of the said statute: And whereas it duly appears to us, upon the oath of the said [constable], that the said [constable] hath used his best endeavours to levy the said sum on the goods and chattels of the said A. B. as aforesaid, but that no such distress can be had whereon to levy the same [or, by confession of the said A. B., or by the oath of a credible witness, that the said A. B. hath not goods and chattels within our jurisdiction whereon to levy the said forfeiture and costs]: These are therefore to command you, the said [constable] of aforesaid to apprehend the said A. B., and him safely to convey to the common gaol [or, house of correction] at in the said county or borough, and there to deliver him to the keeper thereof, together with this precept; and we also command you, the said keeper, to receive and keep in your custody the said A. A BILL To make Temporary Provision for the Treatment of Destitute Persons afflicted with Fever in Ireland. [Note.--The Words printed in Italics are proposed to be inserted in the Committee.] 5 W any 1. Central Board of Health to be appointed by Lord Lieutenant. HEREAS it is expedient to make more effectual provisions Preamble. for the treatment of destitute persons afflicted with Fever in Ireland; BE it Enacted, by The QUEEN's most Excellent MAJESTY, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in the present Parliament assembled, and by the Authority of the same, THAT it shall be lawful for the Lord Lieutenant of Ireland, by his warrant, to appoint so many persons as he may think fit, not being more in number than Five, as Commissioners of Health in Ireland; and such Commissioners shall serve without 10 salary, fee or reward; and the said Lord Lieutenant may from time to time, as he may see fit, remove any such Commissioner, and may in the stead of any Commissioner so removed, or who may refuse or decline to act, or become incapable of acting, appoint such other person as the said Lord Lieutenant may think proper; and the Com15 missioners so appointed shall act as a Board of Health for carrying into execution the provisions and purposes of this Act, in such manner and under such regulations as the Lord Lieutenant, or his Chief or Under Secretary, may from time to time appoiut. And be it Enacted, That it shall be lawful for the said Lord Lieute20 nant, from time to time, as he may see fit, to appoint, during the pleasure of the said Lord Lieutenant, for each and every Union for the relief of the destitute poor, a medical officer or medical officers, at such salary as he may direct. 127. And Expenses of Board of Health, and the Salary of the Medical Officer appointed by the Lord Lieutenant, to be paid by the Commissioners of the Treasury. 4. Board of Health may direct Guardians of Unions to And be it Enacted, That the expenses incident to the performance of the duties of such Board of Health, and the salary of every medical officer appointed as aforesaid by the Lord Lieutenant, shall be paid by the Commissioners of Her Majesty's Treasury, upon application to them by the said Lord Lieutenant in that behalf. And be it Enacted, That it shall be lawful for the said Board of Health, by writing under the hands of any 5 or more of them, from time to time to require the Board of Guardians of any Union for the relief of the destitute poor, to rent, hire or procure provide Fever a fitting house, building or rooms, other than the Workhouse of such 10 Hospitals and Dispensaries, Union, to be used as a Fever Hospital, for the purpose of receiving Medicines for and accommodating so many destitute poor persons affected with Out-patients. fever, as the said Board of Health may from time to time think and also 5. The Fever Hospitals and Dispensaries to be under the control of the Guardians of the Poor. 6. Expenses incurred under this Act, except the Salary of Medical Officer, to be paid out of the Poor's Rate. necessary, and to provide such nourishment, bedding, clothing, And be it Enacted, That, subject to the superintendence of the said Board of Health, every Fever Hospital and Dispensary, procured as aforesaid by the Guardians of any Union, shall be managed 30 by such Board of Guardians, and that destitute poor persons affected with fever may be admitted into such Fever Hospital under the authority of such Board of Guardians or their officers duly authorized by them, and not otherwise; and that the medical officer appointed as aforesaid shall be the medical officer of such Guardians for the 35 purposes of this Act. And be it Enacted, That the Poor Law Guardians of any Union for which a medical officer may have been appointed under the provisions of this Act, shall pay out of the rates raised or to be raised off such Union generally, under the authority of an Act passed in the second year of the reign of Her present Majesty, intituled, "An Act for the more effectual Relief of the destitute Poor in Ireland," or of any Act or Acts to amend the same, the cost of all medicine, nourishment, clothes, 40 5 clothes, bedding and other necessaries, and the rent of any Fever Hospital respectively provided as aforesaid, as well as the expense incurred in conveying any destitute poor person from his or her dwelling, or from elsewhere within such Union, to any such Fever Hospital, and in the maintenance of any such destitute poor person in such Hospital, and all other expenses of whatsoever kind (the salary of the medical officer or officers excepted), necessarily incurred in or incidental to the carrying out of the provisions of this Act within such Union. And be it further Enacted, That the said Board of Health shall, as 10 and when the Lord Lieutenant may require, make a report in writing to the said Lord Lieutenant, and shall transmit the same to the office of the said Chief Secretary, and shall in each such report give a full and particular account of all the proceedings of the said Board subsequent to the date of their last report, in such form as may be from time to 15 time directed by the said Lord Lieutenant, or by the said Chief or Under Secretary; and that whenever it shall, by any such report, or by any other means, appear to the satisfaction of the said Lord Lieutenant that any medical officer appointed, or Fever Hospital or Dispensary provided for any Union under the provisions hereof, is no 20 longer required in such Union, it shall be lawful for the said Lord Lieutenant, or for the said Chief or Under Secretary, by any letter under his respective hand, to signify to such Board of Health and to the Guardians and the said medical officer of such Union that they are no longer to exercise within such Union the powers given to them 25 by this Act, and thereupon all such powers shall cease and determine, and the salary of the said medical officer shall thenceforth cease. And be it Enacted, That in the construction of this Act all words importing the singular number or the masculine gender only shall be understood to include several matters as well as one matter, and 30 several persons as well as one person, and females as well as males; and that the words "Lord Lieutenant" shall apply to and include any Chief Governor or Chief Governors of Ireland for the time being, unless it be otherwise and specially provided, or there be something in the subject or context repugnant to such construction. 7. Board of Health to report to the Lord Lieu and their powers shall cease upon his order to that effect. 8. Interpretation Clause. 9. 35 And be it Enacted, That this Act shall continue and be in force until the First day of the month of September in the year One thousand eight hundred and Forty-seven, and no longer.
