in any Part thereof be more than Three eighth Parts of an Inch afunder, fhall, under the Conditions and Regulations hereinafter mentioned, ceafe and determine; and that from and after the faid Fifth Day of July One thoufand eight hundred and fixteen, in lieu and inftead of the Duties hereby repealed, there fhall be raised, levied, collected and paid unto His Majefty, his Heirs and Succeffors, upon the Exportation from Great Britain to Foreign Parts of any Coals which fhall have been screened through a Riddle or Screen the Bars of which not being in any Part thereof more than Three eighth Parts of an Inch asunder, and stamped in the manner hereinafter directed, fuch and the like Duties and no other, as are or may be charged and payable on Culm exported from Great Britain to Foreign Parts.

Provided always, and be it further enacted, That no Coals mitted to Entry, whatever fhall be admitted to Entry on Payment of the Duty due unless Certificate and payable on Culm under the Provifions of this Act, unless a Certificate under the Hand of an Owner or Proprietor of the Mine or Pit from which fuch Coals fhall have been raised, or of the principal and known Agent of fuch Owner or Proprietor, shall be delivered to the Collector of the Customs at the Port of Exportation, which Certificate shall specify the real Quantity of Coals fo to be admitted to Entry, and that all fuch Coals have actually paffed through a Riddle or Screen of the Dimensions herein before described, and which Riddle or Screen stamped as by this Act directed; and fuch Certificate fhall alfo contain the Name and Refidence of the Owner or Proprietor of fuch Coals, with the Description of the Situation of the Mine or Pit from which fuch Coals were raised.

III. And be it further enacted, That the Owner or Owners, Proprietor or Proprietors of any Coal Pit or Mine from which it may be intended to fhip for Exportation any Coals of the Sort and Dimensions hereinbefore described, fhall at his or their Expence provide or caufe to be provided fuch a Number of Riddles or Screens of the Dimensions hereinbefore described as shall be neceffary and fufficient for the Purpose of afcertaining that the Coals intended to be shipped are of the Dimenfions required by this Act in order to entitle them to be exported to Foreign Parts on Payment of the Duty as Culm: Provided always, that all fuch Riddles or Screens fhall be ftamped in fuch manner as the Commiffioners of the Cuftoms in England and Scotland refpectively, or any Three or more of them, shall from time to time direct; fuch Stamps to be provided and affixed at the Expence of the Owners or Proprietors of the Mines or Pits from which fuch Coals fhall be intended to be shipped: Provided always, that all Coals being of a larger Size or Dimen fions than is hereinbefore mentioned and defcribed, fhall on the Exportation thereof from Great Britain be charged with the Duty on Coals fo exported, in fuch and the like manner in every respect as if

this A&t had not been made.

IV. Provided always, and be it further enacted, That if any Coals fhall be entered or fhipped for Exportation to Foreign Parts on which the Duty payable on Culm fhall have been paid under the Provifions of this Act, which fhall be of larger Dimensions than is allowed by this Act to be fo entered, or which shall not have paffed through a ftamped Riddle or Screen of the Defcription by this A& directed to be used, the Owner or Proprietor of any fuch Coals,

V. VI. And be it further enacted, That the Duties by this A&t im- Duties how pofed shall be managed, ascertained, raised, levied, collected, paid and levied. recovered, in fuch and the like manner as any Duties of Cuftoms of a like Nature are managed, afcertained, raised, levied, collected, paid and recovered, and under and fubject to the feveral Powers, Conditions, Regulations, Reftrictions, Penalties and Forfeitures now in force in relation to or made for fecuring the Revenue of Cuftoms in Great Britain, and all Pains, Penalties, Fines and Forfeitures for any Offences whatever committed against or in breach of any A& or Acts of Parliament in force on or immediately before the paffing of this Act, made for fecuring the Revenue of Cuftoms or for the Regulation or Improvement thereof, and the feveral Claufes, Powers and Directions therein contained, fhall be in full Force and Effect as to the faid Duties, as fully and effectually to all Intents and Purposes as if they were at large repeated and reenacted in this Act.

VII. And be it further enacted, That all Monies from time to Application of time arifing from the faid Duties (the neceffary Charges of raifing Duties. and accounting for the fame refpectively excepted) fhall from time to time be paid into the Receipt of His Majefty's Exchequer at Weftminster, and fhall be appropriated and applied in the fame manner as the Duties on Culm exported from Great Britain are directed to be appropriated and applied.

An Act to amend Two Acts, made in the Fifty third Year of the Reign of His prefent Majefty, for opening a more convenient Communication from Mary le bone Park to Charing Cross; and for paving the Streets to be made in Mary le bone Park; and to enable His Majefty to grant fmall Portions of Land as Scites for Public Buildings, or to be used as Cemeteries within the Bills of Mortality. WHEREAS an A&t paffed in the Fifty third Year of the

Reign of His prefent Majefty, intituled An Ad for making a more convenient Communication from Mary le bone Park, and the • Northern Parts of the Metropolis in the Parish of Saint Mary le • bone to Charing Cross, within the Liberty of Westminster, and for making a more convenient Sewage for the fame: And Whereas another Act paffed in the fame Seffion of Parliament, intituled An Ad for paving and other wife improving certain Streets, public Paffages and Places, which are or fhall be made upon certain Pieces of Ground belonging to His Majefty, in the feveral Parishes of Saint Mary le bone and Saint Pancras, in the County of Middlefex, called Mary le bone Park: And Whereas it is neceffary and expedient that further Provision should be made in relation to the Houses and • Buildings to be erected in the Streets, Squares, Circuffes, Ways, Courts and Paffages, to be erected and made under the Provifions of the faid first recited Act, and the paving, lighting and watching the fame, and that certain Parts, therefore, of the faid first recited • Act fhould be repealed, and the Powers and Provifions therein contained, amended and enlarged: And Whereas fome of the Provifions of the faid laft recited A&t require to be amended;' May therefore please Your Majefty that it may be enacted, and be it enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That fo much of the faid first recited A&t as relates to the paving, lighting and watching any of the Streets, Squares, Circufles, Ways, Courts or Paffages, comprised within the Provifions of the said first recited Act, and to any Powers and Authorities given in the faid Act relating thereto, shall be and the fame are hereby repealed.

II. And be it further enacted, That the Lord High Treasurer, Commiffioners. and the Commiffioners of the Treafury for the time being, and the Commiffioners of His Majesty's Woods, Forefts and Land Revenues for the time being, and fuch other Perfon or Perfons as fhall be elected and appointed in manner hereinafter mentioned, fhall be and they are hereby appointed Commiffioners for paving, lighting, watching and otherwife regulating and improving the feveral Streets, Squares, Circuffes, Ways, Courts, Paffages and Places, or fuch Parts thereof refpectively as are or fhall be made upon any Land within the Limits mentioned and defcribed in the faid firft recited A&t, which now belongs, or fhall at any time hereafter belong to His Majefty, his Heirs and Succeffors.

And be it further enacted, That it fhall be lawful for the Power to appoint faid Lord High Treasurer or the Commiffioners of the Treasury for additional Comthe time being, and the faid Commiffioners of His Majesty's Woods, Forefts and Land Revenues for the time being, or any Three or more of them, at any Meeting to be held by virtue of this Act, by any Writing under their Hands and Seals, to elect and appoint any other Perfon or Perfons to be a Commiffioner or Commiffioners for carrying this A&t into Execution; and every Perfon or Perfons who fhall be fo elected and appointed, is and are hereby vefted with the fame Powers and Authorities as if he or they had been named in this prefent Act, and had been hereby appointed a Commiffioner or Commiffioners for carrying this Act into Execution.

IV. Provided always, and be it further enacted, That no Perfon Qualification of who fhall be fo elected and appointed, fhall be capable of acting as a Commiffioner in the Execution of this Act, unless he shall be in his own Right, or in Right of his Wife, in the actual Poffeffion or Receipt of the Rents and Profits of Lands, Tenements or Hereditaments of the clear yearly Value of Fifty Pounds, or poffeffed of or entitled to a Perfonal Estate of the Value of Two thoufand Pounds. V. Provided alfo, and be it further enacted, That if any Perfon hereafter to be elected a Commiffioner for the Purposes of this Act, not being fo qualified, fhall prefume to act in the Execution of this Act, or being fo qualified fhall, during such time as he fhall hold any Place or Office of Profit, or be any way interefted or concerned in any Contract to be made by virtue of this Act, or any Work or Business to be done under the fame, prefume to act as a Commiffioner in the Execution of this Act, he fhall for every fuch Offence forfeit and pay the Sum of One hundred Pounds, together with full Cofts Penalty. of Suit, to any Person who fhall fue for the fame, in any of His Majefty's Courts of Record, by Action of Debt or on the cafe or otherwife; and the Perfon fo fued fhall prove that he is qualified as aforesaid, or that he did not hold any fuch Place or Office of Profit, or was not interested or concerned in any fuch Contract, Work or Bufinefs as aforefaid (as the cafe may happen), or otherwise, shall pay the faid Penalty without any other Proof or Evidence being given on the Part of the Plaintiff, than that fuch Perfon had acted as a Commiffioner in the Execution of this Act, or whilft holding any fuch Place or Office, or being interested or concerned in any fuch Contract, Work or Business as aforefaid.

VI. And be it further enacted, That the faid Commiffioners fhall Meeting of meet at fuch time and Place as any Three or more of them fhall Commiflioners. appoint, by Notice to be figned by them, and affixed on the Church Doors of the Parishes of Saint James in the Liberty of Westminster, Saint Mary le bone, Saint Martin in the Fields and Saint George Hanover Square, at least Eight Days before fuch Meeting, in order to put this Act in Execution; and fhall and may then, and from time to time afterwards, adjourn themfelves to any Place within or near the Limits of this Act; and if at any time there shall not appear at any fuch Meeting a fufficient Number of the faid Commiffioners appointed or to be appointed by virtue of this Act to act in the Execution of the fame, any One of the faid Commiffioners prefent may adjourn the Meeting to another Day; and in cafe of any Neglect or Adjournment. Omiffion to adjourn, any Three of the faid Commiffioners or their Clerk, fhall and may call a Meeting at the Place where the laft Meet

ing of the faid Commiffioners was appointed to be held or was held by Notice or Summons to be delivered at the ufual Place of Abode of all fuch Commiffioners, at leaft Three Days before fuch Meeting; and that at all Meetings to be held in pursuance of this A&t, the faid Commiffioners fhall defray their own Expences (except for the Ufe of the Room or Apartment where fuch Meetings fhall be held, which shall be paid out of the Rates or Affeffments hereinafter directed to be made and levied); and no Act of the faid Commiffioners fhall be valid, unless made or done at fome Meeting to be held by virtue of this Act (except the calling of Meetings as aforefaid); and that all the Powers and Authorities by this Act granted to or vested in the Commiffioners appointed or to be appointed by or by virtue hereof, fhall and may from time to time be exercised by the major Part of them prefent at their respective Meetings to be holden as aforefaid, the Number of Commiffioners prefent at fuch Commiffioners Meeting not being lefs than Three, for the Purpose of borrowing prefent. Money, granting Annuities, or making Contracts, and not being lefs than Two in any other cafe, unless where herein otherwise particularly provided; and in all cafes where the Number of Votes upon any Queftion fhall be equal, (including the Chairman's Vote,) the Chairman shall have the cafting Vote; and at every Meeting to be held under or in pursuance of this Act, the first Business shall be the Election of a Chairman to prefide at the fame: Provided neverthelefs, that it fhall be lawful for the Commiffioners appointed and to be appointed by or by virtue of this Act, and they are hereby authorized to hold any Special Meeting between their then laft Meeting and the Day to which any fubfequent Meeting fhall have been adjourned, fo that fuch Meeting fhall be required by Two or more of the faid Commiffioners, and Notice thereof given as laft aforesaid, at least Three Days before the time to be appointed for the fame, and fo as that fuch Notice fhall be figned by the Clerk or the faid Commiffioners, and specify the Caufe or Caufes of fuch Special Meeting.

VII. And be it further enacted, That no Order made by the faid revoking Orders. Commiffioners, appointed or to be appointed by virtue of this Act, fhall be revoked or altered, unlefs at fome Special Meeting to be required as aforefaid, of which Three Days' Notice fhall be given as laft aforefaid, expreffing the Occafion of fuch Meeting; and alfo, unless a greater Number of Commiffioners fhall attend fuch Meeting, to revoke or alter the fame, than were prefent when fuch Order was made.

VIII. And be it further enacted, That Entries fhall be made in a Book or Books to be provided for that Purpofe of all the Acts, Orders and Proceedings of the faid Commiffioners, and of the Names of the Commiffioners who fhall be prefent at the respective Meetings; and One or more of the faid Commiffioners who fhall be prefent, fhall fubfcribe his or their Name or Names at the End of the Proceedings of the refpective Meetings; and all fuch Entries being fo figned fhall be deemed Originals, and fhall be allowed to be read in Evidence in all cafes, Suits and Actions touching any thing done in pursuance of this Act; and that fuch Book fhall at all feafonable times be open to the Infpection of all Persons rated or assessed for the Purposes of this Act.

IX. And be it further enacted, That the faid Commiffioners fhall from time to time, by Writing under their Hands, appoint a Trea
