AN ACT

Relative to the Lehigh coal and navigation company.

WHEREAS, The Lehigh coal and navigation company have been pre- Preamble. vented, by causes beyond their control, from completing their railroad from the Lehigh to the borough of Wilkesbarre, within the time limited by law; therefore,

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same. That

so much of the first proviso to the first section of the act authorizing Completion of the construction of a railroad from the borough of Wilkesbarre to the railroad extended. Lehigh, passed thirteenth March, one thousand eight hundred and thirtyseven, as limits the time for the completion of the said railroad, be and,

the same is hereby repealed; and two years from the passage of this

act are hereby granted for the completion of the said railroad.

SECTION 2. That it shall be lawful for the Lehigh coal and naviga- Locomotives and tion company, to furnish locomotives and cars for the conveyance of cars. passengers, mails or merchandize upon the said railroad; and the same powers, relative to the transportation on the said road, as are granted to the Philadelphia and Reading railroad company, relative to their road, by the act incorporating them, passed fourth April, one thousand eight hundred and thirty-three, are hereby extended to the Lehigh coal and navigation company.

SECTION 3. That it shall be lawful for the Lehigh coal and navigation Toll. company, to charge and collect a toll, not exceeding one cent a mile for

each passenger travelling on their navigation.

Trustee of Thos. Ash, to mortgage real estate.

Preamble.

No. 147.

AN ACT

Authorizing Benjamin Jones, junior, trustee of the children of Thomas Ash, deceased, to mortgage real estate, and for other purposes.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Benjamin Jones, junior, his successor, trustee of the children of the late Thomas Ash, by virture of a certain indenture, bearing date the twenty-fifth day of March, one thousand eight hundred and thirty-nine, between Joseph Ash, Caleb Ash, Alexander Elmslie, and Sarah, his wife, Robert Taylor and Elizabeth A., his wife, Sarah E. Jones, of the one part, and the said Benjamin Jones of the other part, which indenture is recorded in the office for the recording of deeds, and so forth, for the city and county of Philadelphia, in deed book G S, number four, page one hundred and fifty-eight, be and he hereby is authorized under the direction of the court of common pleas of the county of Philadelphia, to raise a sum of money not exceeding thirty-five hundred dollars, by mortgage of the premises or any part of them described in the said indenture, and thereby granted and conveyed to the said Benjamin Jones, junior, in trust; and to apply the sum so raised to relieve a house and lot situate in Swanson street, number 144, in the district of Southwark, between Catharine and Queen streets, in said county, from a mortgage executed by Joshua Ash and Joseph Ash, in favor of George Williams; and it shall be lawful for Rebecca Ash, the owner of said house and lot, to apply to the said court by petition, setting out the facts which entitle her said real estate to be relieved from said mortgage, agreeably to the directions of the will of Joshua Ash, and the spirit and intention of said indenture; and thereupon the said court shall order and direct the said Benjamin Jones, Jr., or his successor, to execute a mortgage of the real estate conveyed by said indenture, not exceeding the said sum of thirty-five hundred dollars, and apply the proceeds thereof in such manner as may be necessary to carry into effect the intention of this act.

WHEREAS, The representatives of Edward Bartholomew and Alexander A. Anderson, deceased, and Samuel Patton, in his lifetime, sold several lots in the town of Covington, in the county of Tioga, to John Gray and others, and the said lots have been improved and sold to persons who claim the rights of the said John Gray and others, and are

now in the possession of the said lots, but no deeds have been executed E. P. Gerould to to the purchasers of the said lots or their alienees; therefore, that it shall make deeds for and may be lawful for Ephraim B. Gerould, of the town of Covington, lots of E. Barin the county of Tioga, on the receipt of any purchase money still due tholomew, dec'd. and unpaid on all or any of the lots sold in the said town of Covington, by the representatives of Edward Bartholomew, deceased, by Samuel Patton, in his lifetime, and the executors of. Alexander A. Anderson, deceased, to convey and assure the said lots to those who may be entitled to receive the said conveyance in fee, as fully and effectually as if the said deeds had been made by the representatives of Edward Bartholomew, the executors of Alexander A. Anderson, and Samuel Patton, in their lifetime, any moneys received by the said Ephraim B. Gerould on account of the said lots, he shall distribute it amongst the persons entitled to receive it, according to their respective proportions in the said lots.

AN ACT

To authorize the executors of David Wolmer, deceased, to sell and convey a certain ground rent.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the executors of David Wolmer, late of the borough of Norristown, and county of Montgomery, deceased, be and they are hereby authorized to sell, at public sale, and convey any ground rent or ground rents, which had been granted and conveyed to the said David Wolmer, as fully and effectually, as the said David Wolmer could do in his lifetime: Provided, That before such sale and conveyance, the said executors shall give security to the satisfaction of the orphans' court, of the county in which said ground rents may be charged, for the faithful application of the proceeds of such sale according to law; and the purchaser of said ground rent shall not thereafter be in any way liable for the proper application of the purchase money.

Extending the time for the completion of the Hollidaysburg and Bedford turnpike road.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the time fixed for the completion of the Hollidaysburg and Bedford turnpike road, by the fifteenth section of the act, entitled "An Act authorizing the governor to incorporate the Hollidaysburg turnpike road company," to make a turnpike road from Hollidaysburg, in Huntingdon county, through Newry to Bedford, in Bedford county, passed the tenth day of April, one thousand eight hundred and thirty-five, be and the same is hereby extended for another period of ten years from the passage of this act.

Bank.

No. 150.

AN ACT

To provide for the election of directors of the Columbia Bank and Bridge company, and the Moyamensing Bank.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the affairs of the Columbia Bank and Bridge company, shall be conducted by thirteen directors, to be chosen by the stockholders, at an election to be held on the fourth Monday of November next, and on the fourth Monday of November of each year thereafter: Provided. That the directors at present elected, and now in office, and the president by them chosen, shall be and remain in office, until the fourth Monday of November next, and until others are elected in their stead.

SECTION 2. That so much of the first section of the act to incorporate the Moyamensing Bank, in the county of Philadelphia, passed the

thirtieth day of March, one thousand eight hundred and thirty-two,

as prohibits the election of more than five directors who reside in the Directors.
city of Philadelphia, be and the same is hereby repealed; and the stock-
holders shall hereafter be authorized to elect the whole number of the
board of directors from the city and county of Philadelphia, or either
as they may choose.
