XLI. And be it further enacted, That the faid Commiffioners for Watchmen to be putting this A&t in Execution may, and are hereby authorized and appointed. empowered, from time to time to appoint fuch Number of Watchmen and Patroles, to be employed within the Limits of this A&t, for fo long time in the Night, under fuch Regulations and for fuch Wages, as they fhall think proper, and to provide them with proper Arms, Ammunition, Weapons and Clothing, for the Discharge of their Duty; and if any Watchman or Patrole appointed as aforefaid fhall Neglect of Duty. refufe or neglect to perform his Duty, or fhall in any wife misbehave himself in the Execution of his Office, he fhall forfeit and pay any Sum not exceeding Five Pounds for every such Offence.

Duty of Watch-

XLII. And be it further enacted, That the Watchmen to be appointed as aforefaid fhall, during the time of their being upon Duty, men. ufe their utmost Endeavours to prevent any Mischief by Fire, and alfo any Burglaries, Robberies, Affrays or other Outrages and Diforders, within the Limits of this Act; and that it shall be lawful for the faid Watchmen, or any of them, and they are hereby refpectively authorized and required, while on Duty, to apprehend and fefecure all Malefactors, Rogues, Vagabonds and other diforderly Perfons, within the Limits of this Act, who fhall difturb the public Peace, or whom they fhall have caufe to fufpect of any evil Designs, and to fecure and keep in fafe Cuftody every fuch Perfon, in order that he or she may be conveyed as foon as conveniently may be, before fome Juftice of the Peace for the County of Middlefex or City

of Westminfer to be examined and dealt with according to Law; and Victuallers harif any Victualler or Keeper of any Public House fhall knowingly bouring Watchharbour or entertain any Watchman to be employed within the Limits men. of this Act, or permit or fuffer any Watchman to be and remain in his House during any Part of the time appointed for his being on Duty, every fuch Victualler or Keeper of every fuch Public House fhall for every fuch Offence forfeit and pay any Sum not exceeding Five Pounds.

Penalty.

XLIII. And for raifing Money to enable the faid Commiffioners appointed and to be appointed by virtue of this Act to carry the feveral Purposes of this Act into Execution; be it further enacted, That one or more Rate or Rates, Affeffiment or Affeffments, fhall Rates to be laid for the Purpofe of paving, cleanfing, lighting, watering and watching on Houtes, &c. the faid Streets, Squares, Circufles, Ways, Courts and other public Paffages and Places, which fhall be within the Limits of the Jurifdiction of the Commiffioners under this Act, and for carrying the feveral Purposes of this Act in relation thereto into Execution, shall be laid, rated and affeffed by the faid laft mentioned Commiffioners once in every Year if they fhall judge it needful, upon all and every Perfons and Perfon who do or fhall inhabit, hold or occupy any Land, Houfe, Shop, Warehouse, Coach Houfe, Stable, Cellar, Vault, Building or Tenement, in any of the faid Streets, Squares, Circuffes, Ways, Courts and other public Paffages and Places, in fuch Sum or Sums of Money as fuch Commiffioners fhall order and direct, and that one or more Rate or Rates, Affeffment or Affeffments, fhall for the Purpose of forming, making, enclosing, planting, ornamenting and embellishing the Centres or Areas of the faid Squares and Circuffes, be in like manner laid, rated and affeffed, upon all and every Perfons and Perfon who fhall inhabit, hold or occupy any House and Building erected and built, or to be erected and Tt 2

built, and encompaffing the faid Squares and Circuffes, in fuch Sum or Sums of Money as the faid Commiffioners fhall order or direct, but fo neverthelefs as that fuch Rate or Rates, Affeffment or Affeffments, do not exceed in the whole in any one Year the feveral Sums of Money next hereinafter mentioned; (that is to fay) for paving, repairing, cleaning, watching and lighting the faid feveral Streets, Squares, Circuffes, Ways, Courts and other public Passages and Places, the Sum of Two Shillings in the Pound, according to the yearly Rent or Value of fuch Houfes, Shops, Warehouses, Coach Houfes, Stables, Cellars, Vaults, Buildings and Tenements, which are or fhall be fituate within the Limits of this Act; and for watering fuch Streets, Squares, Circuffes, Ways, Courts, Paffages and Places, the Sum of Sixpence in the Pound, according to the yearly Rent or Value of fuch Houfes and Buildings as are or shall be erected and built in or about fuch Streets, Squares, Circuffes, Ways, Courts, Paffages and Places which shall from time to time be watered in purfuance of the Directions of this Act, and for forming, making, enclofing, ornamenting and embellifhing the Centres, Areas or Middle Spaces of the faid Squares and Circufles which fhall be laid out and made within the Limits of this Act, and for fupporting and main taining the fame, after the Rate of Two Shillings in the Pound, according to the yearly Rent or Value of fuch Houses and Buildings as are or fhall be erected in fuch refpective Squares, Circuffes or Places; in the making of which faid feveral Rates or Affeffments, the Stables, Coach Houses, Erections and other Buildings, which fhall belong to or be respectively held and occupied with any of the Houfes erected or to be erected or fituate in any of the faid Streets, Squares, Circuffes, Ways, Courts and other public Paffages and Places, fhall be refpectively rated together and along with fuch Houses, and not as feparate Buildings; and that the faid Commiffioners fhall cause separate and distinct Accounts to be kept of the Produce of the faid refpective Rates and Affeffments, and the Appli cation of the fame refpectively.

XLIV. And be it further enacted, That the Annual Value of all fuch Houses, Stables, Cellars, Vaults, Buildings and Tenements, fo to be refpectively rated and affeffed as aforefaid, fhall be fettled and afcertained according to the real Rack Rent or full yearly Value Commencement thereof; and the First Year, for which fuch Rates or Affeffments as aforefaid fhall be made, fhall commence for or in refpect of fuch Houses or other Buildings as now are, or fhall be then erected, built and tiled, flated or covered in, within the Limits of this Act, and paved in Front thereof, from the Twenty fourth Day of June One thoufand eight hundred and fixteen; and for and in refpect of all fuch Houfes or Buildings hereafter to be erected or built within the Limits of this Act, which fhall not be tiled, flated or covered in, and paved in Front thereof as aforefaid on the said Twenty fourth Day of June, fhall commence from the next Quarter Day after the fame fhall be fo tiled, flated or covered in, and the Pavements made in Front thereof as aforefaid; and the Money fo rated and affeffed, un der or in purfuance of this Act, fhall from time to time be paid to the Collectors to be appointed as aforefaid, at such time and times in every Year, and in fuch manner as the faid Commiffioners for executing this A&t fhall order and direct, and fhall be paid over by fuch Collectors into the Hands of the Treasurer to the faid Commiffioners.

XLV. Provided always, and be it further enacted, That when Empty Houses any of the faid Houfes or other Buildings fhall, at the time of to be charged making any of the faid Rates or Affeffments, be empty or unoccu- with Half Rates. pied, then and in every such case it shall be lawful for the faid Com miffioners for executing this A&t to rate and affefs fuch Premises respectively at One Half of fuch Rates and Affeffments, and not more, during the time only fuch Premifes fhall be empty or unoccupied; and alfo in cafe fuch Premifes, after the making of any fuch Rate or Affeffment, fhall become empty or unoccupied, One Half only of fuch Rates or Affeffments fhall be charged on fuch Premifes refpectively, for and during fo long time as the fame fhall continue empty and unoccupied; and then and in every such case the faid Rates or Affeffments, and all Arrears due thereon, fhall be paid by the Perfon or Perfons for the time being entitled to fuch Premifes, or by the Firft or any other Tenant or Occupier thereof, but fuch Tenant or Occupier fhall not be liable or compellable to pay more than One Year's Rates or Affeffments due at the time of his entering thereon in refpect of fuch Premifes; and every fuch Tenant or Occupier fhall and may and is hereby authorized to deduct and retain the fame out of his or her Rent, and the Perfon or Perfons for the time being entitled to fuch Premifes is and are hereby required to allow fuch Deductions; and that where any Houfe, Building or Tenement, in refpect whereof any Rate or Affeffment fhall be made as aforefaid, fhall be let to more than One Tenant, any One or more of fuch Tenants fhall be deemed the Occupier or Occupiers thereof for the Purposes of this Act: Provided alfo, that in all cafes where Proportions of any Perfon fhall remove from or quit any Houfe, Building or Tene- Rates to be paid ment, which fhall be rated or affeffed by virtue of this Act, fuch Per- by Perfons refon fhall be liable to pay fuch Rate or Affeffment in proportion to moving. the time that he or the occupied the fame; and in all cafes where any Perfon fhall come into or occupy any Houfe, Building or Tenement, rated or affeffed as aforefaid, out of or from which any other Perfon who fhall have been rated or affeffed for the fame shall be removed, or which at the time of making any Rate or Affeffment was empty or unoccupied, the Perfon coming into or occupying the fame shall be liable to pay fuch Rate or Affeffment in refpect thereof, in Proportion to the time that he or fhe occupied the fame, which faid refpective Proportions, in case of Dispute, fhall be fettled How fettler. or ascertained by the faid Commiffioners for executing this Act. XLVI. Provided always, and be it further enacted, That the Rates or Affeffments to be made and laid by virtue of this A&t upon or in refpect of any Chapel, Meeting House, Hofpital, School or other public Building, or any Wall or void Space of Ground, fhall be ascertained according to the Number of Square Yards of Pavement paved or repaired, cleanfed, lighted, watched or watered, under or by virtue of this Act, belonging to fuch Chapel, Meeting House, Hofpital, School or other public Building, Wall or void Space of Ground, measuring the fame from fuch Chapel, Meeting House, Hofpital, School, Building, Wall or void Space of Ground, to the Middle of the Street, Square or Place, on which the fame shall respectively abut, and the fame fhall never exceed in any One Year the Sum of Nine pence for every fuch Square Yard; and fuch Rates or Affeffments to be made and laid upon fuch Chapel, Meeting House, Hospital, School or other public Building, Wall or void Tt 3

Space of Ground, fhall be paid by the Chapelwardens, Trustees or Owners or Proprietors thereof respectively; but fo, nevertheless, as that no Rate or Affeffment fhall by virtue of this A&t be laid upon, or collected or received for or in respect of any Wall or void Space of Ground, unless the fame fhall abut upon or front fome Street, Lane or Place, to be paved, cleansed or lighted as aforefaid.

XLVII. And be it further enacted, That fevery Rate or Affeffment which shall be laid or affeffed by virtue of this Act, for or in respect of any Houfe, Building, Coach Houfe, Stable or Tenement, which any Ambaffadors, Refident Agent, or other public Minifter, of any Foreign Prince or State, or the Servant of fuch Ambaffador, Refident Agent, or other public Minifter, or any other Perfon not liable by Law to pay fuch Rate or Affeffment, shall hereafter inhabit, fhall be paid by and recoverable from the Landlord or Proprietor of every fuch Houfe, Building, Coach Houfe, Stable or Tenement, who fhall for that Purpose be deemed the Occupier thereof.

XLVIII. And be it further enacted, That the Leffee, Landlord or Owner of every Houfe, within the Limits of this A&t, which is or fhall or may be let out ready furnished to a Lodger or Lodgers, fhall be deemed and taken to be the Occupier thereof, and shall be liable and fubject to the Rates or Affeffments directed by this A& to be made, raised and levied, according to the yearly Value of the Premises, and that every Perfon renting or occupying any fuch ready furnished House as aforefaid shall be liable and compellable to the Payment of the faid Rates or Affeffments, to be recovered in manner herein directed; but fuch Perfon fo renting or occupying any fuch ready furnished House as aforefaid shall not be liable and compellable to the Payment of the said Rates or Affeffments beyond the Rent actually due by him or her in refpect of the faid Premifes, and that every such refpective Occupier or Occupiers who shall pay any fuch Rate or Affeffment, or from whom the fame fhall be recovered in pursuance of this Act, fhall and may deduct the fame from and out of the next Rent due and payable from him, her or them, to fuch respective Leffee or Landlord, or Owner, and the Receipt for fuch Payment shall be a fufficient Discharge for fuch Tenant or Te nants, Occupier or Occupiers, to his, her or their refpective Landlord, for fo much Money as he, fhe or they fhall pay, or shall be levied on him, her or them by virtue of this Act.

XLIX. Provided always, and be it further enacted, That if any Houfe or Premifes fhall be fituate partly within the Limits of the Jurifdiction of the Commiffioners under this Act, and partly in any Street or Place not within fuch Limits, fuch Houfe or Premifes fhall be affeffed to the Rates to be raised by virtue of this Act, for a proportionable Part only of the Rent thereof; and it shall be lawful for the faid Commiffioners for executing this Act, or any Perfon ap pointed by them at fome Meeting to be holden for that Purpose, and they or he are or is hereby refpectively authorized and required to apportion and settle at how much and what Part of the Rent of fuch House and Premises the fame fhall be affeffed.

L. And be it further enacted, That no Land, Houfe, Shop, Warehouse, Coach Houfe, Stable, Cellar, Vault, Building, Tene ment or Premifes, of any Sort, Kind or Defcription whatever, within

the Limits of the Jurifdiction of the Commiffioners under this A&t, and the Occupier or Owner whereof fhall be rated and affeffed in refpect thereof by the faid Commiffioners, under the Provifions of this Act, fhall after the making of such Rate be liable to any Rate or Affeffment for the like Purpose, under any other A&t or Acts of Parliament; any thing in any A&t or Acts of Parliament to the contrary notwithstanding.

LI. And for the better enforcing the Payment of the Rates or Affeffments to be made by virtue of this Act, be it further enacted, That if any Perfon or Perfons liable to pay any of the faid Rates or Affeffments fhall refuse or neglect to pay the Money rated or affeffed upon him, her or them, and all Arrears due thereon; or if any Perfon or Perfons liable to pay any of the faid Rates or Affeffments fhall at any time begin to remove his, her or their Goods or Furniture from the Houfe or Premifes in his, her or their Occupation within the Limits of this Act, or to fell or dispose of such Goods or Furniture therein by Public Auction, or fell, difpofe of or carry away his, her or their Goods or Furniture as aforefaid, without paying all Arrears then due or rated in refpect of fuch House, (in which the current Quarter fhall be confidered as due,) that then and in every of the said cafes, it fhall be lawful for the Collector for the time being to the faid Commiffioners for executing this Act to collect and levy fuch Rates or Affeffments, and all Arrears due thereon, and the Rate or Affeffment for fuch Quarter wherein fuch Removal or Sale shall begin to be made as aforefaid, although previous to the time for Payment of the Rate or Affeffment for fuch Quarter, by Warrant under the Hand and Seal or Hands and Seals of any One or more Justice or Juftices of the Peace for the County of Middlefex or City of Weftminster, by Diftress and Sale of the Goods and Distress. Chattels of the Party fo neglecting or refufing, or beginning to remove, take fell away, or any fuch Goods or Furniture as aforefaid; and if within Five Days next after fuch Distress shall be made, the faid Rates or Affeffments, and all Arrears due thereon, together with the reasonable Charges of taking and keeping the faid Diftrefs, shall not be paid, the faid Collector fhall caufe the faid Goods and Chattels to be appraised and fold, or fuch Part thereof as shall be fufficient to pay fuch Rates or Affeffments, together with all Arrears due thereon, and the reasonable Charges of making such Distress, and of keeping and selling the fame, returning the Overplus (if any) to the Owner or Owners of fuch Goods and Chattels refpectively.

LII. Provided always, and be it further enacted, That it shall be Commiffioners lawful for the faid Commiffioners for executing this Act, if they fhall may bring Acthink it more expedient, to bring or caufe to be brought, in the tions for Rates. Name of their Treasurer or Clerk, or of any One of them the faid laft mentioned Commiffioners, any Action or Actions of Debt, or Special Action on the cafe, in any of His Majefty's Courts of Record at Westminster, for all or any of the Rates or Affeffments so to be made by virtue of this Act as aforefaid, in which Action or Actions it fhall be fufficient for the Plaintiff to declare, that the Defendant is indebted to the Plaintiff in fuch Sum of Money as the Plaintiff fhall fuppofe to be due; and if the Plaintiff fhall recover fuch Sum fo declared for, or any Part thereof, he shall have full Cofts, to be levied and recovered as other Monies upon Judgments are now by Law levied and recovered; in which Action or Actions no Effoign, Protection
