An Act to make perpetual certain Temporary or War Duties of Customs, on the Importation into Great Britain of Goods, Wares and Merchandize, and to repeal fo much of several Acts paffed in the Forty seventh, Forty ninth and Fifty first Years of the Reign of His prefent Majefty, as charge any Loans made for the Service of the Years One thousand eight hundred and seven, One thousand eight hundred and nine, and One thoufand eight hundred and eleven, upon the War Duties of Customs or Excife, and to charge fuch Loans on the Duties of Cuftoms made perpetual. [21st May 1816.]

WHEREAS an Act paffed in the laft Seffion of Parliament, 55 G.3.c.33intituled An Act to continue, until the Fifth Day of July One thousand eight hundred and fixteen, certain Temporary or War Duties of Customs on the Importation into Great Britain of Goods, Wares ⚫ and Merchandize, whereby certain Duties of Customs therein de' scribed were continued until the Fifth Day of July One thoufand ' eight hundred and fixteen: And Whereas it is expedient that the faid Duties fhould be made perpetual;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That the Temporary or War Duties of Customs on the Importation into Great Britain of Goods, Wares and Merchandize, which were by the faid recited A&t of the laft Seffion of Parliament continued until the Fifth Day of July One thousand eight hundred and fixteen, fhall be and the fame are hereby made permanent and perpetual.

And Whereas an Act paffed in the Forty feventh Year of the Reign of His prefent Majefty, intituled An Act for charging the Sum of Twelve Millions, Part of the Loan of Twelve millions two bundred thousand Pounds, raised for the Service of Great Britain for the Year One thoufand eight hundred and feven, upon the Duties of Cuftoms and Excife granted to His Majefly during the Continuance of the prefent War, and for certain Periods after the Ratification of a Definitive Treaty of Peace; and for providing a Sinking • Fund for the Redemption of the Stocks or Funds thereby created;

of a Definitive Treaty of Peace; and another A& paffed in the Fifty firft Year of the Reign of His present Majefty, intituled An Aa for charging the Sum of Seven millions five hundred thousand Pounds, raifed for the Service of Great Britain for the Year One thoufand eight hundred and eleven, upon the Duties granted to His Majefty during the Continuance of the prefent War, and for certain Periods after the Ratification of a Definitive Treaty of Peace: And Whereas by the faid refpective Acts certain Loans made for the Services of the Years One thousand eight hundred and feven, One ⚫thoufand eight hundred and nine, and One thousand eight hundred and eleven refpectively, and in the faid recited Acts refpectively fpecified, are charged upon the feveral Duties of Customs and Excife which were granted during the Continuance of the late War for ⚫ certain Periods after the Ratification of a Definitive Treaty of Peace by feveral Acts of the Forty third, Forty fixth, and Forty feventh Years of the Reign of His prefent Majefty, in the faid laft recited Acts of Parliament of the Forty feventh, Forty ninth and Fifty first years refpectively particularly recited and fet forth : And Whereas it is expedient that the fame fhould be repealed;' Be it therefore enacted, That so much and fuch Parts of the faid feveral recited Acts of Parliament of the Forty seventh, Forty ninth, and Fifty first Years refpectively, as charge the faid Loans therein refpectively fpecified upon the faid feveral Duties of Customs and Excife which were granted during the Continuance of the late War, and for certain Periods after the Ratification of a Definitive Treaty of Peace, shall be and the fame is and are hereby repealed.

III. And be it further enacted, That all the Monies arifing by the Duties of Cuftoms by this Act made perpetual, the neceffary Charges of raifing and accounting for the fame excepted, fhall be carried to and made Fart of the Confolidated Fund of Great Britain, and shall be deemed an Addition to the Confolidated Fund of Great Britain for the Purpose of defraying the Charges occafioned by the faid feveral Loans made for the Services of the faid Years One thoufand eight hundred and feven, One thousand eight hundred and nine, and One thoufand eight hundred and eleven refpectively, and shall be deemed to be a Provifion for defraying the annual Charges occafioned by the faid Loans refpectively, in lieu and inftead of the Provifions made for that Purpofe by the faid recited Acts of the Forty feventh, Forty ninth, and Fifty firft Years of His Majesty's Reign refpectively.

IV. And be it further enacted, That this Act, or any of the Provifions thereof, may be altered, varied or repealed by any A&t or Acts of Parliament to be paffed in this Seffion of Parliament.

CAP. XXX.

An Act for indemnifying the Commiffioners of Excife in Scot-
land, and all Perfons who may have acted under their
Authority, in relation to certain Orders iffued and Things
done relative to certain Acts regarding the Distilleries in
Scotland.

WHEREAS an Act was paffed in the Twenty fifth Year of

the Reign of His prefent Majefty, intituled An A& for repealing fo much of an A& made in the laft Seffion of Parliament as • relates

relates to the Diftillation of Corn Spirits in fmall Stills in certain Counties or Districts of the Highlands in that Part of Great Britain called Scotland; and for authorizing the Commiffioners of Excife in 'Scotland to grant Licences to Perfons living in the faid Counties or Diftrias to diftil Spirits from Barley, Bear or Bigg, the Growth of the faid Counties, and for impofing a Duty on fuch Licences: And 'Whereas another Act was paffed in the Thirty third Year of the 33 G. 3. c. 61. Reign of His prefent Majefty, intituled An A&t for the Regulation

another Act was paffed in the Thirty ninth and Fortieth Years of 39 & 40 G. 3. the Reign of His present Majefty, intituled An A& for repealing the Duties of Excife on Diftilleries in Scotland, and on the Exportation of British made Spirits from England to Scotland, and for granting other Duties in lieu thereof; and for altering, amending and continuing certain Acts of Parliament for the Regulation of Diftilleries in Scotland; by which feveral Acts Regulations were 'made relative to Stills and Diftillers in certain Districts of Scotland diftinguifhed from each other by Boundaries in the faid Acts re

of the Duties payable in Scotland upon Distillers' Wafb, Spirits and Licences, impofed by an A&t of the Fifty fourth Year of His prefent Majefty, and for enabling His Majefty, by Order in Council, to modify the Operations of the faid Act, or reduce the Duties thereby impofed: And Whereas Doubts have been entertained whether the Diftinction of Lowland, Highland and intermediate Districts as described by the Boundary Lines in any of the faid Acts made in the Twenty fifth, Thirty third, Thirty feventh and Thirty ninth and Fortieth Years refpectively of His Majefty's Reign, were abolished by the faid Two laft mentioned Acts of the Fifty fourth and Fifty fifth Years of His Majefty's Reign refpectively, or were 'till to be continued and obferved; and by reafon thereof Questions have arifen whether Spirits could pafs from any one Part to any 'other Part of Scotland: And Whereas the Commiffioners and Officers of the Excife in Scotland may have given Directions and 'iffued or refused Permits, and done other Acts, Matters and Things in relation to the faid recited Acts and to the Distilleries in Scotland which might be deemed unlawful, and Doubts might 'arife whether fuch Commiffioners and Officers might not be subject to Suits and Actions by means thereof; and it is therefore neceffary that fuch Commiffioners and Officers, and all Perfons acting under G 3 their

their Authority or by their Direction, fhould be indemnified in relation thereto;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That all Commiffioners and Officers of Excife in Scotland, and all Perfons acting under their Authority, or by their Direction, or in pursuance of any Orders or Inftructions given by any fuch Commiffioner or Officer in relation to the Distilleries in Scotland, or any of the Provifions of any Act or Acts of Parliament relating to the Distilleries of Scotland, or the regulating and collecting any Duties of Excife in refpect of such Distilleries, fhall be and are hereby indemnified for and in respect of all fuch Orders, Inftructions, Directions, Acts, Matters and things, as the faid Commiffioners of Excise, or any Person or Perfons acting bona fide under their Directions or by their Authority, may have given, executed or done in reference to the faid recited Acts; and that no fuch Commiffioner or Officer of Excise or Person aforefaid shall be liable to any Action or Actions, Suits, Indictments or Informations, in confequence of any fuch Orders, Inftructions or Directions, or Acts, Matters or things, which shall have been fo done as aforefaid; and in cafe any Action, Suit, Indictment or Information, fhall have been or fhall be commenced or profecuted against any fuch Commiffioner or Officer of Excife, or Perfon aforefaid, by reafon of any fuch Orders, Inftructions or Directions, or A&s, Matters or things as aforefaid, fuch Commiffioner, Officer or Perfon may plead the General Iffue, and give this Act and the Special Matter in Evidence, and shall in every such case, if the Verdict shall be for the Defendant, recover Treble Cofts of Suit.

II. And be it enacted, That it shall and may be lawful for the faid Commiffioners of Excife, and they are hereby empowered to iffue Directions for the granting of Permits to any Person or Perfons for the carrying or transferring of Spirits from any Part or Parts of the Highlands of Scotland to the Lowlands of Scotland, pursuant to and in Fulfilment of any Contract which shall be proved to the Satisfaction of the faid Commiffioners of Excife to have been made and entered into previous to the First Day of February One thousand eight hundred and fixteen.

CAP. XXXI.

An Act for transferring all Contracts and Securities entered
into with or given to the Commiffioners for Transports to
the Commiffioners of the Navy and Victualling.

WHEREAS by a Commiffion or Letters Patent paffed under

the Great Seal of the United Kingdom of Great Britain and "Ireland, bearing Date at Weftminfler, the Fifteenth Day of Septem"ber One thoufand eight hundred and thirteen, Sir Ruper George Baronet, James Bowen Efquire, John Douglas Efquire, John Har nefs Doctor of Phyfic, Courtnay Boyle Efquire, and John Forbes Efquire, were conftituted and appointed Commiffioners, during His Majefty's Pleafure, for conducting the Transport Service, and also for the Care of fick and wounded Seamen, as well as for the • Care and Cuftody of Prisoners of War: And Whereas it is expe• dient

dient that if His Majesty should be pleased to cancel or revoke the faid Letters Patent, all Properties, Eftates, Rights and Contracts now vefted in the faid Commiffioners, or their Afsigns, on Behalf of His Majefty, fhould be preferved and conveyed over to fuch other Commiffioners or Perfons as His Majefty may be pleased to appoint in that Behalf;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That if His Majefty fhall be pleafed by any Commiffion or Letters Patent to cancel and revoke the faid Commiffion or Letters Patent bearing Date the faid Fifteenth Day of September One thoufand eight hundred and thirteen; and by any other Commiffion, Letters Patent or Order in Council, hereafter to be made, to grant, transfer or commit all or any of the Powers, Authorities and Rights now vefted in the faid Commiffioners, relating to or fo far as they may relate to the Conduct and Management of the Transport Service, or other Service refpecting the Employment of Ships or Veffels in any other Department of His Majefty's Government, or any thing relating thereto, to the principal Officers and Commiffioners of the Navy, that from and after fuch Revocation, and fuch further Grant, by His Majesty, all Contracts, Covenants and Agreements made and entered into between the faid Commiffioners for conducting the Transport Service, or any Perfon on their Behalf, and any other Perfon or Persons whom. foever, for the Hire of Transport Ships and Veffels, or for any other Purpofe connected with the Tranfport Service, or other Services above mentioned, or in any manner relating thereto; and all Bonds and other Securities entered into by any Perfon or Perfons for the due Performance of fuch Contracts, Covenants or Agreements, or for the doing or performing of any other Act, Matter or thing whatsoever, relating to the faid Transport and other Services, fhall be vested in and transferred to the faid principal Officers and Commiffioners of the Navy, and shall continue in force in like manner, to all Intents and Purposes, as if the fame Contracts, Covenants and Agreements, Bonds and other Securities, had been entered into with the Commifhoners of His Majefty's Navy, or any of them.
