lations, Restrictions, Penalties and Forfeitures as in and by the faid recited A&ts, or either of them, are expreffed and contained of and concerning the Shares created by virtue thereof, and now vefted in the feveral and refpective Proprietors of and in the faid Undertaking; and the Admiffion of all and every Perfon and Perfons to any fuch new Share or Shares, by any Order or Refolution of the faid Company, or their Court of Directors, fhall be and be deemed to be a good and effectual Title to fuch Perfon or Perfons, and his, her or their refpective Executors, Adminiftrators or Affigns, on his, her or their paying to the faid Company, or their Treasurer or Treasurers for the time being, the Sum or Sums of Money required to be paid for fuch Shares refpectively, within the time limited in fuch Order or Refolution for that Purpose: Provided always that no Perfon shall be entitled to vote at any General or Special Meeting of the faid Company, in respect of any Shares created by virtue of this Act, until he or the fhall have been poffeffed thereof for the Space of Three Calendar Months.

IV. V. VI. And be it further enacted, That it fhall be lawful for the faid Company, and they are hereby fully authorized and empowered, in fuch cases as to them fhall feem meet and convenient, to carry, fit up and furnish any Pipe or Pipes, Cocks or Branches, or other neeffary Apparatus, from any main Pipe laid in any Street, Highway, Road, Lane, Paffage or Place by the faid Company, by virtue of the faid recited Acts or this Act, or any or either of them, in, to or through any Dwelling Houfe or Houfes, Manufactories, public or private Buildings, for the Purpofe of lighting the fame, or any public or private Lamp, from any fuch Main, with the Confent of the Owner or Occupier of fuch Dwelling Houfe or Houfes, Manufactories, public or private Buildings, but not otherwife: Provided always, that the faid Company, in carrying into Execution the Power hereby granted, in refpect of fitting up any fuch Dwelling Houfes, Manufactories, public or private Buildings, fhall employ or appoint fuch Manufacturers of, or Dealers of the Materials to be ufed, as to the faid Company shall seem meet and proper, and fuch Manufacturers or Dealers fhall execute the fame under and subject to the Superintendance, Controul and Direction of the faid Company: : Provided alfo, that the faid Company fhall not, on any Account or upon any Pretence whatever, employ or fet to work, in fitting up any fuch Dwelling Houfes, Manufactories, public or private Buildings, any Workman or Servant or any other Perfon in the Pay or Employ of the faid Company; nor fhall the said Company themselves manufacture, fell or vend any of the Materials requifite, except Stop Cocks and Burners, nor directly or indirectly take or derive any Emolument, Advantage or Profit from fuch Works, upon pain of forfeiting for every Offence the Sum of Fifty Pounds, with full Cofts of Suit, to the Party who fhall fue for the fame, to be recovered by Action of Debt or on the Cafe, Bill, Plaint, Suit or Information, in any of His Majesty's Courts of Record at Westminster, in which no Effoin, Protection, Wager of Law, nor more than one Imparlance, fhall be allowed.

VII. VIII. And be it further enacted, That it fhall not be lawful to Reftrictions reor for the faid Company, or any Perfon or Perfons acting by or specting breakunder their Authority, to break or take up, or cause to be broken ing up Paveor taken up, any of the Pavements or Ground in any of the Streets, Roads or public Places within the Cities of London and Weftminster, the Borough of Southwark, and the Suburbs, Precincts and Liberties thereof respectively, for the Purpose of making or laying down or repairing any Main or Mains of Pipes, or any Pipe or Pipes, or of altering the Pofition of or repairing any Pipes, Stop Cocks, Valves or Syphons, or other Works, or for any other Purpose,

unless Notice in Writing of their Intention to break or take up fuch Notice of breakPavement or Ground, figned by the Principal Clerk or Secretary, up Pavement, or Inspector or Surveyor to the faid Company, fpecifying the Street, &c. Road or public Place, and the particular Part of fuch Street, Road or public Place in which fuch Pavement or Ground is intended to be broken or taken up, fhall have been given to a Surveyor of the Pavements or Roads for the time being, (duly appointed and notified in pursuance of any Act of Parliament now or hereafter in force for that Purpose,) of the parochial or other District or Place wherein fuch Street, Road or public Place, the Pavement, Ground or Soil whereof is fo intended to be broken or taken up fhall be fituate, or fhall have been left for him at his Dwelling House or Office within fuch parochial or other District or Place, for the Space of Three Hours at the least, before fuch Pavement or Ground or any Part thereof shall be so broken or taken up, except in all cafes of fudden Emergency, in which fuch Notice as aforefaid shall be given to fuch Surveyor of Pavements or Roads as foon as poffible after fuch Pavement or Ground, or any Part thereof, shall be broken or taken up; and that the said Company shall not break or take up or difturb or cause to be broken or taken up or disturbed, the Pavement or Ground in any Street, Road or public Place within the Limits aforefaid, for the Purpofe of laying down any Mains or Pipes, except service Pipes of a Diameter not exceeding One Inch in the Bore, without the Consent in Writing of the Commiffioners or Trustees or other Perfons having the Controul of the Pavements or Roads, Ground or Soil, in any parochial or other District or Place, fignified under the Hand or Hands of their Clerk or Clerks, or other proper Officer or Officers, firft obtained; and that if the faid Company, or Company breakany Person or Persons acting by or under their Authority, fhall break ing up Paveor take up, or cause to be broken or taken up, any of fuch Pavement ment without or Ground without fuch Notice being given or left as aforefaid Notice, &c.

(except as aforefaid), or fhall break or take up, or difturb or cause to be broken, taken up or disturbed, any of such Pavement or Ground, for the Purpose of laying down any Mains or Pipes (except fervice Pipes as aforefaid) without fuch Confent as aforefaid, then and in every fuch case the said Company fhall forfeit and pay to the Commiffioners or Trustees or other Perfons having the Controul of the Pavements or Roads within the parochial or other District or Place in which fuch Pavement or Ground fo broken or taken up or difturbed fhall be fituate, or to their Treasurer, Clerk or Surveyor, or to fuch other Perfon as they may appoint, the Sum of Twenty Pounds for every fquare Foot of Pavement or Ground which fhall be fo broken or taken up without fuch Notice or Confent as aforefaid, to be recovered with full Cofts of Suit, in any of His Majesty's Courts of Record at Westminster, by Action of Debt, or on the Cafe, Bill, Plaint, Suit or Information, wherein no Effoin, Protec tion, Wager of Law or more than One Imparlance fhall be allowed: Provided always, that the faid Company shall not be fubject or liable to the Payment of more than one Penalty, or to more than one Action, Suit or other Proceeding in refpect of any one Offence committed, whether by virtue of this Act, or any other A&t or Acts of Parliament, now or hereafter in force, any Law, Statute, Ufage or Cuftom to the contrary thereof in any wife notwithstanding.

IX. And be it further enacted, That whenever and fo often as the faid Company fhall have lawfully broken up or removed the Stones, Ground, Soil or Pavement, in or of any Street, Road, Highway or public Place, or any Part thereof, the faid Company shall and they are hereby required immediately then after to reinftate and make good fuch Ground, Soil or Pavement, in as good found State and Condi tion as the fame was or were in at the time of being so broken up, to the Satisfaction of the Surveyor of the Commiffioners or Trustees of such Pavement, Soil or Ground respectively; and the faid Company fhall carry away all furplus Earth, Filth and Rubbish occa fioned thereby, at their own Cofts and Charges; and that during the Works of the faid Company, and reinftating fuch Ground, Sou or Pavement as aforefaid, the faid Company fhall provide proper Watchmen, with neceffary Lamps, and otherwife fecure and guard the faid Works, fo as to prevent any Damage or Inconvenience Company not re- happening to Paflengers, Cattle or Carriages; and in cafe the faid Company fhall neglect and make Default in making good and rein ftating fuch Ground, Soil or Pavement as aforefaid, within Twenty four Hours next after Notice given to or left for the faid Company at their Houfe or Office, it shall be lawful for the faid Commiffioners or Trustees to reinftate and make good fuch Ground, Soil or Pave ment; and the Charges and Expences thereof fhall be reimbursed and repaid by the faid Company, or their Treasurer, to the faid Commiffioners or Truftees, or their refpective Treasurer; and in Default of Payment thereof within Seven Days next after Demand thereof in Writing fhall have been made by the Clerk of the faid Commiffioners or Trustees, fuch Sum or Sums of Money fo paid by them shall and may be recovered of and from the faid Company or their Trea furer, Clerk or Agent, by Action of Debt, in any of His Majesty's Courts of Record at Westminster; and in which Action or Actions, no Effoin, Protection or Wager at Law, or more than one Imparlance, shall be allowed.

X. And be it further enacted, That if any Perfon or Perfons Destroying fhall wilfully and malicioufly, and to the Prejudice of the faid Com- Works. pany or of their Undertaking, break, throw down, deftroy, take away, damage or injure any or any Part of any Pipe, Trunk, Valve, Syphon, Machine, Erection or Building laid, placed, erected or fet up by the faid Company, by virtue of the faid recited Acts and this Act, or either of them, for the Purpofe of carrying into Execution the feveral Powers and Authorities given to and vefted in the faid Company, every fuch Perfon fhall be adjudged guilty of Felony; and every fuch Perfon fo offending, and being thereof lawfully convicted, fhall be fubject to the like Punishment and Penalties as in cafes of Grand Larceny; and the Court by or before Punishment. whom fuch Person shall be tried and convicted, shall have Power and Authority to caufe fuch Perfon to be punished in like manner as Felons are directed to be punished by the Laws and Statutes of this Realm; or in Mitigation of fuch Punishment, fuch Court may award fuch Sentence as the Law directs in cafes of Petty Larceny. XI. And be it further enacted, That the Court of Directors of the faid Company shall, and they are hereby required, within One Calendar Month after every Half Yearly General Meeting of the faid Company, or oftener if required by the Right Honourable the Secretary of State for the Home Department for the time being, to tranfmit to the faid Secretary of State a Report in Writing, figned by the Governor, Deputy Governor or one of the Directors leaft. of the faid Company, of the State of the faid Company and of their Works, and the Means poffeffed by the faid Company for fecuring the Continuance of their Operations, and fuch other matters relating to the Works and Proceedings of the faid Company as the faid Secretary of State fhall from time to time require.

XII. And be it further enacted, That all the Stations and Works of the faid Company shall be open at all convenient times for the Infpection and Examination of fuch Perfon or Perfons as the faid Secretary of State for the Home Department for the time being fhall appoint from time to time for that Purpofe; and the faid Company fhall, and they are hereby required, to conform to fuch Regulations and Proceedings in the feveral Parts of their Works and Operations, as well in refpect of thofe already erected or executed, as of fuch as fhall hereafter be erected and executed, as the faid Secretary of State fhall confider neceffary and proper, and fhall direct to be adopted, for the better and more effectually lighting the several Parts of the Metropolis and the Suburbs, Liberties and Precincts thereof, where the Mains and Pipes of the faid Company fhall lie, and for more effectually fecuring a proper and permanent Supply of Gas for lighting the public Lamps therein, and for affifting and advancing the Benefits to be derived from an active and efficient Police, and for fuch other Purposes as to the faid Secretary of State fhall feem meet and proper for the Advantage of the Public.

XIII. And be it further enacted, That all the Powers, Authorities, Provifions, Regulations, Directions, Privileges, Penalties, Forfeitures, Claufes, Reftrictions, matters and things whatsoever contained in the faid recited A&ts, fo far as the fame were in force at the time of paffing this Act, and fo far as the fame are not exprefsly altered or repealed by this A&t, shall extend and be conftrued
