FOURTH SECTION APPLICATION No. 15648

COAL FROM KENTUCKY, TENNESSEE, AND VIRGINIA

Submitted April 15, 1935. Decided November 22, 1935

Authority granted, on conditions, to establish and maintain rates on bituminous coal, in carloads, from points in Kentucky, Tennessee, and Virginia to destinations in Illinois, without observing the long-and-short-haul provision of section 4 of the Interstate Commerce Act.

Lawrence Chaffee, W. A. Northcutt, and E. A. Smith for applicants.

REPORT OF THE COMMISSION

DIVISION 2, COMMISSIONERS AITCHISON, MAHAFFIE, AND SPLAWN BY DIVISION 2:

The Louisville and Nashville Railroad Company and the Illinois Central Railroad Company apply for authority to establish and maintain rates on bituminous coal, in carloads, from mines on the Louisville & Nashville in Kentucky, Tennessee, and Virginia to destinations on the Illinois Central in Illinois, without observing the long-and-short-haul provision of section 4 of the Interstate Commerce Act. Relief was temporarily authorized by fourth-section order no. 11683. A hearing was held and no opposition to the relief sought was presented. Rates will be stated in amounts per net ton. The rates here considered are grouped at origin and destination. The origin groups 1 to 4, inclusive, are located in the coal-producing territory known as the Inner Crescent and Outer Crescent. These and other origin groups in the so-called Crescent district have been approved by the Commission in several cases. The adjustment at destinations has been in effect for many years.

Applicants proposed to establish, over the route of the Louisville & Nashville to Evansville, Ind., and the Illinois Central beyond, a rate of $3.09 from origin groups 1, 3, and 4 to destination group 1, which embraces all points on that route from Kankakee to Chicago, Ill., inclusive, and to continue the present rates of $3.19 and $3.12 to intermediate points in destination groups 2 and 5 respectively. The rates from origin group 2 to destination group 1 will reflect the 1 See Bituminous Coal to C. F. A. Territory, 46 I. C. C. 66, and Ohio-Michigan Coal Cases, 80 I. C. C. 663.
