Proviso.

such laws as may be necessary, to assess, apportion, and appro priate such taxes, as may be thought by a majority of the town council best calculated to promote the foregoing purposes, and to do every matter and thing incident to, and for the good of the said borough; for the preservation of peace and good govern ment within the same, which by-laws, rules, ordinances, and regulations shall not be repugnant to the constitution and laws of the United States and of this State; and the same to revise, alter, and amend, and make anew, as occasion may require; but no person shall be punished for any breach of the ordinances, by-laws, rules, and regulations, unless after passing of any ordinance, the same shall have been put up at three of the most public places within the said borough, and no ordinance or by law shall take effect, until after the lapse of three weeks from the date of each publication: Provided nevertheless, That no tax shall be levied in any one year on the valuation of taxable property, exceeding one half cent in the dollar, unless some object of general utility should be thought necessary; in such case, a majority of the taxable inhabitants of the said borough, by writing under their hands, shall certify the same to the town council, who shall proceed to assess the same, as before directed.

SECTION 7. The burgess elect, agreeably to the directions Collection of of this act, is hereby authorized and empowored to issue his pretaxes & fines cept to the high constable, commanding him to collect all taxes, assessed from time to time as aforesaid, and all fines and forfeitures that may become due by this act, or by the ordinances and regulations of the corporation, and the same to pay over to the treasurer to be appointed by the town council, and to carry into effect whatever may be enjoined on him for the well ordering and good government of the said borough: Provided nevertheless, That it may be lawful for the justice or justices of the peace, residing in the said borough, to do and execute any and every act pertaining to their offices, agreeably to the powers conferred upon them by the constitution and laws of this Commonwealth.

SECTION 8. act, and the by-laws and ordinances of the town council, under
the like penalties and manner of removal Provided always, Proviso.
That if any person shall think himself or herself aggrieved by
any thing done in pursuance of this act, he or she may appeal
to the next court of Quarter Sessions, to be holden for the coun-
ty of Allegheny, he or she giving security according to law, to
prosecute his or her appeal with effect, which said court shall
jake such order therein as shall be just and reasonable, which
order or judgment shall be conclusive upon all parties.

SECTION 9. AN ACT

Authorizing the Commissioners and inhabitants of the incorporated district of the Northern Liberties to extend the market houses in Second street, between Coats'-street and Poplar lane.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That it shall and may be lawful for the commissioners and inhabitants of the incorporated district of the Northern Liberties, at such time or times as they may think proper, to construct or build additions to the ends of the market houses now erected in Second-street, between Coats'-street and Poplar lane, of the same width as the said market houses now are, so as that the said market houses between Coats'-street and Brown

street may be extended to the northern line of Coats'-street and
to the southern line of Brown-street, and that the said market
houses between Brown-street and Poplar lane may be extended
to the northern line of Brown-street and to the southern line of
Poplar lane; any thing in any law of this Commonwealth to
the contrary notwithstanding.

AN ACT

Granting aid to Allegheny College.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That the Governor be and he is hereby authorized and required to draw his warrant on the State Treasurer in favor of the president and trustees of Allegheny college, in the county of Crawford, for two thousand dollars annually, for four years, to commence on the first day of May, one thousand eight hundred and thirty-four: Provided, That before the Governor shall so issue his warrant, satisfactory evidence shall be exhibited to him, on cach application, that an equal sum has been secured to the said college by the subscriptions of individuals, and actually paid in: And provided also, That after paying what is yet due for finishing the college edifice, the remainder of this appropriation shall be faithfully applied to secure the permanent success of the institution, and the encouragement of the manual labour system.

SECTION 2. The said president and trustees of Allegheny college shall, during the operations of said college, cause, annually, to be instructed, free of expense for tuition, twelve students, if so many shall apply, in the elementary branches of an English education, in a manner best calculated to qualify them for teachers in the English language: Provided, That the said president and trustees shall signify their assent in writing to the conditions of this act, directed to the State Treasurer, on or

before the first day of May, one thousand eight hundred and thirty-four.

AN ACT

To continue the improvement of the State by rail-roads and canals.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That it shall be, and hereby is made the duty of the canal commissioners to complete, as soon as practicable, the following public works, according to the routes heretofore determined upon and approved, to wit: the Philadelphia and Columbia rail-road, with a double track of rails, stationary en- Works to be gines, and all other things and means to finish said road for completed. transportation, with the least possible delay; the Allegheny portage rail-road, with a double track of rails, and all the means to finish said road for transportation; the Beaver division of the Pennsylvania canal and the Shenango towing path; the Franklin line of the Pennsylvania canal and the north and west ends of the feeder; the Wyoming line of the North Branch division of the Pennsylvania canal and the Lackawanna feeder; the Lycoming line of the West Branch division of the Pennsylvania canal and the Lewisburg and Bald Eagle side cuts;-and for the expenditures thereof the sums hereinafter mentioned are severally and specifically appropriated: for the Philadelphia and Columbia rail-road, eight hundred and four thousand nine Appropriat'ne hundred dollars; for the Allegheny portage rail-road, three for the several hundred and sixty-five thousand nine hundred dollars; for the works. three hundred dollars; for repairs of the ensuing year, four
hundred and ten thousand eight hundred dollars; for the pay-
ment of damages, forty-nine thousand four hundred dollars.

SECTION 2. Nothing contained in this or any former act shall be so construed as to authorize the canal commissioners to construct a towing path bridge or road bridge over the pool of the feeder dam at Dunnsburg.

SECTION 4. The sum appropriated to the payment of damages by the first section of this act, is to be paid as speedily as possible, in the order as to time in which the said claims for damages may have been awarded, assessed and confirmed, and afterwards to such as may hereafter be awarded, assessed and confirmed, and may be agreed upon as due by prior acts.

SECTION 5. The Governor of this Commonwealth is hereby authorized to borrow, on the credit of this Commonwealth and such fund or funds as have been or shall be created for securing the punctual payment of the interest and the re-imbursement of the principal, the sum of two million two hundred and sixtyfive thousand four hundred dollars, payable in instalments, in such manner as he may designate in proposals for said loan, which sum shall be paid to and vest in the commissioners of the internal improvement fund, and shall be applied to the payment of the contracts necessary to be made to complete the works directed to be completed by this act specifically as aforesaid: Provided, That no engagement or contract shall be entered Redeemable into which shall preclude the Commonwealth from reimburs1st July, 1862 ing the said loan at any time after the expiration of twentyeight years from the first day of July next: Provided also, interest of 5 That no rate of interest beyond five per cent. per annum sha!! be allowed or paid for said loan.
