CAP. LXXXI.

An Act to alter the Period during which Manufacturers of Oil of Vitriol are to deliver in their Accounts.

[25th June 1816.]

WHEREAS by an Act palled in the Fiftieth Year of His 50 G. 3. c. 40.

prefent Majefty's Reign, intituled An Ad for difcontinuing

the Bounty on Exportation of Oil of Vitriol, and allowing a Drawback of a Proportion of the Duties paid on the Importation of Foreign Brimftone ufed in making Oil of Vitriol; it is enacted, that every 'Manufacturer of Oil of Vitriol, intending to claim any Drawback or Repayment under the above recited Act fhall make an Entry of his Name and Place of Abode with the Collector of the Customs of the Port within or nearest to which his Work shall be carried on, and shall once in every Month enter in a Book to be kept for that • Purpose an Account of the whole Quantity of Foreign Brimstone ufed and confumed in his Manufactory within the preceding Month; and at the End of the Year, to be computed from the Date of fuch Entry as aforefaid, fhall deliver the faid Account to 'the Collector of the Cuftoms with whom he shall have made fuch Entry as aforefaid: And Whereas it has been found by Experience 'that Difficulties arife in delivering fuch Account at the End of the Year; Be it therefore enacted by The King's Moft Excellent Majefty by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled,

and by the Authority of the fame, That from and after the paffing Accounts to be of this A&t it fhall and may be lawful for the Manufacturers of Oil delivered within of Vitriol to deliver the Account required by the aforefaid recited Six Months after Expiration A&t to the Collector of the Cuftoms with whom they fhall have made of Year. the Entry as required by the faid recited Act, within Six Months after the Expiration of the Year, computed from the Date of the Entry.

II. And be it further enacted, That it fhall not be requifite for the Manufacturers of fuch Oil of Vitriol after the First Entry of his Name and Place of Abode to make any further Entry of the fame unless any Alteration fhall take Place in the Firm of fuch Manufactory, or where more than One Year has been fuffered to elapfe without manufacturing any fuch Oil of Vitriol, any thing in the before recited Act to the contrary notwithstanding; and the Manufacturers of Oil of Vitriol fhall be entitled to the like Drawback on the like Conditions, and fhall be liable to the like Forfeitures for delivering false Accounts, as were provided by the aforefaid recited A&t.

An Act to render valid the judicial Acts of Surrogates of
Vice Admiralty Courts abroad, during Vacancies in Office
of Judges of fuch Courts.

HEREAS it is requifite that due Validity should be given to the judicial A&ts of Surrogates who have executed the ' Offices of Judges in the Courts of Vice Admiralty established in His Majefty's Plantations and Colonies, during Vacancies occafion'ed by the Deaths or Refignation or other Removals of the faid

Judges, or who also shall hereafter execute the fame during fuch • Vacation;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament assembled, and by the Authority of the fame, That all judicial Acts of Surrogates having been appointed to act as Judges during fuch Vacancies, either by Judges of the faid Courts previously to their Removal, or, in Default of fuch Appointment, by the Governors of the Plantations and Colonies in which fuch Courts fhall be, fhall have the fame Force and Validity, and shall be subject to the fame Course of Appeal, as if the faid Acts had been done by the Authority of Judges regularly appointed by the Lords Commiffioners of the Admiralty.

CAP. LXXXIII.

An Act for regulating the carrying of Paffengers to and from the Ifland of Newfoundland and Coast of Labrador.

[25th June 1816.] HEREAS an Act was paffed in the Forty third Year of His prefent Majefty's Reign, intituled An Ad for regulating the Veffels carrying Paffengers from the United Kingdom to His Majefty's Plantations and Settlements abroad, or to Foreign Parts, with refped to the Number of fuch Paffengers: And Whereas an Act was paffed in the Forty fourth Year of His faid Majefty's Reign, to exempt Veffels in the Newfoundland Trade from the • Provifions of the above recited Act of the Forty third Year of His prefent Majefty's Reign, whereby the Conveyance of Paffengers from the United Kingdom to Newfoundland and Labrador is no longer fubject to any legal Provifions: And Whereas it is expedient to make special Regulations for the Intercourfe between the United Kingdom and the Inland of Newfoundland and Coast of Labrador, fo far as regards the Conveyance of Paffengers and the providing them with proper Accommodation, and an adequate Supply of Water and Provifions;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That before fels to enter into the failing of any Ship or Veffel from any Port or Place in the United Kingdom to Newfoundland or the Coaft of Labrador, with Paffengers, the Mafter or other Perfon having or taking the Charge or Command of every fuch Ship or Vessel, and the Owner or Owners thereof, fhall enter into Security by Bond to His Majefty, his Heirs and Succeffors, in the Penalty of Five hundred Pounds, with Condition that there fhall not be taken on board any fuch Ship or Veffel any more fuch Paffengers than are hereinafter permitted and allowed; which Bond fhall be taken by and depofited with the Collector and Comptroller, or other principal Officer of His Majesty's Customs at the Port from which fuch Ships or Veffels fhall fail; and the Mafter or other Perfon, having or taking the Charge or Command of fuch Ship or Veffel previous to his leaving the faid Port, fhall and is hereby required to deliver to the faid Collector and Comptroller, or other principal Officer of His Majefty's Customs at the faid Port, a Lift containing the Number of the faid Paffengers, with their Names,

II. And be it further enacted, That if the Mafter or other Perfon Taking more having or taking the Charge or Command of fuch Ship or Veffel, than Number fhall take or have on board his Ship or Veffel, or if the Owner or Owners of fuch Ship or Veffel fhall engage to take on board more Perfons than the Number allowed, they fhall refpectively forfeit the Penalty. III. And be it further enacted, That from and after the paffing Number of Parof this Act it shall not be lawful for any Ship or Veffel from fengers allowed Place in the United Kingdom of Great Britain and Ireland, or from according to Size Guernsey and Jerfey, to carry to any Part of Newfoundland or Coaft of Labrador a greater Number of Paffengers than in the following Proportion; that is to say, any British Ship or Veffel having a Second Deck may take Paffengers at the Rate of One for every unoccupied Space being Six Feet in Length by Two Feet in Breadth, and being of the full perpendicular Height between the Two Decks; or any British Ship or Veffel which shall have only One Deck over her Hold may take Paffengers at the Rate of One for every Space between the Cargo ftowed in the Hold and the Deck, being Six Feet in Length and Two Feet in Breadth, and being the Height of Five Feet perpendicular above the Cargo, and being independent in either cafe of the Space which may be requifite for the Stowage of the Water and Provifions and Baggage of the Paffengers, and the full Space before mentioned fhall accordingly be allotted for the Accommodation of each Paffenger fo taken on board.

IV. And be it further enacted, That every fuch Ship or Veffel Quantity of fhall be furnished at the time of her Departure to commence the Provifions to be Voyage, with at leaft Ten Weeks' Supply of good and wholefome on board. Water, fo as to furnish a Supply of Five Pints of Water per Day for every fuch Paffenger, exclufive of the Crew, and the faid Supply of Water shall be ftowed below the Deck; and every fuch Ship or Veffel fhall also be furnished with such a Supply of Provifions as will afford an Allowance for every fuch Paffenger, exclufive of the Crew, during the faid Period of Ten Weeks, of One Pound of Bread or Biscuit and One Pound of Beef, or Three Quarters of a Pound of

V. And be it further enacted, That the Master or other Person having or taking the Charge or Command of any Ship or Veffel, failing to give out the Allowance of Provifions and Water hereinbefore fpecified, fhall forfeit the Sum of Ten Pounds of lawful Money for each and every fuch Neglect and Omiffion.

VI. And be it further enacted, That an Abstract of this A&t, ftating the Number of Paffengers allowed to be taken, and the daily and weekly Allowance of Water and Provifions, fhall be expofed in fome confpicuous Part of the Ship or Veffel to which the faid Paífengers have Recourfe; in failure of which, the Mafter, or other Perfon having or taking the Charge or Command of fuch Ship or Veffel, fhall forfeit the Sum of Ten Pounds.

VII. And be it further enacted, That the Master or other Perfon having or taking the Charge or Command of any fuch Ship or from Newfound- Veffel, engaging to take on board any fuch Paffengers from Newfoundland or the Coast of Labrador, for the Purpofe of returning form to Regul- from thence to the United Kingdom, fhall conform to the Regul ations above enacted as to the Number of Paffengers which it shall be lawful for them to take on board, and shall be liable to the like Penalties for any Breach of fuch Regulations as are hereinbefore enacted, with respect to Veffels proceeding from the United Kingdom to Newfoundland or the Coast of Labrador.

VIII. And be it further enacted, That every fuch Ship or Vessel returning from Newfoundland or the Coast of Labrador to any Port or Place of the United Kingdom with Paffengers as aforefaid, shall be furnished, at the time of her Departure to commence the Voyage, Supply of Water with at least Seven Weeks' Supply of good and wholesome Water, fo as to furnish a Supply of Five Pints of Water per Day for every fuch Paffenger, exclufive of the Crew, and the faid Supply of Water fhall be ftowed below the Deck; and every fuch Ship or Veffel shall also be furnished with fuch a Supply of Provifions as will afford an Allowance for every fuch Paffenger, exclufive of the Crew, during the faid Period of Seven Weeks, of One Pound of Bread or Bifcuit and One Pound of Beef, or Three Quarters of a Pound of Pork, per Day, and alfo Two Pounds of Flour, Three Pounds of Oatmeal, or Three Pounds of Peas or Pearl Barley, and Half a Pound of Butter, weekly; the weekly Allowance to commence on the Day the Veffel puts to Sea.

IX. And be it further enacted, That the Mafter or other Perfon having taken the Charge or Command of any Ship or Veffel, failing to give out the Allowance of Provifions and Water hereinbefore fpecified, fhall forfeit the Sum of Ten Pounds of lawful Money for each and every fuch Neglect and Omiffion.

X. And be it further enacted, That all Penalties and Forfeitures to be incurred under this Act fhall and may be recovered in a fummary way on the Oath of One or more Witnefs or Witnesses, before any One or more of His Majefty's Juftice or Juftices of the Peace of any County, County of a City, Riding, Shire or Place in the United Kingdom where fuch Ship or Veffel fhall depart from or come to in or during fuch Voyage, or in a fummary Way in any

Surrogate Court or Courts of Seffion, having Jurifdiction in the Iland of Newfoundland; and fuch laft mentioned Penalties and Forfeitures as fhall be recovered in Newfoundland shall be paid to the Governor of Newfoundland for the time being, or other Person acting for him, or fome Perfon authorized by either of them for that Purpose; to be applied under the Direction of fuch Governor or other Perfon acting for him, or fome Person authorized by either of them for that Purpofe, for defraying the Paffage home of such Perfons as ought to be fent to that Country to which they belong.

XI. Provided always, and be it further enacted, That nothing in this A&t contained fhall extend, or be conftrued to extend, to the Conveyance of any Perfons on board of any fuch Ship or Veffel, whether Fishermen, Youngsters or others, being Hired Servants to be employed on the Establishment of their refpective Mafters or Hirers in the Profecution of the Fisheries carried on from Newfoundland or the Coaft of Labrador.

Act not to affect Conveyance of Perfons employed on the

Establishment.

An Act for the better Accommodation of His Majesty's Packets within the Harbour of Holyhead, in the Ifland of Anglefed; and for the better Regulation of the Shipping therein. [25th June 1816.] HEREAS the Pier within the Harbour of Holyhead, in the Ifland of Anglefea, has been erected at the Public Expence, 'chiefly for the Accommodation and fafe lying of His Majesty's Packets: And Whereas great Inconvenience has arifen, in confe'quence of the occafionally crowded State of the Harbour, and the Want of Regularity in mooring the Veffels therein;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this present Parliament affembled, and by the Authority of the fame, That from and after the paffing of this Act it fhall Poftmafters and may be lawful for His Majefty's Poftmafter or Postmasters Ge. II. And be it further enacted, That every fuch Harbour Mafter Power of Harfhall have full Power and Authority to direct the mooring, unmooring, moving and removing of all Ships or other Veffels, coming into, lying or being in the faid Port or Harbour of Holyhead, or any Part thereof, or any Place being within the Distance of Five hundred Yards of the Entrance or Mouth of the faid Harbour; and to appoint and regulate the time or times, and the manner of their Entrance into, lying in or going out of or from fuch Harbour, fave and except in ftormy or tempeftuous Weather; and to regulate and determine the Pofition of fuch Ships and other Veffels; and in case any Owner, Master or other Perfon having the Charge or Command of any fuch Ship or other Veffel fhall refufe or neglect to moor, unmoor, place, move or remove his Ship or Veffel according to fuch Direction, immediately when Notice to him or them shall be given or left with any
