Refund of $40 to the Bay Ridge Home, Being Amount of Claim Filed for

Repairs.

The Deputy and Acting Comptroller presented the following report and offered the following resolution:

Hon. Commissioners of the Sinking Fund:

September 8, 1916.

Gentlemen-On the 12th day of July, 1916, Bay Ridge Home filed a claim in this department for the refund of $82.27, amount paid in advance for rent of 332 Throop Avenue, Brooklyn, alleged to be uninhabitable, and for amount claimed to have been spent on said premises for repairs.

After a thorough examination made by the Bureau of Law and Adjustment of this Department it was recommended that the matter be transmitted to the Corporation Counsel for his opinion.

Under date of August 15, 1916, the Acting Corporation Counsel says: "In the circumstances disclosed by the papers, I am of opinion that it would be advisable to adjust this claim by the payment of $40, provided that satisfactory evidence of the payment by the Home to the Plumber and Cleaner be submitted, so that no liens upon these premises can be filed."

The amount paid to the City by the Bay Ridge Home was deposited in the Sinking Fund for the Payment of the Interest on the City Debt.

In accordance with aforesaid stated report and opinion I attach hereto a resolution for your adoption. Yours very truly,

E. D. FISHER, Deputy and Acting Comptroller.

Resolved, That a warrant payable from the Sinking Fund for the Payment of the Interest on the City Debt be drawn in favor of Bay Ridge Home for the sum of $40, refunding it that amount of rent paid to the City for premises 332 Throop avenue, Brooklyn, and for amount paid by it for repairs and cleaning of said premises.
