Refund of Croton Water Rend Paid in Error. The Deputy and Acting Comptroller presented the following report and offered the following resolution:

Hon. Commissioners of the Sinking Fund:

February 4th, 1916.

Gentlemen-Applications have been made, as per statement herewith, for refund of Croton Water Rents paid in error. The Applications are severally approved by the Collector of Assessments and Arrears, Commissioner of Water Supply, Gas and Electricity, or the Receiver of Taxes, and the amount so paid ($459.20) has been deposited in the City Treasury to the credit of the Sinking Fund for the Payment of the Interest on the City Debt.

The attached resolution is necessary to reimburse the account "Croton Water Rent Refunding Account" for amount so overpaid.

Refund to Henry M. Fertig of Amount of Jury Fee Paid in Case Settled Before Trial.

The Deputy and Acting Comptroller presented the following report and offered the following resolution:

Hon. Commissioners of the Sinking Fund:

February 4th, 1916.

Gentlemen-Application has been made by Henry M. Fertig for refund of $4.50. amount paid as jury fee to the Clerk of the Sixth District Municipal Court, Borough of Manhattan, in an action entitled "Spalding vs. Cury." After an examination made by the Law and Adjustment Division of this Department, it is recommended that the amount of $4.50 so paid be refunded in accordance with the provisions of Section 351A of the Municipal Court Act of New York City. Attached hereto is a resolution for adoption. Yours very truly,

Gentlemen-Application has been made by Julius Hahn for the refund of $1.00, amount overpaid as a trial fee to the Clerk of the 2nd District Municipal Court. Borough of Manhattan, in an action entitled "Sheffield vs. New York Consolidated Railroad Company. After an examination made by the Law and Adjustment Division of this Department, it is recommended that the sum of $1.00 so erroneously paid be refunded.

Attached hereto is a resolution for adoption.

Refund of Amounts Due on Revoked Taxicab Licenses, Etc. The Deputy and Acting Comptroller presented the following report and offered the following resolution:

Hon. Commissioners of the Sinking Fund:

February 4th, 1916.

Gentlemen-Applications have been made by James Sheals and Thomas F. Duffy for amounts due on Taxicab Licenses, etc., which were revoked by the Mayor on July 31st, 1913.

On June 23rd, 1914, the Board of Aldermen passed an ordinance granting refunds to licensees whose licenses were so revoked. This ordinance took effect July 7, 1914. and the applications are each approved by the Commissioner of the Department of Licenses and the amount to be refunded is certified to by him. The total amount to be refunded, $10.26, is a proper charge against the Sinking Fund for the Redemption of City Debt No. 1.

The attached resolution is necessary to reimburse the account "Refunds-Licenses Taxicab, etc." for amount to be refunded.

Refund of Amounts Overpaid on Assessment for Prospect Park Improvement. The Deputy and Acting Comptroller presented the following report and offered the following resolution:

Hon. Commissioners of the Sinking Fund:

February 4, 1916.

Gentlemen-On January 14, 1916, Peter F. Reilly overpaid an assessment for the Prospect Park Improvement, on Section 4, Block 1137. Lots 35 and 38, in the amount of $4.56, and on January 13, 1916, Jerome Property Corporation overpaid an assessment for the Prospect Park Improvement on Section 4, Block 976, Lot 68, in the amount of $3.69. On December 8, 1915, and January 13, 1916, Jerome Property Corporation overpaid an assessment for the Prospect Park Improvement on Section 4, Block 1172. Lots 23 and 25, in the amount of $25. The payments so erroneously made were deposited with the Sinking Fund of the City of Brooklyn and the refund thereof will be made through account "Refunds Payable Account-Special."

The adoption of the resolution hereto attached is necessary to reimburse the said Yours very truly, account for assessments to be refunded.

Refund to Fillippo Bonifacio of Amount Overpaid on Stoop Stand License, "Newspaper," "Fruit."

The Deputy and Acting Comptroller presented the following report and offered the following resolution:

Gentlemen-Application has been made by Fillippo Bonifacio, of 237 East 29th Street, New York City, for refund of $10 on stoop stand license (newspaper and fruit), No. 1450, Document No. M2418, issued on July 6, 1915, in the amount of $15.

It appears that the license was issued by the Department of Licenses in error, the applicant applied for a newspaper stand license, the charge for which is $5.

and the license issued to applicant was a newspaper and fruit license, the charge for which is $15. After an examination made by the Division of Law and Adjustment of this department, it is recommended that the sum of $10 so erroneously paid be refunded. The amount paid has been deposited in the Sinking Fund for the Redemption of the City Debt No. 1.

Children's Court, Kings County-Amendment to Resolution Authorizing a Lease for, of Premises at No. 98 Court Street, Borough of Brooklyn. The Deputy and Acting Comptroller presented the following report and offered the following resolution:

To the Honorable, the Commissioners of the Sinking Fund:

February 7, 1916.

Gentlemen-On December 29, 1915, the Commissioners of the Sinking Fund authorized a lease to the City from the State Holding Corporation, of the second floor of premises No. 98 Court Street, Borough of Brooklyn, for use of the Children's Court of the County of Kings, for a period from January 1, 1916, to February 13, 1918, at an annual rental of $693, payable quarterly. The period of this lease should have been from January 1, 1916, to February 15, 1918.

Respectfully.

I therefore respectfully recommend that the resolution above mentioned be rescinded, and that the Commissioners of the Sinking Fund adopt in place thereof the attached resolution. ALEX. BROUGH, Deputy and Acting Comptroller. Resolved. That the resolution adopted by this Board at meeting held December 29, 1915, authorizing a lease of premises at No. 98 Court Street, Borough of Brooklyn, for use of the Children's Court, County of Kings, for a period from January 1, 1916, to February 13, 1918,

-be and the same is hereby rescinded.

Resolved, That the Corporation Counsel be and is hereby requested to prepare a lease to the City from the State Holding Corporation, of the second floor of the premises No. 98 Court Street, Borough of Brooklyn, for use of the Children's Court of the County of Kings, for a period from January 1, 1916, to February 15, 1918, at an annual rental of six hundred and ninety-three dollars ($693), payable quarterly. with the privilege of renewal for a further term of one or more years, at a rental of four hundred dollars ($400) a year and otherwise upon the same terms and conditions; the lessor to pay taxes and water rates, make inside and outside repairs during the term of the lease or any renewal thereof; cut an opening in the wall at the second floor and place door connecting the demised premises with No. 100 Court Street; remove range, wash tubs and closets from the room occupied heretofore as a kitchen and remove certain grill work from four of the other rooms formerly occupied as living rooms; cut through a partition in premises No. 100 Court Street and cause door to be placed thereat; install heating fixtures and electric lighting wiring and fixtures, all of said alterations and repairs to be completed to the satisfaction of the resident Justice; the lessee to furnish heat, light and janitor service; and the Commissioners of the Sinking Fund deeming the said rent fair and reasonable and that it would be for the interests of the City that such lease be made. the Comptroller be and is hereby authorized and directed to execute the same when prepared and approved by the Corporation Counsel, as provided by sections 149 and 217 of the Greater New York Charter.

The report was accepted. and the resolutions severally adopted, all the members present voting in the affirmative.
