AN ACT

To authorize Edward Siter, Joshua Evans, aud William Harris to sell
certain real estate of the heirs of Thomas Kennedy, deceased, and for
other purposes.

SECTION 1. Be it enacted by the Senate and House of Re-
presentatives of the Commonwealth of Pennsylvania, in General
Assembly met, and it is hereby enacted by the authority of the

same, That Edward Siter of the county of Delaware, Joshua Evans, & W.
Evans of the county of Chester, and Doctor William Harris, Harris, to sell
now of the city of Philadelphia, in the said commonwealth, at- certain roal
tornies in fact, of John Wysong, guardian of the minor children estate in

of Thomas Kennedy, late of Jefferson county, state of Virginia, Delaware,
deceased, and the survivor or survivors of them shall have counties.
power and authority to sell, either for cash or on credit, and
convey to the purchasers and their heirs, in fee simple, the
whole, or any part or parts of the right, title, and interest of the
said minor children of, in, and to the real estate or their late
grandfather, Robert Kennedy, late of the county of Chester, in
this commonwealth, now deceased, situate within the counties
of Chester and Delaware, in this commonwealth, whether held
in possession, or in expectancy, in severalty, or in common
with any other or others, and also to make exccutory contracts
for the sale and disposal thereof, upon such terms, as shall be
agreed on with the purchasers, and also to make and execute
all or any such deeds and assurances, for completing such
sales, or making or carrying into effect such contracts, as the
said minors themselves or any of them, if of full age, might
make or execute, and also to give receipts for the purchase mo-
ney, which shall fully acquit and discharge the persons paying
the same.

Provided nevertheless, That the said attornies, in Proviso.
fact, shall duly account with the said minors, their guardian, or
guardians, or legal representatives for the amount of said sales,
and for that purpose shall enter into recognizance, with security,
to be approved of by the Orphan's court of Chester county.

SECTION 2. The power by the act of assembly, passed on the
twenty-seventh of March, one thousand, eight hundred, and Isab'lla Hurst
twenty-seven, entitled "An act authorizing the administrators to sell certain
real estate.
of Henry Hurst, deceased, to sell and convey real estate,'
given to Eliphalet Betts, Ira A. Blossom, and Isabella Hurst,
administrators as aforesaid, to sell and convey the real estate
of the said Henry Hurst, and which has become inoperative, in
consequence of the removal of the said Ira from the State, and
of the discharge of the said Eliphalet from the further adminis
tration of the said estate, is hereby extended to, and vested in

the said Isabella alone on the same terms and conditions, and subject to the same restrictions and limitations as in and by the said act are expressed and contained.

SECTION 3. The power to sell certain real estate of Patrick Farrelly, late of Meadville, Crawford county, by the twentyninth section of the act, passed on the fourth of April, one thou sand, eight hundred and thirty-one, entitled "An act relative to real estate, and vesting the interest of this Commonwealth in escheated estates, in certain persons therein named," given to David Derickson, then administrator of the said estate, but who has since relinquished his administrationship, and been released therefrom by the proper court, is hereby transferred to, and vested in John Wilson Farrelly, now administrator of the estate of the said Patrick, to be exercised by the said John Wilson Farrelly upon the same terms and conditions, and subject to the same restrictions and provisions as in, and by the said twenty-. ninth section of the said act are imposed upon the said David Derickson.

SECTION 4. That John Paul, George Vaux Bacon, and Thomas C. Price, all of the city of Philadelphia, or the survivor or survivors of them, be and they are hereby authorized and empowered to sell at public or private sale, for cash or on' credit, as they may think best, all the share or shares, part or parts, right, title, interest, and estate of Joseph K. Arthur, W. & Francis K. Howell minor children, and heirs at law of Harriet K. Howell, deceased, of in, and to all or any part of the following tracts of land, situate in Armstrong county, to wit: One of three hundred and forty-three acres, surveyed in the name of John Biddle; one of three hundred and twenty-nine and threefourth acres, surveyed in the name of Bartholomew Mather; one of three hundred and eight and three-fourth acres, surveyed in the name of Matthew Maris; one of three hundred and sixty-one acres, surveyed in the name of William Eckhart; one of three hundred and twenty-seven acres, surveyed in the name of John Salter; one of three hundred and fifteen acres, surveyed in the name of Sebastian Fisher; one of three hundred and sixty-three and one-fourth acres, surveyed in the name of Charles Vanderin; one of three hundred and eighty and three-fourth acres, surveyed in the name of George Risler; one of three hundred and six and three-fourth acres, surveyed in the name of Nicho las Rittenhouse; one of two hundred and eighty-two and threefourth acres, surveyed in the name of Joseph Mather; also, the two following tracts of land, situate in Somerset county, to wit: One of three hundred and eleven acres, surveyed in the name of Jonathan Yerkes; one of three hundred and forty acres, surveyed in the names of Joseph and Mary Paul, and to convey the same, whether sold together or in parcels by good and sufficient instruments of writing, to the purchaser or purchasers thereof, in fee simple, as fully and effectually as if the said mipors were of full age, and had conveyed the same, Provided,

That before the said John Paul, George Vaux Bacon, and Thomas C. Price, or the survivor or survivors of them shall make sale as aforesaid, they or he shall enter into bond or recogniz ance, with one or more sureties, in such sum, as the Orphan's court of the county of Philadelphia shall direct, conditioned for the faithful discharge of their or his duty, and the proper appli cation of the money arising from any sale or sales, made in pursuance of the authority hereby given..

Provided, That Proviso. such sale and conveyance, by changing the nature of the perty, shall not prejudice any person or persons, having an interest, in the proceeds, either as creditors of the said Alice

AN ACT

For improving the navigation of the Susquehanna river.

WHEREAS, By a supplement to an' act approved the twentyfifth day of March, Anno Domini, one thousand eight hundred and twenty-five, the sum of thirty thousand dollars is appropri ated to the improvement of the Susquehanna river: And whereas, Ten thousand eight hundred and seventy-eight dollars of the above appropriation has not been expended or drawn from the treasury of the Commonwealth: Therefore,

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That two thousand dollars of the said unexpended appropriation, is hereby transferred to the improvement of the Susquehanna above the mouth of the Sinnamehoning, in the following proportions and manner :-Five hundred dollars to that part of the river situate above the mouth of the Sinnamehoning creek, in Lycoming county, and extending to the mouth of Clearfield creek, in Clearfield county; and one thousand dollars is to be expended on that part of the river extending from the mouth of Clearfield creek to the Canoe place, in Cambria county; and the remaining five hundred dollars, is to be expended on the Clearfield branch of said river, from its mouth to the head of navigation thereof; and the following named persons are hereby appointed commissioners for the several sections aforesaid Thomas Reed, for that section of the river lying between the mouth of the Sinnamehoning and Clearfield creeks; Arthur Bell and John Mehaffy, junior, for that section of the river lying

between the mouth of Clearfield creek and Canoe place; Isaiah H. Warrick, for the Clearfield branch of said river-each of whom shall give bond, with good security, to the Common- To give bond, wealth, conditioned for the faithful discharge of his duty; and &c. the Governor is hereby authorized to draw his warrant on the State Treasurer, in favour of said commissioners, for the sums respectively mentioned, as soon as bond shall have been given and filed in the office of the Secretary of State as aforesaid.

SECTION 2. Each of the said commissioners shall, for his services, receive the sum of one dollar and twenty-five cents Compensato per day, to be paid by the county of Clearfield, on orders drawn and duties. by the commissioners of the county on the treasurer thereof, which said sum shall be his sole compensation, for every day necessarily spent by him in performing his duties as aforesaid; and the said commissioners shall proceed, with the least possible delay, in removing from their several sections such obstractions as they may deem most injurious to the navigation, and render, on oath, to the Auditor General, a statement of their accounts, within one year after the passage of this act.

SECTION 3.
