Mr. CONNALLY, from the Committee on Public Buildings and Grounds, submitted the following

REPORT

[To accompany S. 2050]

The Committee on Public Buildings and Grounds, to whom was referred the bill (S. 2050), to authorize a sale of the old Carson City, Nev., mint site and building notwithstanding the provisions of Joint Resolution 18 of February 23, 1865, having considered the same, report favorably thereon without amendment and recommend that the bill do pass.

The purpose of this bill is to authorize the sale of the Carson City mint site and building in accordance with the provisions of either the act of August 26, 1935 (49 Stat. 800; U. S. C., title 40, sec. 345b), or the act of August 27, 1935 (49 Stat. 885; U. S. C., title 40, sec. 304a). The act of August 26, 1935, authorizes the sale by the Secretary of the Treasury of public buildings and the sites thereof, under his control and for which there is no further Federal need, to States or political subdivisions thereof for not less than 50 per centum of the appraised value of the land. The act of August 27, 1935, authorizes the Director of Procurement, with the approval of the Secretary of the Treasury, to sell at public sale to the highest responsible bidder Federal real property for which there is no longer any Federal need.

The enactment of this bill appears to be necessary because of the fact that the joint resolution of February 23, 1865, authorizing the acceptance by the Secretary of the Treasury of title to the site of the building, provided that the property "shall remain the property of the United States." The Acting Secretary of the Treasury in his letter of March 20, 1939, to the chairman of the committee, reporting on the provisions of S. 1030, Seventy-sixth Congress, expressed the opinion that in view of the quoted language it was doubtful whether or not the property could be sold under the provisions of either the act of August 26, 1935, or the act of August

27, 1935. The enactment of this bill would eliminate any doubts with respect to the authority to make such a sale.

The Treasury Department has no objection to the enactment of the bill. The Carson City Mint has been closed since 1933 and the Acting Secretary indicated that the Department does not now have, nor does it anticipate that it will have, use for any space in the building.

R. 5219) making appropriations to supply deficiencies in certain appropriations for the fiscal year ending June 30, 1939, and for prior fiscal years, to provide supplemental appropriations for the fiscal years ending June 30, 1939, and June 30, 1940, and for other purposes, report the same to the Senate with various amendments and present herewith information relative to the changes made.
