Provifo.

And fufpend the levying thereof,

order and adjudge on board any Ship, Hulk or Veffel, properly accommodated for the Security, Employment and Health of the Perfons to be confined therein, and by being employed in hard Labour in the raifing Sand, Soil and Gravel from, and cleanfing any River in Ireland navigable for Ships of Burthen, or any Port, Harbour or Haven in Ireland, fuch River, Port, Harbour or Haven being previously approved and appointed for that Purpose by Order of the Lord Lieutenant or other Chief Governor or Governors of Ireland, and His Majefty's Privy Council of Ireland, or in any other Service for the Benefit of the Navigation of any fuch River, Port, Harbour or Haven, or in any other public Works upon the Banks or Shores of any fuch River, Port, Harbour or Haven, under the Management and Direction of fuch Superintendant or Superintendants as fhall be appointed for that Purpose by the faid Lord Lieutenant or other Chief Governor or Governors of Ireland, and under fuch Rules, Regulations and Directions as shall from time to time be made by the Lord Lieutenant or other Chief Governor or Governors, and His Majefty's Privy Council of Ireland, for the carrying fuch Punishment into effect.

III. And be it further enacted, That whenever any Person shall be convicted at any Affizes of any Offence declared by this Act, or any other Act or Acts in force for the Suppreffion of illicit Diftillation in Ireland, to be a Misdemeanor, upon the Evidence of any Inhabitant (not being an Officer of Cuftoms or Excife) of the Townland, Diftrict, Divifion or Place where fuch Offence was committed, the faid Inhabitant (or any other fuch Inhabitant) having previously given Information on Oath before a Juftice of the Peace of the County where fuch Offence was committed, at any time before the First Day of fuch Affizes, the Court before whom fuch Conviction fhall be had fhall fine fuch Townland, Diftrict, Division or Place in one Half only of the Sum which by Law fuch Townland, Diftrict, Divifion or Place would be fubject to, provided that fuch Conviction fhall be had at the fame Affizes at which the Fine shall be fought to be impofed on fuch Townland, Diftrict, Divifion or Place; and fuch Court fhall in fuch case alfo fufpend the levying of fuch Half of fuch Fine for the Term or Space of Twelve Calendar Months next after the First Day of fuch Affizes; and in cafe no Fine fhall be impofed on fuch Townland, Diftrict, Divifion or Place, for or on account of any Offence committed against any A&t or Acts for the Suppreffion of illicit Distillation of Spirits in Ireland, within fuch Twelve Calendar Months next after the First Day of fuch in a Year after. Affizes, then fuch Half of fuch Fine fo impofed and fufpended as aforefaid fhall be altogether remitted, and shall not be levied off fuch Townland, District, Divifion or Place; any thing in any A&t or Acts to the contrary in any wife notwithstanding: Provided always, Twelve Months. that if any Fine shall be impofed on fuch Townland, Diftrict, Divifion or Place, for or on account of any such Offence which shall be committed within fuch Twelve Calendar Months as aforefaid, then and in such case fuch Half of the Fine which fhall have been fo impofed, and the levying of which fhall have been fufpended as afore. faid, fhall and may be forthwith levied in the fame manner and with the like Powers in all Refpects, as any Fine may be levied under any A&t or Acts for the Suppreffion of illegal Diftillation, in cafes where no Applotment fhall have been made under fuch A&t or A&s.

IV. And be it further enacted, That if on any Trial or Proceed- No Fine shall be ings at any Affizes, for the Purpose of or relative to the impofing impofed on any of any Fine on any Townland, District, Division or Place, for or Townland, on account of any unlicenfed Still, or any Part of a Still, or any ation of Offence Appendage to a Still, or any Worm or any Utenfil for diftilling is given by InSpirits, or any Wafh, Pot Ale, Low Wines or Singlings, having hutant, and been found or used respectively in any Place within fuch Town- Still, &c. feized land, District, Divifion or Place, in cafe it fhall be fatisfactorily convicted made to appear to fuch Court by due Proof, that Information in thereon. Writing on Oath was given to the Justice of the Peace, or Officer of Excife or Cuftoms refpectively, refiding nearest the Place where the Offence fhall have been committed, by an Inhabitant (not being an Officer of Cuftoms or Excife) of fuch Townland, District, Divifion or Place, which Information the faid Juftice and Officer are hereby authorized to take, of fuch unlicensed Still, or Part of a Still, or Appendage to a Still, or Worm, or Utenfil for distilling Spirits, or Wash, Pot Ale, Low Wines or Singlings, having been found or used respectively in fuch Place within fuch Townland, Diftrict, Divifion or Place, in confequence of which Information fuch Still or any Part of a Still, or any Appendage to a Still, or any Worm or any Utenfil for diftilling Spirits, or any Wafh, Pot Ale, Low Wines or Singlings, shall have been feized, and fuch Trial or Proceedings fhall have been inftituted; or if it fhall alfo in like manner be made to appear to fuch Court, that the Offender was tried and convicted of fuch Offence on the Information and Evidence of fuch Inhabitant, or of fome other fuch Inhabitant of fuch Townland, District, Divifion or Place, then and in such case it shall not be lawful for fuch Court at the faid Affizes to impofe any Fine whatever on fuch Townland, District, Divifion or Place, for or on account of fuch Offence refpecting which fuch Information fhall have been given, and fuch other Proceedings and Conviction had as aforefaid, any thing in this Act or in any other Act or Acts to the contrary thereof in anywife notwithstanding.

V. And be it further enacted, That it fhall not be lawful for the Court at any Affizes to proceed to try or determine any Information for any Offence, on account whereof any Townland, District, Divifion, Place or House shall be liable to the Payment of any Fine under any Act or Acts in force in Ireland for the Suppreffion of illicit Distillation, on the Commiffion Day or Firft Day of such Affizes; any thing in any fuch A&t or Acts to the contrary notwithstanding: Provided always, that every fuch Court fhall and they are hereby required to try and determine all fuch Informations, and all Iffues and Traverses, matters and things relating to or concerning fuch Informations, at some time during the Continuance of fuch Affizes.

VI. And be it further enacted, That whenever any Officer of Officer feizing Cuftoms or Excife fhall find or discover any unlicensed Still, or any any illegal Still, Part of a Still, or any Appendage to a Still, or any Worm, or any Utenfil for distilling Spirits, or any Wafh, Pot Ale, Low Wines or Singlings, for or in refpect whereof the Person who shall use or have the fame would be fubject to any Penalty or Punishment, or the Townland, District, Divifion or Place within which the fame fhall be found or ufed would be fubject to any Fine or Penalty, every fuch Officer fhall and he is hereby refpectively required, within Six Days after

Defect in refpect of Notices fhall not vitiate Proceedings on

Trials for Fines.

fuch Finding or Discovery as aforefaid, to give Notice thereof in Writing to the Collector of Inland Excife and Taxes of the District in which any fuch unlicensed Still or Appendage to a Still, or Worm or Utenfil for diftilling Spirits, or fuch Wash, Pot Ale, Low Wines or Singlings fhall have been fo found or discovered, specifying the particular Articles, and the time of the Finding or Discovery of the fame, and fetting forth the Name of the Parish, Townland, District, Divifion or Place in which the Place fhall be fituate, where such unlicensed Still or Appendage to a Still, or Worm or Utenfil for diftilling, or fuch Wash, Pot Ale, Low Wines or Singlings fhall have been found or discovered, and defcribing the Situation in fuch Parish, Townland, Diftrict, Divifion or Place, and the particular Place in which fuch unlicensed Still or Appendage to a Still, or Worm or Utenfil, Wash, Pot Ale, Low Wines or Singlings fhall have been found or difcovered; and every fuch Collector who shall receive fuch Notice fhall Twice in every Month, that is to fay, on or before the Second and Fourth Wednesday in each Month, tranfmit or caufe to be tranfmitted, to the Collector of the Grand Jury Cefs in each Barony or Half Barony, or County of a Town or City, within which the Place shall be fituate where fuch unlicensed Still, or Part of or Appendage to a Still, or Worm or Utenfil for diftilling, or Wash, Pot Ale, Low Wines or Singlings fhall have been found or discovered, an Abstract or Schedule of all fuch Notices relating to any fuch Finding or Discoverey, had within fuch Barony or Half Barony, County of a Town or City, which fuch Collector of Inland Excife and Taxes fhall have received up to the Saturday next preceding fuch Wednesday; and fuch Collector of Grand Jury Cefs fhall, on the Saturday next after fuch Second and Fourth Wednefday refpectively, give public Notice of the Contents of fuch Abitract, by pofting a Copy thereof, or caufing the fame to be pofted on or at the Church, Chapel, Meeting Houfe, Market House or Market Place within the Barony or Half Barony, or County of a City or Town within which the Place fhall be fituate, and which shall be nearest to the Place where fuch Offence was committed; and such Collector of Grand Jury Cefs fhall also from time to time, on Demand, produce fuch Abftract to any Inhabitant of any fuch Barony or Half Barony, County of a Town or City, liable to the Payment of Grand Jury Cefs therein, who fhall require to fee and peruse the fame, at any reafonable time in the Day time, at the ufual Dwelling Place of fuch Collector.

VII. Provided always, and be it enacted, That on the Trial of any Information or other Proceedings for any Fine or Penalty againft any Townland, District, Divifion or Place, or for any Offence against any A&t or Acts for the Suppreffion of illicit Diftillation of Spirits, it fhall not be neceffary to prove or give in Evidence, that any fuch Notice had been given by the Officer of Customs or Excise to the Collector of Inland Excife and Taxes, or that such Collector had transmitted an Abftract or Schedule of fuch Notice to the Collector of Grand Jury Cefs, nor fhall any Omiffion or Neglect in the giving any fuch Notice, or in tranfmitting any Abftract or Schedule of the fame, or in making the Contents of fuch Abstract or Schedule known and public, nor fhall any Defect in any fuch Notice or AbAtract or Schedule, which shall be given or tranfmitted, or any Variance between the fame, and any Information or other Proceeding

for or relating to any fuch Fine or Penalty, in any manner vitiate or affect fuch Information or other Proceeding, but every fuch Information or other Proceeding fhall and may be tried, had and determined in all respects, as if the Regulations herein contained relating to fuch Notice, Abstract or Schedule had not been made.

Collector of Grand Jury Cefs neglecting his

Duty.

VIII. And be it further enacted, That if any Collector of Grand Jury Cefs fhall neglect or omit in any Inftance to make known and public the Contents of any fuch Abstract or Schedule which fhall have been tranfmitted to and received by him, by pofting a Copy thereof in manner aforefaid, or fhall wilfully neglect or refuse to produce fuch Abstract to any Inhabitant of any Barony or Half Barony, or County of a Town or City, liable to the Payment of Grand Jury Cefs therein, on Demand of fuch Inhabitant at a feasonable time in the Day time, at the ufual Dwelling Place of fuch Collector, every fuch Collector shall for every fuch Neglect or Refufal, or Omiffion, forfeit the Sum of Twenty Pounds, to be recovered by Civil Bill Penalty. at the Quarter Seffions of the Juftices of the Peace, in the proper County, County of a Town or City in Ireland, by any Person who fhall fue for the fame, and the Money recovered by fuch Civil Bill shall be applied to the Ufe of the Perfon fuing for the fame.

IX. And Whereas in and by an Act made in the Fifty fourth Year of His prefent Majefty's Reign, intituled An Act to confolidate and amend the Regulations contained in feveral Ads of Parliament, for impofing and levying of Fines upon Parishes, Townlands and other Places, in refpect of the unlawful Diftillation of Spirits in Ireland, the Parishioners in Veftry affembled are authorized to elect One or more Perfon or Perfons for the Purpose of discovering or profe⚫ cuting all Offences against any Act or Acts in force in Ireland for the regulating and fecuring the Collection of the Duties on Spirits diftilled in Ireland: And Whereas it may tend towards effectuating the Purposes aforefaid if additional Powers were given to the Perfon or Perfons fo elected;' Be it therefore enacted, That it fhall and may be lawful for the Commiffioners of Inland Excife and Taxes in Ireland, if they fhall deem it expedient fo to do, upon Representation of the Churchwardens of any Parish in Ireland, to grant and iffue, with the Approbation of the Lord Lieutenant or other Chief Governor or Governors of Ireland for the time being, a Commiffion commonly called a Preventive Commiffion, to each and every Person who fhall have been or fhall be fo elected for the Purpofes aforefaid; and every fuch Perfon fhall have full Power and Authority to act under fuch Commiffion; and all and every the Claufes, Regulations, Provifions, matters and things contained in any A&t or Acts, for the Protection of the Officers of the Revenue, fhall extend to and shall be applied to and put in practice with respect to each and every fuch Perfon acting in the Performance or Execution of his Duty under fuch Commiffion, as fully and effectually in all respects as if fuch Clauses, Regulations, Provisions, matters and things were herein repeated and reenacted with regard to such Perfon or Perfons.

more; and the Treasurer of the faid County, Town or City is hereby authorized and required forthwith to pay to fuch Profecutor or other Perfon authorized to receive the fame, fuch Sum of Money as aforefaid, and shall be allowed the fame in his Accounts; and it shall and may be lawful to and for the Grand Jury at each and every Affizes and Prefenting Term, and they are hereby required to prefent all fuch Sums as fhall have been fo paid by the Treasurer of the County, County of a City or County of a Town, under any fuch Order, and which fhall not have been previously presented; fuch Sums to be prefented, raised and levied off the Townland, Diftria, Divifion or Place in which the Offence shall have been committed, in fuch manner as any Prefentment of a Grand Jury may be raised and levied.

XI. And be it further enacted, That all Spirits which shall have been or fhall be feized, as having been illicitly made or diftilled, fhall, immediately upon the Seizure thereof, be conveyed to and depofited in the Stores of the Collector of Inland Excife and Taxes of the District in which the fame shall have been seized, or in the like Stores of the next neighbouring Diftrict to which the fame can be conveniently conveyed; and the Strength and Quantity of fuch Spirits having been afcertained and taken an Account of, fuch Spirits fhall, after Condemnation thereof, be fpilled and effectually deftroyed in the Prefence of the Collector or other Officer in charge of the Collection of fuch District respectively, and of an Inspector General of Excife, or other Officer to be appointed for that Purpose by the Commiffioners of Inland Excife and Taxes in Ireland, or any Three of them, under fuch Rules and Regulations as the faid Commiffioners fhall in that behalf order or direct; and that the Officer or Officers, or other Perfon or Perfons feizing any fuch Spirits, fhall receive fuch Recompence or Reward for feizing the fame as the faid Commiffioners fhall order and direct.

XII. And be it further enacted, That from and after the Expiration of Three Calendar Months next after the paffing of this Act, every Perfon who fhall keep any Kilu for the drying of any Corn, Grain or Malt, fhall, within One Calendar Month after beginning or continuing to keep fuch Kilu or Mill refpectively, make out, fign and deliver a Return or Account in Writing to the Gauger or other Officer in charge of the Walk in which fuch Kiln fhall be fituate; and that every Perfon who fhall keep any Mill for the grinding of Corn or Grain or Malt, fhall make out, fign and deliver a Return or Account in Writing to the Collector of the District in which such Mill fhall be fituated, fpecifying and defcribing in fuch Return or Account refpectively the Name and Place of Abode of fuch Perfon, and the Place where fuch Kiln or Mill is refpectively fituated; and every fuch Perfon fhall cause to be painted in Oil Colour, in Black upon a White Ground, or in White upon a Black Ground, on the Outfide of the Door of or Place of Entrance to every fuch Kiln or Mill refpectively, or on a Board to be affixed or erected on fome confpicuous
