AN ACT

For the relief of Jacob Lohr and the Gettysburg and Petersburg turnpike company.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the auditor general be and he is hereby authorized and required to issue to Jacob Lohr, a certificate of indebtedness for such damages as may Jacob Lohr. have been awarded to him, not exceeding the sum of six hundred and sixty-six dollars, in consequence of the construction of the Gettysburg railroad; the said certificate to bear interest at the rate of six per cent., to be counted from the twenty-seventh day of September, one thousand eight hundred and forty-one.

SECTION 2. A SUPPLEMENT

To the acts relating to the holding of special courts in Fayette county, and for other purposes.

SECTION 1. for any of the reasons enumerated in the thirty-seventh section of the "Act relative to the organization of the courts of justice," passed the fourteenth April, one thousand eight hundred and thirty-four, be certified by the prothonotary into the special court of said county, established by an act passed the sixteenth day of April, one thousand eight hundred and thirty-eight, entitled An Act to authorize the president judge of the district court of Allegheny county to hold special courts in Fayette county, in certain cases, and for other purposes:" Provided, That such party, plaintiff or defendant, desiring his, her or their suit, cause or matter certified into the special court as aforesaid, shall first file in the office of the prothonotary, an affidavit, setting forth the reasons for such application, and that the same is not made for the purpose of delay, with the certificate of his, her or their counsel, that, in their opinion, it is proper to remove said suit, cause or matter pending in said court of common pleas into the special court as aforesaid; whereupon it is hereby made the duty of the prothonotary of the court of common pleas of Fayette county to certify, forthwith, such suit, cause or matter into the said special court, which said suit, cause or matter, shall be placed on the special court list, subject to all the orders and rules of such special court, to the final determination of the same.

SECTION 2. That the district court of Allegheny county shall have and exercise all the like chancery jurisdiction and powers that are conferred upon any other court of this commonwealth: Provided, That in all such cases an appeal may be taken to the supreme court, from the final decree of the said district court, upon the same conditions and terms as a writ of error is allowed in other cases.

SECTION 3. That the district court of Allegheny county shall have the same powers to make general rules and orders, as are given to the district court for the city and county of Philadelphia, by the act of the eleventh of March, one thousand eight hundred and thirty-six, entitled "A supplement to the act, entitled An Act to establish the district court for the city and county of Philadelphia,' passed the twenty-eighth day of March, one thousand eight hundred and thirty-five."

AN ACT

Requiring registers for the probate of wills and granting letters of administration to keep a docket for certain purposes.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That from and after the passage of this act, it shall be the duty of the register Duty of register. for the probate of wills, and granting letters of administration, in the counties of Mercer and Crawford, to purchase a book or books, at the expense of the respective cities or counties, and make, or cause to be made therein, at his own expense, entries setting forth in all cases hereafter arising, the names of decedents; the time of granting letters of administration and letters testamentary, and to whom granted; the amount of the bond filed by any administrator, with the names of his sureties; the time of filing the inventory and appraisement, and the date of settlement of the accounts of executors and administrators, with the amount of debts and credits, showing the balance, and to whom due; the same to be entered in a fair and legible hand, and to be so arranged as to afford easy and ready reference to said matters.

SECTION 2. That it shall and may be lawful for the judges of the Orphans' court. orphans' court, in and for any city or county of this commonwealth, on an inspection and examination of the situation of the papers on file prior to the passage of this act, in the office of the register for the probate of wills and granting letters of administration, in the respective cities or counties, to make an order or decree, requiring said register to make the same entries touching said papers, as are required in the first section of this act, as to cases hereafter arising; and the expense of purchasing books, and of making the entries, in pursuance of said order or decree, shall be paid by the respective cities or counties, on warrants drawn on the treasurer of said city or county, by the commissioners thereof.

SECTION 3. That exemplifications or copies of the entries required Exemplifications. in the preceding sections, under the proper seal of said register, shall, in the event of the loss or destruction of any paper or papers, from which any of said entries shall be made, shall be of the like force and effect, and as good and sufficient evidence in law as the original paper or papers, or exemplifications, or duly certified copies thereof.

A SUPPLEMENT

To the act, entitled "An Act erecting the town of Warren, in the county of
Warren, into a borough and township, and for other purposes."

SECTION 1. Be it enacted by the Senate and House of Representa tives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the borough lines of the borough and township of Warren, in the county of Warren, shall hereafter be as follows: Commencing at the north-east corner of reserved tract, number twenty; thence east to a point at low water mark, on the east bank of the Conewongo creek; thence down said Conewongo creek by the east bank thereof, at low water mark, to the month of the same, and its confluence with the Allegheny river; thence down said river to a point opposite the public way at the west end of the in-lots, in the said borough and township of Warren; thence northerly along the west side of said public way to the south line of reserved tract, number nineteen; thence by the south and southeast boundaries of said reserved tracts, numbers nineteen and twenty, by their various courses and distances, to the north-east corner of said reserved tract, number twenty, the place of beginning; and the corporate powers, rights and privileges of the said borough and township, shall hereafter be, and they are hereby extended over the limits included within the bounds aforesaid, as fully and effectually, as if the same had been originally included therein.

SECTION 2. That so much of the said act, entitled "An Act erecting the town of Warren, and township of Warren, in the county of Warren, into a borough, and for other purposes," as relates to the boundaries of the said borough of Warren, the same is hereby repealed.

SECTION 3. That the court of quarter sessions of the county, named in the sixth section of the act, entitled "An Act declaring the streets, lanes and alleys, in the town of Bloomsburg, in Columbia county, public highways, and authorizing the election of an additional supervisor, and for other purposes," approved the eleventh day of April, one thousand eight hundred and forty, upon the petition of citizens of the borough named in said section, shall have authority to widen any street in said borough; and said court shall proceed therein, by views and reviews, in the manner provided for laying out public roads by the existing laws, and the expenses and damages shall be ascertained and paid by the county, as in cases of laying out public roads: Provided, That such petition shall be accompanied with a plot or draft of said street, showing distinctly the alterations desired by the petitioners, and the report of the viewers and reviewers shall also be accompanied with a plot or draft of said street, showing the alteration or additional width recommended or made in such report; and upon the confirmation of any such report, such street shall be opened and widened agreeably thereto, and kept in repair as other streets in said borough; and all proceedings of said court, heretofore commenced, touching the widening of any street in said borough, are hereby confirmed and declared to be as valid, to all intents and purposes, as if this section had been in full force and existence previous to the commencement of such proceedings:

And provided also, That no street shall be widened to more than fifty
feet wide, and that this section shall not be construed to apply to the
widening of any public alley in said borough.

SECTION 2.
