenance of improved highways; providing for the application of counties and townships for State aid in highway improvement and maintenance; providing for the payment of the cost of highway improvements, made under the provisions of this act, by the State, the counties and the townships, and making an appropriation for this purpose.

Whereas, It is of great importance to the people of this Commonwealth that the public highways should be systematically improved, and that the several counties and townships should be given the aid and encouragement of the State in the building and mainte nance of improved highways; therefore.

Section 1. Be it enacted, &c., That immediately upon the approval of this act, a State Highway Department shall be established by the appointment, by the Governor of the Commonwealth, with the advice and consent of the Senate, for a term of four years, of a State Highway Commissioner, who shall be a competent civil engineer, and experienced in the construction and maintenance of improved roads. Said State Highway Commissioner shall receive a salary of three thousand five hundred dollars per annum, and shall be allowed his actual traveling expenses, not exceeding five hundred dollars, while officially employed. He shall furnish a bond in the sum of twenty-five thousand dollars for the faithful performance of his duty, said bond to be approved by the Governor, and he shall give his whole time and attention to the duties of his position. The said State Highway Commissioner may appoint, as the work of the department requires it, and subject to the approval of the Governor, one assistant, who shall be a capable and competent civil engineer, and experienced in road building, who shall receive an annual salary of two thousand dollars, and shall be allowed his actual traveling expense, not to exceed five hundred dollars, when on official business; and he shall also appoint a chief clerk, at an annual salary of fifteen hundred dollars per annum, and may employ an additional clerk who shall be a competent stenographer, at an expense not to exceed one thousand dollars per annum. The State Highway Commissioner may require the employes of the Department to give bond for the faithful performance of their duty, in suitable and reasonable amounts.

Section 2. The State Highway Department shall be provided with suitable rooms in the State buildings at
