ject and are of the opinion that much inconvenience to families would be experienced if they were prohibited from depositing the small quantity of ashes which are daily made from the burning of coal into the Streets as it soon comes comixed with the ordinary dust and filth and is removed therewith by the scavengers

Your Committe think that as there is an Ordinance of this Board prohibiting the deposit of Ashes and Cinders from Shops and Manufactories it will be inexpedient to grant the request of the petitioners, and accordingly recomme[n]d the adoption of the following resolution Resolved that it is inexpedient to grant the prayer of the petitioners

[50] The Street Committe on the Petition for widening Henry Street from Oliver to Rutgers Street presented a Report which was read, laid for consideration and the Street Commissioner be directed to advertise for objections thereto.

The Street Committe on the Petition for paving Gourverneur Street reported in favor as follows

The Street Committe to whom was referred the petition of the owners of the property on Govurneur Street praying that that Street may be paved throughout report that in the opinion of the Committe their request ought to be granted. And accordingly submit the following resolution

Resolved that Governeur Street be pitched and paved between Water Street and Division Street

The Street Committe on the petition for paving McDougal and Hancock Streets reported in favor as follows

The Street Committe to whom was referred the petition of Nicholas Low and others praying that McDougal and Hancock Streets may be

paved from Houston to Herring Streets-Report that in their opinion the prayer of the petitioners ought to [51] be granted and therefore submit the following resolution

Resolved that the request of the petitioners be granted under the direction of the Street Commissioner

The Street Committe to whom was referred the representation of the Commissioners for opening a New Street in the 7th Ward between Walnut and Scammel Streets reported as follows

The Street Committe respectfully report on the annexed representation of the Commissioners for opening a New Street in the 7th Ward between Walnut and Scammel Streets-That the Commissioners find it impossible to make an estimate and assessment in the said matter, and therefore propose that the proceedings be abandoned. Your committe considering the circumstances, are of the opinion that the proceedings may as well be abandoned inasmuch as the commissioners cannot raise the requisite sum for the improvement, and the parties interested are nearly if not quite unanimous in favor of discontinuing the opening. Such at least are the representations and statements of the commissioners which your committe consider sufficient evidence, as the parties interested will be heard on the matter on the application for abandonment being made to the Court-Your Committe therefore offer for the consideration of the Board the following Resolution.

Resolved that the Counsel prepare the necessary application to the Supreme Court for abandoning the proceedings [52] in this matter; and that notice of such application be given by the Street Commissioner in the papers employed by this Board in such form as the Counsel shall prescribe

The Cou[n]sel presented the following report on the case of Samuel Poole and on several Captains who had neglected to report alien passengers

The Counsel respectfully reports that Samuel Poole was written. to for keeping two hackney coaches, he having a licence for one only— It appeared however that the Mayor had granted a licence for the other carriage but that the Defendant had not taken the same out The defendant has now taken out the licence and paid the costs. The penalty is one hundred dollars The remission of the penalty is respectfully recommended

Capt Lewis of the Ship Canton was [54] written to for not reporting his passengers which he has since done, and paid the costs.

Captain West of the Brig Jesse, was also written to for not reporting, which he has since done, and paid costs

Captain Drossey, of the Brig Ospray, a like case.

Captain Powers of the Schooner Dart a like case.

The remission of these penalties is also respectfully recommended

Whereupon the several penalties were ordered to be remitted

The Counsel to whom was referred the Resolution directing certain lots to be enclosed in fence reported as follows

The Counsel of the board respectfully reports on the annexed resolution, directing the vacant Lots fronting on Rutgers Henry and Banker Streets to be fenced in, and that the City Inspector cause the same to be carried into effect.

The Counsel finds by the act (2 R L 407 § 175) that the Common Council possess the power to direct the pitching and paving of the streets" and the raising reducing levelling or fencing in any vacant or adjoining lots in the said city" and to assess the expences upon the owners &c (see also 2 R L 134 § 20 and the Act of 47 Sess ch 49)

The proper course to be pursued in such cases is to pass an ordinance for the fencing in of the vacant lots, in the same manner as for pitching and paving the streets and appoint assessors to estimate and assess the expence-But the counsel respectfully suggests whether it would not be expedient, in the first [55] instance that the proprietors of vacant lots should be notified to fence in at their own expence, and

upon their neglecting so to do, that an ordinance be passed to have the same done by the Common Council, and to appoint assessors to assess the expence

Whereupon the City Inspector was directed to pursue the directions prescribed in the Report

The Counsel presented the following report respecting Leases

The Counsel herewith respectfully presents for execution the following, leases of land sold for non payment of taxes which have not been redeemed within two years according to Law, and for which the purchasers are accordingly entitled to Leases:

1 A Lease to Abraham Labagh of a Lot in the tenth Ward on the east side of Cannon Street, between Grand street and Broome street designated in a certain Map referred to in the advertisement of sale as N° 3430 assessed as belonging to unknown owners sold to Abraham Labagh for eleven years from 5th Nov 1825 for $15 55100

2 A lease to David Whiting of all those three acres of land situate in the ninth ward of the City of New York at Bloomingdale assessed as belonging to Mathew Hone, sold to David Whiting for seventeen. years from 5th November 1825 for $17.80/100

3 A lease to David Whiting of all those two certain houses and lots of land situate in the said ninth ward at Bloomingdale assessed as belonging to Mathew Hone sold to David Whiting for two years from 5th Novem 1825 for $16 68100 all these leases were made out by direction of the Street Commissioner

[56] Whereupon the Leases were directed to be duly executed The Counsel presented the following Resolutions respecting extending Christopher Street which were adopted

I Resolved that it is desirable for the public convenience to extend Christopher Street in the in the ninth Ward of the City of New York, from Washington Street to West street according to the plan and on the lines laid down in a Map entitled map of the property to be taken for opening Christopher Street from Washington Street to Hudson River Dated New York November 18. 1825 surveyed by Edward Doughty City Surveyor (the said Christopher Street being a street in that part of the City not laid into Streets Avenues squares and Public places by the Commissioners of Streets and Roads in the City of
