WHEREAS, it is represented that William Bart- R cital.
lett, of Washington county, hath heretofore been
found by a jury, empannelled and sworn by order of
the Washington circuit court, to have been an Idiot,
and that it is in proof that said Idiot was still living
and continuing to be an Idiot on the fourth day of
November, one thousand eight hundred and twenty-
nine, and agreeable to the certificate of the Auditor,
there was, on the first day of November, one thou-
and eight hundred and twenty-nine, seventy-five
dollars due and unpaid to said Idiot: Therefore,

SEC. 1. Sec. 2. Be it further enacted, That the Auditor of F, Sheekles. public accounts issue his warrant on the treasury in favor of Frances Sheekles, for the sum of fifty dollars, being the amount due her for keeping Abraham Sheekles, an Idiot, committed to her charge by the Daviess circuit court, being the amount due for one year, ending the first of December, one thousand eight hundred and twenty-nine.

Sheriff of Estill county.

Approved, January 28, 1830. WHEREAS, William McClain, deputy sheriff of Estill county, failed to return his delinquent list, as collector of fines assessed by the court of assess...ent of the seventy-eighth regiment of the militia of this State: For reinedy whereof,

Be it enacted by the General Assembly of the Comnonwealth of Kentucky, That it shall be lawful for the commandant of the seventy-eighth regiment of the militia of this Commonwealth, to receive the delinquent list of William McClain, deputy sheriff of Estill county, as collector of fines for said regiment, under the same rules and regulations as though said list had been tendered to the court of assessment of said regiment; and the certificate of the commandant of said regiment as to said delinquent list, shall be received and duly regarded by the paymaster of said regiment, in his settlement with said McClain.

CHAP. CCXCVIII.

AN ACT requiring Salt Works to be enclosed.

CHAP. CCXCIX.

AN ACT for the benefit of Micajah V. Harrison, and for other purposes.

WHEREAS, it is represented to the present Gen- Preamble. eral Assembly, that on the twentieth day of August, one thousand eight hundred and twenty-seven, a marriage contract was entered into between Micajah V. Harrison, Dulcinia M. Bledsoe and Albert G. Harrison, by which certain lands and slaves were vested in said Albert G. Harrison, as trustee, for the use and benefit of said Dulcinia and her heirs; and whereas, it appears that the parties to said contract are now willing that said land and negroes be sold, for the purpose of vesting the proceeds thereof in a different manner, for the use and benefit of said Dulcinia and her heirs: Therefore,

SEC. 1. Be it enacted by the General Assembly of the Commonwealth of Kentucky, That it shall be lawful for the parties to said contract or deed of trust to file their petition in the Montgomery circuit court, setting forth the state of facts, with an appropriate prayer in said petition, to the judge of the said court, that the lands and slaves in said deed of trust conveyed, may be sold by said trustee, and the pro

Harrison, and in conformity with the terms and stipulations in said deed of trust. Sec. 2. Be it further enacted, That it shall be lawful for the trustee named in said deed of trust, to sell and convey the lands and slaves conveyed to him in trust therein, after the rendition of said decree, and in conformity thereto, and the proceeds of said sales shall be by him vested in other real estate, in this state or elsewhere, the title to which shall be made to him in trust for the purposes mentioned the proceeds in and specified in said deed of trust, and appropriated to the uses therein set forth.

Sec. 3. Be it further enacted, That the judge of said court may make such other order and decree connected with the interests of the said parties, as to the justice of said cause may belong.

CHAP. CCC.

AN ACT to change the Tobacco inspection in the town of Eddyville.

Approved, January 28, 1830. Be it enacted by the General Assembly of the Commonwealth of Kentucky, That hereafter the new brick ware-house, at the corner of main and water street, in the town of Eddyville, and county of Caldwell, of which Lyon, Cobb and Co. are proprietors, shall be the tobacco inspection in said town, in lieu of the former tobacco ware-house, the property of the same proprietors, any law to the contrary notwithstanding.

CHAP. CCCI.

AN ACT to authorize the Sheriff of Monroe county to execute bond for the collection of the revenue tax and county levy of said county.

CHAP. CCCII.

AN ACT to extend the turnpike and wilderness road to

Crab-Orchard.

SEC. 1. Be it enacted by the General Assembly of the Road extendCommonwealth of Kentucky, That the turnpike and ed to Crabwilderness road leading from Lott Pitman's to Grassy Lick, by way of Mount Vernon be, and the same is hereby extended to the town of Crab-Orchard, in Lincoln county; and it shall be the duty of the overseer of said section of the wilderness road, appointed by the Rockcastle county court, to work upon, improve and keep in repair said road, as far as the town of Crab-Orchard.
