der the directions of an act of Assembly entitled, "An act for the sale of all the remaining town lots yet the property of the Commonwealth," in the borough of Beaver, passed the fifth day of March, one thousand eight hundred and sixteen which have reverted to and become the property of the Commonwealth, public notice of the time and place of sale being previously given by said commissioners or a majority of them, in at least two weekly newspapers for four weeks successively, before the day of sale, and upon the day appointed for the sale of said lots, the said commissioners or a majority of them shall attend and publish the conditions of said sale, which shall be as follows, viz: Oneconditions of fourth of the purchase money shall be paid to the said commissale. sioners at the time of sale, and the residue in three annual instalments from the time of such sale upon which payment being made and a certificate thereof signed by the commissioners or a majority of them stating that such person or persons was the purchaser, the Secretary of the Land office is required to issue patents to such purchasers of the lots so sold: Provided, That the commissioners are hereby authorized to reserve to Jackson Sloan, Samuel Power, and William Fields, respectively the right to remove the buildings they have erected on lots authorized to be sold by the act.

SECTION 2. The Surveyor General is hereby required on apDuty requir'd plication to him made to transmit a draft of the said lots to the commissioners who are hereby required immediately after they shall have completed the sale as aforesaid, to make a complete statement thereof containing the number of the lots, the person or persons to whom sold, and the amount for which the same was sold, and transmit the same to the Secretary of the Land office, which statement shall be certified and signed by the said commissioners or a majority of them.

SECTION 3. Each of the said commissioners shall give bond with sufficient security to the Commonwealth, to be approved to give bond. by the Court of Common Pleas, of Beaver county, for the faithful performance of their duties, and shall receive one dollar for each and every day they shall necessarily spend in performing the duties aforesaid, and reasonable expenses for advertising and selling to be paid out of the proceeds of the sale of said lots.

SECTION 4. A SUPPLEMENT

To an act passed March twenty-ninth one thousand sight hundred and twenty-seven, “An act to incorporate and endow the academy of the Protestant Episcopal Church in the city of Philadelphia."

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That so much of the fundamental laws of the corporation Repeal. created by the act to which this is a supplement, and which were recognized and adopted by the said act as requires the pay. ment of ten pounds to entitle a certain description of persons to be elected trustees, be and the same is hereby repealed and that from and after the passage of this act, the four persons annu- Trustees. ally to be elected trustees, as well as those who shall be chosen to supply vacancies occasioned by death, removal or resignanation, may and shall be elected by the remaining trustees from among clergymen of the Protestant Episcopal church, resident in the city of Philadelphia, or within five miles thereof, or from persons qualified to be elected vestrymen of any church in the said communion in the said city or within the said distance therefrom.

SECTION 2. SECTION 3. Five of the said incorporated trustees duly convened, shall be a quorum for the transaction of ordinary business and for ordering the payment of the current expenses of the corporation but for the purposes of authorizing the conveyance of real estate or of making by-laws, a majority of the whole number shall be present in order to constitute a quorum.

AN ACT

To authorize the sale of certain real estate, late the property of Jasper Slaymaker, George Denison, James P. McMullen and Penelope Adams, and for other purposes.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the authorized to same, That Molten C. Rogers and Nathaniel W. Sample, junior, sell at public guardians of the minor children of Jasper Slaymaker, late of or private Lancaster county, deceased, are hereby authorised and empow ered to sell, at public or private sale, all the right, title and interest, of the minor children aforesaid, to a certain piece of ground situate on the east side of Prince street, in the city of Lancaster, being the western moiety of lot number two hundred and thirty-one, on the plan of said city: Provided, That before the said Molton C. Rogers and Nathaniel W, Sample, junior, shall execute any deed for the same to the purchaser or pur chasers, they shall give bond in such sum and with such sureties as the Orphan's Court of said county shall direct, conditioned for the faithful discharge of their duty and proper applica tion of the money arising from said sale: And provided further, That the sale of said property shall not be valid, until the same shall have been reported to and approved by the Orphan's Court of said county,

SECTION 2, George M. Hollenback, Ziba Bennett and Esther Ann Bowman, guardians of the heirs of George Denison, late of the county of Luzerne, deceased, are hereby authorised to sell and convey all or any part of the real estate of which the said George Denison died scized and possessed, at public or private sale, as they shall deem most conducive to the in terests of the said heirs, and to make and execute good and sufficient deeds to the purchasers, as well for the lands sold previous to the passage of this act, by any of the said guardians, or by any of the administrators of the said George Denison, or by the said George Denison himself, in his life-time, as for those to be sold in pursuance of this act: Provided, That the sales to be made in pursuance of this act shall not be valid until reported to and approved by the Orphan's Court of Luzerne coun ty: And provided, That deeds shall not be made to those who purchased of the said George Denison, in his life time, until 3d proviso. they make proof of such purchase or contract in the manner prescribed by the existing laws of this commonwealth: And provided further, That the said guardians shall be accountable for the proceeds of said sales, as they are now accountable for other money which comes into their possession.

SECTION 3. John Johnson and William Waddle, trustees of Authorized to James P. McMullen, of Franklin county, are hereby authorized sell & convey and empowered to sell and convey in fee simple, the whole, or so much as they may deem necessary, of the tract of land conveyed to the said trustees by Richard Bard, on the twenty-third day of January, eighteen hundred and twenty-six, for the purpose of paying the purchase money, and interest remaining due and unpaid thereon, and the surplus, if any, shall be applied to the objects provided for in the deed from said Richard Bard.

SECTION 4. Gawin Adams, guardian of Penelope Adams, Authorized to daughter and heir at law of Penelope Adams, deceased, late of sell & convey Indiana county, is hereby authorized and empowered to sell, at public or private sale, and convey by deed, in fee simple, all the right, title and interest of the said minor Penelope Adams, (being the one undivided eighth part,) to a tract of one hundred acres of land, situate and being in Centre township, Indiana county, adjoining lands of Francis Gombers, Conrad Rice, the heirs of John Denniston, Daniel Repine and others: Provided, That be- Proviso. fore the said Gawin Adams shall execute any deed for the same to the purchaser or purchasers, he shall give bond in such sum and with such sureties as the Orphan's Court of said county shall direct, conditioned for the faithful discharge of his duty, and proper application of the money arising from said sale: And provided further, That the sale of said property shall not be valid, until the same shall have been reported to and approv ed by the orphans' court of said county.

SECTION 5. The sale heretofore made by Isaac Beggs and Certain sale John McEwen, executors of the last will and testament of Hen- confirmed. ry Anderson, late of Mercer county, deceased, to John Reed, of Butler county, of a certain tract of land or plantation, in Wolf creek township, Mercer county, on which John White then resided, is hereby confirmed, agreeably to the terms mentioned in the deed conveying said land: Provided, That the said executors shall enter into bend, with security, to be approved by the Orphan's Court of Mercer county, conditioned for the faithful application of the money arising from said sale, agreeably to the directions of the said last will and testament. AN ACT

To authorize the Governor to incorporate a company to make a turnpike road from the borough of Johnstown in Cambria county, to New Alexandria in Westmoreland county.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That for the purpose of making a turnpike road from the borough of Johnstown in Cambria county, to New Alexandria, in Westmoreland county, James Murry, James L. Clow, William Craig, John Bigham, John Snodgrass, James M'Clelland, John Bell, Jacob Covode, William Mathews, of Westmoreland county, John Mathews, Peter Livergood and J. C. M'Gill of Cambria county, be and they are hereby appointed commissioners to do and perform the several things hereinafter mentioned, that is to say, they shall on or before the first Monday of July next,procure two books or more, and in cach of them enter as follows: "We whose names are hereunto subscribed, do promise to pay to the president and managers, of the Johnstown and New Alexandria turnpike road company, the sum of fifty dollars for every share of stock in said company set opposite to our respective names, in such manner and proportions and at such times as shall be determined by the president and managers of said company in pursuance of an act of the General Assembly of this Commonwealth, entitled, "An act to authorize the Governor to incorpo rate a company to make a turnpike road from the borough of Johnstown in Cambria county to New Alexandria in Westmoreland county. Witness our hands the day

in the year of our Lord one thousand eight hundred and ;" and thereupon shall give notice in two or more of the public papers printed nearest the route of the Notice of the said road for twenty days at least of the times and places when and where the said books shall be opened to receive subscrip tions for the stock of the said company, at which times and places one of the said commissioners shall attend and permit and suffer all persons of lawful age who shall offer to subscribe in said books in their own names, or in the name or names of any other persons who shall duly authorize the same for any number of shares of stock, and the said books shall be kept open respectively for the purposes aforesaid at least six hours in every juridical day for the space of six days, or until the said books shall have three hundred shares therein subscribed and if at the expiration of the said six days the books aforesaid shall not have the said number of three hundred shares therein subscri
