An Act to amend the Act of the Fifty third Year of His prefent Majefty, intituled An Act for the Relief of Infolvent Debtors in England; and to give further Powers to the Court appointed by the faid Act. [1st July 1816.] WHEREAS an Act paffed in the Fifty third Year of His 53 G. 3. c. 101. &c. he shall not prefent Majefty's Reign, intituled An Ad for the Relief of Infolvent Debtors in England; and it is expedient to amend the faid Act, and to diftinguish between the cafes of fuch Infolvent Debtors who fhall have been guilty of grofs Injuftice towards ⚫ their Creditors, and the cases of those who shall not have so con• ducted themselves;' Be it therefore enacted and declared by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from In cafe Prifoner and after the paffing of this Act if it fhall appear to the Court eftab- has acted with lifhed by virtue of the faid recited Act, upon the Examination of grofs Injuftice, any Prifoner, or otherwife, that fuch Prifoner has acted with grofs be entitled to his Injuftice towards his or her Creditor or Creditors, either in contract- Difcharge, unless ing any Debts, or entering into any Engagements, without any fair the whole of the Profpect or probable Means of paying fuch Debts or fulfilling fuch Creditors conEngagements, or by fquandering or otherwife improperly difpofing of his or her Monies, Effects or other Property, which he or she might have applied in paying fuch Debts or fulfilling fuch Engagements, either wholly or in Part, fuch Prisoner shall not be entitled to his or her Discharge by virtue of the said recited A&, unless the whole of the Creditors of fuch Prisoner fhall confent to his or her Diícharge, or fuch Prifoner fhall have been confined within the Walls of any Prifon for the Space of Five Years, to be computed from the time when fuch Prifoner shall have applied for his or her Difcharge. fent. II. And be it further enacted, That in every Notice directed to Declaration by be given by the faid rec'ted A&t, by any Prifoner, to his or her Cre- Prifoner. ditor or Creditors, fuch Prifoner fhall declare that he or she is ready and willing to fubmit to be fully examined touching the Juftice of his or her Conduct to his or her Creditor or Creditors. III. And be it further enacted, That from and after the paffing Order by the of this Act it fhall not be lawful for the faid Court to order that Court for Exa any Prifoner fhall be examined at any Seffion of the Peace for the mination of Counties of Middlefex or Surrey, or for the Cities or Liberties of Prifoner. 56 GEO. III. LI London London and Westminster, or by any One or more Juftice or Juftices of the Peace, out of Seffion, for any County, Riding, Divifion or Place whatsoever. IV. And be it further enacted, That the Court established by virtue of the faid recited Act, and the Courts of Quarter Seffions, fhall examine each and every Prisoner touching the Juftice of his or her Conduct towards his or her Creditor or Creditors. V. And be it further enacted, That the Courts of Quarter Seffions for any County, Riding, Divifion or Place, at which any Prifoner shall be examined, fhall declare in open Court whether fuch Prisoner has acted with grofs Injuftice towards his or her Creditor or Creditors, or not, and fhall also certify their Determination thereon to the Court established by virtue of the faid recited A&t. VI. Provided always, and be it further enacted, That no Prisoner hereafter shall be entitled to be examined under the Provifions of the faid recited A&t at any Quarter Seffions except at fuch Quarter Seffions for fuch County, Divifion, Riding or Place, and at fuch time whereof he fhall have given Notice to each and every of his or her Creditors; and no Prifoner who shall not appear to be examined pursuant to fuch Notice fhall be brought up before any Court to be examined without having given the like Notice at leaft Six Months previous to the time at which he or she fhall appear in order to be examined. VII. Provided always, That nothing in this A&t contained fhall extend to repeal or alter any of the Powers or Provifions of the faid recited A&t, or of another Act paffed in the Fifty fourth Year of His Majefty's Reign, intituled An Act to amend an Act of the Fifty third Year of His Majesty's Reign, for the Relief of Infolvent Debtors in England, further than any of the Powers or Provifions in the said As are hereby exprefsly repealed or altered respectively. CAP. CIII. An Act for further fecuring the Duties on Paper and Pafte- WHEREAS the Regulations by L [1st July 1816.] eftablished for fecur hade in Great Britain good Purposes thereby ing the Duties payable on Paper, have been found infufficient to anfwer the intended, and it has therefore become neffary to make further regulations for the better Collection of e faid Duties;' Be it therefore enacted by The King's Moft E ellent Majefty, by and with the Advice and Confent of the Lords. piritual and Temporal, and Commons, in this prefent Parliamen affembled, and by the Authority of the fame, That from and after, the Tenth Day of 080ber One thousand eight hundred and fixteer, all and every Maker and Makers of Paper, Millboard, Button Board, Button Paper, Glazed Paper, Sheathing Paper or Pafteboard in Great Britain, fhall from Day to Day enter or cause to be entered in a Book or Books, or on a Paper or Papers, to be delivered to him, her or them for that Purpose by the proper Officer of Excife, and kept by fuch Maker or Makers in fome public and open Part of his, her or their entered 1 entered Premises, of the Number of Sheets of Paper, Millboard, Button Board, Button Paper, Glazed Paper, Sheathing Paper and Pafteboard, diftinguishing the kinds or Sorts of Paper, Millboard, Button Board, Button Paper, Glazed Paper, Sheathing Paper or Pafteboard, made or turned out of Moulds daily, fuch Number of Sheets of Paper being in fuch Account reduced by Calculation into Reams and Odd Quires, and fuch Number of Sheets of Millboard, Button Board, Button Paper, Glazed Paper, Sheathing Paper and Pafteboard into Dozens and odd Sheets, with their refpective efti mated Weight, reckoning Twenty fix of fuch Sheets of Paper (Two of them being allowed for wafte or damaged Paper) for a Quire confifting of Twenty four Sheets when dried and finished; and fhall make or caufe fuch Entries of each Day's Work at his, her or their Mills or Manufactories, to be made and completed before Twelve on Oath. or obftructing Officers, &c. of the Clock at Noon of the following Day; which Entries fhall, Entries to be deat or after the End of every Six Weeks or Forty two Days, be livered every Six delivered to the proper Officer by and verified by the Oath of fuch Weeks, verified Maker or Makers of Paper, Millboard, Button Board, Button Paper, Glazed Paper, Sheathing Paper or Pafteboard refpectively, or his, her or their Chief Workman or Foreman employed in the Manufactory (which Oath the feveral Collectors and Supervisors of Excife are hereby refpectively authorized to adminifter); and Makers making if any Maker or Makers of Paper, Millboard, Button Board, But- falle Entries, reton Paper, Glazed Paper, Sheathing Paper or Pafteboard, fhall fufing Inspection, neglect or refufe to make any fuch Entry as aforefaid, or fhall knowingly make, or caufe or permit or fuffer to be made, in any fuch Book or Paper as aforefaid, any false Entry, or shall remove, conceal or deftroy any fuch Book or Paper fo delivered to him, her or them as aforefaid, or fail to keep the fame in fome open or public Part of his, her or their entered Premifes, or withhold or keep the fame from the Infpection of any Officer or Officers of Excife furveying; his, her or their Manufactory, or by any Means hinder, obftruct or prevent fuch Officer or Officers from freely examining the fame, and comparing the Entries therein with his, her or their Stock, or fhall erafe, deface or alter any of the Entries therein or thereon, or fhall upon Demand refuse or neglect to deliver in a perfect State any fuch Book or Paper in which any fuch Entries fhall have been made or ought to have been made as aforefaid, at or after the End1 of the Six Weeks or F ty two Days for which such Book or Paper fhall have been delivered him, her or them as aforefaid, or to verify the fame by fuch Oath a aforefaid, fuch Maker or Makers of Paper, Millboard, Button Boa , Button Paper, Glazed Paper, Sheathing Paper or Pafteboard offending fhall, for each and every such Offence, forfeit and lofhe Sum of Two hundred Pounds. II. And be it furthe enacted, That it fhall be lawful for the Paper, PasteOfficers of Excife, whe' Occafion fhall require, or they may think board, &c. to be fit, to infpect or take in Account of the Stock of Paper, Mill. kept feparate acboard, Button Board, Button Paper, Glazed Paper, Sheathing respective Paper and Pafteboard respectively, and of the kinds, Sorts and Quan- Claffes, that the tities of each, in the Cuftody or Poffeffion of all and every Maker Officer may take and Makers of Paper, Millboard, Button Board, Button Paper, an Account Glazed Paper, Sheathing Paper or Pafteboard; and all and every fuch Maker and Makers of Paper, Millboard, Button Board, Button Paper, Glazed Pape Sheathing Paper or Pafteboard, shall at LI 2 all Penalty. cording to their without remov ing the fame, Makers to affift Account. The Edges of Paper, Pafteboard, &c. may be cut before tied up. divided each Piece to be deemed a Sheet, all times place and keep his, her and their Stock of Paper, Millboard, Button Board, Button Paper, Glazed Paper, Sheathing Paper and Pafteboard respectively, diftinct and feparate, according to their refpective Clafs or Denomination, Sort or kind, and in fuch manner that any Officer or Officers furveying the Mill or Manufactory may at all times, with the Affiftance of fuch Maker and Makers, or a fufficient Number of his, her or their Servants, which Affistance they the said Maker and Makers are hereby required on the Requeft of fuch Officer or Officers to give to the utmost of his, her or their Power, correctly and without Difficulty take Account of the Number of Reams or Parcels of each Clafs or Denomination, Sort or kind of Paper, Millboard, Button Board, Button Paper, Glazed Paper, Sheathing Paper or Pafteboard refpectively, and be able, without the Neceffity of removing or disturbing any of the Reams of fuch Paper, to diftinguish the Words, matters and things directed to be printed, written or ftamped upon the Wrapper, Cover or Label of each Ream of fuch Paper; and if any Maker or Makers of Paper, Millboard, Button Board, Button Paper, Glazed Paper, Sheathing Paper or Pafteboard, or any other Perfon or Perfons whatfoever, fhall oppose, molest, obstruct or hinder any Officer or Officers of Excife in infpecting or taking fuch Account as aforefaid, or shall at any time refufe or neglect, when required, to give to any Officer or Officers fuch Affiftance as aforefaid, or fhall at any time neglect or refufe to keep his, her or their Stock of Paper, Millboard, Button Board, Button Paper, Glazed Paper, Sheathing Paper or Pafteboard in fuch manner as aforefaid, or hide or conceal any Part thereof, all and every fuch Maker or Makers, or Perfon or Perfons fo offending, fhall, for every fuch Offence, feverally forfeit and lofe the Sum of One hundred Pounds. III. And be it further enacted, That from and after the faid Tenth Day of October it fhall and may be lawful to and for any Maker and Makers of Paper, Millboard, Button Board, Button Paper, Glazed Paper, Sheathing Paper or Pafteboard, to cut the Edges of fuch Paper, Millboard, Button Board, Button Paper, Glazed Paper, Sheathing Paper or Pafteboard, before the fame is tied up in Reams or Parcels respectively in the manner hereinafter But if Paper be mentioned: Provided always, that if any Paper be divided with a Knife or other Inftrument before fuch Paper fhall be tied up in Reams or Parcels (except by cutting the Edges of fuch Paper), each separate Piece into which fuch Paper fhall be fo divided fhall be deemed a Sheet of the Ream into which it shall or is to be tied up; and that all and every Maker and Makers of Paper shall distinguish each and every Ream of fuch divided Paper, by marking, writing or printing in large legible Characters and Words at Length on the Label thereof, hereinafter mentioned, the Words " Cut Paper," and the Number of Pieces into which each original Sheet has been divided, and shall place and keep fuch Paper feparate and apart from all uncut Paper, and from all Millboard, Button Board, Button Paper, Glazed Paper, Sheathing Paper and Pafteboard; and if any Maker or Makers of Paper fhall neglect or refuse to diftinguish such Paper fo divided as aforefaid by the Words "Cut Paper," and by the Number of Pieces into which each original Sheet has been divided as aforefaid, being fo marked, written or printed thereon by him, her or them refpectively as aforefaid, or shall neglect or refuse to keep all fuch Paper feparate and Reams diftinguished on Labels with the Words "Cut Paper," and kept feparate from the uncut. and apart from all uncut Paper, and from all Millboard, Button Board, Button Paper, Glazed Paper, Sheathing Paper, and Pafteboard, he, fhe or they fo offending fhall for each and every fuch Offence forfeit and lofe the Sum of Fifty Pounds. Penalty. IV. And be it further enacted, That all and every Maker or Directions for Makers of Paper, Millboard, Button Board, Button Paper, Glazed tying up. Paper, Sheathing Paper or Pafteboard, in tying up any Ream or Parcel of Paper, Millboard, Button Board, Button Paper, Glazed Paper, Sheathing Paper or Pafteboard, fhall make ufe of only one entire and unknotted String, and that fuch String fhall pafs over the Length and across the Middle of each Ream of Paper, so that the Knot formed by tying together the Two Ends of fuch String shall be on the Middle of One of the Sides of fuch Ream; and that fuch String fhall pafs over the Length, and Twice at equal Distances across the Breadth of each Parcel of Millboard, Button Board, Button Paper, Glazed Paper, Sheathing Paper or Pafteboard, fo that the Knot formed by tying together the Two Ends of fuch String fhall be in the Middle of One of fuch Croffings, and on One tions forfeited. of the Sides of fuch Parcel; and all and every Ream and Reams Reams or Parof Paper and Parcel and Parcels of Millboard, Button Board, cels tied up conButton Paper, Glazed Paper, Sheathing Paper or Pafteboard, which trary to Direcfhall be found by any Officer or Officers of Excise tied up otherwise than as aforefaid fhall be forfeited, and fhall and may be feized by any Officer or Officers of Excife. found of undue Weight. V. And be it further enacted, That all and every Maker and Makers to mark Makers of Paper, Millboard, Button Board, Button Paper, Glazed the Weight on Paper, Sheathing Paper or Pafteboard, fhall mark, write or print, the Label affixed or caufe to be marked, written or printed in large and legible of Paper or Pak to every Ream Characters upon the Label hereinafter mentioned, affixed on every cel of PateReam of Paper, and upon every Parcel of Millboard, Button Board, board. Button Paper, Glazed Paper, Sheathing Paper or Pafteboard, the Weight of fuch Ream or Parcel respectively; and if any fuch Maker Makers refusor Makers of Paper shall refuse or neglect to mark, write or print, ing, or if Paper or caufe to be marked, written or printed as aforefaid, on the Label of every Ream of Paper, and of every Parcel of Millboard, Button Board, Button Paper, Glazed Paper, Sheathing Paper or Pafteboard, hereafter mentioned, the Weight of fuch Ream or Parcel, or if any fuch Ream of Paper, or Parcel of Millboard, Button Board, Button Paper, Glazed Paper, Sheathing Paper or Pafteboard, fhall at any time, on being reweighed by any Officer or Officers of Excife, be found to weigh lefs or more than Five per Cent. under or over the Weight fo marked, written or printed on fuch Ream or Parcel by fuch Maker or Makers as aforefaid, the fame fhall be forfeited, and fhall and may be feized by any Officer or Officers of Excife; and the Maker or Makers of fuch Paper, Millboard, Button Board, Button Paper, Glazed Paper, Sheathing Paper or Pafteboard, fhall forfeit and lose the Penalty of Fifty Pounds.
