and which Quietus or Acquittance fhall be a full and perfect Difcharge to fuch Receiver, for or in refpect of all Monies received by him and comprised in such Account.

VIII. And be it further enacted, That if any fuch Receiver or Accountant fhall wilfully forfwear himself in regard to any Article, Matter or Thing relating to fuch Account, then fuch Receiver or Accountant fhall and may be profecuted for the fame; and upon Conviction thereof, shall be subject and liable to fuch and the fame Pains and Penalties as Perfons guilty of wilful and corrupt Perjury are by the Laws in being fubject and liable to.

IX. And be it further enacted, That all Balances due or to become due to His Majefty on the periodically making up of fuch Accounts by the Auditor or Auditors thereof, or his or their Deputy or Deputies, or the acting Auditor or Auditors as aforefaid, or by the Perfon or Perfons to whom the Duty of making up the same shall be then transferred; and all fuch Sum or Sums of Money as prior to the ascertaining fuch Balances fhall be from time to time required to be paid on account or in refpect thereof, either by any Debenture or Debentures, or Inftruments in Writing from the faid Auditor or Auditors, or his or their Deputy or Deputies, or the acting Auditor or Auditors, or the Perfon or Perfons to whom the Duties now performed by or in the Offices of the Auditor of the Land Revenue shall be then transferred, by virtue or in pursuance of any Warrant from the Lords Commiffioners of His Majefty's Treasury for the time being, or any Three of them, or by any Order in Writing from the Commiffioners for the time being of His Majefty's Woods, Forefts and Land Revenues, or from the Surveyor General for the time being of His Majefty's Land Revenues, fhall be paid over by fuch Receiver as aforefaid, to fuch Perfon or Perfons, at fuch time or times, Office or Place, and in fuch manner as he shall be directed or required by any fuch Debenture, Inftrument or Order to pay the fame; and in Default of fuch Direction or Requifition, then to fuch Perfon or Perfons, and in fuch manner, and at fuch time or times, and Office or Place, as the Receivers of His Majefty's Land Revenues were immediately before the paffing of this Act, by the Laws and Statutes then in force, and the Ufage and Practice in that Behalf, bound or required to anfwer, render and pay the Monies in their Hands, on the Balances of their respective Accounts.

X. And be it further enacted, That every fuch Receiver shall have and be allowed, and fhall and may charge, retain and deduct, in making up fuch his annual Accounts as aforefaid, One twentieth Part of all fuch Monies as fhall by him have been received within the time comprifed in fuch Account, and fhall be therein duly accounted for, as and for a Compenfation for his Trouble in collecting and receiving the fame Monies, and as a full Recompence and Satisfaction for all the Services to be performed by him in pursuance of this Act, or in Execution of any of the Duties of his faid Office, or fuch other Compenfation not exceeding fuch One twentieth Part as aforefaid, as the Commiffioners for the time being of His Majefty's Woods, Forefts and Land Revenues, or the faid Surveyor General for the time being of His Majesty's Land Revenues, fhall, by and with the Confent and Approbation of the Lords Commiffioners for the time being of His Majefty's Treafury, to be fignified in manner aforefaid, from time to time order, direct or allow.

And be it further enacted, That if any Leffee or Leffees, Oc- Leffees and cupier or Occupiers, Tenant or Tenants, of any Eftates or Poffeffions Tenants in arof the Crown, the annual Rent or annual Value whereof shall exceed rear to pay the Sum of One hundred Pounds, shall be in arrear, or hold in his or Intereft. their Hands or Cuftody any Rent or Rents or mefne Profits, or other Profits belonging to the Crown arifing from the faid Estates or Poffeffions, for the Space of Three Calendar Months after the fame fhall have become due, and after he or they shall have been applied to, either perfonally or by Letter from the Receiver for the Payment thereof, without paying over the fame to the Receiver authorized and empowered to receive the fame; then and in such case every fuch Perfon, liable to the Payment of and who ought to have paid the fame, fhall be charged and chargeable with Intereft for fuch Arrear, to be calculated after the Rate of Five Pounds for every One hundred Pounds Five Pounds per by the Year, upon the Sum or refpective Sums fo in Arrear, from the Cent. per AuDay or time, Days or times, at which each Half yearly Payment of num. the faid Rent fo in arrear became due, up to the Day or time at or upon which the fame fhall be actually paid; and that fuch Interest fhall and may be added to the Rent or mefne Profit fo in arrear as aforefaid, and fhall be recovered and received by the fame Ways and Means as any Rent in arrear is by Law recoverable, together with all Cofts and Expences to be fuftained or incurred in or about the Recovery thereof.

XII. And be it further enacted, That in cafe any fuch Receiver or Receivers as aforefaid shall at any time have received or got into his or their Hands any Sum or Sums of Money belonging to the Crown, exceeding the Sum of Five hundred Pounds, and fhall not within One Calendar Month after the Receipt thereof give Notice thereof in Writing to the Commiffioners for the time being of His Majefty's Woods, Forefts and Land Revenues, or to the faid Surveyor General, to the Intent that the fame may from time to time thereafter be drawn out, called for or applied as Occafion may require; then and in fuch case every such Receiver fhall be charged and chargeable with Intereft for every fuch Sum after the Rate above mentioned, from the Day or time, Days or times, at which it shall have been fo received, until it shall be drawn out of his Hands, or paid over by him to the proper Officer, Commiffioners, or other Persons by Law entitled to receive the fame.

XIII. And be it further enacted, That it shall be lawful for every Perfon who shall be so appointed Receiver as aforefaid, and he is hereby authorized and empowered, by virtue of fuch his Appointment, alone and without any further Order, Warrant or Authority whatsoever, by himself, or any Person whom he shall for that Purpose depute, to make any Diftrefs or Diftreffes for any Rent or Rents which shall be due in arrear or unpaid from any Leffee or Leffees, Occupier or Occupiers, Tenant or Tenants, of any of the Eftates or Poffeffions which fhall be in the Collection, Receipt, or Management of fuch Receiver, and the Goods, Chattels and Effects fo diftrained, to impound, fell and difpofe of; and all Sheriffs, Mayors, Juftices, Bailiffs, Conftables, Headboroughs and other Officers and Minifters of Justice, are hereby directed and required to be aiding and affifting fuch Receiver or his Subftitute in the making fuch Distress or Diftreffes, and the impounding, felling and difpofing of the Goods, Chattels or Effects so to be taken or diftrained, and in all other Matters relating thereto,

thereto, or to the Execution of the faid Office, as Occafion shall require: Provided always, that every fuch Receiver fhall, and he is hereby required, in making or caufing to be made any fuch Distress, and in relation to any Queftion or Queftions at Law or otherwise which may arise thereupon, to obey and conform to all fuch Orders and Regulations as fhall be given him in that Behalf by the Commiffioners of His Majefty's Woods, Forefts and Land Revenues, or the Surveyor General for the time being of His Majesty's Land Revenue.

XIV. And be it further enacted, That every fuch Person so to be appointed Receiver as aforefaid, shall, before he shall exercise or execute the faid Office, or anywife intermeddle in the Exercife or Execution thereof, enter into a Bond or Obligation, in fuch Penalty and with fuch Sureties as the Commiffioners for the time being of His Majefty's Woods, Forefts and Land Revenues, or the Surveyor General for the time being of His Majesty's Land Revenues, with the Confent and Approbation of the Lords Commiffioners of His Majefty's Treafury, to be fignified in manner aforefaid, fhall direct or require for the faithfully anfwering and accounting for the Rents, Iffues, Revenues and Profits, to be by him received by virtue of fuch his Appointment; and for the doing, executing and performing all fuch Services and Duties as are hereby required, or fhall in manner aforefaid by the Lords Commiffioners of His Majefty's Treafury for the time being, or by the Commiffioners for the time being of His Majefty's Woods, Forefts and Land Revenues, or the faid Surveyor General, with the Confent of the Lords Commiffioners of His Majesty's Treasury, to be fignified in manner aforefaid, be from time to time, by any Minute, Order or Writing, directed or required to be done or performed in relation to fuch Office as aforefaid; and every fuch Bond may be in the Form or to the Effect in the Schedule marked (B.) to this A&t annexed, or as near and fimilar thereto as Circumstances will permit, and fhall be exempt from any Stamp Duty whatever, and fhall have the Effect of a Statute Staple to His Majefty, his Heirs or Succeffors, for the answering and Payment of all and every Sum or Sums to become payable by virtue thereof, and fhall be enrolled in the Office of the Auditor of the Premifes to which the fame relates, within the Space of One Calendar Month next after the Date thereof, to whom the ufual and accustomed Fees fhall be paid for enrolling the fame, and fhall be depofited and kept in the Office of the Commiffioners of His Majesty's Woods, Forefts and Land Revenues, or of the faid Surveyor General for the time being.

XV. Provided always, That during the Life of the faid Walker Lord Bishop of Rochester, this Act or any thing herein contained shall not extend to any of His Majetty's Honors, Lordships, Manors, Meffuages, Lands, Tenements, Poffeffions or Hereditaments, which are fituate within the County of Middlefex or the City of London, or to determine or vacate the Office of Receiver of the Iffues, Rents and Revenues thereof, fo held by the faid Walker Lord Bishop of Rochefter, under or by virtue of the faid Letters Patent, but that the faid Letters Patent and the Appointment thereby made, so far as refpects fuch Honors, Lordships, Manors, Meffuages, Lands, Tenements, Poffeffions and Hereditaments, in the faid County of Middlefex, and in the faid City of London, and the Rents and Revenues thereof, and the Office of Receiver thereof, fhall be and remain as valid

valid and effectual, and he the faid Walker Lord Bishop of Rochester, by himself and his Deputy or Deputies, fhall continue to receive the Iffues, Rents and Revenues thereof, and to pafs his Accounts in regard thereto, in fuch or the like manner, and to have such and the like Fees, Salaries, Allowances or Emoluments, in respect of such laft mentioned Honors, Lordships, Manors, Meffuages, Lands, Tenements, Poffeffions and Hereditaments, as if this A&t had never been paffed; and that no Bond, Obligation or other Security, given or entered into by the faid Walker Lord Bifhop of Rochester, or any Perfon or Perfons as his Surety or Sureties for the due Execution of his faid Office, fhall be in any manner vacated, annulled, rendered void or prejudiced by this prefent Act; but that every fuch Bond, Obligation or Security fhall be, remain and continue in full Force and Effect, with reference to the faid Poffeffions in the faid County of Middlefex and in the faid City of London, any thing herein contained or to be done in purfuance of this Act, or any Law, Statute or Usage to the contrary in anywife notwithstanding.

XVI. Provided also, and be it further enacted, That from and after After Deceafe the Decease of the faid Walker Lord Bishop of Rochester, all the Re- of Bishop, Regulations, Directions, Powers, Claufes and Provifions herein contained gulations of Act fhall extend to comprise and be applicable to the faid Honors, Lord- to extend to the hips, Manors, Meffuages, Lands, Tenements, Poffeffions and Hereditaments, in the County of Middlefex, and in the City of London, and the Rents and Revenues thereof, and the Appointment of all fubfequent Receivers thereof, which Receivers may be Surveyors of Lands or of Houses, or other competent Perfons, as fully and effectually, and in fuch and the like manner as if fuch Honors, Lordships, Manors, Meffuages, Lands, Tenements, Hereditaments and Poffeffions had been originally included in and fubjected to the faid Regulations, Directions, Powers, Clauses and Provifions of this A&t. XVII. Provided alfo, and be it enacted, That this Act, or any Auditor's Fee thing herein contained, or to be done in pursuance hereof, fhall not extend or be conftrued to take away, abridge or diminish any of the Fees, Perquifites or Allowances which the feveral Auditors of His Majefty's Land Revenues have been used and accustomed to take, receive or be allowed, for the Execution of any of the Duties of their refpective Offices before the paffing of this Act.
