tried or discharged at the feveral Affizes, Seffions of Oyer and Terminer and Gaol Delivery, General Seffions, Quarter Seffions and other Seffions at which they respectively act as fuch Clerks as aforesaid, which shall have been holden within the preceding Year; diftinguishing particularly the Crimes with which all fuch Persons were feverally charged upon their Commitment, the Crimes of which fuch of them as were indicted were respectively indicted, and the Crimes of which fuch of them as were convicted were refpectively convicted; and diftinguishing under each Head of Offence the Numbers convicted, acquitted, difcharged by reafon of no Bill being found against them and difcharged by reafon of no Profecution, and the Sentences of fuch as were convicted, and also ftating under each Head of Offence the Numbers of those capitally convicted who have been executed; and all fuch Accounts shall be made out and returned according to the Form contained in the Schedule to this Act annexed, or in fuch Form and manner and with any fuch additional Particulars as fhall from time to time be ordered and required by fuch Chief Secretary in that behalf, and fuch Accounts fhall be figned by every fuch Clerk of Affize, Clerk of the Crown or other

Clerk as aforefaid refpectively; and every Clerk of Affize, Clerk Clerk of Affize, of the Crown or other Clerk as aforefaid, who fhall refufe or neglect &c. refufing. to make or tranfmit any fuch Return or Account in the manner and Form prescribed, fhall forfeit for every such Offence the Sum of

One hundred Pounds, to be recovered by Information or Action at Penalty. the Suit of His Majefty in any Court of Record in Ireland.

II. And be it further enacted, That the Chief Secretary to the Returns to be Lord Lieutenant or other Chief Governor or Governors of Ireland laid before for the time being, fhall, between the Twenty fourth Day of January and the Twenty fourth Day of February in each Year, if Parliament fhall be fitting during any Part of fuch Period, or if Parliament fhat not be fitting during any Part of fuch Period, then within Fourteen Days after Parliament fhall meet after the faid Twenty fourth Day of February in each Year, caufe all fuch Accounts and Returns to be laid before Parliament.

III. And be it further enacted, That the Grand Juries affembled Allowances to at the refpective Spring Affizes for the feveral Counties and Coun- Clerks of Allize, ties of Cities and Towns in Ireland, and at the Prefenting Term for the County and County of the City of Dublin next after fuch Returns fhall be made by fuch Clerks of Affize, Clerks of the Crown and other Clerks refpectively in each and every Year, † fettle and afcertain the Allowances to be paid to the Clerks of Affize, Clerks of the Crown and other Clerks as aforefaid, acting at the refpective Affizes and Seffions, for their Care, Pains and Trouble in making fuch Returns; and it shall be lawful for fuch Grand Juries respectively, and they are hereby required to prefent the Amount of fuch Allowances to be raised off the County at large, or County of the City or Town, as the cafe may be, to which fuch Returns refpectively relate or apply; and fuch Amount when raised shall be paid by the Treafurer of fuch County, or County of a City or Town, to fuch Clerk of Affize, Clerk of the Crown or other Clerk refpectively, † alfo fhall be entitled to the fame under the Provisions of this Act.

CA P. CXXI.

An Act for defraying, until the Twenty fifth Day of June
One thousand eight hundred and feventeen, the Charge of
the Pay and Clothing of the Militia of Ireland; and for mak-
ing Allowances in certain cafes to Subaltern Officers of the
faid Militia during Peace.
[1st July 1816.]

VII. AND Whereas it is expedient to grant Allowances to ' certain Officers of the faid Militia Forces of Ireland while difembodied under certain Regulations;' Be it further enacted, That the following Allowances shall be made and paid to the Amount, under the Restrictions and in the manner hereinafter expreffed, to every Subaltern Officer and Affiftant Surgeon, now bearing a Commiffion, and ferving in the Milita of Ireland, who fhall have continued faithfully to serve until the Difembodying thereof; that is to fay, to a Lieutenant Two Shillings and Sixpence a Day, to an Enfign Two Shillings a Day, and to an Affiftant Surgeon Two Shillings and Sixpence a Day: Provided always, that fuch Allowances fhall not be received for the time during which the Regiment, Battalion or Corps, to which fuch Officers belong, is affembled for Training and Exercise, or when called out for the Suppreffion of Riots or Tumults.

VIII. Provided always, and be it further enacted, That no Perfon who is or fhall during the Continuance of this A&t become poffeffed of fuch an Eftate or Income, as would by Law entitle him to hold a Captain's Commiffion in the Militia of a County at large in Ireland, or who is or fhall be appointed Adjutant or Surgeon in any Regiment or Battalion of the faid Militia, nor any Officer on Full Pay of the Navy, Army or Marines, who fhall alfo hold the Commiffion of a Subaltern or Affiftant Surgeon in the faid Militia, fhall have or be in anywife entitled to the faid Annual Allowance or any Part or Share thereof; any thing herein contained to the contrary thereof in anywife notwithstanding.

IX. And be it further enacted, That the Subaltern Officers and Affiftant Surgeons of the faid Militia, who fhall claim under the Authority of this Act to receive any Part of the faid Allowances, fhall, previous to receiving the fame, and in order to entitle themfelves thereto, take and fubfcribe an Oath before fome One of His Majefty's Juftices of the Peace for any County in the United Kingdom in which they fhall refpectively be, in the Words or to the Effect following; (videlicet),

of Captain of a Company in the Militia of a County at large in Ireland; that I have not, during the above Period, held the Appointment of Adjutant or Surgeon in any Regiment, Battalion or Corps of Militia; that I did not hold or enjoy, nor did any • Perfon for me hold or enjoy, during the faid Period, any Office or Income what foever from the Public, except my Half Pay as So help me GOD.' Which Oath fo taken and fubfcribed, shall be by the faid Juftice forthwith certified and tranfmitted, and he is hereby required to certify and tranfmit the fame to the Paymaster of the Regiment or Battalion of Militia in which fuch Subaltern Officer or Affiftant Surgeon fhall be then ferving.

XII. And be it further enacted, That upon fuch Certificates as aforefaid of fuch Juftice of the Peace and Commanding Officer as aforesaid, or where any Regiment or Battalion of Militia fhall not have been called out to their Annual Exercise as aforefaid, upon a Certificate of any fuch Juftice of the Peace only being produced to or received by the respective Paymafters, it shall be lawful for such Paymafters, and they are hereby authorized and required to pay to the faid Subaltern Officer and Affiftant Surgeon, according to their refpective Commiffions of Lieutenant, Enfign or Affiftant Surgeon, the Allowance above mentioned for Six Months, or other proper Period, on the Twenty fourth Day of December One thousand eight hundred and fixteen, and the other Proportion of the fame on the Twenty fourth Day of June One thoufand eight hundred and feventeen, without any Deduction what foever; the Certificates before mentioned to be by them preferved and produced among the Vouchers for the Payments from time to time made by them in purfuance of this Act.

XVI. And be it further enacted, That whenever any fupernu- Supernumerary merary Lieutenant, Enfign or Affiflant Surgeon, of any Regiment Lieutenant, &c. of Militia in Ireland, which fhall have been augmented during War, fucceeding to Vacaucy, enti and which shall have been reduced to its original Eftablishment, fhall tled to Pay and have fucceeded or fhall fucceed to any Vacancy which shall have Allowances. occurred or fhall occur in any fuch Regiment refpectively, fuch Lieutenant, Enfign or Affiftant Surgeon, fhall, from the time of his fo fucceeding, be entitled to fuch Pay and Allowances under this Act, and in like manner and to the like Amount, and under the like Restrictions and Regulations as any Lieutenant, Enfign or Affiftant Surgeon, who fhall have been ferving on the original Eftablishment of fuch Regiment at the time of the difembodying thereof; and such Lieutenant, Enfign or Affiftant Surgeon, fo fucceeding, fhall be deemed to have belonged to fuch Regiment when the fame was disembodied, and to have continued to ferve therein from that time, and shall in all Refpects, from and after his fo fucceeding, be fubject to the Regulations in this Act contained, with refpect to any Lieutenant, Enfign or Affiftant Surgeon of the faid Militia who fhall claim and receive the Pay and Allowances under this Act.

Perfons on Naval or Military Half Pay,

XVIII. Provided always, and be it further enacted, That any Perfon being on Naval or Military Half Pay, or being entitled to any Allowance, as having ferved in any of His Majefty's Forces, or Navy or Marines, and ferving in the Militia, fhall and may, and he is hereby empowered to receive and take the Pay and Allowances by this Act directed to be paid to Field Officers, Captains, Lieute- His Majesty's
