the western boundary thereof; thence southwardly along the western boundary of Hugh M'Ilvain's property, to the south side of the Lancaster turnpike road; thence along the south side of said turnpike road, to the eastwardly line of the late Crean's estate; thence along the said eastwardly line of said late Crean's estate, southwardly, to the southwardly side of Green street; thence along the southwardly line thereof, to the westwardly line of Cedar lane; thence continuing the same course to the eastwardly line of Rose's estate; thence southwardly along the same to the westwardly line of Hamilton village; thence following the said westwardly line to its intersection with Darby road, the place of beginning, be, and the same is hereby constituted and formed into a borough and a body corporate, to be styled, the borough of West Philadelphia," and is hereby vested with all the rights, privileges, powers and immunities enjoyed and exercised by the late borough of West Philadelphia, under its charter, adjudged to be defective; and that all acts of assembly heretofore passed, referring to the borough of West Philadelphia, be, and the same are hereby continued in full force and effect, and extended and confined to the borough of West Philadelphia, hereby created: And the borough of West Philadelphia, as created by this act, shall constitute a separate election and municipal district; and all connection with Blockley township therewith, shall from henceforth cease and determine.

SECTION 2. That Henry Leech, H. G. Freeman, Jacob Broom, Commissioners Richard M'Ilvain, James Hanna, James Twaddell, or a majority of with power to colthem, be, and they are hereby appointed commissioners, with full lect and receive power and authority to collect, recover and receive of and from all per- certain moneys, sons indebted to the late borough of West Philadelphia, and who were so indebted at the time of the quashing the said borough by the decision of the supreme court of this commonwealth, all such sums of moneys as said borough would have been entitled to, if said defective charter had been legal, and after public notice for that purpose, made through two newspapers, published in the city of Philadelphia, to divide the same to and among such of the creditors of the said late borough as may substantiate their respective claims before the said commissioners, at the time to be designated by them for that purpose, as aforesaid, and after the collecting of so much of the said claims due to the said late borough, as they may believe it practicable to recover, then, with full power and authority, which is hereby invested in the said commissioners, to assess, levy and collect of, and from all the owners of property within the bounds of the said late borough of West Philadelphia, as said bounds were intended to be incorporated by the court of quarter sessions of the county of Philadelphia; and according to the assessment of the real estate within the said late borough, made for the year one thousand eight hundred and forty-two, such amount of money as may be sufficient to pay in full any balance remaining due and unpaid, against the said late borough, together with all expenses and charges attending the execution of this act; and after paying such claims as may be substantiated, as aforesaid, the said commissioners shall settle in the court of common pleas of Philadelphia county, a full account of their doings in the premises; and said court is hereby vested with the same powers over the accounts of said commissioners, as are given to the courts over the accounts of assignees, under voluntary assignments, and may compel a settlement thereof, at any time, on the application of any person interested therein.

shall not exceed in the whole, the sum of three thousand dollars, in any event: And in order to facilitate the collection of taxes already assessed and unpaid, and taxes which may be assessed by virtue of this act, the said commissioners, or a majority of them, shall appoint one or more collectors of said taxes, who shall have all the powers which collectors now have by law, in collecting county rates and levies; and all suits necessary to be brought by said commissioners, to enforce the payment of debts or liens of any description, may be in the name of the late borough of West Philadelphia: And the proceedings of the court Certain proceed of quarter sessions of the county of Philadelphia, incorporating the said late borough of West Philadelphia, and all proceedings under said defective charter, are hereby declared to be legal and valid to all intents and purposes, so far as may be necessary to carry into full effect the intention and provisions of this act, and so far as said proceedings relates to officers of said late borough of West Philadelphia.

AN ACT

To confer on Catharine Pike the rights and benefits of a child born in lawful wedlock.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Catharine, now the wife of James Pike, and daughter of George Miller, of Northmoreland township, Wyoming county, shall have and enjoy all the rights and benefits of a child born in lawful wedlock; and shall be able and capable in law to inherit and transmit all the estate, real, personal and mixed, of her said father, as fully and completely as if she had been born in lawful wedlock.

AN ACT

Changing the time of holding the courts in the sixteenth judicial district of this commonwealth.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That from and after the passage of this act, the time for the commencement of the several courts for the counties composing the sixteenth judicial district of this commonwealth, shall be as follows, to wit: The courts for the county of Franklin, shall commence, and be held on the second Monday in April, the second Monday in August, the last Monday in October, the third Monday in January, to continue two weeks, if necessary in the county of Bedford, on the fourth Monday in April, the fourth Monday in August, the second in November, and the first Monday in February: in the county of Somerset, on the Mondays next succeeding the days hereinbefore fixed for the commencement of the courts in Bedford county; and the writs of venire and other writs, as well as all precepts whatsoever, which have already or may hereafter be issued in the counties above named, shall be made returnable, agreeably to the times fixed for holding the courts by this act.

AN ACT

To enable Catharme Kemp, the wife of Jacob Kemp, of Oley township, Berks county, to dispose of her real estate by will.

WHEREAS, Catharine Kemp, of Oley township, Berks county, intermarried with Jacob Kemp, holds in her own right, in fee simple, a tract or tracts of land, situate in said county, containing about five hundred acres: And whereas, The said Catharine is desirous of being empowered by law to dispose of her real estate by will, and the said Jacob Kemp has signified his assent that the said Catharine Kemp should be so empowered; therefore,

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That at any time after the passage of this act, Catharine Kemp, the wife of Jacob Kemp, of the township of Oley, in the county of Berks, be and she is hereby authorized and empowered to dispose of her real estate by will, as fully and effectually as if she were a feme sole and unmarried: Provided, That no such last will and testament shall have any effect, unless the husband of the said Catharine Kemp shall give his consent thereto in writing, under his hand and seal, duly acknowledged, endorsed on said will, at the time of the execution thereof.

A SUPPLEMENT

To an act, entitled "An Act to compel the supervisor of the unincorporated district of the Northern Liberties, in the county of Philadelphia, to give security, and for other purposes," approved the twenty-first day of April, A. D., eighteen hundred and forty-one.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That it shall be lawful for such of the stockholders in the company, entitled Stockholders in the president, managers and company for erecting a bridge over the the Nescopeck river Susquehanna, at the falls of Nescopeck, as have stock connected bridge company, with the hydraulic works, under the provisions of the ninth and tenth Berwick hydrau- sections of the act to which this is a supplement, upon the certificate of the holders of a majority of such stock being filed with the treasurer of said bridge company, at least ten days previous to the next annual election for officers of said bridge company, setting forth his, her or their wish to hold the said hydraulic works separate from the control of the managers of the bridge company, to vote at the next election, in addition to the officers of said company, for three persons as trustees of Hydraulic works, said hydraulic works, each stockholder being entitled to one vote for every share of stock bona fide held by him; and the persons receiving the greatest number of votes shall be duly elected trustees of said hydraulic works; and thereafter the hydraulic works, together with power vested in. the water power attached to the same, shall be vested in fee in the said trustees and their successors in office, with the right to sell or

otherwise dispose of all such surplus water and water power as may not be required to propel the machinery of said company, the proceeds to be for the use and benefit of such of the stockholders as shall continue their stock connected with the said hydraulic works; and the trustees so elected shall have and enjoy all the corporate rights and Powers, priviprivileges granted to the hydraulic company of the borough of Berwick, leges, &c. under an act, entitled "An Act to authorize the governor to incorporate the hydraulic company of the borough of Berwick," approved the twenty-first day of March, one thousand eight hundred and thirty-one, and the supplements thereto; and they shall be known in law by the style and title of the hydraulic company of the borough of Berwick.

SECTION 2. It shall be the duty of the treasurer of said Nescopeck bridge company to pay, from time to time, to the treasurer who may be Dividends. appointed by the trustees of the said hydraulic company, the dividends upon all the stock connected with the said hydraulic works, under the provisions of the ninth and tenth sections of the act to which this is a supplement and also, to deliver over to the said trustees all the books, papers, vouchers, &c., connected with the said hydraulic works: Pro- Proviso. vided, That if any stockholder shall notify the treasurer of the said bridge company, of his or their wish to withdraw his or their stock, or Notice of withany part thereof, from the said hydraulic works, that they shall have drawal. the right to withdraw the same; and the dividends thereafter, on the stock thus withdrawn, shall remain unconnected with the said hydraulic works, for the use of the holder of such stock: Provided always, Proviso. That all stock, thus withdrawn, shall be liable to pay, first out of its dividends, its proportionate share of all debts which may be due of or Stock liable. on account of the said hydraulic works, at the time of the notice of the desire to withdraw the stock as aforesaid: and that before any stockholder shall have a right to withdraw any stock from the hydraulic works, they shall execute a release to the trustees of the hydraulic company for all right, title, claim and interest, of, in, to or out of the said hydraulic works, on account of said stock.
