Perfon or Perfons on board of fuch Ship or Veffel for that Purpose, every fuch Owner, Mafter or other Person shall for every fuch Offence forfeit and pay a Sum not exceeding Ten Pounds; and it fhall and may be lawful to and for the faid Harbour Master and his Affiftants, and he or his Affiftants are hereby required, to moor, unmoor, place, move or remove fuch Ship and Veffel accordingly; and Harbour Master in cafe any Mafter, Commander, Mate, Pilot or other Perfon or Perfons taking charge or command of any Ship or other Veffel, or any other Perfon or Persons whofoever, fhall obftruct or hinder the mooring, unmooring, placing, moving or removing of any Ship or other Veffel, lying or being in the faid Harbour, or being within the Distance of Five hundred Yards of the Entrance or Mouth of the faid Harbour, then and in every such case fuch Perfon or Perfons fo offending fhall for every such Offence forfeit and pay any Sum not exceeding Twenty Pounds.

III. And be it further enacted, That all Penalties to be incurred under this Act fhall be recovered in a fummary manner before any One of His Majesty's Juftices of the Peace for the County of Anglefea, by Diftrefs and Sale of the Offender's Goods and Chattels ; and in cafe no fufficient Diftrefs can be had, it shall and may be law ful for fuch Juftice of the Peace to commit the Perfon or Perfons fo offending to the Common Gaol or Houfe of Correction of the faid County, for any time not exceeding Six Months, or until such Fine fhall be paid.

An Act to make further Regulations for fecuring the Collection
of the Duties of Cuftoms and Excife in Ireland, and for the
Importation into Ireland of American Staves, and of old
Plate and Books from Great Britain. [26th June 1816.]

WHEREAS it is expedient to proportion the Rewards to

Officers of the Revenue and others making Seizures of Spirits, Tobacco and Snuff, in fome Degree to the Activity and Zeal of the Officers, and the Danger and Risk incurred in making 'fuch Seizures;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That fo much of an Act made in the Forty fixth Year of His prefent Majefty's Reign, intituled An A& more effectually to regulate the Collection of the Duties on Goods, Wares and Merchandize, imported or exported into or from Ireland, and the Payment of Bounties, Allowances and DrawProduce of Sei- backs thereon; and of an Act made in the Forty feventh Year of zures of Foreign His Majefty's Reign, intituled An Act to grant to His Majefty, until the Fifth Day of July One thousand eight hundred and eight, certain Duties on the Importation, and to allow Drawbacks on the Exportation of certain Goods, Wares and Merchandize into and from Ireland, as directs in what manner the Produce arifing by the Sale of any Brandy, Rum, Geneva or other Foreign Spirits, or of any Tobacco, which fhall be feized and condemned, as being illegally imported into Ireland, or attempted or intended fo to be, fhall be applied, or as gives any Part of fuch Produce to any Perfon or Perfons who fhall feize fuch Spirits or Tobacco, fhall be and the fame is hereby repealed.

And be it further enacted, That from and after the paffing of In what manner this A&t it fhall and may be lawful for the Commiffioners of Cuftoms fuch Seizures and Port Duties, and for the Commiffioners of Inland Excife and fhall be dif pofed of. Taxes in Ireland, or any Three of them refpectively, and they are hereby authorized in cafes appertaining to the Cuftoms or Excife refpectively, to direct any Foreign Spirits, Tobacco or Snuff, which shall be seized, and fhall be condemned as forfeited under any Act or Acts in force in Ireland, relating to the Revenues of Cuftoms or Excife, to be fold either for Home Confumption or Exportation, if under all the Circumftances it fhall appear to the faid Commiffioners respectively, to be most conducive to the Protection of the Revenue fo to do; and it shall be lawful for the faid Commiffioners respectively from time to time to give fuch Directions for the Removal of any fuch Spirits, Tobacco or Snuff, and to make fuch Regulations for the afcertaining the Value of fuch Spirits, Tobacco or Snuff, or to fix any average Value thereof, for the Purpose of afcertaining the Rewards to which the Informers or Officers or Perfons feizing the fame refpectively may be entitled, and as to the time and manner of paying the fame, as to fuch Commiffioners refpectively shall feem fitting, and alfo to regulate the Amount and Mode of Diftribution of Rewards to any Commiffioned or Non Commiffioned Officer or Private Man of His Majesty's Forces, or any Commiffioned Officer, Petty or Warrant Officer, or Seaman of His Majefty's Navy or Marines, as shall appear to be reasonable, and the time and mode of paying the fame.

III. And be it further enacted, That the feveral Rewards herein- Rewards for after mentioned fhall be paid and allowed for and in refpect of all Seizures, how Seizures of Foreign Spirits, Tobacco and Snuff, which shall be made apportioned and from and after the paffing of this Act, that is to fay, in the case of applied. Seizures of fuch Spirits, Tobacco or Snuff made at Sea, or in any Port or Harbour of Ireland, if the Officer of Cuftoms or Excise, or other Persons making fuch Seizures, fhall also arreft, ftop and detain the Perfons, or fome or one of them, who shall be or shall have been employed in navigating the Ship, Veffel or Boat in or on board which fuch Spirits, Tobacco or Snuff fhall be or shall have been brought, found or feized, or in unlading, removing or carrying away. fuch Spirits, Tobacco or Snuff, and fhall take or convey, or cause every Perfon fo arrefted, stopped or detained, to be taken or conveyed before One or more of His Majefty's Juftices of the Peace, to be dealt with according to Law, or being a Seaman or Seafaring Man found on board fuch Ship, Veffel or Boat, fhall take and carry him to any Ship or Veffel of War in His Majefty's Service, or into the Cuftody of any Officer employed in His Majefty's Imprefs Service, then and in any fuch cafe fuch Officer of the Customs or Excife, or other Perfon fo making Seizure of Spirits, Tobacco or Snuff, fhall be entitled to and shall be paid One Moiety of the Value at which fuch Spirits, Tobacco or Snuff fhall be or fhall have been respectively estimated or fixed by the faid Commiffioners of Customs and Port Duties, or by the faid Commiffioners of Inland Excife and Taxes respectively, in pursuance of the Powers vefted in them by this A&t; and in the case of fuch Seizures of Spirits, Tobacco or Snuff made on Shore, if the Officer of Cuftoms or Excife, or other Per. fon making the fame, fhall alfo ftop, arreft and detain the Perfons Arrefting Peror fome or one of them from whom the fame fhall be feized, and fhall fons from whom 56 GEO. take or carry, or cause every Perfon fo arrested, stopped or detained to be taken or carried before Óne of His Majefty's Juftices of the Peace to be dealt with according to Law, then and in fuch cafe fuch Officer of the Cuftoms or Excife, or other Person so making feizure of Spirits, Tobacco or Snuff, fhall be entitled to and fhall be paid One Moiety of the full Value at which fuch Spirits, Tobacco or Snuff fhall be or fhall have been fo estimated or fixed as aforefaid; and in the cafe of fuch Seizure of Spirits, Tobacco or Snuff, whether on Sea or on Shore, if the Officer of the Customs or Excise, or other Perfon making the fame, fhall alfo feize and profecute, or cause to be profecuted, the Ship, Veffel or Boat on board of which fuch Spirits, Tobacco or Snuff fhall be or fhall have been brought, found or seized, or the Cattle or Carriages ufed or employed in moving or conveying and not arrefting the fame, but fhall not alfo ftop, arreft and detain the Perfons, or fome or one of them, who fhall be or fhall have been employed in navigating the Ship, Veffel or Boat in or on board which fuch Spirits, Tobacco or Snuff fhall be or fhall have been brought, found or feized, or in unlading, removing or carrying away fuch Spirits, Tobacco or Snuff, or the Perfons, or fome or one of them, from whom the fame fhall be feized and taken, or carry or cause all and every fuch Perfons fo ftopped, detained or arrefted to be taken or carried before One or more of His Majefty's Juftices of the Peace, to be dealt with according to Law, then and in every fuch cafe the Officer of the Customs or Excife, or other Perfon making fuch Seizure, fhall be entitled to and fhall be paid only One Third Part of the Value at which fuch Spirits, Tobacco and Snuff fhall be fo estimated or fixed as aforefaid; and in cafe any Officer of Cuftoms or Excife, or other Perfon, fhall make Seizure of any Spirits, Tobacco or Snuff, and fhall neither feize and profecute, or caufe to be profecuted, the Ship, Veffel or Boat, Cattle or Carriage, in or on board which fuch Spirits, Tobacco and Snuff fhall be or or fhall have been brought, found or feized, or which fhall be used or employed in removing or conveying the fame, nor fhall ftop, arreft and detain the Perfon or Perfons, or fome or one of them, who fhall be or fhall have been employed in navigating the Ship, Veffel or Boat in or on ⚫ board which fuch Spirits, Tobacco or Snuff fhall be or fhall have been brought, found or feized, or in unlading, removing or carrying fuch Spirits, Tobacco or Snuff, or from whom the fame fhall be feized or taken, or fhall not carry and convey, or caufe all and every fuch Perfon fo arrefted, stopped or detained before One or more of His Majesty's Juftices of the Peace, then and in fuch cafe the Officer of the Customs or Excife, or other Perfon making fuch Seizure, fhall be entitled to and fhall be paid only One Fourth Part of the Value at which fuch Spirits, Tobacco or Snuff shall be so estimated or fixed as aforefaid; and in all cafes where any fuch Officers or Perfons shall seize, within the Limits of any of the Ports of Ireland, or in any Part of the Irish Channel, or elsewhere on the High Seas within One hundred Leagues of any Part of the Coafts of Ire land, any Spirits which fhall have been funk or concealed under or in the Water within fuch Limits or Diftance, every fuch Officer and Perfon fo feizing fuch Spirits fhall be entitled to and fhall be paid One Moiety of the Value at which fuch Spirits shall be fo eftimated or fixed as aforefaid.

IV. And be it further enacted, That so much of the faid recited 46 G. 3. c.87. Act of the Forty fixth Year of His prefent Majefty's Reign, whereby $ 98. repealed. it is enacted, that an Allowance at the Scale fhall be made of Eight Pounds for Draft of every Package that shall contain Four hundred and fifty Pounds Weight of Tobacco, or more, and Two Pounds for every fuch Package for Nailage, fhall be and the fame is hereby repealed; and that from and after the paffing of this Act, the proper Cuftoms Landing Waiter and Landing Waiters fhall, in the weighing and taking Account of all Tobacco and Snuff respectively, give the Turn of the Scale in favour of the Crown, and in lieu thereof fhall allow Two Pounds Weight Avoirdupois, and no more for Draft Allowance. of every Package which fhall contain Four hundred and fifty Pounds. Weight, or more, of Tobacco or Snuff respectively, any Law, Usage or Cuftom to the contrary notwithstanding.

V. And be it further enacted, That from and after the paffing of Commiffioners this A&t, it shall and may be lawful for the Commiffioners of Cuftoms and Port Duties in Ireland, to permit the Importation into Ireland of Tobacco, Spirits, Teas, Wines or Coffee, at any fuch Ports or Places in Ireland as the faid Commiffioners fhall think fit, under and fubject to fuch Regulations and Restrictions in other Refpects as Tobacco, Spirits, Teas, Wines or Coffee may by Law be imported into Ireland; provided it shall be made to appear, to the Satisfaction of the faid Commiffioners, that fuch Port or Place is, with respect to the Trade and Commerce carried on therein, and from the Nature of its Situation, a Port or Place at which it would be just and reafonable to permit fuch Importation.

VI. And be it enacted, That from and after the paffing of this Staves not exAct it shall and may be lawful for the Commiffioners of Cultoms and ceeding 15 Port Duties, to permit all Staves of Wood not exceeding One Inch Inches thick of and a Half in Thickness, being of the Growth and Production of States, &c. may the United States of America, or of the Growth and Production of be imported on Eaft or Weft Florida, and imported from thence respectively into Payment of One Ireland, on Payment of One Third Part only of the feveral Duties Third of the of Cuftoms charged on Staves in and by an Act made in the Fifty fourth Year of His prefent Majefty's Reign, intituled An Ad to grant to His Majefly Rates and Duties, and to allow Drawbacks and Bounties on certain Goods, Wares and Merchandize, imported into and exported from Ireland, in lieu of former Rates and Duties, Drawbacks and Bounties; and in and by an Act made in the laft Seffion of Parliament, intituled An A&t to impofe certain Duties on the Importation, and to allow Drawbacks on the Exportation of certain Sorts of Wood into and from Ireland, in lieu of former Duties and Drawbacks on the like Sorts of Wood; and to indemnify Perfons who have admitted certain Sorts of Wood to Entry, on Payment of a Proportion only of the Duty impofed thereon, and the Schedules to the faid Acts refpectively annexed; any thing in the faid recited Acts or either of them, or in the Schedules thereto annexed, to the contrary in anywife notwithstanding,

VII. And, for the better fecuring the Collection of the Duties Auctioneers to payable on Auctions in Ireland, be it further enacted, That upon prove no Sale the Trial of any Complaint or Information against any Auctioneer took place un(who fhall have delivered or caufed to be delivered, or who shall de- der Catalogue in liver or caufe to be delivered any Catalogue of any Sale by Auction, Non Delivery of intended to be held by such Auctioneer) for the Recovery of any Sale Accounts Gg 2

Penalty for the Offence of neglecting or omitting to deliver any fuch Sale Account as fuch Auctioneer is, under and by virtue of an Act paffed in the Fifty fourth Year of His prefent Majefty's Reign, intituled An Act to grant to His Majefty Duties upon Auctions in Ireland, in lieu of former Duties thereon, and to provide for the regulating and fecuring the Collection of the faid Duties, and to prevent Frauds therein, required to deliver of the feveral Articles, Lots or Parcels contained in fuch Catalogue as aforefaid, every fuch Auctioneer shall be convicted of fuch Offence and fhall incur fuch Penalty, unless such Auctioneer shall make due Proof that no Sale whatever by way of Auction had taken place, or was any way opened or begun under fuch Catalogue.

• VIII. And Whereas by an Act made in the Forty eighth Year of His prefent Majefty's Reign, intituled An Ad for abolifbing Fees received by Officers in the Service of the Customs, in the feveral Ports of Ireland, and for regulating the Hours of Attendance, and the Number of Holidays to be obferved by the faid Officers and certain Officers of Excife, it is enacted, that certain annual Payments by way of Compenfation fhall be made to Officers, Clerks and other Perfons employed in or holding any Office in the Service of the Cuftoms, at any Port in Ireland, who may fuftain Lofs by the Abolition of 'Fees directed by the said Act, and that every fuch annual Payment by way of Compenfation to any fuch Officer, Clerk or other Person 'fhall continue during the time any fuch Perfon fhall continue to hold fuch Office or Employment: And Whereas it may happen that fuch Officers, Clerks or other Perfons receiving fuch Compenfation, may be removed to fome other Offices or Employments in the Ser'vice of the Cuftoms, the annual Salary or other Emoluments of ' which may not amount to more than the Salary and annual Allowance by way of Compenfation made to fuch Officer, Clerk or other Perfon under the faid recited Act in refpect of the Office from which 'fuch Officer, Clerk or other Perfon may be removed, and which might be detrimental to the Officer, Clerk or other Person so removed;' Be it therefore provided and enacted, That in cafe any fuch Officer, Clerk or other Perfon who fhall receive any fuch annual Payment by way of Compenfation under the faid recited A&t of the faid Forty eighth Year fhall be removed to any other Office or Em ployment in the Service of the Cuftoms, the annual Salary or other Emoluments of which do not amount to more tham the Salary, and the further annual Allowance by way of Compenfation made under the faid recited Act, to any fuch Officer, Clerk or other Perfon, would have amounted to, then and in fuch case it shall and may be lawful for the Commiffioners of Cuftoms and Port Duties, by and with the Con. fent and Approbation of the Lord Lieutenant or other Chief Gover nor or Governors of Ireland, to continue to pay fuch Officer, Clerk or Perfon fo removed, the Allowance or any Part thereof which may have been granted by way of annual Compenfation, for Lofs of Fees, to fuch Officer, Clerk or other Perfon, by the said Commiffioners, by the Direction of the Lord Lieutenant or other Chief Governor or Governors of Ireland, according to the faid recited A&t, notwithtanding any fuch Removal as aforefaid, and notwithstanding any thing in the faid recited A&t in anywife to the contrary.

IX. And be it further enacted, That from and after the paffing of this Act it shall and may be lawful for the Commiffioners of Customs
