To an aet entitled "An act authorizing the Governor to incorporate the Lackawanna and Susquehanna Rail Road Company.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvama in General Assembly met, and it is hereby enacted by the authority of the same, That the President pro tempore of the Lackawanna and Susquehanna Rail Road Company, is hereby authorized to advertise the time and place of holding the annual and special elections and meetings of said company.

To the aet entitled "An act to encourage the destruction of Foxes and Wild Cats "

SECTION 1. Be it enacted by the Senate and House of Re presentatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the provisions of the act passed on the third of March, eighteen hundred and twenty-nine, entitled "An act to encour the destruction of Foxes and Wild Cats," be and the same are age hereby extended to the counties of Somerset, Cambria, Butler, Northumberland, Clearfield and Bedford.

A SUPPLEMENT

To the act entitled "An act to authorize the Governor to incorporate the
Hydraulic company, of the borough of Berwick."

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the president, managers and company, of the Hydraulic company of the borough of Berwick, be and they are hereby authorized to extend their capital stock to two thousand shares, under the several provisions and restrictions contained in the first section of the act to which this is a supplement, and that said company may rent or dispose of any surplus water power, created thereby, for manufacturing purposes: Provided, That nothing herein contained, shall be so construed, as to authorize the said company to engage in manufactures, or any other business other than what is granted above, and in the act to which this is a supplement.

A SUPPLEMENT

To the act entitled "An act establishing an academy in the borough of
Beaver, in the county of Beaver."

WHEREAS, by an act of the General Assembly of this Commonwealth, passed the twelfth day of March, one thousand eight Preamble. hundred, the quantity of five hundred acres of land, adjoining the town of Beaver, was granted to the county of Beaver for the use of such school or academy as should be established by law in the said town, and the said tract of land was vested in the trustees of the county of Beaver, and their successors, for the use and trust aforesaid: And whereas, by sundry subse quent acts of Assembly, certain additional trustees were ap

pointed, and powers given to the trustees to sell a moiety of the said land, and with a portion of the proceeds of such sales to erect a suitable building on one of the public squares of the said town for an academy, which was done accordingly: And whereas, By an act passed the twenty-fifth day of February, one thousand eight hundred and thirteen, there was established an academy or public school for the education of youth in the useful arts, sciences and literature, by the name of the Beaver Academy, appointing certain persons therein named trustees, who, with their successors, were erected into a body corporate, by the style and title of the trustees of the Beaver Academy, and power was given to the said trustees to fill vacancies as often as they occurred; and the said tract of land, or the property which grew thereout, was vested in the said trustees and their successors: And whereas, The citizens of the county of Beaver, for whose use the said tract of land was granted as aforesaid, have petitioned the Legislature to confer upon them the right to elect the said trustees from time to time, so as to ensure the faithful application of the bounty of the State to the laudable objects for which it was intended: Therefore,

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That the number of trustees of the Beaver academy, from and after the second Tuesday of October next, shall be eight, and shall be so changed as that none of them after that time continue in office for a longer period than four years, without being elected by the citizens of the county of Beaver; and for that purpose the present trustees of Beaver academy, at a meeting to be held by them on second Monday of May next, when not less than six of thein shall be present, (which number shall be a board or quorum to do business,) and they shall cast lots to ascertain who of five of the present board shall go out on the second Tuesday of October next, and who of the residue of the Changing of said board shall be changed in each subsequent year, until the whole number shall be changed; and in order annually to supply the vacancies that may take place, the citizens of the county of Beaver shall on the second Tuesday of October next, and annually thereafter, at the same places and in the same manner and under the same laws, rules and regulations as members of the State Legislature are chosen, elect two trustees to supply the place of the trustees going out of office: Provided always, That in the case the places of the trustees shall become vacant by death, resignation, or otherwise, before the annual election, the remaining trustees shall appoint a person or persons to fill such vacancy or vacancies until the next general election, when the same shall be filled by election of the people as aforesaid.

SECTION 2. In case the present trustees of the said Academy: shall neglect or refuse to meet on the second Monday of May next, and determine by lot who of five of

them shall go out of office on the second Tuesday of Octo. SECTION 3. The trustees shall appoint a treasurer annually, who shall receive and hold all monies belonging to the institution, and pay the same on orders signed by the board; he shall keep fair accounts thereof, to be open at all times to the inspec- His duties. tion of the trustees, and before he enters upon the duties of his office, give bond in any sum at their discretion, with two or more sufficient sureties, conditioned for the faithful performance of the duties enjoined, and the re-payment of all monies received by him, which bond shall be deposited with the prothonotary of the county.

SECTION 4. SECTION 5. All the contracts and agreements which the late trustees have entered into, and all things which by former laws they were authorized to do in and about the premises, shall and may be performed by the trustees herein created.

SECTION 6. The trustees elected by virtue of this act, and their successors in office, shall, before they enter on the duties of their trust, before any judge or justice of the peace of this State, take and subscribe the oaths or affirmations prescribed by the constitution of this State to be taken by the officers of the State, and shall also take and subscribe an oath or affirmation for the faithful discharge of their respective trusts or office aforesaid.

SECTION 7. So much of any act or acts as is hereby altered or supplied, is hereby repealed.

A FURTHER SUPPLEMENT

To the act entitled, An act authorizing the Governor to incorporate the
Mahonoy Navigation Company.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly me', and it is hereby enacted by the authority of the same, That the books for receiving subscriptions of stock to the said company, may be re-opened at any time before the first day of July, eighteen hundred and thirty-six, and said subscriptions may be taken hereafter as provided for in the original act, and that the time for commencing the work under said act is hereby extended to two years after the stock of said company shall have been subscribed, and for completing said improvements so as to render it fit for the conveyance of coal to the Pennsylvania canal to five years after the commencement of the

same.
