SECTION 3. SECTION 4. So soon as the president, managers and company shall have perfected said road from Millersville, the distance of one mile, and also when they shall have completed the remainder of the distance, they shall give notice thereof to the judges of the court of quarter sessions of Allegheny county, who shall thereupon, forthwith nominate and appoint three disinterested persons to view and examine the same, and report to them in writing, whether the said road or part thereof, has been executed in a permanent and workmanlike manner, with stone, gravel and timber, so as to make a substantial road, eighteen feet wide; and if their report shall in either case be in the affirmative, then the said judges shall by license under their hands and the seal of the said court, permit and suffer said president, managers and company, to erect and fix so many gates and turnpikes upon and across the said road as will be Gates. necessary and sufficient to collect the toll and duties granted to the said

company by this act, from all persons travelling on the same with horses, mules, cattle, carts, wagons and carriages: Provided, That all persons attending funerals or places of worship, their horses, mules and carriages, shall be exempt from the payment of tolls in going to and returning therefrom.

SECTION 5. The legislature expressly reserves the right at any future time, to alter and modify the charter of said company, incorporated in pursuance of this act, in such manner as may be deemed conducive to the public interests.

AN ACT

To authorize the trustees of Susanna Sigman, wife of Abraham Sigman, junior, to sell and convey certain real estate.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That John Y. Kachlein, trustee, &c., of Susanna Sigman, wife of Abraham Sigman, junior, together with John Deichman, the former trustee of the said Susanna, be and they hereby are authorized to grant and convey, in fee simple, to John Clifton, of the borough of Easton, and to his heirs and assigns forever, all that frame messuage, tenement and lot or piece of ground, situated on the east side of Pomfert street, in the borough of Easton, in the county of Northampton, containing in front on said street thirty-three feet, and extending in depth eastward, one hundred and forty-eight feet, bounded on the south by a house and lot of Benjamin Ihrie, on the west by the aforesaid street, on the north by Peter Nungessor's lot, number ninety-eight, and on the west by a twelve feet wide alley, being the same premises which Samuel Moon and Henry D. Maxwell, executors, &c., of William White, deceased, by indenture, dated the first day of April, Anno Domini, one thousand eight hundred and thirty-nine, recorded in the office for recording deeds at Easton, in and for the county of Northampton, in deed book E, volume six, page one hundred and seventy, granted and conveyed to the said John Deichman, and to his heirs and assigns in trust, nevertheless, to and for the sole and separate use of Susanna Sigman, wife of Abraham Sigman, junior, and her heirs, for ever, free, clear and discharged of and from any trusts created in relation thereto, for the said Susanna and her heirs: Provided however, That no conveyance of the said premises

shall be made until the said Susanna Sigman shall, by writing under her
hand and seal, duly executed in the presence of at least two credible
witnesses, and acknowledged before a justice of the peace, direct and
appoint: And provided, further, That before any such conveyance
shall be made, the said John Y. Kachlein shall give a bond to the com- Bond.
monwealth, to the use of the persons interested, in such penalty and
with such security as may be approved by the orphans' court of the said
county, conditioned for the faithful appropriation of the proceeds of the
said sale, according to the true intent and meaning of said trust, and the
direction and appointment of the said Susanna, in said writing men-
tioned and contained.

A FURTHER SUPPLEMENT

To an act, entitled "An Act to incorporate the Beaver Meadow railroad and coal company."

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the annual meeting of the stockholders of the Beaver Meadow railroad Annual meeting. and coal company shall be held on the third Monday in January, of which meeting notice shall be given as provided in the third section of the act incorporating said company, approved the seventh day of April, one thousand eight hundred and thirty.

SECTION 2. That it shall be lawful for the president and directors of said company to forfeit to the use of the company, any stock on which stock. any sum remains due, either by note or notes, due and unpaid, or otherwise: Provided, That nine months notice be first given to the person or persons, or bodies politic or corporate, in whose name said stock stands on the books of the company, or to his, her or their legal representatives, that unless such arrears be paid within nine months the stock shall be declared forfeited, as above provided.

SECTION 3. That the same rights, privileges, restrictions and limitations as are contained in an act, entitled "A further supplement to an act leges, restrictions, entitled An Act to incorporate the Hazleton coal company,' passed &c. the fourth day of April, eighteen hundred and forty-three," be and they are hereby extended to the president and directors of the Beaver Meadow railroad and coal company: Provided, That the sum or sums of

money which may be borrowed under this act, shall not exceed thirtynine thousand dollars: Provided further, That no certificate or other evidence of loan for any money hereby authorized to be borrowed, shall be issued for any sum less than one hundred dollars.

AN ACT

Authorizing the committee of Jacob K. Landis to purchase real estate.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That John Miller and Henry Bear, committee of Jacob K. Landis, late of Manheim township, Lancaster county, are hereby authorized to purchase for the use of the said Jacob K. Landis, a house and lot in East Hempfield township, in said county, at a price not exceeding eight hundred and fifty dollars, and hold the same in trust for the use of the said Jacob K. Landis and his heirs: Provided, That the said committee shall not give any judgment, mortgage or other securities to the vendors of said house and lot, that will be a lien or incumbrance upon any other real estate of the said Jacob K. Landis; and they or their successors to hold the same in trust for the use of the said Jacob K. Landis, and his heirs, in the same manner as the real estate now belonging to the said Jacob K. Landis is held.

AN ACT

Authorizing the trustees of St. John the Baptist's Female academy to sell and convey a certain house and lot.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the trustees of "St. John the Baptist's female academy of McSherrystown," Adams county, be and they are hereby authorized to sell a certain house and lot, situate in the said town, formerly conveyed by the bishop of Philadelphia, to the Reverend Mathew Lekieu, and to execute to the purchaser or purchasers thereof, a deed of conveyance, in fee simple.

Swatara, in the county of Dauphin.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That
