provided always, And it is hereby declared to be the true
intent of this act that said collector shall, in all respects,
be governed by the charter of Paducah as far as the same
is consistent with this act, and the sales to have the same
effect, and the same time is given for the redemption of
real estate sold, as prescribed by said city charter.
§ 2. This act shall take effect from its passage.

CHAPTER 95.

AN ACT to amend an act, entitled "An act for the protection of the liverystable keepers of this Commonwealth," approved January 31st, 1871.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the provisions of an act, entitled "An act for the protection of livery-stable keepers in this Commonwealth," approved January 31st, 1871, be, and the same are hereby, applied to the counties of Warren and Elliott. § 2. This act shall take effect and be in force from and after its passage.

CHAPTER 96.

AN ACT to amend an act, entitled "An act to incorporate the town of
Grayson, in Carter county."

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That section 1 (one) of an act, entitled “An act to incorporate the town of Grayson, in Carter county," approved February 22, 1860, be amended so that the corporate limits of said town shall be fixed and bounded as follows, viz: beginning at the State road leading from Grayson to Olive Hill, at the first drain west of the residence of Susan Armstrong; thence down said drain to the town branch; thence a straight line to and including the residence of John Ratcliff, in said town; thence a straight line to the forks of the road leading from Grayson towards Mt. Savage Furnace, near the residence of Jno. Shraub; thence a straight line to a stake in the county road leading from Grayson to Coalton, in the mouth of the lane east of the store of Messrs. Gibbs & Co.; thence a straight line north to a stake in the line of fence of W. D. Jones, below the depot of the East

ern Kentucky Railway Company; thence a straight line a westerly course to the northeast corner of Samuel W. W. Osenton's lot; thence with the north line of said lot to the north line of Dr. Lewis Prichard's land; thence with his north line to the line of Stephen Nethercutt; thence with his line to the top of the hill; thence around the ridge with the plank fence of said Nethercutt to where the same starts down the hill; thence a straight line to the beginning.

§ 2. That the powers and duties of the marshal of said town shall be the same as that of constable in said county; and he shall have power to serve criminal and civil process, and collect fee bills, executions, and other claims put into his hands for collection generally, in said county of Carter, under the same rules and restrictions as constables are governed by under general laws.

§3. That it shall be the duty of the board of trustees of said town to hold their meetings at least once in each month, which shall be held in the court-house in said town; and on their failure to hold such meeting, they shall be severally liable to a fine of ten dollars each, to be recovered by indictment in the name of the Commonwealth.

§ 4. This act shall take effect and be in force from and after its passage.

CHAPTER 97.

AN ACT to amend an act, entitled "An act providing for the collection of railroad tax in the county of Montgomery."

WHEREAS, W. B. Tipton was appointed collector and receiver of the tax levied by the Montgomery county court for the benefit of the Elizabethtown, Lexington, and Big Sandy Railroad Company, under the act providing for the collection of the railroad tax in the county of Montgomery, approved April 16, 1873, and died before completing the duties of the office of collector and receiver aforesaid, and many tax-payers had arranged with said collector and receiver for the payment of their taxes; therefore,

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§1. That the county court of Montgomery county, composed as provided in section one of the act providing for the collection of railroad tax in the county of Montgomery, approved April 16th, 1873, shall proceed to appoint a successor to said Tipton, who shall have all the power

and rights conferred by the act aforesaid on the collector and receiver, except that the time within which the taxpayers may pay the amount of the taxes due by them is extended to the 20th day of February, 1874; and the collector and receiver shall have no power to coerce the payment of ten per cent. damages on the amount of taxes due by the delinquent tax-payers until after said 20th day of February, 1874.

§ 2. This act is to apply to the collection of the railroad tax aforesaid levied for 1873 only.

3. This act to take effect from its passage.

CHAPTER 99.

AN ACT repealing an act, entitled "An act to prohibit the sale of spirituous, vinous, or malt liquors in Crittenden county," approved March 29th, 1873.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1. That an act to prohibit the sale of spirituous, vinous, or malt liquors in Crittenden county, approved March 29th, 1873, be, and the same is hereby, repealed. 2. This act shall be in force from its passage.

CHAPTER 100.

AN ACT to repeal an act. entitled "An act declaring certain portions of
Roundstone creek, in Rockcastle county, a navigable stream," approved
April 24, 1873.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That an act, entitled "An act declaring certain portions of Roundstone creek, in Rockcastle county, a navigable stream," approved April 24, 1873, be, and the same is hereby, repealed.

§ 2. That this act shall take effect from its passage.

CHAPTER 101.

AN ACT to repeal an act, entitled "An act to prohibit the sale of spirituous, vinous, or malt liquors in Glasgow Junction precinct, in Barren county."

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§1. That an act, entitled "An act to prohibit the sale of spirituous, vinous, or malt liquors in Glasgow Junction precinct, in Barren county," approved February 6th, 1873, be, and it is hereby, repealed; and all acts and parts of acts repealed by said act are hereby re-enacted and made the same as if said act had never been passed. §2. This act shall take effect from its passage.

CHAPTER 102.

AN ACT to repeal an act, entitled "An act to prohibit the sale of spirituous, vinous, or malt liquors in Cave City precinct, in the county of Barren."

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That an act, entitled "An act to prohibit the sale of spirituous, vinous, or malt liquors in Cave City precinct, in the county of Barren," approved January 21st, 1873, be, and it is hereby, repealed; and all acts and parts of acts repealed by said act are hereby re-enacted, and made the same as if said act had never been passed. § 2. This act shall take effect from its passage.

CHAPTER 103.

AN ACT to extend to the farmers in Fayette county the lien provided in an act, entitled "An act for the protection of livery-stable keepers in this Commonwealth," approved January 31, 1871.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

1 That the lien provided in an act, entitled “ An act for the protection of livery-stable keepers in this Commonwealth," approved January 31, 1871, be extended to the farmers in county, so that within said county the lien given in said act to the owners and keepers of livery-stables shall also be given to farmers upon the stock placed in their charge, for the reasonable charges, or such as may be agreed upon by contract for feeding, grazing, or caring for such stock; and that all the remedies provided in said act for the enforcement of said lien in favor of owners

and keepers of livery-stables shall be fully applicable. within said county, to the persons in whose favor said lien is extended in this act.

§ 2. This act shall take effect from and after its passage.

CHAPTER 104.

AN ACT to amend the charter of the Lexington Building and Accumulating
Fund Association.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That section one of an act, entitled "An act to incorporate the Lexington Building and Accumulating Fund Association," approved February 24, 1872, be so amended that the corporate name of said association be, and the same is, now changed from that of the "Lexington Building and Accumulating Fund Association No. 1" to " Lexington Building and Accumulating Fund Association." 2. This act shall take effect from and after its passage.

CHAPTER 105.

AN ACT to legalize certain acts of a deputy clerk of the Logan county

court.

WHEREAS, On the 25th day of September, 1871, James H. Campbell was sworn as a deputy clerk of Logan county court; and whereas, it was unknown to the clerk of said county court at the time of appointment, and for a considerable time thereafter, that said Campbell was postmaster at Gordonsville, in said county, and holding an office under the United States Government; and doubts having arisen as to the legality and binding force of the official acts of said Campbell; therefore, for remedy whereof,

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That all official acts done and performed by James H. Campbell, as deputy clerk of the Logan county court, be, and the same are hereby, declared legal and binding upon all parties affected thereby.

§ 2. This act shall be in force from and after its pas

sage.
