Supplementary to an act, entitled “An act to altor and amend the Fes Bill," passed the twenty-second day of February, Anno Domini,eighteen hundred and twenty-one.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That in addition to the fees prescribed by the act to which this is a supplement, the sheriff of each county shall receive the following:

For summoning and returning a struck and special jury, to be paid by the party putting off or losing the cause, three dollars, and four cents mileage each mile circular. And the jurors at. tending a view shall, in addition to their pay, be allowed mileage in the same manner as jurors attending court.

AN ACT

To incorporate the Trustees of the Associate Reformed Congregation of
Brush creek, in the county of Westmoreland.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the trustees of the Associate Reformed Congregation of Brush creek, in the county of Westmoreland, are hereby erected into one body politic and corporate, in deed and in law, by the name, style and title, of the "Trustees of the Associate Reformed Congregation of Brush creek, in the county of Westmoreland," and by the same name shall have perpetual succession, and be able to sue and be sued in all courts of law and elsewhere, and shall be able and capable, in law and equity, to

take and hold lands and tenements, goods and chattels, of what- Capacities &. soever kind, nature and quality, real, personal or mixed, which privileges. are now or hereafter shall become the property of the said congregation, by gift, grant, bargain, sale, conveyance, assurance, will, devise, bequest or otherwise, by any person or persons capable of making the same, and the same to grant, bargain, sell, nortgage or dispose of: Provided, That the yearly value or Proviso. income of the real and personal estate of said corporation shall not at any time exceed two thousand dollars.

SECTION 2. The affairs of said corporation shall be man- Officers of aged and superintended by seven trustees, four of whom shall corporation. be a quorum to transact business, to be chosen from the members of said congregation, who shall choose by ballot, from among their number, a president and secretary, and shall also choose a treasurer from among the members of the congregation who is not a trustee, and who shall if required by the trustecs of said corporation, give sufficient security for the trust reposed in him, and shail account to such trustees for all sums of money received by him or remaining in hands at any time, and in case of the removal of the president or any of the trus Vacancies, tees, by death, resignation or otherwise, the vacancy or vacan- how supplied. cies shall be supplied, by the board of trustees, till the next annual election, and the following named persons shall be trustees until the first Monday of September, one thousand eight hundred and thirty-four, viz: William Aitken, William Wilson, Humphrey Fullerton, Hezekiah Robbins, David McCormack, Samuel Osborn and Joseph Grier, on which day the members of said congregation shall elect seven trustees, to continue in office for one year, or until others shall be elected to fill their places, and the annual election of trustees shall be on the first Monday in September in each year: Provided always, That Proviso. the same trustees, or any of them, may be re-elected.

SECTION 3. All elections to be held in pursuance of this act shall be conducted by three members of the corporation, who Inspectors shall be appointed inspectors at the same place where the trustees are to be elected, as aforesaid, by the electors then assembled, in such manner as may be agreed on by said electors, Their duties. and the inspectors so chosen shall appoint one or more persons

as their clerk or clerks, to perform such duties as the nature of

the case may require; and any person contributing yearly to Persons enthe support of the said congregation, shall be entitled to vote titled to vote. at the elections of said corporation, and shall be eligible as a trustee; and each election so had as aforesaid shall be closed, and the number of votes for each person shall be ascertained; the inspectors of said election, or a majority of them, shall thereupon make out under their respective hands a return thereof, with the names of the trustees elect, and shall deliver the said return to the secretary of the corporation, who shall, with in three days thereafter, give notice in writing to each of the trustees elect of their respective election,

SECTION 4. Any person who shall hereafter be a member now members of said congregation, shall be entitled to all the privileges, and subject to the same regulations as other members, and every member shall be at liberty, at any time, to withdraw from said corporation.

SECTION 5. The said corporation shall have a right to make and use a common seal, with such devise and inscription as to them shall seem meet, and to alter and revise the same at pleasure.

SECTION 6. The said trustees and their successors shall enact by laws have power to enact and enforce such by-laws and ordinances as may be proper and necessary for the regulation and transaction of the business of the said corporation, to establish and change the time and place of the annual election of trustees from time to time, as the same may be found convenient, or if said congregation neglect to elect on the day of the annual meet. ing, appoint'any subsequent time on which said election shall be held: Provided, That public notice shall be given on the Sab bath, immediately before or after divine service, and in such other manner as a majority of the trustees may direct, at least two weeks previous to the time and place of holding such elec2d proviso. tions: And provided also, That said by-laws and ordinances shall not be inconsistent with the constitution and laws of this State or of the United States, and that the same be approved of by a majority of the members of the congregation qualified as aforesaid to vote at any special meeting, called by the trustees for that purpose, on notice given as aforesaid; and the by-laws and ordinances of the said corporation shall be fairly entered and registered by the secretary, which book and other records of the corporation shall be opened to the inspection of any mem ber of the corporation at all reasonable hours, on applica tion to the secretary; and in case an election of trustees shall not be held at the time or times appointed, the corporation shall not thereby be dissolved: And moreover, The legislature reserve the right to repeal, alter or amend this act, or any part thereof, at any time hereafter.

AN ACT

Vacating certain streets, lanes and alleys, in Williamsport and in Wil liamsburg.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That all that part of an addition to the borough of Williamsport" in the county of Lycoming, laid out into lots, streets, lanes, alleys, &c. by Francis and Jeremiah Church, lying and being south of the Pennsylvania canal, bounded by the West Branch of the Susquehanna on the south, the said borough of Williamsport on the west, the canal on the north, and lands of P. Vanderbelt, Esquire, on the east, be and the same is hereby vacated, and the title to the said streets, lanes, alleys, &c. vested in William F. Packer, the assignee of the original proprietors, as fully and effectually as though the same had never been dedicated to the public use and benefit.

SECTION 2. The following streets and alleys in the town of Williamsburg, in the county of Lebanon, viz: that part of Plump street beginning at Broad street, to lots numbered two hundred and twenty-six, and two hundred and thirty-four, including the same; that part of Chesnut street from lots numbered one hundred and eighty-eight and one hundred and ninety four, to King street; Oak alley, from lots numbered one hundred and ninety-four and two hundred and twenty-seven, to King street; Mulberry alley, from lots numbered two hundred and thirteen and two hundred and seven, to lots numbered two hundred and eighteen and two hundred and twelve, including the same; to Starsberry alley, from two hundred and three and one hundred and ninety-seven, to lots two hundred and two hundred and six, including the same, are hereby vacated, and that the title of the said streets and alleys be vested in George Seltzer forever, purchaser from the original proprietors, as fully and effectually as though the same had never been dedicated to the public use and benefit.

AN ACT

Authorizing the laying out of a state road from the Borough of Lebanon in Lebanon county, to Churchtown, in Lancaster county.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the Commissrs. same, That Jacob Hibshman and John Tom, of Lancaster county, and Tobias Kreider, jr. of Lebanon county, be and they are hereby appointed commissioners to lay out, by courses and distances, a state read, from the borough of Lebanon, in the county of Lebanon, through Sheafferstown aud Reamstown, to Churchtown, in Lancaster county; running, marking and laying out, for at least three fourths of a mile, the contemplated new road, immediately from the borough of Lebanon, on the old road now leading from said borough of Lebanon to Sheafferstown, on taking the turnpike road, for at least three fourths of a mile immediately from said borough.

SECTION 2. It shall be the duty of the said commissioners, or a majority of them, after taking an oath or affirmation before a justice of the peace to perform the duties enjoined upon thens by this act with inpartiality and fidelity, carefully to view the ground on which the said road may pass, and to lay out the same as near to a straight line between the aforesaid points, as the nature of the ground and circumstances will admit.

SECTION 3. It shall be the duty of the commissioners, or a majority of them, to have due regard to the nature of the ground and damages to private property, and all other circumstances that may affect the route adopted, may best promote> the public good; and further, that they shall clearly and distinctly mark upon the ground the roate agreed upon, in such manner as to enable the supervisors readily to find the same, and for the purpose of fulfilling the duties in this act enjoined, the said commissioners are hereby authorized to employ one To employ a surveyor, whose compensation shall not exceed two dollars per day, and two chain bearers and one axeman, at a sum pot exceeding one dollar per day for each.

SECTION 4.
