An Act for eftablishing and regulating a Fund for the Widows,
Children and Relatives of Officers or Perfons belonging to the De-
partment of Customs in England.
[22d June 1816.]

WHEREAditional Benefit and Relief of the Widows and

WHEREAS the Eftablishment and Regulation of a Fund for

• Children or other Relatives of the established Officers, Clerks or other Perfons employed in the Department of the Cuftoms in • England would be highly beneficial; but the fame cannot be effect ually made without the Aid of Parliament;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, Certain Officers That all the established Officers, Clerks and other Perfons permanently employed in the Department of the Customs in the Port of London, who fhall have figned a Notice in the Form in the Schedule to this A&t annexed, marked A., fignifying that they accede to the Con tribution of Poundage authorized by this Act, in aid of the general Purposes of the Cuftoms Annuity and Benevolent Fund, and thall have delivered fuch Notice to the Perfon to be appointed by the Commiffioners of the Cuftoms to receive the fame, fhall meet on fome Day and at fome Time and Place to be appointed for that Purpote by the Commiffioners of the Customs, and which the faid Commiffioners of the Customs, or any Four or more of them, are hereby required to appoint within Fourteen Days after the paffing of this Act, and to cause Seven Days' Notice to be given of fuch Day, Time and Place, in fuch manner as they fhall deem expedient and fufficient; and the fenior Officer in the Department prefent at fuch Meeting shall be the President and Chairman of fuch Meeting, and have the cafting Voice in cafe of Equality of Votes at fuch Meeting; and the Officers and Perfons prefent at fuch Meeting shall elect and nominate Twelve Perfons fuperintending in the faid Department, or being Principals of Offices, and not being Clerks, as a Committee for the Formation of the Cuftoms Annuity and Benevolent Fund; which faid Committee shall elect and nominate a Prefident or Chairman, and fhail forthwith proceed to confider and make and arrange fuch Rules and Regulations for the Establishment and Formation of a Fund for the Benefit of the Widows and Children or other Relatives of the Estab lifhed Officers, Clerks other Perfons belonging to or employed in the Department of the Cuftoms in England, and the regulating the Conduct and Management of the faid Fund, and raifing, collecting and receiving the Subfcriptions and Contribution of Poundage neceffary for forming fuch Fund, and paying all Annuities and Claims thereout, and making Tables of Rates of Subfcription to and Pay ments out of fuch Fund for that Purpose, and alfo the Number and Defcription of Directors, Truftees, Auditors, Secretary or other Officers neceffary for managing and conducting the faid Fund, and the Collection and fafe Cuftody of the Monies from time to time to be raised and subscribed, and the Intereft and growing Produce arifing therefrom, and paying all Sums to be paid thereout according to fuch Rules, Regulations and Tables; and it fhall be lawful for the Rules to fpecify faid Committee in fuch Rules and Regulations to specify the refpective

Powers, Authorities and Duties of fuch Directors, Trustees, Auditors, Secretary or other Officers refpectively, and the Mode of appointing new Director, Trustee, Auditor, Secretary or other Officer, to fupply any Vacancies or otherwife; and all Questions which may arife at any fuch Meeting of the faid Committee fhall be decided by the Majority of Perfons prefent at the Meeting; and in cafe of Equality of Votes, the Prefident or Chairman, or in case of his Abfence the Officer or Perfon appointed by him to be his Deputy at fuch Meeting of the Committee, fhall have the cafting and fecond Vote.

II. III. And Whereas it is expedient that the Rules, Regulations and Tables of Rates of Subfcription of the Cuftoms Annuity and Benevolent Fund fhould be published as speedily as poffible to the Officers, Clerks and other Perfons employed in the Department of the Customs in London and in the Out Ports, and Creeks and Places attached thereto;' Be it therefore enacted, That within Fourteen Days at the fartheft after the said Rules, Regulatious and Tables of Rates of Subfcription shall have been ratified and confirmed as aforefaid, the Commiffioners of His Majelty's Customs, or any Four or more of then, fhall and they are hereby required to cause the fame to be made public, for the Information of all established Officers and Perfons belonging to or in the Employment of the Department of Customs under their Controul and Superintendance, in fuch manner as they fhall fee fit, and for that Purpose to communicate or caufe to be communicated the fame to the Collector and Comptroller of each and every of the Out Ports, with fuch Directions as they fhall think fit, for the making the fame public as aforefaid; and the said Collectors and Comptrollers are hereby authorized and required, within fuch Periods as fhall be specified for that Purpose, to communicate and make public the fame to all Officers, Clerks and other Perfons, at their refpective Ports, and the Creeks and Places attached

thereto.

IV. And be it further enacted, That a Contribution of Poundage Two pence in in aid of the general Purposes of the Customs Annuity and Bene- the Pound for volent Fund shall be raised, levied and collected, in the Port of London, in the Eight Quarters, and remitted from the Out Ports in fuch manner, and by fuch Perfons Pound for every as the Rules and Regulations, approved and ratified as aforefaid, fhall fucceeding authorize and direct, either by Deduction or otherwife, out of the Quarterly ettablished and incidental Salaries due and payable to all the Officers, Clerks or other Perfons of every Rank, Situation or Denomination whatfoever, who fhall not fignify that they decline 56 GEO. to make fuch Contribution, in manner directed by this A&t; and fuch Contribution shall be affeffed for the firft Eight Quarters, to be reckoned from the Commencement of fuch Contribution, or thenceforth from the First Affeffment of every Officer, Clerk or other Perfon as aforefaid, appointed after the paffing of this Act, to the faid Department of Cuftoms, in refpect of whom the faid Contribution of Poundage is hereby declared to be, and thereafter to continue to be compulsory, at the Rate of Two pence in every Pound Sterling, and in every fractional Part of a Pound Sterling, and for every fucceeding Quarter, the Sum of One Penny in every Pound Sterling, and in every fractional Part of a Pound Sterling: Provided alfo, that nothing in this A&t contained fhall extend, or be conftrued to extend, to authorize the taking any fuch Contribution of Poundage out of the Day Pay Allowance of any Perfon or Perfons whatever, employed in the Department of the Customs, or to the Salary or Sum awarded by way of Compenfation or Superannuation to any Officers, Clerks or other Perfons, who belong or may have belonged to the faid Department; and the First Contribution fhall be railed, levied, collected and deducted out of the Salaries payable at the Quarter next enfuing and immediately after the Ratification and Confirmation of fuch Rules, Regulations and Tables, as aforefaid; and all fuch Money, which fhall be fo collected, shall be paid over to fuch Perfon or Perfons, or to fuch Account as fhall be specified in fuch Rules and Regulations, in relation to Contribution of Poundage to fuch Fund; and thereafter all fuch Contribution to fuch Fund fhall be raised, collected, paid over, laid out, accounted for and applied according to fuch Rules and Regulations.

V. And Whereas certain Officers, Clerks or other Persons who may have belonged to the faid Department, before the paffing of this Act, may object to the faid Quarterly Contribution of Poundage;' Be it therefore enacted, That every Officer, Clerk or other Perfon who may object and decline to make fuch Quarterly Contribution of Poundage fhall and is hereby required to give Notice thereof in the Form in the Schedule to this A&t annexed, marked B., which Notice fhall be figned by him; and if the faid Officer, Clerk or other Perfon fhall be employed in the Port of London, he fhall addrefs the faid Notice to the Secretary or other Officer of the faid Fund appointed to receive the fame, within One Calendar Month at the fartheft after the Rules, Regulations and Tables of Rates of Subfcription fhall have been approved and ratified as aforefaid; and if the faid Officer, Clerk or other Perfon fhall be employed at an Out Port, or Creek, or Place attached thereto, he fhall addrefs the faid Notice to the Collector or Comptroller at the Out Port to which he fhall or may be attached, within Two Calendar Months at the fartheft after the Rules, Regulations and Tables of Rates of Subfcription fhall have been approved and ratified as aforefaid, which Notice the Collector and Comptroller, fo receiving the fame as aforefaid, fhall forthwith tranfmit to fuch Secretary, or other Perfon as aforefaid; and in Default of fuch Notice being fo duly given by fuch Officer, Clerk or other Perfon either in London or the Out Ports, he fhall be deemed, and adjudged to be, and thereafter to continue liable to fuch Quarterly Contribution of Poundage to the faid Fund as aforefaid.

VI. And be it further enacted, That every Officer, Clerk or other Perfon fo giving Notice, and declining the faid Quarterly Contribution

VIII. And be it further enacted, That the faid Directors fhall and Directors may may, if they fhall deem it expedient, admit any Perfon to be a Subfcriber, and to participate in the Benefits of the faid Fund, who hold the Situation of a Supernumerary Officer or Clerk in the faid Department; and the refpective Nominees of every Supernumerary Officer, Clerk or other Person so admitted as aforefaid, shall, and are hereby declared to have, and thereafter to continue to have, to all Intents and Purposes, the fame and the like Intereft in the faid Fund, and in the Advantages thereof, as if the faid Supernumerary Officer, Clerk or other Perfon had been permanently established in the said Department, under and fubject in every respect to the Rules, Regulations and Tables of Rates of Subfcription approved and ratified as aforefaid.

IX. And be it further enacted, That the faid Directors fhall and may, if they fhall deem it expedient, admit any Perfon or Perfons to be the Nominee or Nominees of any Subfcriber to the faid Fund who may not be a Relative or Relatives of the faid Subfcriber; and the faid Nominee or Nominees fo admitted as aforefaid fhall, and are hereby declared to have, and thereafter to continue to have, to all Intents and Purposes, the fame and the like Intereft in the faid Fund, and in the Advantages thereof, as if the faid Nominee or Nominees had been a Relative or Relatives of the said Subscriber, under and fubject in every refpect to the Rules and Regulations approved and ratified as aforefaid.

X. And be it further enacted, That an Order for Payment of Money addressed to the Receiver General of His Majefty's Cuftoms, or to the Collector and Comptroller of any Out Port for the time being, by any Officer, Clerk or other Perfon employed in the faid Department, and under his Hand and Signature, fhall be a fufficient Order, Warrant and Authority to the faid Receiver General, and Payment. Collector and Comptroller, and who are hereby thereupon required to pay, from time to time, the Sum declared and specified in Words at length in fuch Order, as the Quarterly Amount of Subfcription, or the Amount of other Monies due and owing by the faid Officer, Clerk or other Perfon, to and on the behalf of the faid Fund; and the faid Sum, fo declared and specified in fuch Order, shall be deducted from the Salary due and payable to the faid Officer, Clerk or other Perfon at the Quarter or Quarters as fet forth in the faid Order, and Thall be paid over to fuch Perfon or Perfons, or to fuch Account as shall be specified in fuch Rules and Regulations, approved and ratified as aforefaid; provided that the faid Order or Orders fhall be delivered to the faid Receiver General, Collector and Comptroller, Three Days 3 E 2
