COMMISSIONERS OF THE SINKING FUND OF THE CITY OF NEW YORK.

Proceedings of the Commissioners of the Sinking Fund at a Meeting Held in Room 16, City Hall, at 11 o'Clock A. M., on Thursday, September 14, 1916.

Present-John Purroy Mitchel, Mayor; Edmund D. Fisher, Deputy and Acting Comptroller; Edward F. Barrett, Deputy and Acting Chamberlain; Frank L. Dowling, President, Board of Aldermen; Francis P. Kenney, Chairman Finance Committee, Board of Aldermen.

The Minutes of the meeting held August 15, 1916, were approved as printed. Dock Department-Issue of $13,500 of Additional Corporate Stock for Work of Extending Piers New 20 and 21, North River, Recommended to the Board of Estimate and Apportionment.

The following was received from the Commissioner of Docks:

August 1, 1916.

Extensions to Piers 20 and 21, North River. Hon. JOHN PURROY MITCHEL, Mayor, and Chairman of the Commissioners of the Sinking Fund.

Dear Sir-On November 3rd, 1915, the Commissioners of the Sinking Fund approved of a lease to the Erie Railroad Company of extensions to Piers New 20 and 21, North River, to be constructed by the City, at a rental of 271⁄2 cents per square foot for the land under water covered by the extensions plus 51⁄2 per cent. on the cost. This lease has since been executed.

On December 10th, 1915, the Board of Estimate and Apportionment appropriated corporate stock to the amount of $54,500 to cover the cost of said extensions. At the request of the railroad company work was not commenced at that time, and we have since been awaiting notification from them to start the work. I am today in receipt of a communication from the President of the Erie Railroad Company requesting that the extensions be put under way as soon as possible.

Since making the estimate upon which the appropriation of December 10th, 1915, was passed, the cost of materials has advanced considerably, so that the revised estimate today for doing the work is $68,000, an increase of $13,500 over the former figures.

I would respectfully request that the Commissioners of the Sinking Fund adopt a resolution recommending the Board of Estimate and Apportionment authorize the Comptroller to issue additional corporate stock in the sum of $13,500, making a total of $68,000 for the work of extending Piers New 20 and 21, North River. In connection therewith the Deputy and Acting Comptroller presented the following report of the Corporate Stock Budget Committee and offered the following resolution:

To the Commissioners of the Sinking Fund:

August 31, 1916.

Gentlemen-On August 2, 1916, you referred to the Committee on Corporate Stock Budget a request from the Commissioner of Docks dated August 1, 1916, for $13,500 corporate stock in addition to the amount heretofore authorized for the construction of extensions to Piers New 20 and 21, North River.

The Bureau of Contract Supervision reports thereon as follows:

"On December 10, 1915, the Board of Estimate and Apportionment pursuant to section 180 of the Greater New York Charter and the recommendation of your Board authorized the Comptroller to issue corporate stock to the amount of $54,500 to cover the cost of the said extensions.

"The extensions when completed are to be occupied by the Erie Railroad Company, the lease for the same having already been executed.

"The rental is at the rate of 271⁄2 cents per square foot for the land under water covered by the extensions, plus 51⁄2 per cent. on the cost.

"The Commissioner states in his communication that the President of the Erie Railroad Company has requested that the extensions be put under way as soon as possible.

"The original estimates of cost for the construction of these extensions were made prior to November, 1915, since which time the cost of materials has increased to such an extent that it is deemed advisable to provide the additional amount so that there may be no delay in proceeding with the letting and awarding of the contract.

"The revised estimate is based on present prices and the amount is not considered excessive."

We recommend the adoption of the attached resolution granting the request. Respectfully,

Resolved, That the resolution adopted by the Commissioners of the Sinking Fund on November 3, 1915, as follows:

"Resolved, That, pursuant to the provisions of section 180 of the Greater New York Charter, as amended, the Commissioners of the Sinking Fund hereby recommend to the Board of Estimate and Apportionment that the Comptroller be authorized to issue corporate stock of The City of New York to the amount of fifty-four thousand five hundred dollars ($54,500), the proceeds whereof to be used for the construction of extensions to Piers 20 and 21, North River," -be amended to make the amount read sixty-eight thousand dollars ($68,000). The report was accepted and the resolution unanimously adopted.

Dock Department-Issue of $500 Additional Corporate Stock to Permit an
Award of Contract for the Extension of Pier 47, North River, to the Lowest
Bidder, Recommended to the Board of Estimate and Apportionment.
The following was received from the Commissioner of Docks:

Hon. JOHN PURROY MITCHEL, Mayor, and Chairman of the Commissioners of the Sinking Fund:

Dear Sir-June 22nd, 1916, resolution was adopted by the Commissioners of the Sinking Fund recommending issuance of corporate stock to the amount of $12,000 for extending Pier 47, North River, near the foot of Perry Street, out to the pierhead line. On June 30th, 1916, resolution was adopted by the Board of Estimate and Apportionment authorizing the issuance of this corporate stock. The preliminary estimate made by our Engineering Division at that time was $12,000.

July 11th, 1916, the Comptroller approved the plans, specfications, form of contract and estimate of $12,000.

After advertisement bids were received to-day as follows:

It will be noted from the above that the lowest bid received is $500 in excess of the amount authorized.

I request that a resolution be adopted by the Commissioners of the Sinking Fund recommending to the Board of Estimate and Apportionment that the Comptroller be authorized to issue additional corporate stock in the sum of $500 to permit the award of this contract to the low bidder. "It is the opinion of the Bureau of Contract Supervision (in view of the high prices for materials and labor at the present time) that a bid lower than $12,500 would not be received if the contract were readvertised, and that the additional amount requested should be provided."

Resolved, That the resolution adopted by the Commissioners of the Sinking Fund on June 22, 1916, as follows:

"Resolved, That, pursuant to the provisions of section 180 of the Greater New York Charter, as amended, the Commissioners of the Sinking Fund hereby recommend to the Board of Estimate and Apportionment that the Comptroller be authorized to issue corporate stock to an amount not exceeding twelve thousand dollars ($12,000), the proceeds to be used for the construction of extension to Pier 47, North River,"

-be amended to make the amount read twelve thousand five hundred dollars ($12,500). The report was accepted and the resolution unanimously adopted.

Dock Department-Request of, for Authority to Approve of the Assignment or Subletting by the American Malting Company, to George Ehret, of a Lease of Bulkhead Property Between East 63rd and East 64th Streets, in the Borough of Manhattan.

Withdrawn by the Dock Commissioner.

Dock Department-Amendment to That Portion of the New Plan Lying Between West 202nd Street and West 205th Streets, Harlem River, Borough of Manhattan.

A communication was received from the Commissioner of Docks transmitting for approval proposed amendment to that portion of the new plan lying between West 202d and West 205th streets, Harlem River, Borough of Manhattan, made and adopted by the Commissioner of Docks August 10, 1915.

A public hearing being necessary, the following resolution was offered for adoption:

Resolved, That the Commissioners of the Sinking Fund hereby fix 11 o'clock in the forenoon on Thursday, October 5, 1916, in Room 16, City Hall, Borough of Manhattan, as the time and place for a public hearing in the matter of the proposed amendment to that portion of the new plan lying between West 202nd and West 205th Streets, Harlem River, Borough of Manhattan, made and adopted by the Commissioner of Docks in accordance with law August 10, 1915.

Which resolution was unanimously adopted.

Board of Education-Lease for, of Plot of Ground at the Northeast Corner of Church Avenue and East 48th Street, Borough of Brooklyn.

The Deputy and Acting Comptroller presented the following report and offered the following resolution:

To the Honorable the Commissioners of the Sinking Fund:

September 8, 1916.

Gentlemen-The Secretary of the Board of Education in a communication to

your Board under date of May 11, 1916, states that a resolution was adopted by the Board of Education on May 10, 1916, requesting the Commissioners of the Sinking Fund to approve of and consent to the leasing of a plot of ground at the northeasterly corner of Church avenue and East 48th street, Borough of Brooklyn, on which is located a one-story temporary building, occupied by P. S. 135, at a rental of $75 a month.

As a result of negotiations by the Division of Real Estate of this Department, the owner has consented to renew this lease on a month-to-month basis for a period not exceeding one year, at a rental of $50 a month.

Deeming the rent reasonable and just under the circumstances, I respectfully recommend that the Commissioners of the Sinking Fund adopt a resolution authorizing a lease of the following described premises in the Borough of Brooklyn, for use of the Board of Education:

Beginning at a point formed by the intersection of the northerly line of Church Avenue with the easterly line of East 48th Street, and running thence northerly along the easterly line of east 48th Street 93 feet 51⁄2 inches; thence easterly and parallel or nearly so with Church Avenue 120 feet; thence southerly and parallel or nearly so with East 48th Street 96 feet 6 inches to the northerly line of Church Avenue; thence westerly along the northerly line of Church Avenue 120 feet to the easterly line of East 48th street, the point or place of beginning, be the said several dimensions more or less.

-at a rental of $50 a month on a month-to-month basis, for a period not exceeding one year from July 1, 1916; the lessor to pay taxes; the lessee to pay water rates, furnish heat, light and janitor service and make such inside and outside repairs to its buildings as it may deem necessary, a condition of this lease being that if Church Avenue be physically widened at that point during the term of occupancy by the City, the lease shall thereupon terminate; it being further understood and agreed that The City of New York may remove all improvements erected thereon at the expiration of said lease or any renewal thereof, otherwise upon the same terms and conditions as contained in the lease which expired July 1, 1916. Resolved, That the Commissioners of the Sinking Fund hereby approve of and consent to the execution by the Board of Education of a lease to the City of the following premises in the Borough of Brooklyn:

-at a rental of fifty dollars ($50) a month, on a month to month basis, for a period not exceeding one year from July 1, 1916; the lessor to pay taxes; the lessee to pay water rates, furnish heat, light and janitor service and make such inside and outside repairs to its buildings as it may deem necessary, a condition of this lease being that if Church Avenue be physically widened at that point during the term of occupancy by the City the lease shall thereupon terminate. It being further understood and agreed that the City of New York may remove all improvements erected thereon at the expiration of said lease or any renewal thereof, otherwise upon the same terms and conditions as contained in the lease which expired July 1, 1916; lessor, Arthur Lyman; the Commissioners of the Sinking Fund deeming the said rent fair and reasonable and that it would be for the interests of the City that such lease be made. The report was accepted and the resolution unanimously adopted.

Board of Education-Amendment to Resolution Authorizing a Renewal of the Lease of Premises on Walworth Street, Near Myrtle Avenue, Borough of Brooklyn.

The Deputy and Acting Comptroller presented the following report and offered the following resolution:

To the Honorable, the Commissioners of the Sinking Fund:

September 8, 1916.

Gentlemen-On July 26, 1916, the Commissioners of the Sinking Fund adopted a resolution approving of and consenting to the execution by the Board of Education of a renewal of the lease of the two one-story buildings on Walworth Street, near

Myrtle Avenue, Borough of Brooklyn, for a period from July 1, 1916, to July 1, 1918, with the privilege of renewal thereafter for one or two years, at an annual rental of $700, the City to assume the water tax.

The Secretary of the Board of Education states that the resolution adopted by the Board of Education should have contained the clause "otherwise on terms and conditions the same as those contained in the existing lease," and requests that the above mentioned resolution adopted by the Commissioners of the Sinking Fund be so amended.

I therefore respectfully recommend that the above mentioned resolution adopted by the Commissioners of the Sinking Fund on July 26, 1916, be amended by adding the clause, "otherwise on terms and conditions the same as those contained in the existing lease." Respectfully,

Resolved, That the resolution adopted by this Board at meeting held July 26, 1916, approving of and consenting to the execution by the Board of Education, of a renewal of the lease to the City of the two one-story buildings on Walworth Street near Myrtle Avenue, Borough of Brooklyn, for a period from July 1, 1916, to July 1, 1918, with the privilege of renewal thereafter for one or two years, at an annual rental of seven hundred dollars; the City to assume the water taxes, be and the same is hereby amended by adding the clause, "otherwise on terms and conditions the same as those contained in the existing lease."

The report was accepted and the resolution unanimously adopted.

Health Department-Lease for, of Premises No. 5 Terrace Avenue, Jamaica, Borough of Queens.

The Deputy and Acting Comptroller presented the following report and offered the following resolution:

To the Honorable the Commissioners of the Sinking Fund:

September 8, 1916.

Gentlemen-The Secretary of the Department of Health, in a communication to your Board under date of August 19, 1916, requests the execution of a lease of the premises at 5 Terrace avenue, Jamaica, Borough of Queens, for use as a dormitory for the nurses employed at the Queensboro Hospital, for a period of one year from August 1, 1916, with the privilege of renewal for one or two years, at a rental of $660 per annum.

The Queensboro Hospital was designed to accommodate eighty patients, but at present the number is from 105 to 112, with twenty-nine to thirty nurses. For these nurses there are four rooms which will accommodate twelve, so that it is absolutely necessary to find other quarters for seventeen or eighteen nurses.

The premises to be leased at 5 Terrace avenue consist of an 11-room, two-story and attic, frame and stucco house, on a lot 40 feet by 100 feet, and are located on the north side of Terrace avenue, about 100 feet west of Flushing avenue.

The appraised value of the house and lot is $7,200, and the rental asked is therefore 9.1 per cent. on the appraised value.

I therefore respectfully recommend, the rent being reasonable and just, that the Commissioners of the Sinking Fund adopt a resolution authorizing a lease of the premises at No. 5 Terrace avenue, located on the north side of Terrace avenue, about 100 feet west of Flushing avenue, Jamaica, Borough of Queens, for use of the Department of Health, for a period of one year from August 1, 1916, with the privilege of renewal for an additional period of one or two years upon the same terms and conditions, at a rental of $660 a year, payable quarterly; the lessor to pay taxes and make inside and outside repairs, the lessee to pay water rates and furnish heat, light and janitor service. Resolved, That the Corporation Counsel be and is hereby requested to prepare a lease to the City, from Joseph Froissard, of the premises No. 5 Terrace Avenue, located on the north side of Terrace avenue, about 100 feet west of Flushing Avenue, Jamaica, Borough of Queens, for use of the Health Department for a period of one year from August 1, 1916, with the privilege of renewal for an additional period of one or two years upon the same terms and conditions, at a rental of six hundred and sixty dollars ($660) a year, payable quarterly; the lessor to pay taxes and make inside and outside repairs: the lessee to pay water rates and furnish heat, light and janitor service; and the Commissioners of the Sinking Fund deeming the said rent fair and reasonable and that it would be for the interests of the City that such lease be made, the Comptroller be and is hereby author
