AN ACT to authorife the Governor, Lieutenant Governor or Perfon adminiftering the Government of this Province for the time being, to extend the period by Law prescribed, for making the Returns of Members to ferve in the Provincial Parliament, for the County of Gafpé.

HEREAS by an Act paffed in the Parliament of Great Britain, in the thirty first year of His prefent Majefty's Reign, intituled, "An Act for making more effectual provifion for the Government of the Province of Quebec in North America, "and to make further provifion for the Government of the faid Province," it is enacted, that the Writs directed to the refpective Returning Officers of the feveral Diftrias or Counties or Circles and Towns or Townships, in the Provinces of Upper and "Lower Canada, shall be made returnable within fifty days at furtheft from the day on "which the fame fhall bear date, unlefs it fhall at any time be otherwife provided, by any Act of the Legislative Council and Affembly of the Province, affented to by His Majefty, his Heirs or Succeffors. And Whereas from the remote and local fituation of the County of Gafpé, it has been found from experience, that the fifty days fo by Law prefcribed, for making the returns aforefaid are infufficient for that purpose: Be it therefore enacted by the King's Moft Excellent Majefty, by and with the advice and confent of the Legislative Council and Affembly of the Province of Lower Canada conftituted and affembled by virtue and under the authority of the aforerecited A&, paffed in the Parliament of Great Britain, intituled, " An Act to repeal certain parts of an A&t paffed in the fourteenth year of his Majesty's Reign, intituled " An A&t for ma“king more effectual provifion for the Government of the Province of Quebec in North America," "and to make further provifion for the Government of the faid Province," And it is hereby enacted by the authority of the fame, that it fhall and may be lawful, for the Governor, Lieutenant Governor or Perfon adminiftering the Gouvernment of this Province, for the time being, to extend the period in which any Writ for a Member to serve in the Provincial Parliament, for the County of Gafpé aforefaid, fhall be made returnable, to a number, not exceeding one hundred Days, from the day on which the Writs of Election, for the aforefaid County of Gafpé, fhall hereafter be dated, any Law to the contrary hereof notwithstanding.

U que par un A&te paffé dans le Parlement de la Grande Bretagne, dans la Trente-unieme Année du Règne de fa préfente Majefté, intitulé," Acte qui rap"pelle certaines parties d'un Acte paffé dans la Quatorzieme Année du Règne de Sa Ma'jefté, intitulé," Acte qui pourvoit plus efficacement pour le Gouvernement de la Province de "Québec dans l'Amérique Septertrionale," et qui pourvoit plus amplement pour le Gou"vernement de la dite Province," il eft ftatué " que les Writs adreffés aux Officiers ref"pectifs qui feront les Retours des différens Diftricts ou Comtés, ou Cercles et Villes ou Jurifdictions dans les Provinces du Haut et Bas-Canada, feront retournables dans Cinquante jours au plus, à compter du jour de leur date, à moins qu'il ne foit en au"cun tems pourvu autrement, par aucun Acte du Confeil Législatif et de l'Affemblée "de la Province, approuvé par fa Majefté, fes Héritiers ou Succeffeurs ;” et Vu que, par la fituation éloignée et locale du Comté de Gafpé, l'expérience a prouvé que les Cinquante jours prefcrits par la Loi comme ci-deffus mentionné, font infuffifans pour cet effet: Qu'il foit donc ftatué par la très Excellente Majefté du Roi, par et de l'a vis et du confentement du Confeil Législatif et de l'Affemblée de la Province du BasCanada, conftitués et affemblés en vertu et fous l'autorité de l'Acte ci-deffus cité, paffé dans le Parlement de la Grande Bretagne, intitulé," A&te qui rappelle certaines "parties d'un Acte paffé dans la Quatorzieme Année du Règne de Sa Majefté, intitulé, "Acte qui pourvoit plus efficacement pour le Gouvernement de la Province de Québec dans l'Amérique Septentrionale;" et qui pourvoit plus amplement pour le Gouvernement de la dite "Province;" et il eft par le présent ftatué par la même autorité, qu'il fera et pourra être loifible au Gouverneur, Lieutenant Gouverneur ou à la Perfonne ayant l'adminiftration du Gouvernement de cette Province, pour le tems d'alors, d'étendre la période dans laquelle le Writ pour un Membre pour fervir dans le Parlement Provincial pour le Comté de Gafpé, fera mis retournable à un nombre de jours, n'excédant pas Cent jours, à compter du jour auquel les Writs d'Election pour le Comté de Gafpé fufdit, feront datés à l'avenir, nonobftant toute Loi à ce contraire,

HEREAS in pursuance of the Addrefs of the House of Affembly, bearing date the fourth day of April one thoufand eight hundred and one, the fum of four Thoufand Pounds current money of this Province, by Your Majefty's Orders has been iffued and advanced to the Commiffioners appointed by virtue of and under the authority of an A&t paffed in the thirty ninth year of Your Majefty's Reign, intituled, "An At for erecting Court Houfes with proper Offices in the feveral Diflricts of

Quebec and Montreal, and for defraying the expences thereof," May it therefore please Your Majefty that it may be enacted, and be it enacted by the King's Moft Excellent Majefly, by and with the advice and confent of the Legislative Council and Affembly of the Province of Lower Canada, conftituted and affembled by virtue of and under the authority of an A&t paffed in the Parliament of Great Britain, intituled, "An Act to repeal certain parts of an Act, paffed in the fourteenth year of His Majefty's Reign, intituled, "An Act for making more effectual provifion for the Govern"ment of the Province of Quebec, in North America," and to make further provifion for "the Government of the faid Province," and it is hereby enacted by the authority aforefaid, that out of the furplus of any fund or funds, fubject to the difpofition of the Provincial Parliament, under the authority of an Act paffed in the thirty fifth year A&t 85th Geo. of His Majefty's Reign, intituled, "An Act for granting to His Majefly additional "and new Duties on Goods, Wares and Merchandizes and for appropriating the fame towards further defraying the charges of the Administration of Justice and fupport of the Civil Government within this Province, and for other purpofes therein "mentioned." and alfo, under and by virtue of another Act passed in the thirty fifth year of His Majefty's Reign, intituled, "An Act for granting to His Majelly, Duties "on Licence to Hawkers, Pedlars and Petty Chapmen, and for regulating their "Trade, and for granting additional Duties on Licences to perfons for keeping Houfes for Public Entertainment or for retailing Wine, Brandy, Rum or other Spirituous Liquors in this Province, and for regulating the fame, and for repealing the Act "or Ordinance therein mentioned, and alfo under and by virtue of another Act, Aft 41ft Geo. paffed in the forty firft year of His Majefty's Reign, intituled, "An Act for granting to His Majelly certain new Duties on the Importation into this Province of all "manufactured Tobacco, and Snuff, and for difallowing the Drawback on Tobacco manufactured within this Province, and now remaining in the hands of the Receiver General of this Province, unappropriated, there fhall be iffued and applied the fum of four Thousand Pounds, current money of this Province, to make good the like fum, which has, fo as aforefaid, been iffued and advanced, by His Majefty's Orders, in purfuance of the aforefaid Addrefs of the Houfe of Affembly.

qu'en conféquence d'une Adreffe de la Chambre d'Affemblée, en date du quatre Avril Mil huit cent un, la fomme de Quatre Mille Livres, Argent courant de cette Province, a été débourfée et avancée, par les Ordres de Votre Majefté, aux Commiffaires appointés en vertu et fous l'autorité d'un Acte paffé dans la Trente-neuvieme Année du Règne de Votre Majefté, intitulé, " Acte pour ériger des Salles d'Audience avec des Offices "convenables dans les Diftricts de Québec et de Montréal, et pour défrayer les dépenfes d'icelles;" Qu'il plaife donc à Votre Majefté qu'il puifle être ftatué, et qu'il foit ftatué par la Très Excellente Majefte du Roi, par et de l'avis et confentement du Confeil Légiflatif et de l'Affemblée de la Province du Bas-Canada, conftitués et assemblés en vertu et fous l'autorité d'un Acte paffé dans le Parlement de la Grande Bretagne, intitulé, "Acte qui rappelle certaines parties d'un Acte paffé dans la Quatorzieme Année du "Règne de Sa Majeflé, intitulé, "Acte qui pourvoit plus efficacement pour le Gouvernement "de la Province de Québec dans l'Amérique Septentrionale;" et qui pourvoit plus amplement pour le Gouvernement de la dite Province;" et il eft par le préfent ftatue par la même autorité, que fur le furplus d'aucuns fonds sujets à la difpofition du Parlement Provincial fous l'autorité d'un Acte paflé dans la Trente-cinquieme Année du Règne de Sa Majeffé, intitulé," Acte qui accorde à fa Majefté des droits nouveaux et additionels fur certaines "Marchandifes et effets; qui les approprie à fournir des moyens plus amples de défrayer les dé"penfes de l'adminiftration de la Justice, et au foutien du Gouvernement Civil de cette Pro"vince; et à d'autres effets y mentionnés;" et auffi fous et en vertu d'un autre Acte paffé dans la Trente-cinquieme Année du Règne de Sa Majefté, intitulé, "Acte pour accor"der à Sa Majefté des Droits fur les Licences de Colporteurs, Porte-Caffettes et Petits Mar"chands, et pour règler leur Trafic; et pour accorder une augmentation de droits fur les Li"cences de perfonnes qui tiennent des Maifons publiques, ou qui détaillent du Vin, de l'Eau- Cap. VIII. "de-vie, du Rum ou aucune autre Liqueur forte dans cette Province, et pour les règler; et "pour abroger un Acte ou Ordonnance y mentionné;" et auffi fous et en vertu d'un autre Acte paffé dans la Quarante-unieme Année du Règne de Sa Majefté, intitulé, "Acte qui accorde à Sa Majesté certains droits nouveaux fur l'importation dans cette Province de Année du Règne "tout Tabac manufacturé, et Tabac en poudre, et qui retranche les rabais fur le Tabac manufacturé dans cette Province;" et qui reftent entre les mains du Receveur Général de cette Province, fans être appropriés, il fera débourfé et appliqué la fomme de Quatre Mille Livres, argent courant de cette Province, pour rembourfer la même fom. me qui a été, comme fufdit, débourfée et avancée, par les Ordres de Sa Majefté, en con, féquence de la fufdite Adreffe de la Chambre d'Affemblée.
