ther, Peril of the Sea, or other inevitable Accident or urgent Neceffity, and of having quitted and departed from the faid Island as hereinbefore mentioned, fhall lie upon the Party claiming fuch Exemption from the Pains, Penalties and Punishments aforefaid; any thing in this Act or any other A&t contained to the contrary notwithftanding.

• VI. And Whereas in confequence of Napoleon Buonaparte having been detained and kept in Cuftody in the Island of Saint Helena, and in order to the fafely and fecurely detaining and keeping him in fuch Cuftody, it may have happened that the Commiffioners for executing the Office of Lord High Admiral, or the Governor of the faid Ifland for the time being, or the Commander of His • Majefty's Naval or Military Forces refpectively, or other Officers and Perfons acting or who have acted in their Aid and Affiftance, or under their Advice, Orders or Commands, may from the Urgency of the Occafion have given Orders, done Acts, or used Means for the Purpose, which may not be strictly justified by Law; and in fuch cafe it is highly fit that they should be juf⚫tified and indemnified by Act of Parliament for the fame;" Be it therefore enacted, That the faid Commiffioners for executing the Office of Lord High Admiral, and the Governor of the faid Ifland of Saint Helena for the time being, and the Commander or Commanders of His Majefty's Naval or Military Forces for the time being, and all and every Officer and Officers, Perfon and Perfons, who have acted in their Aid and Affiftance, or under their respective Advice, Orders and Commands, fhall be and they are hereby indemnified for the fame.

VII. And be it further enacted, That all Actions, Suits, Indictments, Prosecutions and Proceedings whatsoever, which may have been or which shall be hereafter profecuted or commenced against any Perfon or Perfous, for or by reafon of any Advice, Orders or Commands iffued, or for or by reafon of any Act, Matter or Thing advised, commanded, appointed, ordered or done by the faid Commiffioners for executing the Office of Lord High Admiral, or by the Governor of the faid Island for the time being, or the Commander of His Majesty's Naval or Military Forces refpectively, or by any Officer or Officers, Perfon or Perfons, acting in their Aid and Affistance, or under their or either of their Advice, Orders or Commands, at any time before the paffing of this Act, be and fhall be difcharged and made void by virtue of this Act; and that in any Action, Suit, Indictment, Profecution or Proceeding now commenced, or which fhall or may hereafter be profecuted and commenced, against any of the faid Commiffioners, Governor or Governors, Commanders, Officers or Perfon or Perfons as aforefaid, for or by reason of fuch Advice, Order or Command, or for or by reason of any Act, Matter or Thing, done in fuch Aid and Affiftance, or under fuch Advice, Order or Command refpectively, he, fhe or they may plead the General Iffue, and give this Act and the Special Matter in Evidence. VIII. Provided always, That this Act or any thing herein contained, fhall not extend or be conftrued to extend to restrain or preIndia Company judice the Trade or Right of Trade or Navigation of the faid United Company of Merchants of England trading to the East Indies, to the faid Inland of Saint Helena, in Ships of and belonging to or chartered by the said Company, and duly licensed by them for that

IX. And be it further enacted, That this A&t may be altered, varied or repealed by any Act to be made in this prefent Seffion of Parliament.

for the Establishment of Her Royal Highnefs the Princess
Charlotte Augufta, and His Serene Highnefs Leopold George
Frederick Duke of Saxe, Margrave of Meiffen, Landgrave of
Thuringuen, Prince of Cobourg of Saalfeld:

mons of the United Kingdom of Great Britain and Ire• land, in Parliament affembled, having taken into Confideration the moft Gracious Meffage of His Royal Highnefs the Prince Regent, ⚫ acting in the Name and on the Behalf of His Majefty, communicating that His Royal Highness the Prince Regent, acting in the Name and on the Behalf of His Majefty, having given the Royal • Confent to a Marriage between His Daughter Her Royal High⚫ nefs the Princess Charlotte Augufta and His Serene Highness Leopold George Frederick Prince of Cobourg of Saalfeld, and being fully perfuaded that this Alliance could not but be acceptable to all His Majefty's faithful Subjects, was defirous of making such a • Provision with a View to the faid Marriage as might be fuitable to ⚫ the Honour and Dignity of the Country;' do moft humbly, cheerfully, and unanimously befeech Your Majefty that it may be enacted; and be it enacted by The King's Moft Excellent Majefty, by and. with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this present Parliament affembled, and by the Authority of the same, That it fhall be lawful for The King's Moft Ex- An Annuity of cellent Majefty, in order to provide for the Establishment of Her faid 60,000l. to be Royal Highness the Princefs Charlotte Augufta, and His Serene granted during Highness Leopold George Frederick Duke of Saxe, Margrave of the Life of the Meiffen, Landgrave of Thuringuen, Prince of Cobourg of Saalfeld, lotte upon fuch Marriage, by any Letters Patent, under the Great Seal of the United Kingdom, to give and grant to Her faid Royal Highnefs the Princess Charlotte Augufta and His Serene Highnefs Leopold George Frederick Duke of Saxe, Margrave of Meifen, Landgrave of Thuringuen, Prince of Cobourg of Saalfeld, or to fuch other Perfor or Perfons as His faid Majefty fhall think fit to be named in fuch Letters Patent, and his and their Heirs, to or to the Ufe of or in Truft for Her faid Royal Highnefs and His Serene Highness, one Annuity of Sixty thousand Pounds of lawful Money of Great Britain; which Annuity of Sixty thoufand Pounds fhall commence and take Effect from the Day of the Marriage of Her faid Royal Highness and His faid Serene Highnefs, and continue from thenceforth for and during the Life of Her faid Royal Highness, and shall be paid and payable at the Four moft ufual Days of Payment in the

Year; (that is to fay), the Fifth Day of January, the Fifth Day of April, the Fifth Day of July, and the Tenth Day of October, in every Year, by even and equal Portions; the First Payment thereof to be made on the First Quarterly Day of Payment next after the said Marriage, of such Proportion of fuch Quarterly Payment as shall have accrued between the Day of Marriage and fuch Quarter Day; and that the faid Annuity of Sixty thousand Pounds shall and may by fuch Letters Patent be directed to be iffuing and payable out of the Confolidated Fund of Great Britain during the Life of Her faid Royal Highness, (after paying or referving fufficient to pay all fuch Sums as fhall have been directed to be paid out of the fame by any Act or Acts of Parliament made previous to the time of paffing this Act,) and with a Preference to all other Payments which fhall or may at any time or times after the paffing of this Act be charged upon and payable out of the faid Fund.

II. And be it further enacted, That it shall be lawful for The Serene Highness King's Moft Excellent Majefty, by any Letters Patent under the Great Seal of Great Britain, to give and grant unto His Serene Highnefs Leopold George Frederick Duke of Saxe, Margrave of Meiffen, Landgrave of Thuringuen, Prince of Cobourg of Saalfeld, in cafe he fhall furvive Her faid Royal Highness Princefs Charlotte Augufta, or to fuch Perfon or Perfons as His Majefty fhall think fit to be named in fuch Letters Patent, and his or their Heirs, to the Ufe of or in Truft for His Serene Highness, One Annuity or Yearly Sum of Fifty thousand Pounds of lawful Money of Great Britain, Part of the faid Annuity or Sum of Sixty thousand Founds; which Annuity or Yearly Sum of Fifty thousand Pounds, and every Part thereof, to commence and take effect immediately from and after the Decease of Her faid Royal Highness Princefs Charlotte Augufta, and continuė from thenceforth for and during the natural Life of His faid Serene Highness, and fhall be paid and payable at the Four moft ufual Days When payable. of Payment in the Year; (that is to fay), the Fifth Day of January, the Fifth Day of April, the Fifth Day of July, and the Tenth Day of Odober, in every Year by even and equal Portions; the First Payment thereof to be made on the Firft Quarterly Day of Payment next after the Decease of Her faid Royal Highness, of fuch Proportion of fuch Quarterly Payment as fhall have accrued between the Day of fuch Deceafe and fuch Quarter Day; and that the faid Annuity of Fifty thoufand Pounds fhall and may by fuch Letters Patent be directed to be iffuing and payable out of the faid Confolidated Fund during the Life of His faid Royal Highness, (after paying or referving fufficient to pay all fuch Sums as fhall have been directed to be paid out of the fame by any Act or Acts of Parliament made previous to the time of paffing this Act,) and with a Preference to all other Payments which fhall or may at any time or times after the paffing of this A&t be charged upon and payable out of the said Fund.

III. And be it further enacted, That the faid Annuities of Sixty thousand Pounds and Fifty thousand Pounds fhall respectively be paid and payable at the Receipt of His Majefty's Exchequer; and the Auditor of the faid Receipt fhall and he is hereby required, by virtue of fuch Letters Patent, to make forth and pafs Debentures from time to time for paying, according to the Directions of this A&t, the faid Annuities respectively as the fame fhall become due and pay

able,

able, without any Fees or Charges to be demanded or taken for paying the fame, or any Part thereof; and the faid Debentures to be made forth and paffed as aforefaid fhall be a fufficient Authority to the feveral and refpective Officers of the Receipt of the Exchequer now and for the time being, for the Payment of the faid Annuities refpectively, according to the Directions of this Act, without any further or other Warrant to be fued for, had or obtained in that Behalf.

IV. And be it further enacted, That the faid Annuities of Sixty Tax free. thousand Pounds and Fifty thousand Pounds, and every Part thereof refpectively, fhall be free and clear from all Taxes, Rates and Affeffments, and all other Charges whatfoever, impofed or to be impofed by Authority of Parliament or otherwife.

An Act for charging certain Duties on the Importation of
Butter.

HEREAS it is expedient that the feveral and respective
Duties of Cuftoms payable on the Importation of Butter,
'from Foreign Countries into the United Kingdom, fhould be re-
'pealed, and that other Duties fhould be impofed in lieu thereof;"
Be it therefore enacted by The King's Moft Excellent Majefty, by
and with the Advice and Confent of the Lords Spiritual and Tem-
poral, and Commons, in this prefent Parliament affembled, and by
the Authority of the fame, That from and after the Fifth Day of Instead of the
April One thoufand eight hundred and fixteen, the Duties of Cuftoms Duties repealed,
payable by Law upon the Importation into the United Kingdom of thefe (pecified

feiture relating thereto, which shall have been incurred at any time
before the faid Fifth Day of April; and that, from and after the
faid Fifth Day of April, in lieu and inftead of the Duties hereby
repealed, there fhall be raised, levied, collected and paid, unto His
Majefty, his Heirs and Succeffors, the feveral and refpective Duties,
as the fame are inferted, defcribed and fet forth in Figures in the
Table hereunto annexed marked (A.)

of Customs.

II. And be it further enacted, That fuch of the faid Duties as Duties under fhall arife in that Part of Great Britain called England fhall be Management of under the Management of the Commiffioners of Cuftoms in England Commiffioners for the time being; and fuch thereof as fhall arife in that Part of Great Britain called Scotland fhall be under the Management of the Commiffioners of the Cuftoms in Scotland for the time being; and fuch thereof as fhall arife in that Part of the United Kingdom called Ireland fhall be under the Management of the Commiflioners of the Cuftoms and Port Duties in Ireland.

III. And be it further enacted, That the faid Duties fhall be ma- Duties levied as maged, afcertained, raifed, levied, collected, paid and recovered in other Duties of fuch and the like manner as any Duties of Cuftoms of a like Nature Customs. are managed, afcertained, raifed, levied, collected, paid and recovered, and under and fubject to the feveral Powers, Conditions, Rules, Regulations, Restrictions, Penalties and Forfeitures of any Act or Ads of Parliament now in force, in relation to or made for fecuring DIET $19 75 28 12 F45 lat is

the Revenue of Cuftoms in Great Britain or Ireland; and all Pains, Penalties, Fines and Forfeitures for any Offences whatever committed against or in Breach of any Act or Acts of Parliament in force on or immediately before the paffing of this Act, made for fecuring the Revenue of Cuftoms, or for the Regulation or Improvement thereof, and the feveral Claufes, Powers and Directions therein contained, fhall be in full Force and Effect as to the faid Duties, as fully and effectually to all Intents and Purposes, as if they were at large repeated and re-enacted in this A&.

IV. And be it further enacted, That all Monies from time to time arifing from the faid Duties in Great Britain (the neceffary Charges of raifing and accounting for the fame refpectively excepted) fhall from time to time be paid into the Receipt of His Majefty's Exchequer at Westminster, and fhall be appropriated and applied in the same manner as the Duties, called Permanent Duties, imposed by an Act, paffed in the Forty ninth Year of the Reign of His prefent Majefty, intituled An A& for repealing the feveral Duties of Customs chargeable in Great Britain, and for granting new Duties in lieu thereof, are directed to be appropriated and applied; and that all Monies arifing from the faid Duties in Ireland, the neceffary Charges of raifing and accounting for the fame being deducted, shall be carried to and made Part of the Confolidated Fund of Ireland.

V. And be it further enacted, That this A&t may be altered, varied or repealed by any Act to be passed in this prefent Seffion of Parliament.
