A SUPPLEMENT

To an act, entitled "An Act relating to elections of this commonwealth," passed the second day of July, Anno Domini one thousand eight hundred and thirtynine.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Assessors in Brad from and after the passage of this act, the fifty-ninth section of an act ford, Wyoming, to which this a supplement, which requires the attendance of assessors Tioga, Susquehanna, Wayne, at the board of elections, is hereby repealed, so far as it relates to Montgomery and Bradford, Wyoming, Tioga, Susquehanna, Wayne, Montgomery and Clinton counties. Clinton counties.

SECTION 2. The expenses of the borough and township elections, of Crawford county. the county of Crawford, held in March annually, shall be paid by the borough and townships respectively.

AN ACT

To authorize the Practical house carpenters' society of the city and county of Philadelphia, to hold a certain amount of real estate.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That in addition to the privileges already secured and granted to "Practical house carpenters' society of the city and county of Philadelphia," they shall make, and are hereby authorized to hold and enjoy by purchase, devise or bequest, to them and their successors, lands, tenements, rents, hereditaments of every nature, kind and quality, whatsoever; and the same, from time to time, to mortgage, sell, grant, alien, let upon ground rent, or otherwise dispose of: Provided, That the clear yearly value or income of the houses, lands and tenements, rents, annuities, or other

hereditaments and real estate of the said corporation, and the interest of money by it lent, shall not exceed the sum of two thousand five hundred dollars.

SECTION 2. That all conveyances of real estate by the said corpora- Sales confirmed. tion, heretofore made upon ground rent, or otherwise, be, and the same are hereby confirmed and declared good and valid, for the purposes therein mentioned, and as though the same had been made, executed and delivered after the passage of this act.

AN ACT

To provide for the education of the deaf mutes of this commonwealth.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the governor be and he is hereby authorized and required to draw his Appropriation. warrant on the treasurer of the commonwealth, in favor of the president of the Pennsylvania institution for the deaf and dumb, for the sum of one hundred and sixty dollars per annum, for every indigent deaf mute of this commonwealth, taught at said institution, one-half of which said sum shall be paid at the expiration of six months, and the other half thereof at the end of the year: Provided, That no pupil shall be Limited. educated at the expense of the commonwealth, under the age of ten years, nor over the age of twenty years, or for a longer period than six years: And provided also, That the annuity hereby granted, shall continue in force for six years, from and after the first day of April, one thousand eight hundred and forty-four, and no longer; and the payment to be made pursuant to the provisions of this act, shall be limited by the appropriations made and hereafter to be made by law.

AN ACT

For the relief of Peter Hess, and others, recently of Fayette county, Pennsylvania.

WHEREAS, Samuel Mullen, lately of Fayette county, Pennsylvania, but now of Guernsey county, Ohio, intermarried with Susan Hess, a daughter of Peter Hess, in the year one thousand eight hundred and thirty-nine, sold a certain farm or tract of land situate in Fayette county aforesaid, to Isaac Crow, of the same county; but in consequence of her being then, and ever since, non compos mentis, the said Susan Mullen has been incapable of joining with her husband in any conveyance for the said tract of land to the said Isaac Crow, so as to discharge the same from her right of dower therein; and in order to indemnify the said Isaac Crow, his heirs and assigns, against any claim of dower by the said Susan Mullen, in said premises, in the event of her surviving her said husband, the said Samuel Mullen, and said Peter Hess, as his surety, executed a bond and judgment to the said Isaac Crow, in the penal sum of two thousand dollars, with condition aforesaid; which judgment remains a lien on the real estate of the said Peter Hess, situate in Fayette county aforesaid: And whereas, The said Peter Hess has sold his said real estate, but is unable to recover the consideration money for the same, in consequence of said lien; for remedy whereof, therefore,

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Trustee of Susan James Fuller, of Fayette county, Pennsylvania, uncle of Susan MulMullen to perfect len, the wife of Samuel Mullen, lately of said county, now of Guerncertain deeds. sey county, Ohio, who is a daughter of Peter Hess, lately of Fayette county aforesaid, now of Guernsey county aforesaid, be and he is hereby appointed trustee of the said Susan Mullen, who has for a long time been, and still is, non compos mentis, to continue trustee during her unsoundness of mind; and the said trustee is hereby authorized and required, if he approve of the same, to signify his assent to the sale and conveyance of a farm or tract of land situate in Fayette county aforesaid, sold by the said Samuel Mullen, to Isaac Crow, in one thousand eight hundred and thirty-nine, in writing, upon any deed or deeds for the said premises, which has been, or may hereafter be, executed by the said Samuel Mullen, to the said Isaac Crow, his heirs or assigns; and the deed or deeds so made by the said Samuel Mullen, and assented to by the said trustee, and acknowledged by him in the manner now required by law for the acknowledgment of deeds, shall vest the estate thereby granted by the said Samuel Mullen, in the said Isaac Crow, his heirs and assigns, as fully, to all intents and purposes, as if the said Susan Mullen were competent to execute the same, and had duly executed and acknowledged such deed according to law: Provided, That before the said trustee shall signify his assent to any such deed, the said Peter Hess shall execute a bond to the said trustee, for the use of the said Susan Mullen, in such penalty as the orphans' court of Fayette county, aforesaid, shall direct, accompanied by a judgment or mortgage, duly executed, upon unincumbered real estate of sufficient value, in the state of Ohio, conditioned for the payment to the said Susan Mullen, annually, during her life, in the event of her surviving her said husband, of the interest on one-third of the value of the above

mentioned premises, (to be fixed by the said trustee, and the owner
thereof, and if they cannot agree, or the same be not bona fide made,
then to be fixed in such manner as the said orphans' court may direct,)
or of one-third of the rents, issues and profits thereof, to be fixed as
aforesaid, in lieu of her dower in said premises.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That

in conformity with said act, but no certificate shall issue for less than

the outstanding certificate, and to call in the original certificate, and issue
new ones in their stead, less the pro rata reduction.

SECTION 2. The said company may, from time to time, receive notes Insurance.
or other securities, real or personal, premiums from persons intending
to effect insurances therewith, or from any other person or persons
under such regulations or agreements as shall be authorized by the
directors, which said notes or other securities may be negociated, trans-
ferred or conveyed by the said company for the purpose of paying
claims for losses accruing in the course of its business, and on such
portion of the said notes or securities as may exceed the amount of pre-
miums paid or agreed to be paid by the parties, from whom the same
may have been received, the said company may allow and pay such in-
terest or other compensation not exceeding five per cent. per annum, as
may be agreed upon by the directors.

AN ACT

To incorporate Emanuel church, Holmesburg, in the county of Philadelphia.

WHEREAS, The rector, church wardens and vestrymen, of All Saints church, Lower Dublin township, in the county of Philadelphia, together with certain members of the said corporation and others, worshipping at Emanuel chapel, Holmesburg, have united in an application to the legislature, praying for the separation of the latter from the former, and their erection into a distinct church and corporation, and also for the grant of permission and authority for said All Saints church, to convey to the proposed new corporation, a certain building and lot of ground situate in Holmesburg, aforesaid, to be held and used for a house of divine worship, and as a burial ground:

And whereas, The grant of the application aforesaid, will conduce to the well-being and prosperity of the said church and chapel, and to the furtherance of the cause of religion; therefore,

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the individuals hereafter to be elected rector of the church, Alexander Brown and Edward J. Glen, church wardens, and Richard P. Lardner. George Fox, Simmons H. Barrett and Joshua B. Smith, vestrymen. and their successors, be and they are hereby erected into a separate body politic or corporate, by the name, style and title of "the rector. church wardens and vestrymen of Emanuel church, Holmesburg, in the county of Philadelphia," and by the same name shall have perpetual succession, and shall be able to sue and be sued, to plead and be impleaded, in all courts of law and elsewhere; and shall be able and capable in law and equity to take and hold to them, and their successors, for the use of said church, lands, tenements, goods and chattels, of whatsoever nature or quality, real or personal, which now are or shall hereafter become the property of the said corporation, or be held for their use by any manner of conveyance, devise, bequest or otherwise : Provided, That the clear yearly value or income of the estate, real, personal or mixed, of the said corporation of Emanuel church, exclusive Income limited. of the moneys arising from the pews of the said church, and opening any ground thereto belonging, for burials, shall not exceed the sum of four thousand dollars.

SECTION 2. That the said rector, church wardens and vestrymen, of Emanuel church, may have and use one common seal, with such device and inscription as they may think proper, and the same may change, alter, break and renew at their pleasure; and that they and their successors, or a majority of them, met from time to time, shall have power and authority to make rules, by-laws and ordinances, and to do every thing needful for the good government and support of the said church: Provided, That the said rules, by-laws and ordinances be not repugnant to the constitution and laws of the commonwealth Pennsylvania, or of the United States.
