Board of Estimate and Apportionment-Resolution of, That an Appropriation of $315,000 for Use of the Department of Docks for Building a Shed and Reconstructing the Pier at the Foot of East 4th Street, Manhattan, Be Held in Abeyance (Cal. No. 52).

The following was received from the Secretary of the Board of Estimate and Apportionment:

Sir-I transmit herewith certified copy of resolution adopted by the Board of Estimate and Apportionment, December 3, 1920, relating to above calendar number and affecting the Department of Docks. Respectfully,

Resolved, That an appropriation of $315,000 for the use of the Department of Docks for building shed and reconstructing the pier foot of East 4th street, Borough of Manhattan, be held in abeyance and that the matter of the lease of said pier be referred to the Corporation Counsel and associate counsel to be investigated with other matters to be taken up by the investigation of the Board of Estimate and Apportionment of City contracts.

Sale at Public Auction of Plot of Land at the Corner of East Main Street and Brookside Avenue, in the Village of Mt. Kisco, Westchester County, New York (Cal. No. 53).

The Deputy and Acting Comptroller presented the following report and offered the following resolution:

To the Honorable Commissioners of the Sin'ing Fund:

December 10, 1920.

Gentlemen-On July 18, 1917, the Department of Water Supply, Gas and Electricity surrendered to the Commissioners of the Sinking Fund as no longer required a plot of land on the corner of East Main street and Brookside avenue, in the Village of Mt. Kisco, Westchester county, New York, as shown on Map 1153-Z of the Map of the Department of Water Supply, Gas and Electricity, and on July 26, 1917, your Board authorized the Comptroller to derive such revenue as may be had from this property from the temporary leasing thereof until its final disposition should be determined.

The entire parcel has an area of 1.768 acres and The City of New York has been unable to obtain any revenue whatever from the property.

I am in receipt of a request for the sale at public auction of part of this property comprising a strip, having a frontage of 40 feet in the southerly side of Brookside avenue and being at the easterly side of the parcel in question, at a minimum or upset price of $1,000, which in the opinion of the Appraiser of Real Estate of the Department of Finance, is a fair and reasonable value therefor.

I therefore respectfully recommend that the Commissioners of the Sinking Fund adopt a resolution authorizing the sale at public auction of the following described property.

All that certain piece or parcel of property situated in the village of Mt. Kisco, Town of Bedford, County of Westchester, and State of New York shown on Map 11531-Z on file in the office of the Department of Water Supply, Gas and Electricity bounded and described as follows:

Beginning at a monument at the point of intersection of the easterly property line of lands of the City of New York with the southerly side of Brookside avenue; running thence south 30 degrees 50 minutes 40 seconds west, 213.9 feet to a monument; running thence south 89 degrees 29 minutes west, 66.3 feet along lands now or formerly of St. Marks Protestant Episcopal Church; running thence north 34 degrees 40 minutes east, 249.4 feet to the southerly side of Brookside avenue at a point 40 feet westerly from the easterly property line of the lands of the City of New York; running thence south 58 degrees 32 minutes 30 seconds east, 40 feet to the point or place of beginning, the said several dimensions more or less.

-together with all right, title and interest of The City of New York of, in and to Brookside avenue, in front to the centre thereof.

-at a minimum or upset price of $1,000, subject to the following terms and conditions:

All buildings or structures of whatsover nature which may be erected thereon shall be connected with the public sewer before being occupied. The sewer connection shall

be made under the supervision of the Department of Water Supply, Gas and Electricity. No roof, cellar or surface drainage shall be permitted to enter the sewer.

No outside privies shall be permitted on the property.

All garbage, empty cans, paper and other like material shall be deposited in watertight cans and removed promptly from the property. No slops shall be thrown or discharged upon the ground.

No stables, horse sheds or places where animal manure accumulates shall be erected or maintained; neither shall poultry be kept or harbored on the property.

No bottling works, junk shops or yards nor factories discharging trade wastes shall be permitted.

The highest bidder will be required to pay ten per cent. of the amount of their bid, together with the auctioneer's fees at the time of sale and ninety per cent. upon the delivery of the deed, which shall be within ninety days from the date of sale.

The deed so delivered shall be in the form of a bargain and sale deed without covenants.

The Comptroller may at his option, re-sell the property if the successful bidder fails to comply with the terms of the sale, and the persons so failing to comply with them will be held liable for any deficiency which may result from said resale. The right is reserved to reject any and all bids. Respectfully.

Armory Board-Request of, for Approval of the Selection by, of Quarters at Whitestone, L. I., for the Sixth Division, Fourth Battalion, Naval Militia (Cal. No. 54).

A communication was received from the Secretary of the Armory Board, dated December 28, 1920, transmitting copy of resolution adopted by the Armory Board December 27, 1920, requesting the Commissioners of the Sinking Fund to approve of the selection by the Armory Board of quarters for the Sixth Division, Fourth Battalion Naval Militia, at Whitestone, L. I., and appropriate the sum of $37,000 for carrying out the purposes of said resolution.

Which was referred to the Comptroller.

Fire Department-Request of, for Assignment of Plot of Land, Preferably in the Borough of Manhattan, for the Purposes of Establishing a Storage Yard (Cal. No. 55).

A communication was received from the Fire Commissioner, dated December 28, 1920, requesting the assignment of a suitable plot of land, preferably in the Borough of Manhattan, for the purposes of establishing a storage yard for castings and cables used in the maintenance of the fire alarm telegraph system.

Which was referred back to the Fire Commissioner to suggest some property for assignment.

William H. Darling-Offer of, to Purchase Property at the Northeast Corner of 159th Street and Walton Avenue, The Bronx (Cal. No. 56).

A communication was received from William H. Darling, dated December 29, 1920, offering a bid of $3,500 for building on property acquired by the City for park purposes at the northeast corner of 159th street and Walton avenue, Borough of The Bronx. Which was referred to the Comptroller for a reply.

John Kelly-Offer of, to Lease to the City a Building on the East Side of Lincoln Avenue, Between 132d and 133d Streets, The Bronx (Cal. No. 57).

A communication was received from John Kelly, dated December 29, 1920, offering to lease to the City a three-story building 200 by 100 feet on the east side of Lincoln avenue between 132d and 133d streets, Borough of The Bronx, at a rental of 60 cents per foot with steam and 50 cents per foot without steam.

Which was referred to the Comptroller for a reply.

Chief City Magistrate—Request of, for Approval of the Transfer of Two Pens Attached to the Women's Court to the Department of Correction (Cal. No. 58).

A communication was received from the Chief City Magistrate, dated December 21, 1920, requesting approval of the transfer of two pens attached to the_Women's Court on the second floor of the Jefferson Market to the Department of Correction. Which was referred to the Comptroller.

Mrs. Grace B. Merritt-Petition of, for a Release of the City's Interest in Certain Lands in Flushing Avenue, Queens (Cal. No. 59).

A petition was received from Mrs. Grace B. Merritt, dated December 24, 1920, for a release of the City's interest in certain lands in Flushing avenue, Borough of Queens. Which was referred to the Comptroller the Chief Engineer of the Board of Estimate to report to the Comptroller.

W. I. Brown, George V. Martin, Michael B. McHugh-Payment of Bills of, Authorized (Cal. No. 60).

The Deputy and Acting Comptroller presented the following report and offered the following resolutions:

To the Honorable the Commissioners of the Sinking Fund:

December 22, 1920.

Gentlemen-On July 29, 1920 (Cal. No. 15), the Commissioners of the Sinking Fund adopted a resolution appointing William I. Brown, George V. Martin and Michael B. McHugh, residing in the Borough of The Bronx, appraisers, to appraise the value of the property owned by The City of New York, located at the southwest corner of Brook avenue and East 142d street, Borough of The Bronx, and also to appraise the value of the property located at the northwest corner of Alexander avenue and East 138th street, Borough of The Bronx, which it was proposed to exchange for the above-mentioned parcel.

In a communication to the Comptroller, dated November 8, 1920, the owner of the property located at the northwest corner of Alexander avenue and East 138th street, Borough of The Bronx, withdrew his offer to exchange.

The appraisers have presented their bills for their appraisals of the properties above mentioned of $200 each for the two appraisals which, in my opinion, is fair and reasonable.

I therefore respectfully recommend that the Commissioners of the Sinking Fund adopt a resolution requesting the Board of Estimate and Apportionment to transfer the sum of six hundred dollars ($600) to the fund known as No. 56, Contingencies, Commissioners of the Sinking Fund.

I also recommend that a resolution be adopted by the Commissioners of the Sinking Fund authorizing the payment of two hundred dollars ($200) each to William I. Brown, George V. Martin and Michael B. McHugh for services rendered by them in appraising properties in accordance with a resolution adopted by the Commissioners of the Sinking Fund on July 29, 1920. Respectfully,

Resolved, That the Board of Estimate and Apportionment be and is hereby requested to transfer the sum of six hundred dollars ($600) from such funds as may be available to the appropriation made to the Commissioners of the Sinking Fund for the year 1920, known as No. 56, Contingencies, in order to provide funds to pay bills of William I. Brown, George V. Martin and Michael B. McHugh two hundred dollars ($200) each for services rendered by them in appraising property owned by The City of New York located at the southwest corner of Brook avenue and East 142d street, Borough of The Bronx, and also property owned by private parties located at the northwest corner of Alexander avenue and East 138th street, Borough of The Bronx, which it was proposed to exchange.

Resolved, That the Comptroller be and is hereby authorized to pay to William I. Brown, George V. Martin and Michael B. McHugh the sum of two hundred dollars ($200) each, being amount of bills rendered by them for services in appraising the value of property owned by The City of New York, located at the southwest corner of Brook avenue and East 142d street, Borough of The Bronx, and property owned by private parties located at the northwest corner of Alexander avenue and East 138th street, Borough of The Bronx, which it was proposed to exchange, and which services were rendered in accordance with resolution adopted by the Commissioners of the Sinking Fund authorizing such appraisals July 29, 1920; payment to be made from the appropriation made to the Commissioners of the Sinking Fund for the year 1920, known as No. 56, Contingencies.

The report was accepted and the resolutions severally unanimously adopted.

Charles Pickler-Bill of ($62) for Reporting Minutes of Meetings of the Commissioners of the Sinking Fund, from September 8 to and Including October 14, 1920 (Cal. No. 61).

The following resolution was offered for adoption:

Resolved, That, subject to proper audit, the Comptroller be and is hereby authorized to pay to Charles Pickler the sum of sixty-two dollars ($62.00), being amount of bill for reporting in shorthand and transcribing the minutes of the meetings of the Commissioners of the Sinking Fund and Committee of the Whole, from September 8 to and including October 14, 1920, and furnishing one original and four carbon copies thereof; payment to be made from the appropriation made to the Commissioners of the Sinking Fund for the year 1920, known as No. 56, Contingencies.

Which resolution was unanimously adopted.

Percy Lowe-Bill of ($432) for Reporting the Minutes of Meetings of the Commissioners of the Sinking Fund, from October 21, to and Including December 16, 1920 (Cal. No. 62).

The following resolution was offered for adoption:

Resolved, That, subject to proper audit, the Comptroller be and is hereby authorized to pay to Percy Lowe the sum of four hundred and thirty-two dollars ($432), being amount of bill for reporting in shorthand and transcribing minutes of the meetings of the Commissioners of the Sinking Fund and Committee of the Whole, from October 21, 1920, to and including December 16, 1920, and furnishing one original and four carbon copies thereof; payment to be made from the appropriation made to the Commissioners of the Sinking Fund for the year 1920 and known as No. 56, Contingencies.

Which resolution was unanimously adopted.

Come Back Club of Columbia University (Cal. No. 63).

A communication was received from the Come Back Club of Columbia University, dated September 15, 1920, appealing for the temporary use of some parcel of land approximately 140 by 160 feet within easy reach of the university, on which to erect for living purposes, buildings used as a base hospital during the late war which the club proposes to purchase from the Red Cross Society. It is suggested that a parcel in Morningside or Van Cortlandt Park be allotted.

Laid over and referred to the Committee of the Whole October 21, 1920 (Cal. No. 80).

Anastasia Chmelik-Petition of, for a Release of the City's Interest in a Strip of Land on 2d Avenue, Astoria, Queens (Cal. No. 64).

A petition was received from Anastasia Chmelik, dated December 10, 1920, for a release of the City's interest in a strip of land on 2d avenue, formerly known as Debevoise avenue, Astoria, Borough of Queens.

Which was referred to the Comptroller; the Chief Engineer of the Board of Estimate to report to the Comptroller.

New York College of Dentistry-Petition of, for the Cancellation of Certain Taxes (Cal. No. 65).

The Deputy and Acting Comptroller presented the following report and offered the following resolution: December 30, 1920.

To the Honorable the Commissioners of the Sinking Fund of The City of New York: Gentlemen-The New York College of Dentistry has presented to you a petition for the cancellation of certain assessments for public improvements affecting premises in the Borough of Manhattan, designated on the official tax map as Section 3, Block 904, Lot 7.

This application is made pursuant to the provisions of chapter 789 of the Laws of 1920, which provides that the Commissioners of the Sinking Fund of The City of New York, upon the written certificate of the Comptroller of said City approving the same, may, in their discretion and upon such terms as they may deem proper, by a unanimous vote cancel and annul all taxes, assessments and water rents for the year 1919 which are now a lien against the real estate owned by the New York College of Dentistry, an educational corporation, known as Section 3, Block 904, on the land map of The City of New York.

It appears from the petition submitted, which is duly verified, that the petitioner is a corporation incorporated under the laws of the State of New York, and is the owner in fee simple of the above described premises, having acquired the same on or about November 20, 1918; that it has owned the above described premises continuously since said date and is still the owner thereof, and that the same now are and have always been exempt from local taxation, under said provision of the Tax Law, during the periods when the liens hereinafter set forth accrued. Said premises are used as an educational institution for dental science and art.

It appears from an examination of the Assessment Rolls that the property has been exempt from local taxation for the year 1920, and the assessed valuation for the year 1920 is $125,000.

It further appears from the records of the Bureau for the Collection of Assessments and Arrears that the following assessments for local improvements were levied against said property and are now open and unpaid on the records of the Department, namely:

The records of this Department show no awards paid or payable to petitioner and no lease to The City of New York affecting the property hereinbefore described. The total amount involved as principal in the above assessments is $696. The property affected by these assessments is located in the Borough of Manhattan, 211-213 East 23d street.

It appearing, therefore, that the petitioner was the actual owner of the real estate in question during the time when said liens above mentioned accrued and became a lien thereupon, I am of the opinion that the petitioner has presented a proper case for
