No. 322.

AN ACT

To confer on Ellen, daughter of Clarissa, wife of James E. Brooks, the name of Ellen Brooks, and also the rights and privileges of a child born after the marriage of the said Clarissa and James E. Brooks.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Ellen, the daughter by a previous marriage of Clarissa, who now is intermarried with James E. Brooks, of the Northern Liberties of Philadelphia county, shall hereafter have the name of Ellen Brooks, and shall enjoy all the rights, benefits and advantages, and shall be able and capable in law to inherit and transmit any estate whatever, as fully and completely, to all intents and purposes, as if she were the child of the said James E. Brooks and Clarissa, his wife.

AN ACT

To change the name of the Plymouth Rifle Greens, in the county of Luzerne, to the Kingston Monument Guards, to be recognized as light infantry.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That from and after the passage of this act, the rifle company in the county of Luzerne, called the Plymouth Rifle Greens, shall be and they are hereby changed into an infantry company, to be called the Kingston Monument Guards; and that the seven years services of each individual member thereof, shall be calculated from the date of the organization of said company as a rifle corps; and the adjutant general is hereby authorized, upon the requisition of the proper brigade inspector, to furnish said company with the proper number of muskets and accoutrements, under such restrictions and securities as are provided by existing laws: Provided, That before any arms are delivered to said company, the Proviso.

rifles and accoutrements that may now be in their possession, shall be delivered, in good order, to the proper brigade inspector: And provided further, That said company shall equip themselves in conformity to the dress of infantry of the army of the United States.

Preamble.

Award of arbitrators.

No. 324.

AN ACT

To authorize the proprietors of the Norwich markets, in Callowhill street, to transfer the same to the corporate authorities of the Northern Liberties district, in the county of Philadelphia.

WHEREAS, By an act of assembly, passed sixth of September, one thousand seven hundred and eighty-three, the subscribers to the Callowhill market were empowered to erect market houses, and let the stalls in the same, until they were repaid the amounts advanced by them, with legal interest, when the said market houses were to become the property of the inhabitants of the Northern Liberties:

And whereas, The income arising from said Callowhill markets has not been sufficient to pay the interest on the cost thereof and keep them in repair, and it being the wish of many of the proprietors or subscribers, that the said market houses should become the property of the commissioners of the incorporated district of the Northern Liberties, upon fair and equitable terms:

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That from and after the passage of this act, all the right, title and ownership of and to the Callowhill market houses, situate on Callowhill street, between Front and Second streets, in the incorporated district of the Northern Liberties, shall be vested in the inhabitants and commissioners of said district, in their corporate capacity, upon the following terms and conditions, viz: Each of the said parties, the subscribers to the said markets and the commissioners of said district, shall appoint a disinterested person, (to be duly qualified,) and who may appoint a third person, if they cannot agree, to whom shall be submitted all claims or demands that may arise for or against said market houses, and whose decision thereon shall be final and conclusive.

SECTION 2. That upon the fulfilment of the award of the arbitrators, provided for in the first section of this act, the commissioners of the incorporated district of the Northern Liberties shall have power to tear

down, repair or rebuild and reconstruct said market houses on the present site thereof, in any manner they may deem proper: Provided, That no interference is had with the rights and privileges of the adjacent property holders, or with any public streets or highways.

AN ACT

Authorizing H. J. Huidekoper of Meadville, in the county of Crawford, to erect a dam and take water from French creek, below the feeder dam at Bemus's, for the use of his mills.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That H. J. Huidekoper, his heirs and assigns, be and they are hereby authorized to erect and maintain a dam across French creek, at any point between the feeder dam at Bemus's and the head of the island opposite the borough of Meadville, in the county of Crawford, and conduct the water therefrom, by a race or otherwise, as he or they may deem proper, to and for the use of his or their mills and machinery at or near the mouth of Cussewago creek: Provided, That he or they shall not carry said race through the property of any person or persons, without having first obtained his or their consent: And provided, also, That said dam shall be so built as in no way to injure or obstruct the navigation of said creek; the privilege hereby granted shall be subject to such reasonable restrictions and conditions as the burgess and town council, of the borough of Meadville, may impose, for the purpose of securing to the above said borough such supply of water as may be necessary, in cases of fire and domestic use, at all seasons of the year.

AN ACT

To authorize the conveyance of certain real estate.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Heirs of Edward Ellen Henderson, widow of Jonathan Henderson, and daughter of EdBartholomew, to ward Bartholomew, late of the city of Philadelphia, deceased, Jonathan H. Dorsey, Samuel Miles Green and Rachael E., his wife, Thomas Duncan and Elizabeth, his wife, Mary H. Dorsey, and William Dorris, guardian of John P. Dorsey, Greenbery Dorsey and H. P. Dorsey. minor children of Henry P. Dorsey, deceased, being the heirs and representatives of the heirs of Elizabeth Dorsey, deceased, the other daughter of said Edward Bartholomew, deceased, or their attorney in fact duly constituted, be and they are hereby authorized to execute to Francis Tyler of Bradford county, a good and sufficient deed in fee for two tracts of land, situate in Athens township, in said county, on the Chemung river, adjoining the New York line, surveyed on warrants, Nos. 84 and 93, at the first and third crossings of said line, containing about six hundred acres, more or less, upon the said Francis Tyler paying or securing to be paid to the said persons, respectively, their full and proper proportion of the consideration money of said tracts of land; and the deed of conveyance executed shall vest all the right, title and interest of the said Edward Bartholomew, of the said tracts of land, who died seized thereof, and of his devisees and legatees and their heirs, as fully, to all intents and purposes, as if the said Edward Bartholomew had duly executed the same in his lifetime: Provided, The orphans' court of said county shall be of opinion, that the said sale of said premises is not prejudicial to the interest of said minors, and shall approve of said conveyance before the same be executed: And provided, also. That before such conveyance the said guardian shall give bond to the commonwealth, for the use of the persons interested, with such securities and in such penalty as said court shall approve, conditioned for the faithful appropriation of the said minors' share of said consideration money, received by him for the use of said minors.

Relating to the public highways of East Nottingham township and West Nottingham township, in the county of Chester, and for other purposes.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That

ham, in the county of Chester.

AN ACT

Authorizing the heirs of Jacob Scharadin to redeem certain lands sold for taxes.

WHEREAS, Jacob Scharadin, late of Berks county, died in the year Preamble. one thousand eight hundred and twenty-two, leaving several minor children: And whereas, The said decedent, in his lifetime, owned two tracts of land in Luzerne county, known as tracts in the warrantee names of Samuel Scott and John Thornburg, which said tracts were sold to the commissioners of said county for taxes, and which lands were not redeemed by the neglect of the guardians of the said minor children, within the time limited by law, and the legal title is now in the said commissioners; therefore,
