Mr. WYANT, from the Committee on Interstate and Foreign Commerce, submitted the following

REPORT

[To accompany H. R. 8506]

The Committee on Interstate and Foreign Commerce, to whom was referred the bill (H. R. 8506) to extend the times for commencing and completing the construction of a bridge across the Mahoning River at New Castle, Lawrence County, Pa., having considered the same, report thereon with a recommendation that it pass.

The bill has the approval of the War and Agriculture Departments, as will appear by the letters attached.

So far as the interests committed to this department are concerned, I know of no objection to the favorable consideration of the accompanying bill (H. R. 8506, 72d Cong., 1st sess.) to extend the times for commencing and completing the the construction of a bridge across the Mahoning River at New Castle, Lawrence County, Pa.

DEAR MR. RAYBURN: Careful consideration has been given to the bill (H. R. 8506) transmitted with your letter of January 28 with request for a report thereon and such views relative thereto as the department might desire to communicate. This bill would extend for one and three years, respectively, from March 2, 1932, the times for commencing and completing the construction of a bridge across the Mahoning River just south of New Castle, Lawrence County, Pa., authorized by act approved March 2, 1931, to be built by the State Highway

Department of Pennsylvania. The location indicated for the proposed bridge is on the system of Federal-aid highways approved for Pennsylvania. Favorable action on the bill is recommended.

AN ACT Granting the consent of Congress to the State Highway Department of Pennsylvania to construct, maintain, and operate a free highway bridge across the Mahoning River near New Castle, Law. rence County, Pennsylvania

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the consent of Congress is hereby granted to the State Highway Department of Pennsylvania to construct, maintain, and operate a free highway bridge and approaches thereto on Pennsylvania State Highway Route Numbered 18, across the Mahoning River at a point just south of New Castle, Lawrence County, Pennsylvania, now served by a structure known locally as the Willow Grove Bridge, and at a point suitable to the intereste of navigation, in accordance with the provisions of an act entitled "An act to regulate the construction of bridges over navigable water," approved March 23, 1906.

SEC. 2. That the right to alter, amend, or repeal this act is hereby expressly reserved.

REPORT

[To accompany H. R. 8696]

The Committee on Interstate and Foreign Commerce, to whom was referred the bill (H. R. 8696) to extend the times for commencing and completing the construction of a bridge across the St. Lawrence River near Alexandria Bay, N. Y., having considered and amended the same, report thereon with a recommendation that it pass. Amend the bill as follows:

Page 1, line 10, after the figures "1929," insert the following: "and heretofore extended by an Act of Congress approved February 13, 1931,". After the word "hereby" insert the word "further". After the word "and" strike out the word "four" and insert the word "three" in lieu thereof.

MY DEAR MR. LAYTON: Your letter at hand in regard to H. R. 8696, introduced by me. In order to make this legislation effective it is necessary that the State of New York also pass legislation on the question. Bills authorizing the construction of this bridge and another farther down the St. Lawrence were vetoed by Governor Roosevelt and a commission appointed to select a site. This commission reported to the legislature. I am advised that they recommended this site with two others as a proper location but the Legislature of the State of New York has never passed any additional legislation on it so that the matter now awaits the action of the State. For that reason it is desired to have the time extended on this particular bridge so that when the State does act we will be able to proceed.

May I suggest that you include in the report the letter from the War Department, Report No. 2163, Seventy-first Congress, third session. The old report contained an adverse recommendation from the Department of Agriculture.

However, you have in your files a letter from them which amends that and approves the construction.

I will appreciate the committee's favorable action on this measure.

AN ACT Authorizing the New York Development Association, Inc., its successors and assigns, to con struct, maintain, and operate a bridge across the Saint Lawrence River near Alexandria Bay, New York Be it enacted by the Senate and House of Repesentatives of the United States of America in Congress assembled, That in order to facilitate international commerce, improve the postal service, and provide for military and other purposes, the New York Development Association, Inc., a corporation organized under and by virtue of the membership corporation law of the State of New York, having its office and principal place of business at Watertown, New York, its successors and assigns, be, and is hereby, authorized to construct, maintain, and operate a bridge and approaches thereto, across the easterly channel of the Saint Lawrence River at a point suitable to the interests of navigation at or near Collins Landing, in the town of Orleans, Jefferson County, New York, to some suitable and convenient point on Wellesley or Wells Island, and also a bridge and approaches thereto from the westerly side of Wellesley or Wells Island to Hill Island, sometimes known as LaRue Island, and also a bridge from said Hill Island across or over the westerly or Canadian channel of the Saint Lawrence River to some suitable or convenient point between Brockville and Gananoque, in the Province of Ontario, Dominion of Canada, so far as the United States has jurisdiction over the waters of said Saint Lawrence River, in accordance with the provisions of the act entitled "An act to regulate the construction of bridges over navigable waters," approved March 23, 1906, and subject to the approval of the proper authorities in the Dominion of Canada.

SEC. 2. That the New York Development Association, Inc., its successors and assigns, shall commence the construction of said bridge within two years and shall complete the construction thereof within five years after the passage and approval of this act.

SEC. 3. That there is hereby conferred upon the New York Development Association, Inc., its successors and assigns, all such rights and powers to enter upon lands and to acquire, condemn, occupy, possess, and use real estate and other property in the State of New York needed for the location, construction, operation, and maintenance of such bridge and its approaches as are possessed by railroad corporations for railroad purposes, or by bridge corporations for bridge purposes in the State of New York, upon making just compensation therefore to be ascertained and paid according to the laws of such State, and the proceedings therefor shall be the same as in the condemnation and expropriation of property in such State.

SEC. 4. That the said New York Development Association, Inc., its successors and assigns, is hereby authorized to fix and charge tolls for transit over such bridge, and in accordance with any laws of New York applicable thereto, and the rates of tolls so fixed shall be the legal rates until changed by the Secretary of War under the authority contained in the act of March 23, 1906.

SEC. 5. That the right to sell, assign, transfer, and mortgage all the rights, powers, and privileges conferred by this act is hereby granted to the New York Development Association, Inc., its successors and assigns, and any corporation to which or any person to whom such rights, powers, and privileges may be sold, assigned, or transferred, or who shall acquire the same by mortgage foreclosure or otherwise, is hereby authorized and empowered to exercise the same as fully as though conferred herein directly upon such corporation or person.

SEC. 6. That the right to alter, amend, or repeal this act is hereby expressly reserved.

AN ACT To extend the times for commencing and completing the construction of a bridge across the Saint Lawrence River near Alexandria Bay, New York

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the times for commencing and completing the construction of a bridge across the Saint Lawrence River at or near Alexandria Bay, New York, authorized to be built by the New York Development Association (Incorporated), a corporation organized under and by virtue of the membership corporation law of the State of New York, its successors and assigns, by an act of Congress approved March 4, 1929, are hereby extended one and four years, respectively, from March 4, 1931.

SEC. 2. The right to alter, amend, or repeal this act is hereby expressly reserved.

Approved, February 13, 1931.

The bill has the approval of the War and Agriculture Departments, as will appear by the letters attached.

DEAR MR. RAYBURN: Careful consideration has been given to the bill (H. R. 8696), transmitted with your letter of February 2 with request for a report thereon and such views relative thereto as the department might desire to communicate.

This bill would extend for one and three years, respectively, from March 4, 1932, the times for commencing and completing the construction of the bridge across the St. Lawrence River at or near Alexandria Bay, N. Y., authorized by act of Congress approved March 4, 1929, to be built by the New York Development Association, a corporation organized under, and by virtue of the membership corporation law of New York, its successors and assigns. The department has been advised that the New York Development Association did not obtain the authorization to construct a bridge at the site proposed with the view of commercializing the same or of deriving profit therefrom, but that their sole object was to help develop that portion of the State and that it was anticipated legislation would be passed by the New York Legislature for the construction of such bridge by a public agency similar to the Port of New York Authority. The department further is advised that the site upon which a bridge in the vicinity of that covered by the authorization of March 4, 1929, may be built will be determined by a commission appointed by the Governor of New York and that if such commission should select the site at which the New York Development Association has been authorized to construct a bridge, such association would assign, without cost, all of its rights under the authorization to whatever board is set up by the State for the purpose of constructing and operating the bridge.
