It being intended to describe all of the land lying between the northerly side of 161st Street and the southerly side of 162d Street and between the westerly side of Fort Washington Avenue and a line beginning on the southerly side of 162d Street one hundred and forty feet westerly from Fort Washington Avenue, and running thence southerly at right angles to the southerly side of 162d Street to the northerly side of 161st Street, included between the said original centre line of the lane or party road between the lands of Shepherd Knapp and Ambrose C. Kingsland and the centre line of said lane or party road, called Knapp's Lane as thereafter established or used in the most southerly location in which it was ever laid out or designated.

VIII. That your petitioners further show that by reason of the said assertion of outstanding title, some question has arisen as to the validity of the conveyance made by the City of New York as aforesaid as to so much of the land conveyed thereby as lay opposite and adjacent to the land then claimed to be in the ownership of John Dalley or his successors in interest, but now in the ownership of your

petitioners. Annexed hereto and made a part of this petition is a diagram dated February & 1910 showing the land affected by this objection.

IN That full compensation has been made to the City of New York for the lands and premises described in the prayer of this petition.

Wherefore, your petitioners respectfully pray of this Honorable Board for releases of the interest, if any, of the Cry of New York as a cloud upon your petitioners' title or, in and to so much of the respective premises of your petitioners bereinabove in paragraph 1 of this petition described, as is situated between the wester's side of Fort Washington Avenue, as legally opened, and the westerly side of Fort Washington Ridge Road, as laid out in 1873

In connection therewith the Deputy and Acting Comptroller presented the following report and offered the following resolutions:

To the Honorable the Commissioners of the Sinking Fund:

March 10, 1916.

Gentlemen-I am in receipt of a petition to the Commissioners of the Sinking Fund from Friedman Construction Company and Anne Ide Cockran, stating that they are the owners of the block front on the westerly side of Fort Washington Avenue, extending from the northerly side of 161st Street to the southerly side of 162nd Street, Borough of Manhattan, having derived title thereto through mesne conveyances from J. Romaine Brown and Alexander P. W. Kinnan, as executors of the Last Will and Testament of Loyal L. Smith, deceased.

On November 27, 1912, the Commissioners of the Sinking Fund authorized a release to J. Romaine Brown and Alexander P. W. Kinnan of that portion of Fort Washington Avenue, lying between the northerly line of 160th Street and the southerly line of 163rd Street, in consideration of the sum of $10,262.50. One of the conditions contained in this release was that the grantees were the owners of the land fronting on the section of the road conveyed. This resolution was subsequently amended by making a change in the description of one of the parcels conveyed.

In accordance with the above mentioned resolutions a deed dated December 24, 1912, was delivered to the grantees. The petition states that subsequent to the execution and the delivery of the said deed by the City of New York, it was asserted that title to so much of the petitioners' premises as lay north of the center line of a certain lane formerly known as Knapp's Lane and south of the original division line between lands of Knapp and Kingsland, was outstanding in John Dalley or his successors in interest, which interest (if any such was in fact outstanding), has since been conveyed to the petitioners. They request a release to them of whatever interest the City may have in that portion of Fort Washington Avenue abutting their premises, by reason of the fact that J. Romaine Brown and Alexander P. W. Kinnan might not have been the owners of that portion of Fort Washington Avenue between 161st Street and 162nd Street.

I therefore respectfully recommend that the Commissioners of the Sinking Fund authorize a release to the Friedman Construction Company, No. 189 Broadway, New York City, of the interest of the City in and to the following described property:

All that lot or parcel of land in the Borough of Manhattan, City of New York, described as follows:

Bounded on the east by the westerly side of Fort Washington Avenue as legally opened; bounded on the west by the westerly side of old Fort Washington Ridge Road; bounded on the north by the southerly side of West 162nd Street; bounded on the south by the centre line of the block between 161st and 162nd Streets;

and that they adopt a further resolution authorizing a release to Anne Ide Cockran, Port Washington, Nassau County, New York, of the interest of the City in and to the following described property:

All that lot or parcel of land in the Borough of Manhattan, City of New York, described as follows:

Bounded on the east by the westerly side of Fort Washington Avenue, as legally

opened; bounded on the west by the westerly side of old Fort Washington Ridge Road; bounded on the south by the northerly side of West 161st Street; bounded on the north by the centre line of the block between 161st and 162nd Streets.

Each of the above releases to be in consideration of the sum of $1.00, plus an additional charge of $12.50 for the preparation of the necessary papers, and to contain the following terms and conditions:

That the grantee waive any and all claim for damages arising out of the closing of the street or avenue.

That the grantee is the owner of the land fronting on the section of the street or avenue to be conveyed.

The deed not to be delivered until the grantee has paid whatever taxes and assessments are liens against the premises to be conveyed. Respectfully,

Resolved, That the Commissioners of the Sinking Fund hereby determine that the land described as follows is not needed for any public use:

All that lot or parcel of land in the Borough of Manhattan, City of New York, described as follows:

Bounded on the east by the westerly side of Fort Washington Avenue as legally opened; bounded on the west by the westerly side of old Fort Washington Ridge Road; bounded on the north by the southerly side of West 162d Street; bounded on the south by the centre line of the block between 161st and 162d streets,

-and be it further

Resolved, That, pursuant to the provisions of section 205 of the Greater New York Charter as amended, the Commissioners of the Sinking Fund hereby authorize a release to the Friedman Construction Company, No. 189 Broadway, New York City, of the interest of the City in and to the property hereinabove in this resolution bounded and described, in consideration of the sum of one dollar ($1) plus the additional charge of twelve dollars and fifty cents ($12.50) for the preparation of the necessary papers.

The release to contain the following terms and conditions:

That the grantee waive any and all claim for damages arising out of the closing of the street or avenue.

That the grantee is the owner of the land fronting on the section of the street or avenue to be conveyed.

The deed not to be delivered until the grantee has paid whatever taxes and assessments are liens against the premises to be conveyed.

Resolved, That the Commissioners of the Sinking Fund hereby determine that the land described as follows is not needed for any public use:

All that lot or parcel of land in the Borough of Manhattan, City of New York, described as follows:

Bounded on the east by the westerly side of Fort Washington Avenue, as legally opened; bounded on the west by the westerly side of old Fort Washington Ridge Road; bounded on the south by the northerly side of West 161st Street: bounded on the north by the centre line of the block between 161st and 162d streets,

-and be it further

Resolved, That, pursuant to the provisions of section 205 of the Greater New York Charter, as amended, the Commissioners of the Sinking Fund hereby authorize a release to Anne Ide Cockran, Port Washington, Nassau County, New York, of the interest of the City in and to the property herinabove in this resolution bounded and described, in consideration of the sum of one dollar ($1) plus the additional charge of twelve dollars and fifty cents ($12.50) for the preparation of the necessary papers. The release to contain the following terms and conditions:

That the grantee waive any and all claim for damages arising out of the closing of the street or avenue.

That the grantee is the owner of the land fronting on the section of the street or avenue to be conveyed.

The deed not to be delivered until the grantee has paid whatever taxes and assessments are liens against the premises to be conveyed.

The report was accepted and the resolutions severally unanimously adopted.

S. R. Smith Infirmary—Petition of, for the Cancellation of Certain Assessments. Laid over.

The following matters not on the calendar were brought up by unanimous consent:

Bridge Department-Lease for, of Premises at Nos. 121 Canal Street, Borough of Manhattan.

The Deputy and Acting Comptroller presented the following report and offered the following resolution:

To the Honorable the Commissioners of the Sinking Fund:

March 15, 1916.

Gentlemen-The Commissioners of the Department of Bridges, in a communication to your Board under date of March 14, 1916, states the owner of the building at 125-131 Canal Street, Manhattan, does not desire to renew the lease of the room on the second floor now occupied by the Department of Bridges, but wishes to have the department occupy a room on the fifth floor at the same rental of $60 per month. A room can be secured at the southwest corner of the fifth floor of the building at No. 121 Canal Street, at a rental of $35 per month, which will result in a saving to the City of $25 per month, and the proposed change has been approved by the Department of Bridges.

This office is used as a construction office in connection with the work being done on the Manhattan Bridge, and on account of delay in the work of completing the contract for the Manhattan Plaza of this structure and work in connection with the terminal for the Three Cent Line, the office will be required for a period of six months from May 1, 1916.

I therefore respectfully recommend, the rent being reasonable and just, that the Commissioners of the Sinking Fund adopt a resolution authorizing a lease of Room 53 at the southwest corner of the fifth floor, containing 434 square feet, in the building No. 121 Canal Street, Manhattan, for use of the Department of Bridges, for a period of six months from May 1, 1916, with the privilege of renewal for an additional period of six months upon the same terms and conditions, at a rental at the rate of $420 a year, payable quarterly; the lessor to pay taxes and water rates, furnish steam heat and elevator service, and make inside and outside repairs; the lessee to furnish light and room janitor service. Lessor, Marcus Brothers, 121 Canal Street, Manhattan. Respectfully,

ALEX. BROUGH, Deputy and Acting Comptroller. Resolved, That the Corporation Counsel be and is hereby requested to prepare a lease to the City, from Marcus Brothers, of Room 53 at the southwest corner of the fifth floor, containing 434 square feet, in the building No. 121 Canal Street, Borough of Manhattan, for use of the Department of Bridges, for a period of six months from May 1, 1916, with the privilege of renewal for an additional six months upon the same terms and conditions at a rental at the rate of four hundred and twenty dollars ($420) a year, payable quarterly; the lessor to pay taxes and water rates, furnish steam heat and elevator service and make inside and outside repairs; the lessee to furnish light and room janitor service; and the Commissioners of the Sinking Fund deeming the said rent fair and reasonable and that it would be for the interests of the City that such lease be made, the Comptroller be and is hereby authorized and directed to execute the same when prepared and approved by the Corporation Counsel as provided by Sections 149 and 217 of the Greater New York Charter.

The report was accepted and the resolution unanimously adopted.

Police Department-Resolution Authorizing a Sale of the Police Boat "Patrol"
Rescinded and the Boat Returned to the Police Department.
The following communication was received:

The Honorable Commissioners of the Sinking Fund:

March 15, 1916.

Gentlemen-On March 7, a communication was forwarded surrendering to the Sinking Fund Commission the steamer "Patrol." On March 8 a resolution was passed by your Commission authorizing the sale of the boat. I now find that because of conditions in the ship yards, it will probably take eight months for the construction of a boat to take the place of the "Patrol."

I respectfully request, therefore, that the resolution of March 8, referred to above, be rescinded, and that the boat be reassigned to this Department. Respectfully, A. WOODS. Police Commissioner.

--and the following resolution was offered for adoption:

Resolved, That the resolution adopted by this Board at meeting held March 8, 1916, authorizing a sale of the Police Boat "Patrol," turned over as no longer required under date of March 7, 1916, be and the same is hereby rescinded; and be it further

Resolved, That the Commissioners of the Sinking Fund hereby reassign to the Police Department the Police Boat "Patrol."

Which resolution was unanimously adopted.

Dock Department-Rescindment of Certain Corporate Stock Authorizations, and Recommending that the Comptroller be Authorized to Issue Corporate Stock to the Amount of $120,154 for the Construction of the Shed on the Pier Foot of West 46th Street, North River.

The following communication was received:

March 10, 1916. Hon. JOHN PURROY MITCHEL, Mayor, and Chairman of the Commissioners of the Sinking Fund:

Dear Sir-At a meeting of the Commissioners of the Sinking Fund held December 8, 1915, a resolution was adopted recommending to the Board of Estimate and Apportionment that the Comptroller be authorized to issue Corporate Stock of The City of New York to an amount not exceeding $465,000, the proceeds to the par value thereof to be used by this Department for the construction of a shed on the pier at the foot of West 46th street, North River, Borough of Manhattan.

On January 7, 1916, resolution was adopted by the Board of Estimate and Apportionment authorizing the Comptroller to issue Corporate Stock of The City of New York to an amount not exceeding $465,000, the proceeds thereof to the amount of the par value of the stock to be used by this Department for the construction of shed on the pier at the foot of West 46th street, North River, Borough of Manhattan. At a meeting of the Board of Estimate and Apportionment held January 28, 1916, resolution was adopted as follows:

"Resolved, That the Board of Estimate and Apportionment, pursuant to its resolution of July 11, 1912, hereby approves the form of contract No. 1488, the specifications, as amended, the plans and estimate of cost in the sum of five hundred and twenty-eight thousand four hundred dollars ($528,400) for building a freight shed, with appurtenances, on the pier at the foot of West Forty-sixth street, North River, Borough of Manhattan, under the jurisdiction of the Department of Docks and Ferries, the contract to be divided into three parts as follows: Classes 1 and 2, General Construction (a) Freight shed and appur

tenances (b) asphalt pavement for lower deck.. Class 3, Plumbing, installation of water supply... Class 4, Installation of steampiping

"said cost to be paid to the extent of four hundred and sixty-five thousand dollars ($465,000) from the corporate stock fund entitled 'C.D.D.-42, Department of Docks and Ferries, Construction of Sheds on Pier at Foot of West 46th Street,' and the balance, estimated at sixty-three thousand four hundred dollars ($63,400) to be paid from the corporate stock fund entitled_‘C.D.D.-4-K, Department of Docks and Ferries, Construction of New Pier at Foot of West 46th Street and Slips Adjacent,' and be it further

"Resolved, That in the event that the aggregate sum of the lowest bids received for the three items is equal to or less than the aggregate sum of the three items herein approved (although the amount of the lowest bid for one or more items may exceed the amount approved for said item or items) then the awards for the three items, provided all are awarded, may be made without further approval by the Board of Estimate and Apportionment; and be it further

"Resolved, That in the event that the aggregate sum of the lowest bids received for the three items exceeds the aggregate sum of the three items herein approved, no award for either item shall be made and the amount of such estimated cost upon the bids so received may be reconsidered in its discretion by the Board of Estimate and Apportionment, or by any official designated by the Board, provided that the aggregate of the bids is within the amount authorized and available for said work."

On February 11, 1916, bids were opened on this contract, the low bids on Classes 3 and 4 being as follows:

Deeming it to be for the best interests of the City so to do, I rejected the bids received February 11, 1916, on Classes 1 and 2 for the construction of the shed proper and for the laying of the asphalt deck on the pier, and ordered the readvertising of these two classes.
