III. And Whereas the Strengths of Spirits denoted by the faid • Hydrometer called Sikes's Hydrometer, according to the Temperature thereof, have been fet down in a Table, intituled, " A Table of the Strengths of Spirits denoted by Sikes's Hydrometer," and which faid Table has been and is fubfcribed with the Hand of the • Right Honourable Nicholas Vanfittart, Chancellor of the Exchequer of Great Britain; and Three accurate Scales or Sliding Rules have been also constructed and prepared, to be ufed with the faid Hydrometer, for the more convenient and ready Calculation of the Quantity of Spirits of certain Strengths, fpecified by the faid Scales or Sliding Rules, refpectively contained in or which can be made from any Quantity of Spirits of any other Strength, which, upon Trial of fuch Spirits, may be denoted by the faid Hydrometer, called Sikes's Hydrometer; one of the faid Scales or Sliding Rules fhewing the Quantity of Spirits per Centum of the Strength of Proof contained in or which can be made from Spirits of any other Strength, which, upon Trial of fuch Spirits, fhall be denoted by the faid Hydrometer, called Sikes's Hydrometer, according to the Temperature of fuch Spirits; another of fuch Scales or Sliding Rules fhewing the Quantity of Spirits per Centum of the Strength of Eight per Centum above Proof, contained in or which can be made from Spirits of any other Strength, which, upon Trial of fuch Spirits, fhall be denoted by the faid Hydrometer, called Sikes's Hydrometer, according to the Temperature of fuch Spirits; and another of fuch Scales or Sliding Rules fhewing the Quantity of Spirits per Centum of the Strength of Twenty eight per Centum under Proof, contained in or which can be made from Spirits of any other Strength, which, upon Trial of fuch Spirits, fhall be denoted by the faid Hydrometer, called Sikes's Hydrometer, according to the Temperature of fuch Spirits; and it is expedient to make fuch Provifion for and in refpect thereof as is hereinafter mentioned;' Be it therefore enacted, That the faid Establishment of Strengths of Spirits fo fet down in the faid Table, fhall, in and throughout the faid United Kingdom, be deemed and taken to be true and juft; and the faid Scales or Sliding Rules refpectively fhall alfo, in and throughout the faid United Kingdom, be deemed accurate and juft; and the said Table and Scales or Sliding Rules refpectively shall, on all neceffary or convenient Occafions, be ufed by the Officer and Officers of His Majefty's Revenues of Customs and Excife refpectively, in and throughout the faid United Kingdom, for the Purposes in that behalf aforefaid; and the Refults of fuch Use shall on all fuch Occafions be deemed and taken to be accurate and just Results.

IV. A&; and that all Spirits made fubject to Forfeiture under or by virtue of the faid laft mentioned Acts, or any or either of them, for or by reafon of their being of a higher Degree of Strength than laft aforefaid, fhall, together with the Cafks and Packages containing the fame, be and remain forfeited, for and by reason of the faid Spirits being of a higher Degree of Strength than the faid Strength of Nine per Centum above Proof; and that in all fuch Trials as aforefaid, the Strength of Eight per Centum above Proof, denoted by the faid Hydrometer, called Sikes's Hydrometer, fhall be fubftituted for the Strength of One to Ten over Hydrometer Proof, mentioned in the faid Act made in the Twenty fixth Year of His faid prefent Majefty's Reign; or in another Act, made in the Twenty eighth Year of His faid Majefty's Reign, among other things, for better regulating the Exportation of British made Spirits from England to Scotland and from Scotland to England; or of another Act, made in the Thirtieth Year of His faid prefent Majefty's Reign, among other things, to continue Two Acts made in the Twenty eighth and Twenty ninth Years of the Reign of His prefent Majefty therein mentioned; or of another Act made in the Fifty fecond Year of His faid prefent Majefty's Reign, among other things, for regulating the Warehoufing of Spirits diftilled from Corn in Ireland for Exportation, without Payment of the Duty of Excife chargeable thereon; or in any other Act or Acts of Parliament relating to His Majesty's Revenue of Excife in any Part of the United Kingdom, in force immediately before the paffing of this Act; and that all Spirits made fubject to Forfeiture under or by virtue of the faid laft mentioned Acts, or any or either of them, for or by reafon of their higher Degree of Strength than last aforefaid, fhall, together with the Cafks and Packages containing the fame, be and remain forfeited for and by reafon of the faid Spirits being of a higher Degree of Strength than the faid Eight per Centum above Proof; and that in all fuch Trials as aforefaid, the Strength of Fifteen per Centum under Proof, denoted by the faid Hydrometer, called Sikes's Hydrometer, fhall in like manner be substituted for the Strength of One to Six under Hydrometer Proof, mentioned in an A&t made in the Second Year of the Reign of His faid Majefty, among other things, for better regulating and encouraging the Exportation of British made Spirits; and that in all fuch Trials as aforefaid, the Strength of Seventeen per Centum under Proof, denoted by the faid Hydrometer, called Sikes's Hydrometer, fhall in like manner be substituted for the Strength of One in Six under Hydrometer Proof, mentioned in the faid Act of the Twenty fixth Year aforefaid; or in another A& made in the Thirty third Year of the Reign aforefaid, among other things, for regulating the Duties on Distilleries in the refpective Districts in Scotland; or in another A&t made in the Thirty ninth Year of the Reign aforefaid, among other things, for regulating the Duties on Distilleries in the refpective Diftricts in Scotland; or in any other Act or Acts of Parliament relating to His Majefty's Revenue of Excife, in force immediately before the paffing of this Act; and that all Spirits made fubject to Forfeiture under or by virtue of the faid Act of the Thirty third Year aforefaid, for or by reafon of their higher Degree of Strength than laft aforefaid, fhall, together with the Cafks and Packages containing the fame, be and remain made fubject to forfeited, for and by reafon of the faid Spirits being of a higher

Degree of Strength than the faid Seventeen per Centum under Forfeiture under Proof; and also that all Spirits made subject to Forfeiture under or by virtue of any other of the faid laft mentioned Acts, for or by reafon of their lower Degree of Strength than laft aforefaid, fhall together with the Cafks and Packages containing the fame, be and remain forfeited for and by reafon of the faid Spirits being of a lower Degree of Strength than the faid Seventeen per Centum under Proof; and that in all fuch Trials as aforefaid, the Strength of Twenty per Centum under Proof, denoted by the faid Hydrometer, called Sikes's Hydrometer, fhall be fubftituted for the Strength of One in Five under Hydrometer Proof, mentioned in the said Act of the Thirtieth Year aforefaid, or in any other A&t or Acts of Parliament relating to His Majefty's Revenue of Excife, in force immediately before the paffing of this Act; and that all Spirits made fubject to Forfeiture under or by virtue of the faid laft mentioned Acts, or any or either of them, for or by reafon of their higher Degree of Strength than laft aforefaid, fhall, together with the Cafks and Packages containing the fame, be and remain forfeited, for or by reafon of the faid Spirits being of a higher Degree of Strength than the faid Twenty per Centum under Proof; and that in all Accounts taken under or by virtue of the faid Act, made in the Thirtieth Year aforefaid, by any Officer or Officers of Excife, of the Stock of British Brandy, rectified British Spirits, raw British Spirits, Compounds or other British Spirits, of any Rectifier or Rectifiers, or Compounder or Compounders of Spirits (whether a Maker or Makers of Spirits or not), all and every fuch Stock and Stocks shall be taken and computed at the Strength of Twenty eight per Centum under Proof, denoted by the faid Hydrometer called Sikes's Hydrometer, in lieu and inftead of cafting and computing the fame at the Strength of One in Three and Three fourths under Hydrometer Proof, mentioned in the said last mentioned Act; and that all Spirits Forfeiture of made fubject to Forfeiture under or by virtue of the faid laft men- Spirits when diftioned Act, for or by reafon of any fuch Stock added to the Quantity ceed the Quanof Spirits, for which Permits fhall have been granted fince the time of tity found in taking the last preceding Account of fuch Stock, being found to Stock at the time exceed the Quantity of Spirits found by the Officer or Officers of of taking the Excife in fuch Stock, at the time of taking the laft preceding Ac- preceding Account of fuch Stock by the Officer or Officers of Excife, added to the Quantity fince received or made, as in the faid last mentioned Act is mentioned, with the Allowance in the faid last mentioned Act in that behalf mentioned, fhall be and remain forfeited for or by reafon of fuch Stock being found to exceed the Quantity of Spirits found by the Officer or Officers of Excife in fuch Stock at the time of taking the laft preceding Account of fuch Stock, cafting or computing the fame in manner directed by this Act; and that all British Spirits of a greater or higher Degree of Strength than Forty threeper Centum above Proof, denoted by the fame Hydrometer called Sikes's Hydrometer, fhall be deemed and taken to be Spirits of Wine, within the Meaning of the faid Act made in the Twenty 28 G. 3. c. 46. fixth Year of the Reign of His prefent Majefty: Provided always, Provifo, that that if the Strength of any Spirits manufactured and imported from Spirits made in that Part of Great Britain called Scotland into that Part of Great Britain called England as aforefaid fhall upon Trial, by any Officer England, thall or Officers of Excife in England, by the faid Hydrometer, called not be forfeited Sikes's

V. And be it further enacted, That all Fines, Penalties and Forfeitures impofed by this Act fhall be fued for, recovered, levied or mitigated by fuch Ways, Means or Methods, as any Fine, Penalty or Forfeiture may be fued for, recovered, levied or mitigated by any Law or Laws of Excife, or by Action of Debt, Bill, Plaint or Information, in any of His Majefty's Courts of Record at Weminfter, or in the Court of Exchequer in Scotland refpectively, and that One Moiety of every fuch Fine, Penalty or Forfeiture fhall be to His Majefty, his Heirs and Succeffors, and the other Moiety to him or them who fhall inform, difcover or fue for the fame.

VI. And be it further enacted, That this Act, or any of the Provifions thereof, may be varied, altered or repealed by any A&t or Acts to be made in this Seffion of Parliament.

VII. Provided always, That this Act shall have Continuance until the First Day of Auguft which will be in the Year One thousand eight hundred and eighteen, and no longer.

An Act for enabling Ecclefiaftical. Corporate Bodies, under
certain Circumftances, to alienate Lands for enlarging Ce-
meteries or Churchyards.
[2d July 1816.]
HEREAS Cemeteries, Churchyards or Burying Grounds,
are in various Places found to be too fmall, and the fame
cannot be conveniently enlarged, without appropriating for Con-
fecration fome Part of the Lands belonging to Corporations or
Spiritual Perfons, not authorized by Law to alienate fuch Land for
any Purpose whatfoever;' Be it enacted by The King's Moft Ex-
cellent Majefty, by and with the Advice and Confent of the Lords
Spiritual and Temporal, and Commons, in this present Parliament
affembled, and by the Authority of the fame, That from and after
the paffing of this Act it shall and may be lawful for any Spiritual or
Ecclefiaftical Body Corporate or Spiritual Perfon, being a Cor-
poration Sole, poffeffing any Land adjacent to any Cemetery, Church-
yard or Burying Ground, to fell, by Indenture of Bargain and Sale,
inrolled in the High Court of Chancery within Six Calendar Months,
for the Purpofe of Confecration, fuch Portion thereof as may be
deemed neceffary for enlarging any fuch Cemetery, Churchyard or
Burying Ground, not exceeding One Acre.

II. Provided always, That in cafe of any Spiritual Perfon, being a Corporation Sole, the Confent of the Lord Bishop of the Diocefe or Ordinary, and of the Patron of the Living held by fuch Corporation Sole, fhall be teftified by their being Parties to the Alienation of the faid Land; and that previously thereto the Value of fuch Land fhall be afcertained, and, together with a Description thereof, be committed to Writing by fome competent Perfon, to be named and appointed by the Ordinary; which Perfon fo appointed fhall verify the fame on Oath, before fome One of His Majefty's Juftices of the Peace

for the County, Town or District in which such Land is fituated; which Oath the faid Juftice is hereby empowered to administer; and in cafe the Value fhall appear to exceed One hundred Pounds, that other Lands, of at leaft an equal Value, eftimated and verified in manner aforefaid, fhall be well and legally conveyed to and for the fame Ufes as the Lands conveyed by the faid Spiritual Perfons or Corporations Sole, and as the Confideration thereof; and in cafe the Application of Value fhall appear not to amount to One hundred Pounds, but fhall the Money if exceed Twenty Pounds, fuch Value fhall be paid to the Governors under that of the Bounty of Queen Anne, for the Augmentation of the Maintenance of the Poor Clergy, to be by them used and applied for the Benefit of fuch Spiritual Perfon or Corporation Sole, in the fame manner as they are now empowered by Law to use and apply other Sums of Money coming into their Hands; and in cafe the Value shall not amount to Twenty Pounds, the faid Value shall be paid in Money to fuch Spiritual Perfon or Corporation Sole, to be by him. applied at his own Discretion.

III. Provided always, That no Alienation made by virtue of this A&t fhall be queftioned after the Expiration of Twenty Years from the time of such Alienation, on account of any Want of Compliance with the Forms prefcribed by this Act.

IV. And be it further enacted, That all Ground which has been or fhall be confecrated as Burial Ground fhall, after Twenty Years from the time of fuch Confecration, be confidered as difcharged from all adverfe Titles, Claims and Demands whatsoever, and as abfolutely vefted in the Trustee or Trustees, if any, thereof; and if there fhould not be any fuch Truftee or Trustees, then in the Vicar or Perpetual Curate, if any, for the time being; and if there should not be any Vicar or Perpetual Curate, then in the Rector for the time being of each Parish in which fuch Burial Ground is or fhall be fituate.
