or private sale, any other part or parts of the said real estate, so devised; and any ground rents that may have been, or may hereafter be reserved upon any conveyance of any part of the real estate so devised, or from time to time to mortgage any part of the real estate so devised, to secure the repayment of any money that may be, borrowed by him for such purpose or purposes; and the proceeds of every such sale and all money that may be borrowed upon any such mortgage, shall be applied by such trustee to the repair and improvement of such parts of the said real estate, as may be directed by the said Hannah Hollingsworth, and her present husband, and the survivor of them, and not otherwise, or for any other purpose.

SECTION 4. That for the purpose of enabling the said trustee for the Power to purtime being, to purchase a suitable place of residence for the said Hannah chase real estate. Hollingsworth, or her family, it shall be lawful for the said trustee, for the time being, during the lifetime of the said Hannah, and of her present husband, and of the survivor, with the consent of the said Hannah, and of her present husband, or of the survivor, as the case may be, to be testified by them, or his or her joining in the execution of the deed or deeds, to sell, for the best price that he can obtain for the same, at public or private sale, any other part or parts of the real estate so devised; and any ground rents that may have been or may hereafter be reserved on any conveyance of any part of the said real estate, and to execute all proper and necessary conveyances for the same; and to invest the proceeds of such sale or sales, or such portion thereof as may be requisite in the purchase of such other real estate, suitable and proper for the residence of the said family, as may be directed and appointed by the said Hannah, and her present husband, or by the survivor of them, as the case may be; and thereupon to take a conveyance of the real estate so purchased to himself, the said trustee, in fee simple, upon the like trusts, as are mentioned and declared in the said will, relative to the real estate, so as aforesaid devised, in trust for the said Hannah Hollingsworth, her husband and children.

SECTION 5. Provided, That before the said trustee shall execute any Trustee to give absolute conveyance or mortgage, under any authority given by either security. of the preceding sections of this act, he shall give security, to be approved by the judges of the orphans' court for the city and county of Philadelphia, for the due and faithful application of the money raised by sale or mortgage according to the provisions of this act; and upon such security being given, the purchaser or mortgagee, as the case may be, shall take and hold the estate so purchased or mortgaged free and clear from all and every the trusts and trust, in the said will mentioned and declared, of and concerning the same; and such purchaser or mortgagee, as the case may be, shall not be bound to see to the application of the purchase money, or of the money so borrowed on mortgage. AN ACT

Entitled "An Act to prevent the destruction of fish in the river Lehigh, and
Bushkile creek, in the county of Northampton, and for other purposes.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That from and after the passage of this act, any person or persons, who shall make use of coculus indicus, lime, or any other poisonous admixture, in the shape of pills or otherwise, by throwing or causing the same to be thrown into any stream or streams of water within the county of Northampton, for the purpose of taken or catching fish, such person or persons so offending, on conviction thereof, on the testimony of one or more witness, before a justice of the peace of the said county, shall forfeit and pay a fine of five dollars for every such offence, to be recovered as debts of equal amount are by law recoverable, by any person or persons who may sue for the same; one moiety thereof to be paid to the informer, and the other moiety to the supervisors of the public highways of the township where such offence shall have been committed; to be by them applied to improving the roads and highways in their respective townships: Provided, however, That such prosecution shall be commenced within thirty days after such offence shall have been committed.

SECTION 2. Any person or persons who shall be convicted as aforesaid, and who shall neglect or refuse to satisfy the fine imposed on him, Imprisonment. her, or them, and goods and chattels cannot be found whereof to pay the same, the said person or persons so convicted, shall be committed to the jail of the county of Northampton, for the term of five days.

AN ACT

Relating to the borough of Shippensburg, in the county of Cumberland.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the lot or piece of ground, the property of Hugh Craig, situate in the borough of Bounds extende). Shippensburg, and county of Cumberland, and containing about one acre and one hundred and forty perches, and which is divided from the residue of his farm, by the line of the said borough, be and the same is hereby made a part of the township of Shippensburg, in which the said farm is, and shall hereafter be assessed, rated, and taxed as a part of the said farm in the said township of Shippensburg, and not in or as a part of the said borough; and from and after the passage of this act, all the rights, jurisdiction, and authority of the said borough, in, to, and over the said lot, shall cease and determine: Provided, That the remedy for the collection of all taxes and liens of every description, to which said lot was heretofore made subject, shall continue and be the same, as if this act had not been passed.

AN ACT

Respecting the construction of certain acts of assembly relating to the High street markets, in the city of Philadelphia.

WHEREAS, Certain acts of assembly, relating to the High street market house, in the city of Philadelphia, providing that the western moiety Preamble. of the market house in High street shall be let to such persons from the country, as send or carry the produce of their farms to the said market, and that it should not be lawful for any victualler to sell beef in said moieties of such market house, have recently been construed by the supreme court to prohibit farmers from selling in the said market any

beef which had been slaughtered on their farms, which construction is contrary to the intention of the legislature, will operate oppressively on the farmers of the adjacent counties, and be greatly detrimental to their interest, as well as injurious to the citizens of Philadelphia; for remedy whereof,

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That no act of assembly, relating to the market houses, stalls or stands, in the city of Philadelphia, or in the incorporated districts of the county of Philadelphia, shall be construed to prohibit persons who may send or carry the produce of their farms to market, from selling or exposing for sale, beef, mutton, veal, swine and poultry, which may have been slaughtered on their farms; or butter and cheese or other articles, manufactured or prepared thereon for market, on the stalls and stands in said city and incorporated districts, of the county of Philadelphia, which have been, now are, or hereafter may be intended, reserved or appropriated, to the use of such persons; nor shall any person, so selling such meats or other articles, be liable to any fine or penalty therefor, or for selling meats in less quantities than one quarter; and all ordinances which have been or may be enacted by the select and common councils of said city, or by the proper authorities of said districts of the county of Philadelphia, imposing any such fine, shall be held to be null and void: Provided, That farmers using the stalls in said market houses, for the purposes above specified, shall pay a rent or compensation for each stall, not exceeding twenty dollars per annum.

A SUPPLEMENT

To the act, entitled "An Act to incorporate the American insurance company of
Philadelphia."

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That from and after the passage and acceptance of this act, the American insurance company shall be known in law by the corporate name of the American mutual insurance company: Provided, That nothing contained in this act shall impair or alter any legally existing right or privi

lege, consequent upon any agreement, insurance or contract, made by or with said company, prior to the acceptance of this act.

SECTION 2. That the several sections, provisos and limitations, contained in the act, entitled "A supplement to an act to incorporate the Powers and franDelaware county insurance company," passed the seventeenth day of chises. March, Anno Domini one thousand eight hundred and forty-three, and the powers and franchises thereby granted, be and they are hereby extended and applied to the said American mutual insurance company, with the same force and effect, as if they were herein expressly set forth and enacted, in reference to the said American mutual insurance

company: Provided, That so much of the eighth section of said act Proviso.

not be deemed to apply to said company; and that the directors shall
be annually chosen between the hours of ten o'clock, A. M., and three
P. M., and that the present board of directors shall appoint fifteen ad-

provided further, That the minimum amount of certificates to be issued

by the said American mutual insurance company, shall be ten dollars Certificates.

a supplement.

A FURTHER SUPPLEMENT

To an act, entitled "An Act to incorporate the Union insurance company of Philadelphia," passed February sixth, Anno Domini one thousand eight hundred and four.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the Union insurance company of Philadelphia, shall be and hereby is authorized and empowered, immediately, upon, and after the acceptance of this act in writing, by a majority in value of the present stockholders, to set aside one hundred thousand dollars of the capital of the said company, Capital. to be divided among and held by the stockholders of the said Union insurance company of Philadelphia, in proportion to the number of shares to which they may be respectively entitled, on the day of the acceptance of this act as aforesaid; which said sum of one hundred thousand dollars, shall then and thenceforth constitute the capital of said company.
