by the name of The City of Waterbury, and by that name they and their successors forever shall have perpetual succession, and they shall be capable of suing and being sued, pleading and being impleaded, in all suits and actions, in law or in equity; and shall have power to purchase, hold, and convey any estate, real or personal; and may have a common seal, and may change and alter the same at pleasure; and shall be and remain absolutely vested with the title to the improvement of all the lands, tenements, hereditaments, rights, and estates whatsoever, which, since the original incorporation of said city by the name of The Mayor, Aldermen, Common Council, and Freemen of the City of Waterbury, have become vested in said city, and whereof said city has never been lawfully divested.

SEC. 3. Said city is hereby divided into five wards, as fol- Division into lows, viz. All that part of said city lying northerly of a line First ward. running in the center of East Main Street from Center Square to the city limits, and easterly of a line running in the center of North Main Street to the city limits, shall be and remain the

first ward. All that part of said city lying westerly of the line Second ward. in the center of said North Main Street, and northerly of a line running in the center of West Main Street, from a point where East Main and North Main Streets intersect to the city limits, shall be and remain the second ward. All that part of Third ward. said city lying southerly of said line in the center of West Main Street, and westerly of a line running from the point of intersection of the center line of East Main and North Main Streets, through Exchange Place, to and along the center line of Bank Street to the city limits, shall be and remain the third ward. All that part of said city lying easterly of the said line Fourth ward. from the point of intersection of East Main and North Main Streets, through Exchange Place, to and along the center line of Bank Street, and westerly of a line in the center of South Main Street, from said point of intersection of North Main and East Main Streets to Union Street, and southerly of a line in the center of Union Street to Baldwin Street at Scovill's Bridge, and westerly of a line running from Scovill's Bridge in the center of Mad River to Liberty Street, and southerly of a line running in the center of Liberty Street to Baldwin Street, and westerly of a line running in the center of Baldwin Street to the city limits, shall be and remain the fourth ward. All that part of said city lying between said last- Fifth ward. mentioned line and the line in the center of East Main Street

shall be and remain the fifth ward.

ELECTIONS.

SEC. 4. On the first Monday in October, 1895, and biennially thereafter, the legal voters of said city shall elect by ballot from among their number a Mayor, City Clerk, Treasurer, Comptroller, City Sheriff, and two Agents of the Bronson Library Fund, but no person shall vote for more than one Agent of the Bronson Library Fund. And the legal voters in each ward in said city shall further elect on the aforesaid first Monday in October, 1895, and biennially thereafter, by ballot from among their number, three Aldermen. And if, by an equality of votes, any particular officer be not elected, then the persons receiving such equality of votes shall, except as herein otherwise provided, draw lots under the supervision of the Board of Aldermen at its next meeting, and the one upon whom the lot shall fall shall be deemed to be and declared to be elected, and a record shall be made of such drawing and the result thereof upon the records of said city.

SEC. 5. The voting places in the several wards in said city shall be fixed and provided by the Board of Aldermen. The Board of Aldermen shall have like power, by ordinance, to divide each of such wards into two or more districts, defining the limits thereof, and shall provide a voting place in each of said districts, within which the electors shall deposit their ballots. And said Board of Aldermen shall cause notice of such voting places to be published in not more than two daily newspapers printed in said city, at least six days, inclusive, before any election to be holden in said city, or in any ward thereof; and such voting places shall also be plainly set forth in the warnings of all annual and special meetings.

SEC. 6. At every meeting of said city for the election of officers, as herein provided, the Registrars of Voters of the Town of Waterbury, and the other officers by them appointed, shall perform the same duties with reference thereto, as is by law provided in case of electors' meetings in the Town of Waterbury.

SEC. 7. At all meetings of said city for the election of Ballot boxes officers, the ballot boxes shall be opened in the various voting places in the several wards of said city at eight o'clock in the forenoon, and remain open for the reception of votes until five o'clock in the afternoon. Said meetings shall be conducted in all respects, except as herein specified, in the manner by law provided for electors' meetings in the Town of Waterbury.

SEC. 8. The Mayor, City Clerk, Treasurer, Comptroller, Terms of City Sheriff and Aldermen shall hold their respective offices for a period of two years, commencing on the first Monday of January succeeding their election. All of said officers shall hold their respective offices until their successors are chosen and have duly qualified.

SEC. 9. Every elector of this State qualified to vote in the Who may vote. Town of Waterbury, and residing within said city, shall be a legal voter of the City of Waterbury and entitled to vote at all meetings of said city, and at all meetings of the ward in which he is duly registered.

SEC. 10. At any meeting for the election of officers of said city, the legal voters of said city shall vote for said officers in Where legal the several wards wherein they shall have respectively, vote. statedly, and continuously resided for at least one calendar month then next preceding such meeting, and not elsewhere; residence for that purpose being where the legal voters shall have statedly lodged for the term of one calendar month as aforesaid. If any legal voter of said city shall have removed from one ward of said city into another ward thereof, and shall not have statedly and continuously resided one calendar month next preceding such election in the ward in which he shall then reside at the time of such election, he shall be entitled to vote in the ward in which he otherwise would have been entitled to vote, had he not so removed as aforesaid. Any person who shall violate any provision of this act relating to electors, or who shall wilfully fail to perform any duty imposed upon him by this act relating to electors shall, upon conviction, be punished by a fine of one hundred dollars, or suffer imprisonment in the county jail or in the workhouse in

the Town of Waterbury not exceeding sixty days, or pay such fine and suffer such imprisonment both.

SEC. II. In case any vacancy occurs in the office of Mayor, City Clerk, Treasurer, Comptroller, City Sheriff, or Alderman, by reason of the death, resignation or removal from the city of any such officer, refusal to qualify or otherwise, such vacancy may be filled by the electors of said city at a special meeting warned for that purpose, by electing another of their number in his stead to hold such office for the unexpired term and until another be chosen and sworn in his stead; and such special meeting of said city shall in all respects be warned, held, and conducted, and the votes cast at any such special meeting shall be counted, returned, canvassed, and declared in the same manner as at the biennial electors' meetings of said city.
