Wharf Measure.

XXXI. And be it further enacted, That the Vender or Venders Venders to deof, or Dealer or Dealers in Coals, fold and fent as and for Wharf liver Tickets of Measure, from any Ship, Veffel, Lighter, Barge or other Craft, or Coals fold by from any Wharf, Warehouse or other Place within the faid Port of London, or within the faid refpective Cities of London or Weftminster, or the refpective Liberties thereof, or within fuch Part or Parts of the faid refpective Counties of Middlefex, Surrey, Kent or Effex, as is or are fituate within the Distance of Twenty five Miles from the Royal Exchange, and to be delivered to the Purchafer or Purchasers thereof from any Cart, Waggon or other Carriage, fhall, and he and they is and are required to deliver or cause to be delivered, a printed Ticket or Paper, and fuch Carman, Driver, or other Perfon fhall and is required to deliver or caufe to be delivered, the fame Ticket so received from fuch Vender to the Purchaser or Purchasers of fuch Coals, or to his, her or their Servant or Servants, before any Part of the Coals contained in fuch Cart, Waggon or other Carriage, fhall be fhot or delivered therefrom, and every such Ticket or Paper shall be in the Words and Form following:

And in cafe any fuch Vender or Venders fhall not deliver, or caufe Vender not deto be delivered, fuch Ticket as aforefaid to the Purchaser or Pur- livering Ticket. chafers of fuch Coals, or to his, her or their Servant or Servants before any Part of fuch Coals fhall be shot or delivered from fuch Cart, Waggon or other Carriage, every fuch Vender or Venders shall, for every fuch Offence, forfeit and pay any Sum not exceeding Twenty Pounds; and in cafe the Carman, Driver of or other Perfon Penalty. attending fuch Cart, Waggon or other Carriage, laden with Carman not defuch Coals aforefaid, to whom fuch Ticket fhall have been given by Ticket to Purlivering fuch or by the Direction of the Vender, in order to be delivered to the Purchafer, fhall (having fo first received the fame from the Vender or any Perfon by the Vender's Orders) refuse or neglect to deliver fuch Ticket as aforefaid to the Buyer or Buyers of fuch Coals, or

Provided always, and be it further enacted, That the Carman or Driver of any Cart, Waggon or other Carriage laden with Coals for Sale, or to be delivered to the Purchaser or Purchafers thereof by the Vender or Venders, or Dealer or Dealers in fuch Coals, from any Ship, Lighter, Barge or other Craft, or from any Wharf, Warehouse or other Place within the faid Port of London, or within the faid refpective Cities of London and Westminster, or the refpective Liberties thereof, or within fuch Part or Parts of the refpective Counties of Middlefex, Surrey, Kent and Effex, as is or are fituate within the Diftance of Twenty five Miles from the Royal Exchange aforefaid, fhall, and he is hereby directed to meafure gratis, if he fhall be required fo to do, the Coals contained in any one of the Sacks contained in fuch Cart, Waggon or other Carriage, which may be chofen by the Purchaser or Purchasers of the faid Coals, or his or their Servant or Servants, or other Perfon or Perfons acting on the behalf of fuch Purchaser or Purchasers, with fuch Bufhel Measure as aforefaid, in order that fuch Purchaser or Purchafers may be better enabled to judge of the Neceflity of having the whole of fuch Coals remeasured in manner directed by

this Act.

And be it further enacted, That if any Carman or Driver of any Cart or Waggen or other Carriage laden with Coals for Sale, or to be delivered to the Purchaser or Purchafers by the Vender or Venders of, or Dealer or Dealers in fuch Coals, from any Ship, Veffel, Lighter, Barge or other Craft, or from any Wharf, Warehouse or other Place within the faid Port of London, or within the said refpective Cities of London and Weftminster, or the respective Liberties thereof, or within fuch Part or Parts of the faid refpective Counties of Middlefex, Surrey, Kent and Effex, as is or are fituate within the Distance of Twenty five Miles from the Royal Exchange aforefaid, fhall neglect or refuse to measure by the faid Bufhel Meafure, fuch Sacks of Coals in manner herein directed, when thereunto required by the Purchaser or Purchasers of fuch Coals, or by his, her or their Servant or Servants, or other Perfon or Perfons acting by or under the Authority of fuch Purchaser or Purchafers to be measured, or if any fuch Carman or Driver shall drive away, or per mit or fuffer the faid Cart, Waggon or other Carriage to be driven away without measuring in manner herein directed the faid Sack of Coals, or fhall hinder, obftruct or otherwise prevent the Purchaser or Purchasers of fuch Coals, or his, her or their Servant or Servants, or any other Perfon or Perfons whomfoever from measuring the faid Bufhel Measure, or all or any Sack or Sacks in fuch his Cart, Waggon or other Carriage, then and in every fuch case every Carman or Driver fo offending fhall, for every fuch Offence, forfeit Penalty on Car and pay any Sum not exceeding Twenty Pounds nor lefs than Five Pounds; and the Vender or Venders of, or the Dealer or Dealers in fuch Coals, fhall forfeit and pay any Sum not exceeding Twenty Pounds, nor less than Five Pounds.

And be it further enacted, That fuch Purchaser or Pur. chafers, or his, her or their Servant or Servants, fo defiring fuch Coals contained in fuch Cart, Waggon or other Carriage to be remeasured, fhall, and he, fhe or they is and are hereby required to fend or cause to be sent to the Vender or Venders of the faid Coals, or measured. to his, her or their Wharf, Warehouse or Place of Abode, Notice in Writing that the faid Coals are to be remeasured, and fuch Purchafer or Purchasers, or his, her or their Servant or Servants, fhall, and he, fhe or they is and are hereby required forthwith to fend Notice in Writing to any One of the Offices of the faid Principal Land Coal Meter appointed by or by virtue of this Act, or of the Offices of the Principal Land Coal Meters appointed by virtue of the faid recited Act, of his, her or their Defire to have fuch Coals remeafured, and thereupon a Principal Meter, or One of the Labouring Labouring MeMeters appointed by or by virtue of this Act, or of the faid recited ter to attend. ticular Sack of fuch Coals which shall remain in fuch Cart, Waggon or other Carriage, or else to remeasure fuch Coals in fuch manner, and fo as to ascertain the whole Quantity of fuch Coals contained in all the Sacks taken together, and in cafe the Purchafer or Purchasers of fuch Coals fhall not either before or immediately upon the Arrival of fuch Meter fignify or caufe to be fignified to fuch Meter his or their Option or Defire as to which of the faid Two Ways he or they would wish fuch Remeasurement to be taken or made in, then and in every such case fuch Meter fhall proceed to remeasure fuch Coals in fuch manner, and fo as to afcertain the whole Quantity of fuch Fee for Remes- Coals contained in all the Sacks taken together, and for fach Remeasurement such Purchaser or Purchafers fhall pay, or caufe to be paid, to the Principal Land Coal Meter or Coal Meters of and from the Office to which Notice fhall have been fent as aforefaid, Six. pence for every Chaldron of Coals fo remeasured; and in cafe, upor the Remeasurement of any fuch Coals which shall be fo remeafured as to ascertain the Contents of each particular Sack thereof, it fhall appear to the Meter fo remeafuring the fame, that any Sack or Sacks of fuch Coals fhall not contain Three Bufhels, then and in every fuch case the Vender or Venders of fuch Coals fhall for every Sack of Coals that shall be fo found deficient on fuch Remeasurement forfeit and pay any Sum not exceeding Forty Shillings; and in cafe upon the Remeasurement of any fuch Coals as aforefaid which fhall be remeasured in fach manner as to afcertain the whole Quantity of fuch Coals contained in all the Sacks wherein the fame fhall have been fent taken together, it fhall appear to fuch Meter as aforefaid that the Coals thus remeafured do not amount to the Quantity for which they were fold, then if fuch laft mentioned Coals fhall have been fold as and for Wharf Measure, the Vender or Venders of fuch Coals fhall forfeit and pay for every Bufhel of Coals found deficient the Sum of Five Pounds, and alfo forfeit every Chaldron of Coals fo found deficient or wanting in Meafure to and for the Ufe of the Poor of the Parish where fuch Coals fhall be fo remeasured, and the Labouring Meter ander whose Inspection the Coals were first measured fhall, for every Bufhel fo deficient, forfeit and pay the Sum of Twenty Shillings; and the Coal Porters who fhall have firft measured fuch Coals for the Vender or Venders thereof fhall, for every Bufhel of Coals fo wanting, forfeit and pay the Sum of Two Shillings and Sixpence; but if any fuch Coals fo remeasured in the manner laft mentioned, and fo found to amount to lefs than the Quantity for which the fame were fold fhall have been fold as and for Pool Measure, then the Vender or Venders of fuch Coals fhall, in cafe fuch Deficiency fhall exceed Four Bufhels, and not exceed Ten Bufhels in any Five Chaldrons and One Vat fo remeasured, forfeit and pay Bufhel of Coals fo found deficient in every fuch Penalty on Ven- Five Chaldrons and One Vat the Sum of Forty Shillings'; and in cafe fuch Deficiency fhall exceed Ten Bufhels in any Five Chaldrons and One Vat so remeasured, then and in fuch cafe fuch Vender or Venders of fuch Coals fhall forfeit and pay for every fuch Bushel fo deficient in every fuch Five Chaldrons and One Vat the Sum of Five Pounds: Provided nevertheless, that no fuch Coals fo fold and fent fhall be remeafured fo as to afcertain the whole Quantity of fuch Coals taken together, after more than One Sack of fuch Coals fhall have been shot or delivered from fuch Cart, Waggon or other Car.

Measure, the whole of fuch Coals fo remeasured fhall be found lefs than the Quantity for which the whole of fuch Coals fhall be fold, then the Vender or Venders of fuch Coals, in cafe fuch Deficiency fhall amount to or exceed One Bushel, repay to the Purchaser or Purchafers of fuch Coals the Expences of fuch Remeasurement; but if fuch Deficiency fhall not amount to One Bufhel, then fuch Expences fhall be paid and borne by the Purchaser or Purchasers of fuch Coals; and if upon any fuch Remeasurement, which shall be made so as to afcertain the Quantity contained in each and every of the particular Sacks fent, of any Coals fold as and for Wharf or Pool Measure it shall be found that One fourth Part or more of the Num ber of the Sacks of fuch Coals fold and fent to the Purchaser or Purchasers thereof, do not contain the Quantity of Three Bufhels each refpectively, then the Vender or Venders of fuch Coals fhall repay to the Purchaser or Purchasers of such Coals the Expences of the Remeasurement thereof; but if the Number of fuch particular Sacks fo found deficient fhall not amount to One fourth Part of the whole Number of the Sacks of fuch Coals fo fold and fent, thenand in such case fuch Expences fhall be paid and borne by the Pur. chafer or Purchasers of fuch Coals.

XXXVIII. Provided always, and be it enacted, That after any fuch Notice as by this Act directed fhall have been given by or on the behalf of any Purchaser or Purchasers, at any of the faid Prin, cipal Land Meter's Offices, appointed by or by virtue of this Act, or the faid recited Act, requiring the Attendance of any Meter from any of fuch Offices, for the Purpose of remeasuring any Coals, fold either for Wharf or Pool Measure, then, and in every fuch case, the Principal Land Coal Meter for the time being at any of fuch refpective Office or Offices, where fuch Notice fhall have been given or fent, is and are hereby authorized and required to fend a Labouring Meter or Meters, from his or their Office or refpective Offices, for the Purpose of making the Remeasurement, and fuch refpective Labouring Meters, or Labouring Meter hall, and are, and is hereby required and authorized to remeasure any fuch Coals which they or he fhall be fo fent to remeasure, whether the Purchaser or Purchasers 3 C 3
