AN ACT

To establish a new judicial district, composed of the counties of Schuylkill, Carbon and Monroe.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That from and after the first day of May next, the counties of Schuylkill, Twenty-first judi Carbon and Monroe, shall be and they hereby are erected and formed cial district estabinto a separate judicial district, to be called the twenty-first district; lished. and a person of integrity, learned in the law, shall be appointed and

court, and justice of the court of quarter sessions of the peace, agree-
ably to the constitution and laws of this commonwealth.

SECTION 2. That from and after the first day of May next, the said several courts in said district shall commence, and be held on the following days: In the county of Schuylkill, on the first Mondays of March, June, September and December, to continue three weeks if necessary; in the county of Carbon, on the fourth Mondays of March, June, September and December, to continue two weeks if necessary; in the county of Monroe on the Monday next following the courts in Carbon county, and continue two weeks if necessary.

SECTION 3. That until a president judge shall be appointed for the district hereby created, the president judge of the twelfth judicial district shall, and he is hereby authorized to perform the duties of president judge for the district hereby created.

SECTION 4. That so much of any law as is altered by this act, is Repeal. hereby repealed.

AN ACT

Entitled "An Act authorizing Alexander Crow to collect outstanding tax in Springhill township, Fayette county, and for other purposes.'

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Alexander Crow, late a collector of Springhill township, Fayette county, be and he is hereby authorized, at any time within one year from the passage of this act, to collect the outstanding state, county and school tax in said township, for the year one thousand eight hundred and thirtynine; and the commissioners of said county are hereby authorized to issue a warrant to the said Alexander Crow for said purpose.

SECTION 2. That Samuel Cooper, of Nottingham township, Washington county, one of the executors of Frederick Cooper, deceased, late of said township, be and he is hereby authorized to collect the outstanding tax on the duplicates which were in the hands of said Frederick Samuel Cooper, Cooper, at the time of his decease; and the commissioners of said county are hereby authorized to issue a warrant to the said Samuel Cooper for said purpose.

No. 164.

A SUPPLEMENT

To an act, entitled "An Act to enable the governor to incorporate a company to make an artificial road from the court house, in the borough of Lewistown, to Alexander Reed's, in Kishacoquillas valley," and for other purposes.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the president and managers of the Lewistown and Kishacoquillas turnpike road company, be and are hereby authorized and empowered to change the location of said road from time to time, as they may deem

advisable, in such places where it may be necessary to avoid hills and other obstacles, so as to place the road on a more level and suitable location than at present, in such manner so as to do the least injury to the land through which it passes: Provided, That before entering upon the lands of private individuals, for the purpose of locating said road, and constructing the same, the said president, managers and company, shall first pay or secure to be paid for the ground and materials to the owners thereof, such reasonable damages as may, upon view, be assessed by the commissioners of Mifflin county, for the time being, who are hereby appointed a board of appraisers for that purpose.

SECTION 2. The said president and managers be, and are hereby empowered to remove the stone and other materials from such parts of the present road as are intended to be supplied and changed under the foregoing section, for the purpose of constructing and repairing such new portions of said road, and for other purposes; and the said company shall continue to enjoy the same rights and privileges as heretofore.

SECTION 3. During the construction of such new portions of said road, Tolls. it shall and may be lawful for the said president and managers of said road to take tolls on the old road as heretofore, and when the same are completed, then, upon both the old and new parts, according to the present rates; and such parts of the old road as may be abandoned by the said president and managers, shall be vacated, and the owners of lands adjoining such abandoned parts of said road, be and are hereby authorized to fence up and inclose the same; and it shall not be lawful for any person to travel on such abandoned parts of said road, so as to avoid the payment of tolls on said road, and every person so doing, shall be liable to the same penalties as offenders under existing laws, are liable for defrauding turnpike companies, and avoiding the payment of tolls thereon.

SECTION 4. That from and after the passage of this act, the managers Chambersburg of the Chambersburg and Bedford turnpike road company, are hereby and Bedford turnrequired to render an account, verified by their respective oaths or affir- pike road commations, of the number of days they, or any of them shall have been pany. employed in each year, in attending to the business or concerns of the Accounts. said company; and for each day so employed, they shall be each entitled to receive, as now provided by law, one dollar and fifty cents, and

AN ACT

Relative to the "Trustees of the Theological seminary of the German Reformed
church in the United States," now located at Mercersburg, Franklin county,
Pennsylvania.

WHEREAS, Certain citizens of this commmonwealth obtained a charter in 1831, incorporating them and their successors, under the provisions of the act of 1791, by the name, style and title of Trustees of the Theological seminary of the German Reformed church in the United Srates," now located in Mercersburg, Franklin county, Pennsylvania, the annual income of which corporation is limited to £500 by said act of 1791, and to $2,000 by the act of 8th of April, 1833; and by the terms of said charter the synod of said church is vested with the power of annually changing one-third the members of said corporation, by election; of managing and disposing of its funds; of establishing professorships in literature, science and theology; of appointing the salaries and prescribing the duties of the professors; and of appointing a board of visitors, to whom the internal government of said institution is committed; by which it is shown that said seminary is under the direction and patronage of said synod, for the purpose of promoting education and the christian religion :

And whereas, The said synod embraces the territory of Maryland, and parts of Virginia and North Carolina, as well as the whole of Pennsylvania; and the usefulness of said institution would be augmented, by enabling said synod to select members of said corporation, as it deemed best, from the citizens of other states, belonging to said German Reformed church:

And whereas, In view of the laudable objects of said corporation, it is believed that its annual income may be greatly enlarged, and its capacity for usefulness be extended, by relieving it from the restrictions of the said acts of assembly:

Therefore,

SECTION 1. It is hereby enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That from and after the passage of this act, the corporation, known by the name, style and title of the "Trustees of the Theological seminary of the German Reformed church in the United States," shall be enabled, and Election of mem- have full power and authority to elect members of the same, such citizens of other states, in the United States, as it may consider fit and proper, in conformity to the manner and provisions of its charter: but in no case shall a majority of the trustees, so elected, be residents of other states; and also shall be able and capable in law, for the purposes specified in its said charter, to take, receive and hold all and all manner of lands, tenements, rents, annuities, franchises and hereditaments, and any sum and sums of money, and any manner and portion of goods Annual income and chattels, given and bequeathed to it or otherwise acquired by it; notwithstanding the annual income thereof shall in no event exceed the

heretofore passed, to the contrary notwithstanding.

SUPPLEMENT

To an act to incorporate the Cumberland Valley mutual protection company of Dickinson township, Cumberland county, passed the ninth of March, one thousand eight hundred and forty-three.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the business of the said corporation shall be carried on and conducted in the county of Cumberland, and at such place in said county as shall be designated by the board of directors at any regular meeting.

SECTION 2. SECTION 3. That all the provisions of the original act passed the Repeal. ninth March, one thousand eight hundred and forty-three, and the supplement thereto, passed the eighteenth April, one thousand eight hundred and forty-three, to which this act is a further supplement, and which are inconsistent herewith, be and the same are hereby repealed.
