AN ACT to regulate the Curing, Packing and Infpection of Beef and Pork to be exported from the Province of Lower-Canada.

HEREAS Beef and Pork are articles of increafing confequence in the exports from this Province, and it would tend to the improvement of the quality thereof, and have other beneficial effects, that the fame fhould be afcertained previous to their being shipped for exportation: Be it therefore enacted by the King's most Excellent Majefty, by and with the advice and confent of the Legislative Council and Affembly of the Province of Lower-Canada constituted and affembled by virtue of and under the authority of an Act paffed in the Parliament of Great Britain, intituled, "An Act to repeal certain parts of an A&t paffed in the fourteenth year of His Majefty's Reign, intituled, " An Act for making more effectual Provifion for the Government "of the Province of Quebec in North America;" and to make further provision for the "Government of the faid Province;" And it is hereby enacted by the authority of the fame, that from and after the first day of November next no perfon or perfons whatever fhall fhip or export from this Province any Beef or Pork, except in Barrels and half Barrels of the quality and dimenfions herein after provided, and the contents thereof infpected and packed, and the Casks containing the fame are Branded agreeable to the directions of this A&.

II. And be it further enacted by the authority aforefaid, that it fhall and may be lawful for the Governor, Lieutenant Governor or Perfon adminiftering the Govern ment, from time to time, as to him may seem reasonable, to appoint one or more ca pable Perfons in each of the Cities of Quebec and Montreal, to be Infpector or Infpectors of Beef and Pork, who fhall thereupon be the Infpector or Infpectors for putting. this Act in execution with all the powers and subject to all the Penalties herein after defcribed, and each of the Infpectors before he enters upon the execution of his Office, fhall take and fubfcribe an Oath before one of His Majesty's Juftices of the Court of King's Bench of this Province, in the words following, viz. "I do folemnly "fwear that I will faithfully, truly and impartially, to the best of my judgment, skill "and understanding, execute, do and perform the office and duty of an Inspector, "Packer and Repacker of Beef and Pork according to the true intent and meaning of 66 an A&t intituled, "An Act to regulate the Curing, Packing and Infpection of Beef and Pork to be exported from the Province of Lower Canada;" and that I will not

VU que le Boeuf et le Lard font des articles d'une conféquence fufceptible d'accroiffement dans les exportations de cette Province, et que ce feroit tendre à en améliorer la qualité et produire d'autres effets avantageux, fi elle étoit conftatée avant de les embarquer pour l'exportation: Qu'il foit donc ftatué par la Très Excellente Majefté du Roi, par et de l'avis et confentement du Confeil Légiflatif et de l'Affemblée de la Province du Bas-Canada, conftitués et affemblés en vertu et fous l'autorité d'un Acte paffé dans le Parlement de la Grande Bretagne, intitulé, "Acte qui "rappelle certaines parties d'un Acte paffé dans la quatorzième Année du Règne de "Sa Majefté, intitulé," Acte qui pourvoit plus efficacement pour le Gouvernement de la "Province de Québec dans l' Amérique Septentrionale; et qui pourvoit plus amplement pour le Gouvernement de la dite Province;" Et il eft par le préfent ftatué par l'autorité fufdite, que depuis et après le premier jour de Novembre prochain aucune perfonne ou perfonnes quelconques n'embarqueront ou n'exporteront de cette Province du Bœuf ou Lard fi ce n'eft en quarts et demi quarts de la qualité et des dimenfions ci-après pourvues, et que leur contenu foit examiné et falé, et que les futailles qui le contiendront foient étampées conformément aux directions de cet Acte. II. Et qu'il foit de plus ftatué par l'autorité fuf-dite, qu'il fera et pourra être loifible au Gouverneur, Lieutenant Gouverneur ou à la Perfonne ayant l'adminiftration du Gouvernement pour le tems d'alors, ainfi qu'il le jugera raisonable, de nommer une ou plufieurs perfonnes capables dans chacune des Cités de Québec et Montréal pour être Infpecteur ou Inspecteurs de Boeuf et de Lard, qui, d'après telle no nination, fera l'Infpecteur ou feront les Infpecteurs pour mettre cet Acte en exécution avec tous les pouvoirs et fujets à toutes les pénalités ci-après défignées; et chacun des Infpecteurs avant d'entrer dans l'exécution de fon Office prêtera et fouferira de vant un des Juges de la Cour du Banc du Roi de Sa Majefté de cette Province, un Serment dans les mots fuivants, favoir: "Je jure folemnellement que fidèlement, "véritablement et impartialement j'exécuterai, ferai et remplirai, au meilleur de mon "jugement, de mon habileté et de mes connoiffances, l'Office d'un Infpecteur pour "les falaifons de Boeuf et de Lard fuivant le vrai fens et intention d'un Acte intitulé, "Acte qni règle la manière dont le Bauf et le Lard qui feront exportés de la Province du Bas-Canada feront falés, mis en futailles et examinés;" et que directement ni indi

III. Provided always, and be it further enacted by the authority aforefaid, that no under pain oftheir perfon to be hereafter appointed an Inspector of Beef or of Pork under the authority of this Act, fhall deal or buy, barter or exchange any Beef or Pork by him infpected or to be infpected, under pain of the Commiffion under which he acts being null and void, except fuch Beef or Pork as may be neceffary for the confumption of his own family.

IV. And be it further enacted by the authority aforefaid, that no Beef which fhall be killed after the first day of November next, fhall be packed or repacked in Barrels or half Barrels for exportation, unlefs it be of fat Cattle not under three years old, and that all fuch Beef fhall be cut in fquare pieces as nearly as may be not exceeding twelve Pounds weight nor lefs than four Pounds weight, and that all Beef which the faid Infpectors fhall find on examination to have been killed at a proper age, to be fat and merchantable, shall be forted and divided in three different forts for packing and repacking in Barrels and half Barrels to be denominated Mefs, Prime and Cargo; Mefs Beef fhall confift of the choiceft pieces of Oxen, Cows or Steers well fatted, the shin, fhoulder, clod and neck fhall be taken from the fore-quarters, and the legs and legrounds from the hind-quarters, and each Barrel or half Barrel containing Beef of this description fhall be branded on one of the heads with the words, Mefs Beef: Prime Beef fhall confift of choice pieces of Oxen, Steers, Cows and Heifers amongft which there fhall not be more than half a neck and one fhank with the hock cut off, and one of the heads of all Barrels or half Barrels containing Beef of this defcription fhall be Beef, branded with the words Prime Beef: That Cargo Beef fhall confift of fat Cattle of all descriptions of three years old and upwards with not more than half a neck and three fhanks without the hocks in each Barrel or half Barrel in proportion, and to be otherwife merchantable, shall be Branded on one of the Heads with the word Cargo Beef: and every Barrel of Beef fhall be well falted with feventy five Pounds of Clean St. falting the fame, Ubes, Ifle of May, Lifbon or Turk's Ifland Salt, or other Salt of equal quality, exclufive of a Pickle made as ftrong as Salt will make it, and to each Barrel of Beef fhall be added four ounces of Salt-petre, and each half Barrel of Beef fhall be falted with one half of the quantity and of the fame quality of Salt above mentioned and two ounces of Salt petre.

III. Pourvu toujours, et qu'il foit de plus ftatué par l'autorité fufdite, que qui que ce foit qui fera ci-après nommé Infpecteur de Boeuf ou de Lard fous l'autorité de cet Acte, ne trafiquera ou n'achetera, ni échangera ou troquera du Boeuf ou du Lard qu'il aura examiné ou qui fera pour être examiné par lui, fous peine de réfiliation et de nullité de la Commiffion en vertu de laquelle il agira, à l'exception du Boeuf ou Lard qui pourra être néceffaire pour la confommation de fa propre famille..

IV. Et qu'il foit de plus ftatué par l'autorité fufdite, qu'aucun Bœuf ne fera falé ou refalé dans des quarts ou demi-quarts pour l'exportation qui aura été tué après le premier jour de Novembre prochain, à moins qu'il ne foit de beftiaux gras n'étant pas audeffous de l'âge de trois ans, et que tout tel Boeuf fera coupé par morceaux quarrés, autant qu'il fe pourra faire, n'excédant point douze livres pefant ni moins de quatre livres pefant; et que tout Boeuf que les dits Infpecteurs trouveront, d'après un examen, avoir été tué à un âge convenable, être gras et marchand sera afforti et divifé en trois différentes efpeces pour être falé et refalé dans des quarts et demi-quarts, lequel fera diftingué par Mefs, Prime et Cargo; Le Mefs fera compofé des morceaux de choix du Bœuf, de la Vache ou Bouvillon bien engraiflé, le jarret, l'épaule, la faignée et le col feront ôtés des quartiers de devant, et les rondes et jarrets des quartiers de derrière, et chaque quart ou demi quart contenant du Boeuf de cette defcription fera étampé fur un des fonds avec les mots Mefs Beef: Le Prime Beef fera composé des morceaux de choix du Bœuf, du Bouvillon, de la Vache et jeunes Vaches parmi lesquels il n'y aura pas plus d'un demi col et un jarret avec le pied coupé, et un des fonds. de tout quart ou demi quart contenant du Boeuf de cette defcription fera étampé avec les mots Prime Beef: Que le Cargo Beef fera compofé d'animaux gras de toutes def criptions ayant trois ans et audeffus, avec pas plus de moitié d'un col et trois jarrets. fans les pieds dans chaque quart ou demi quart à proportion, et fera d'ailleurs marchand, et il fera étan.pé fur un des fonds les mots Cargo Beef; Et chaque quart de Boeuf fera. bien falé avec foixante-quinze livres de bon fel de St. Ubes, Ile de Mai, de Lisbonne ou de l'Ile aux Turques, ou quelqu'autre fel d'une égale qualité, outre une faumure. auffi forte qu'il eft poffible de la faire avec le fel, et à chaque quart de Bœuf feront ajoutées quatre onces de falpêtre, et chaque demi quart de Boeuf fera falé avec moitié de la quantité de fel et de la même qualité que ci-deffus mentionné avec deux. onces de falpêtre..

V. And be it further enacted by the authority aforefaid, that from and after the firft day of November next every Barrel and half Barrel in which Beef shall be packed Or repacked fhall be made of good, feasoned white oak ftaves and heading free from every defect, and each Barrel fhall contain two hundred Pounds weight of Beef, the Barrels to measure fixteen inches and a half between the chimbs, and to be twenty eight inches long, to be hooped with fourteen good white afh, hickory or oak hoops, the heads to be made of good thick ftuff, the hoops to be well fet and drove; the half Barrels to contain not less than fifteen nor more than fixteen Gallons, and hooped in the fame manner as the whole Barrels, and to contain one half the quantity of Beef as the whole Barrels.

VI. And be it further enacted by the authority aforefaid, that one head of every branded by the Barrel and half Barrel in which Beef or Pork is packed or repacked for exportation Infpectors fhall be Branded the weight it contains with the initial letters of the Inspector's name who fhall have infpected the fame, with the name of the City where it was inspected in legible letters, alfo the addition of L. Canada.

VII. And be it further enacted by the authority aforefaid, that no Infpector appointed by virtue of this A&t fhall Infpect or Brand any Cafk of Beef or Pork out of the City or District for which he fhall be appointed, under the penalty of five Pounds Current money of this Province.

VIII. And be it further enacted by the authority aforefaid, that if any Inspector of Beef or Pork, not then employed in the infpection and examination of Beef or Pork, according to the duties, prefcribed by this Act, fhall, on application on lawful days and reafonable hours to him made for the examination of any Beef or Pork, as aforefaid, refuse, neglect or delay to proceed to fuch examination and inspection for the fpace of four hours after fuch application fo made to him, the Infpector fo refufing, neglecting or delaying to make fuch examination and infpection fhall, for each offence forfeit the fum of twenty Shillings Current money of this Province, to the use of the perfon or perfons fo delayed.

IX. And be it further enacted by the authority aforefaid, that every Inspector fhall receive one Shilling and three Pence Current money of this Province for each Barrel, and nine Pence like money, for each half Barrel of Beef or Pork he fhall falt, pack, infpect and pickle, exclufive of Cooperage; all which falting, packing, inf pecting and pickling fhall be paid by the owners or poffeffors thereof.

X. And be it further enacted by the authority aforefaid, that if either of the Inf pectors appointed by virtue of this A&t fhall be guilty of any neglect or fraud in infpecting any Beef or Pork contrary to the true intent and meaning of this Act, or fhall Brand any Cafks containing Beef or Pork which has not been actually inspected agreeable to this Act, he or they fhall, for every fuch offence, forfeit a fum not ex
