COMMISSIONERS OF THE SINKING FUND OF THE CITY OF NEW YORK.

Proceedings of the Commissioners of the Singing Fund, at a Meeting Held in Room 16, City Hall, at 3 o'Clock P. M., on Thursday, July 13, 1916.

Note-This meeting, which was originally called for 11 a. m., was postponed by His Honor the Mayor until 3 p. m. At 11 a. m. the Secretary made a public announcement in the meeting room of such postponement.

Dock Department-New Plan Layout in the Vicinity of Milton Street, East River, Borough of Brooklyn.

The Chair called for a hearing in the matter of the new plan layout in the vicinity of Milton Street, East River, Borough of Brooklyn, made and adopted by the Commissioner of Docks June 2, 1916.

Pier A, North River, June 2, 1916. Hon. JOHN PURROY MITCHEL, Mayor, and Chairman of the Commissioners of the Sinking Fund:

Dear Sir-Under date of May 16, 1916, a New Plan lay-out in the vicinity of Milton Street, East River, Borough of Brooklyn, was transmitted, after adoption by me, to the Commissioners of the Sinking Fund for approval. The date for a hearing on this New Plan has been fixed by the Commissioners of the Sinking Fund for June 15, 1916.

The Greenpoint Terminal Company have submitted plans for the construction of a pier north of Milton Street, calling for its southerly side to be 50 feet north of the center line of Milton Street, and I am advised that this location was agreed upon between the Greenpoint Terminal Company and the Cunningham Realty Company, the owners of the property southerly.

I transmit herewith, and request your approval thereof, map in duplicate, together with technical description, which has today been adopted by me and which will conform to the location plan as submitted by the Greenpoint Terminal Company. I request that the plan forwarded under date of May 16, 1916, be returned and that the plan transmitted herewith be substituted in lieu thereof.

R. A. C. SMITH, Commissioner of Docks. No one appearing in opposition, the Deputy and Acting Comptroller presented the following report and offered the following resolution:

July 6, 1916.

To the Honorable the Commissioners of the Sinking Fund:
Gentlemen-In a communication dated June 2, 1916, the Commissioner of Docks
transmitted for approval a new plan layout in the vicinity of Milton Street, East
River, Borough of Brooklyn.

The proposed new plan consists in the establishment of one pier 90 feet in width and extending outshore to the established pierhead line, the south side of said pier being 50 ft. north of the center line of Milton Street. This layout will give a slip room of 280 feet north of and parallel with the northerly side of Noble Street.

The establishment of a new pier 280 feet from Noble Street will be to the City's

advantage by providing a sufficiency of slip room.

I am advised that the City is the owner of the pier at the foot of Noble Street, and the property north of Noble Street is under private ownership.

In the event of the Commissioners of the Sinking Fund approving of the new plan layout at the publnc hearing to be held, pursuant to Chapter 372 of the laws of 1907, the attached resolution is recommended for adoption approving the request Respectfully, ALBERT E. HADLOCK, Deputy and Acting Comptroller.

Resolved, That the Commissioners of the Sinking Fund hereby approve of the new plan for improving the water-front and harbor of the City of New York, in the vicinity of Milton Street, East River, Borough of Brooklyn, as adopted by the Commissioner of Docks on June 2, 1916, in accordance with law.

The report was accepted and the resolution unanimously adopted.
The chair then declared the hearing closed.

Dock Department-New Plan for the Improvement of the Water Front Be tween Montague Street and State Street, East River, Borough of Brook lyn. The Chair called for a hearing in the matter of the new plan for the improve ment of the water front between Montague Street and State Street, East River, Borough of Manhattan, made and adopted by the Commissioner of Docks June 7, 1916.

Pier A, North River, June 7, 1916. Hon. JOHN PURROY MITCHEL, Mayor, and Chairman of the Commissioners of the Sinking Fund:

Sir-I submit herewith for your approval map and tracing, together with tech nical description thereof, showing amendment to New Plan between Montague Street and State Street, East River, Borough of Brooklyn, which amended New Plan has this day been adopted by me.

The property to the south of the southerly pier shown on the New Plan is owned or claimed to be owned by the Union Ferry Company, which operates a ferry from the foot of Atlantic Avenue, Borough of Brooklyn, to the foot of Whitehall Street, Borough of Manhattan.

The ferry company has requested a slight modification in the lines of the pr posed new southerly pier as shown on the plans, in which request the New York Dock Company joins.

This change of position of the southerly pier necessitates the relocation of the two piers to the north, and in my opinion there is no objection to the proposed amend ment; in fact I believe the piers as located under the proposed New Plan will be an improvement on the present New Plan.

By an indenture made the second day of June, 1916, between the City of New York, by the Commissioner of Docks, and the New York Dock Company, it is provided:

"Second. For the purpose of affording protection for the Rapid Transit Railroad, the Lessee shall as promptly as may be construct or cause to be cor structed a new substantial modern pier over the said rapid transit railroad. Such pier shall be constructed at the foot of Joralemon Street, beginning at the bulkhead line or thereabouts, as may be designated by the Commission and the De partment, upon plans to be first approved by the Commission and the Department, and shall be constructed under the supervision and inspection of the said Com mission and the Department and in such manner as may from time to time approved by the said Commission and the Department, and so as not to inter fere with, impair or endanger the use and operation of said rapid transit railroad. * * *""

The change in location of the pier foot of Joralemon Street has this day been submitted to the Public Service Commission as required by the terms of the afore said lease. Yours very truly, R. A. C. July 7, 1916

To the Honorable the Commissioners of the Sinking Fund:
Gentlemen-On June 7, 1916, the Commissioner of Docks adopted and submitted
for approval an amendment to the New Plan between Montague Street and State
Street, East River, Borough of Brooklyn.

This amendment modifies the New Plan as approved by the Commissioners of the Sinking Fund on January 12, 1916, to the extent of shifting the lines of the southerly pier a short distance to the north and slightly changing the angle made by the southerly three piers with the bulkhead line.

The ownership of the property to the south of the southerly pier shown on the New Plan is claimed by the Union Ferry Company, which operates a ferry from the

foot of Atlantic Avenue, Borough of Brooklyn, to the foot of Whitehall Street, Borough of Manhattan.

The ferry company requested a slight modification in the lines of the proposed new southerly pier as shown on the plans in order that there may be no question as to the ownership of the land under water, leased to the Dock Company for the erection of a pier, in which request the New York Dock Company joined.

Changing the position of the southerly pier necessitated the relocation of the two piers to the north.

By an indenture made the second day of June, 1916, the City of New York, by the Commissioner of Docks, and the New York Dock Company, it is provided:

"Second. Losei Realty Corporation-Agreement with, to Establish a Boundary Line in Front of Premises Owned by the Corporation in Mill Creek and Mill Basin, 32nd Ward, Borough of Brooklyn.

The following was received:

Agreement made this 7th day of July, one thousand nine hundred and sixteen, by and between The City of New York, party of the first part, and the Losei Realty Corporation, a corporation organized under the Laws of the State of New York and having its principal place of business in the City of New York, party of the second part, witnesseth:

Whereas, the said Losei Realty Corporation is the owner of uplands along Mill Creek and Mill Basin, in the 32nd Ward, Borough of Brooklyn, City of New York, and of certain lands under water in front of part of the same, and The City of New York is the owner of other lands under water adjacent to said lands of the Losei Realty Corporation; and

Whereas, the boundary line between the lands of the parties hereto is, in places, indefinite and subject to change by the action of the elements and the improvement of the water front; and

Whereas, the bulkhead and pierhead lines in the vicinity of said property have been from time to time established and modified by the Secretary of War and the Commissioner of Docks and the Commissioners of the Sinking Fund of the City of New York;

Now, therefore, by reason of said premises and in order that the boundary line along the northerly and easterly boundaries of the premises owned by said Losei Realty Corporation may be fixed and determined permanently, and that the bulkhead and pierhead lines may also be fixed and established permanently and improvement of the water front along the same speedily undertaken, to the mutual advantage of both parties hereto, and in consideration of the premises and of the mutual covenants herein by each party to the other made, and of the sum of one dollar by each party to the other paid, the receipt whereof is hereby acknowledged, it is mutually covenanted and agreed:

First-By the Losei Realty Corporation, that it is the owner in fee of the following tracts, pieces or parcels of land, consisting of upland and lands under water,

situated on said Mill Creek and Mill Basin in Jamaica Bay, Borough of Brook City of New York, bounded and described as follows:

Beginning at a point in the southerly line of East 52d Street, distant 215 westerly from the centre line of Avenue U; thence running northerly, on a line alway distant 215 feet westerly from the centre line of Avenue U, to the centre line of Exe 57th Street; thence westerly, along the centre line of East 57th Street, to a point do feet westerly from the easterly line of Avenue U; thence easterly, along a ditch creek as the same curves and winds to Mill Creek; thence southerly, along Mill Cre as the same curves and winds, to the centre line of Hinsdale Avenue and land formeri of Curley and now of The City of New York; thence westerly, along said centre in of Hinsdale Avenue and the line of land formerly of said Curley and now of 7 City of New York, to the Town Survey Commissioners' Bulkhead Line as etsabliss. in 1874; thence northerly, along the said Town Survey Commissioners' Bulkhead Line of 1874, 28.5 feet to the southerly line of East 52nd Street if extended; thence w st erly, along the southerly line of East 52nd Street extended, to the point or place beginning.

Beginning at a point in a line sixteen hundred and eighty feet east of a parallel to Flatbush Avenue as monumented and laid out by the "Town Survey Cre mission," said line also being the centre line of East 57th Street, as mapped and out by property owners and distant six hundred and thirty-seven feet southerly in Avenue U as also laid out by said Commission, and running thence by magn bearing north forty-seven degrees, thirty-four minutes, twenty second east one b dred eighty-eight and forty-seven one hundredths feet to corner 2; thence north teen degrees, thirteen minutes, fifty seconds west three hundred seven and ninetyone hundredths feet to corner 3; thence north eight degrees nine minutes west ca hundred eight and eighty-five one hundredths feet to corner 4; thence north fifty-a degrees, thirty-eight minutes, forty seconds west one hundred nine and sixty-s one-hundredths feet to corner 5; thence north eleven degrees, eleven minutes, t five seconds west one hundred six and fifty-seven one hundredths feet to corner. thence south, seventy-five degrees, forty-five minutes, twenty seconds east, two dred four and eighty-three one-hundredths feet to corner 7; thence south one dec sixteen minutes, forty-five seconds west two hundred twenty-four feet to corner) thence south thirteen degrees, fifty-one minutes east two hundred seventy-five feet : corner 9; thence south nine degrees, thirty-four minutes, twenty seconds, west nat three feet to corner 10; thence south fifty-one degrees, forty-nine minutes, seconds west one hundred sixty-four and fourteen one-hundredths feet to corner i thence north thirty-one degrees, twenty-five minutes west and parallel to Fato Avenue forty-nine and seventy-one-hundredths feet to corner 1, the point or place beginning, and containing one and nine hundred two one-thousandths acres, S and excepting, however, all that portion of land under water lying in front of adjacent to said East 57th Street, being a strip bounded and described as follows

Beginning at a point where the mean high water line is intersected by the my line of East 57th Street as above described, and running thence along mean 24 water line north forty-seven degrees, thirty-four minutes and twenty seconds ea thirty-five and sixty-six one-hundredths feet; thence parallel with the middle said East 57th Street, south thirty-one degrees and twenty-five minutes east bitt and thirty-seven one-hundredths feet; thence south fifty-one degrees, farten minutes and forty seconds west, thirty-five and twenty-five one-hundredths feet; the in prolongation of the middle line of said East 57th Street north thirty-one digh and twenty-five minutes west, forty-nine and seven-tenths feet to the point o of beginning and containing forty-one thousandths (041) of an acre: the port land under water excluding said exception, containing net one and eight hundred sat one one-thousadths acres (1.861 A.).

Second-Both the parties hereto agree that the boundary line along the and easterly boundaries of the property of said Losei Realty Corporation, an dividing line between the lands of the respective parties hereto shall be the IDMA

line:

Beginning at a point in the centre line of East 57th Street, distant) (measured along the centre line of East 57th Street) westerly from the easter of Avenue U; thence running easterly to a point in the Pierhead and Bulkhead & re-established by the Secretary of War August 31, 1915, at its intersection drawn parallel to and 25 feet easterly from the easterly line of Avenue ! in a southeasterly direction, along said Pierhead and Bulkhead Line and a southeasterly prolongation, to its intersection with a line drawn parallel to a tant 650 feet (measured at right angles to Avenue ) easterly from the easter of Avenue U; thence southerly, parallel with Avenue U and distant sal

easterly there from to its intersection with the Pierhead and Bulkhead Line_re-established by the Secretary of War August 31, 1915, at or near the foot of East 56th Street; thence southerly in a straight line, along the Pierhead and Bulkhead Line re-established by the Secretary of War August 31, 1915, and the southerly prolongation of that portion thereof between East 56th Street and East 52nd Street to the centre line of Hinsdale Avenue, if extended, the property line formerly of Curley and now of The City of New York, hereinbefore mentioned.

Third-The City of New York agrees that, subject to the approval of the Secretary of War, the Plan for the Improvement of the Water Front of the City of New York shall be amended by establishing the westerly bulkhead line along Mill Basin from East 52d Street to a line parallel to and distant 25 feet easterly from Avenue U near East 61st Street, as follows:

Beginning at a point in the bulkhead line adopted by the Commissioner of Docks March 26, 1915, at its intersection with the northerly side of East 52d Street prolonged; running thence easterly and along the prolongation of the northerly side of East 52d Street to its intersection with a line drawn parallel to and distant 650 feet (measured along said East 52d Street) easterly from the easterly line of Avenue U; thence northerly, along said line, parallel to and always distant 650 feet from the easterly line of Avenue U, to its intersection with the said Pierhead and Bulkhead Line re-established by the Secretary of War August 31, 1915, at or near the southerly line of East 56th Street, and thence a Pierhead and Bulkhead Line in prolongation of said bulkhead line parallel to and distant 650 feet easterly from the easterly line of Avenue U and coincident with the boundary line above described; thence northwesterly still coincident with the said boundary line, to a point therein distant 25 feet (measured at right angles to Avenue U) easterly from the easterly line of Avenue U; and thence northerly, parallel to Avenue U, to the southerly line of East 61st Street. The City of New York shall submit to the Secretary of War and advocate the said modification by him of said Pierhead and Bulkhead Lines.

Fourth-The Losei Realty Corporation agrees to convey to The City of New York all its right, title and interest in and to the lands in Mill Basin outshore of the said boundary line hereby agreed to be established along its northerly and easterly boundaries.

Fifth-The City of New York agrees to convey to the Losei Realty Corporation all its right, title and interest in and to the lands under water inshore or within the said boundary line so agreed to be established along the northerly and easterly boundary lines of said Losei Realty Corporation.

Sixth-The Losei Realty Corporation agrees to convey to The City of New York for the purpose of a Basin, the piece or parcel of land bounded and described as follows:

Beginning at the point of intersection of the westerly line of Avenue V prolonged northerly with the centre line of Hinsdale Avenue prolonged easterly (the boundary line between the property of said Curley, now of The City of New York, and of the Losei Realty Corporation); thence running northerly, in continuation of the westerly line of Avenue V, 188 feet, more or less, to the centre line of the block, if extended, between East 52d and East 53d Streets; thence easterly, in continuation of the centre line of the block between East 52d and East 53d Streets, to its intersection with the boundary line (hereinbefore agreed upon) along the westerly line of Mill Basin; thence southerly, along said boundary line agreed upon, to the centre line of Hinsdale Avenue prolonged, being the northerly line of the lands of Curley and now of The City of New York; thence westerly, along the last mentioned line, to the point or place of beginning.

Seventh-Both parties agree that the Plan for the Improvement of the Water Front of The City of New York shall be altered by eliminating the Marginal Street at present proposed to be laid out between Avenues U and V, so far as the same lies northerly of the boundary line between the lands of the Losei Realty Corporation and of said Curley, now of The City of New York.

Eighth-The Losei Realty Corporation agrees to commence the construction of a good and sufficient bulkhead, not more than 30 feet inshore of said bulkhead line hereby agreed to be established, sufficient to retain the filling hereinafter agreed to be done.

Ninth-The City of New York shall, within nine months hereafter, complete the dredging to a depth of 18 feet at mean low water outside of said bulkhead line hereby agreed to be established. and out to the Pierhead and Bulkhead Line reestablished by the Secretary of War August 31, 1915, which line is the Westerly line of the present Mill Basin, and shall dredge in even slope of natural repose, the areas between said bulkhead line hereby agreed to be established and the bulkhead to be
