VI. Provided alfo, and be it further enacted, That it fhall be Security for Paylawful for the Court making any fuch Rule to require that the ment of Coits. Party on whofe Application the fame fhall be made shall give fuch Security as fhall to fuch Court feem proper for Payment of Cofts, under fuch Circumftances as fhall be fpecified in any Rule made for that Purpose.

VII. And be it further enacted, That in all cafes where any Money fhall have been or shall be agreed, or fhall have been or fhall be found by the Verdict of any Jury to be paid or given for any of the Lands, Tenements or Hereditaments hereinbefore mentioned and defcribed, belonging to any Perfon or Perfons under any Difability or Incapacity, or abfent, or not having the abfolute Intereft therein, the fame fhall be paid by the Treasurer of His Majesty's Navy for the time being into the Hands of the Deputy of The King's Remembrancer of His Majefty's faid Court of Exchequer for the time being for the Ufe and Benefit of fuch Perfon or Perfons, and the faid Deputy Remembrancer is hereby authorized and required to receive and to give a Discharge for the fame, and upon the Receipt thereof to fign a Certificate to the Barons or Judges of the faid Courts of Exchequer under his Hand, purporting and fignifying that fuch Money or other Confideration was received by and paid to him in pursuance of this Act, for the Ufe and Benefit of fuch Perfon or Perfons who fhall be named and defcribed in fuch Certificate, and the faid Certificate fhall be filed in the faid Court of Exchequer, and a true Copy thereof figned by the Deputy Remembrancer of fuch Court fhall and may be read and allowed as Evidence for the purposes hereinafter mentioned; and the faid Deputy Remembrancer is hereby required upon Receipt of any fuch Sum or Sums of Money as aforefaid to pay the fame into the Bank of England; and immediately upon the filing of fuch Certificate the faid Lands, Tenements and Hereditaments fhall be and become vested in or to the Ufe of His Majefty, his Heirs and Succeffors.

VIII. And be it further enacted, That the Barons or Judges of Court of ExHis Majesty's Court of Exchequer of the Degree of the Coif for the time being refpectively, or any Two or more of them, fhall be and they are hereby authorized and empowered, in a fummary way, upon Motion or by Petition for and on behalf of any Perfon or Perons interested in or entitled to the Benefit of the Money fo paid to and received by the faid Deputy Remembrancer, or the Intereft or Produce thereof, and upon reading the Certificate directed to be figned by the faid Deputy Remembrancer concerning the fame as aforefaid, and receiving fuch further Satisfaction as they fhall think neceffary, to make and pronounce fuch Orders and Directions for paying the faid Money, or any Part of the fame, or for placing out fuch Part thereof as fhall be Principal in the Public Funds, or upon Government or Real Securities, and for Payment of the Dividends or Intereft thereof, or any Part thereof, to the respective Perfons entitled to receive the fame, or for laying out the Principal, or any Part thereof, in the Purchase of other Lands or Hereditaments, to be conveyed and fettled to, for and upon the fame Ufes, Trufts, Intents and Purposes as the faid Lands and Hereditaments fo taken ftood fettled at the time of the Payment of fuch Money as aforefaid, or as near as the fame can be done, or otherwife, concerning the dif pofing of the faid Money, or any Part thereof, and the Interest of

the fame, or any Part thereof, for the Benefit of the Perfon or Per. fons entitled to and interested in the fame respectively, or for appointing any Perfon or Perfons to be Truftee or Trustees for all or any of fuch Purposes as the faid Court fhall think juft and reasonable. IX. And be it further enacted, That upon the Death or Removal of any fuch Deputy Remembrancer all Stocks and Securities vefted in him by virtue of this Act fhall veft in the fucceeding Deputy Remembrancer for the Purposes hereinbefore mentioned without any Affignment or Transfer; and all Monies paid into the Bank of England in pursuance of this Act, or remaining in the Hands of any Deputy Remembrancer at his Death or Removal, and not vested in the Funds or placed out on Securities as aforefaid, fhall be paid over to the fucceeding Deputy Remembrancer for the time being.

X. And be it further enacted and declared, That if in any cafe The King's Remembrancer fhall execute the faid Office in Perfon, then and in fuch case the several Trufts, Powers and Authorities by this Act vested in the faid Deputy Remembrancer and his Succeffors, fhall, during fuch time as no Deputy Remembrancer shall be appointed, be vefted in and be executed by the faid King's Remembrancer for the time being.

CAP. LXXV.

An Act to repeal the Duties of Cuftoms upon the Importation into the United Kingdom of Rape Seed and Cole Seed, and to grant other Duties in lieu thereof. [24th June 1816.] WHEREAS it is expedient that the Duties of Cuftoms now

payable upon the Importation into the United Kingdom of Rape Seed and Cole Seed fhould be repealed, and that other Duties fhould be impofed in lieu thereof;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the First Day of July One thoufand eight hundred and fixteen, the Duties of Customs payable by Law upon the Importation into the United Kingdom of Rape Seed and Cole Seed shall cease and determine, fave and except in all cafes relating to the Recovery or paying any Arrears thereof which may remain unpaid, or to any Fine, Penalty or Forfeiture relating thereto, which fhall have been incurred at any time before the said First Day of July One thoufand eight hundred and fixteen; and that from and after the said Day, in lieu and instead of the Duties hereby repealed, there shall be raised, levied, collected and paid, unto His Majefty, his Heirs and Succeffors, for every Laft of Rape Seed or Cole Seed imported into the United Kingdom the Sum of Ten Pounds.

And be it further enacted, That fuch of the faid Duties as Management of fhall arife in that Part of Great Britain called England fhall be under the Management of the Commiffioners of the Cuftoms in England for the time being; and fuch thereof as fhall arife in that Part of Great Britain called Scotland, fhall be under the Management of the Commiffioners of Customs in Scotland for the time being; and fuch thereof as fhall arife in that Part of the United Kingdom called Ireland fhall be under the Management of the Commiffioners of the Cuftoms and Port Duties in Ireland for the time being.

And be it further enacted, That the faid Duties fhall be ma- Duties how naged, ascertained, raifed, levied, collected, paid and recovered in fuch levied. and the like manner as any Duties of Cuftoms of a like Nature are managed, afcertained, raised, levied, collected, paid and recovered, and under and fubject to the feveral Powers, Conditions, Rules, Regulations, Restrictions, Penalties and Forfeitures now in force in relation to or made for fecuring the Revenue of Cuftoms in Great Britain or Ireland; and all Pains, Penalties, Fines and Forfeitures for any Offences whatever committed against or in breach of any A&t or Acts of Parliament in force on or immediately before the paffing of this A&t, made for fecuring the Revenue of Customs or for the Regulation or Improvement thereof, and the feveral Claufes, Powers and Directions therein contained, fhall be in full force and effect as to the faid Duties, as fully and effectually to all Intents and Purposes, as if they were at large repeated and reenacted in this Act.

IV. And be it further enacted, That all the Monies from time to Application of time arifing from the faid Duties in Great Britain, the neceffary Duties. Charges of raifing and accounting for the fame respectively excepted, fhall from time to time be paid into the Receipt of His Majesty's Exchequer at Westminster, under the Head of Confolidated Customs, and shall be carried to and made Part of the Confolidated Fund of Great Britain; and that all the Monies arifing from the faid Duties in Ireland, the neceffary Charges of raifing and accounting for the fame being deducted, shall be carried to and made Part of the Confolidated Fund of Ireland.

V. And be it further enacted, That this A&t may be altered, Act may be amended or repealed by any Act or Acts to be passed in the present altered, &c. Seffion of Parliament.

CAP. LXXVI.

An Act for repealing the feveral Bounties on the Exportation of Refined Sugar, from any Part of the United Kingdom, and for allowing other Bounties in lieu thereof, until the Fifth Day of July One thousand eight hundred and eighteen. [24th June 1816.]

WHEREAS it is expedient that the feveral Bounties respect

II. And be it further enacted, That the feveral Bounties on Refined Sugar, by this A&t granted, fhall be paid or allowed in fuch and the like manner in every Refpect, and fubject and under and according to the like Rules, Regulations, Reftrictions, Conditions, Securities, Penalties and Forfeitures, (except where any Alteration is made by this Act,) as any Bounties on Refined Sugar exported from any Part of the United Kingdom were paid or allowed before the faid Fifth Day of July One thoufand eight hundred and fixteen.

III. Provided always, and be it further enacted, That the several and respective Bounties on any Sort of Refined Sugar exported from any Part of the United Kingdom, which from and after the faid Fifth Day of July One thoufand eight hundred and fixteen, are by this Act repealed, fhall be paid or allowed on any fuch Sugar which fhall be actually fhipped for the Purpose of Exportation from any Part of the United Kingdom, on or before the faid Fifth Day of July One thoufand eight hundred and fixteen, notwithstanding fuch Sugar may not be exported until after the faid Fifth Day of July One thousand eight hundred and fixteen.

IV. And be it further enacted, That nothing in this Act contained fhall extend or be conftrued to extend to alter or repeal the Deduction to be made from the Bounty allowed on Sugar when exported from any Part of the United Kingdom, in any other than a British Veffel owned, navigated and registered according to Law, as directed by an A&t paffed in the Forty third Year of the Reign of His prefent Majefty, intituled An Ad for difcontinuing certain Drawbacks and Bounties on the Exportation of Sugar from Great Britain, and for allowing other Drawbacks and Bounties in lieu thereof, until the Fifteenth Day of January One thousand eight hundred and four; or by an Act made in the Forty feventh Year of His prefent Majefty's Reign, intituled An Act to provide more effectually for regu lating the Drawbacks and Bounties on the Exportation of Sugar from Ireland, and for allowing British Plantation Sugar to be warehoused in Ireland until the Twenty fifth Day of March One thoufand eight bundred and eight.

V. And be it further enacted, That this A&t fhall continue in force until the Fifth Day of July One thousand eight hundred and eighteen.

VI. And be it further enacted, That this Act, or any of the Provifions thereof, may be amended, altered or repealed, by any A&t or Acts to be made in this prefent Seffion of Parliament.

of former Acts granting exclufive Privileges of Trade to
the South Sea Company.

§ 5.

WE WHEREAS by an A&t paffed in the Fifty fifth Year of the 55 G. 3. c. 57. Reign of His prefent Majefty, intituled An Ad to repeal the Provifions of former Aas granting exclufive Privileges of Trade to 'the South Sea Company, and to indemnify the faid Company for the Lofs of fuch Privileges; it is enacted, that there fhall be raised, le'vied, collected and paid unto His Majefty, his Heirs and Succeffors, upon all Goods, Wares and Merchandizes imported into any Port of the United Kingdom from any Place within the Limits of the fole and exclufive Trade heretofore granted to the faid Company (except Blubber, Train Oil, Head Matter, or Whale Fins, Seal Skins, and other Produce of Fish or Creatures living in the Seas, taken and caught by the Crews of British and Irish built Ships or Veffels) a Duty of Customs of Two Pounds upon every 'Hundred Pounds Value of all fuch Goods, Wares and Merchan 'dizes, and upon Ships or Veffels according to the Tonnage thereof, ⚫ entering outwards or inwards at any Port within the United King'dom to or from any Port or Place within the Limits of the faid 'fole and exclufive Trade fo heretofore granted to the faid Company as aforefaid, a Duty of Cuftoms of One Shilling and Sixpence upon every Ton Burthen of every fuch Ship or Veffel: And 'Whereas it is expedient that Bullion and Foreign Coin of Gold and 'Silver fhould be imported from any Place within the Limits of the 'fole and exclufive Trade heretofore granted to the faid Company Duty free;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That fo much of the Bullion and aforefaid Act as impofes or authorizes the raifing, levying or col- Foreign Coin lecting any Duty of Cuftoms upon Bullion and Foreign Coin of Gold imported, reand Silver imported from any Ports or Places therein defcribed, fhall be and the fame is hereby repealed accordingly.

And Whereas it is also expedient that the faid Duty of Two Pounds upon every One hundred Pounds Value fhould not be le'vied, upon or in refpect of fuch Goods, Wares or Merchandize, as are warehoused under the Provifions of any Act of Parliament for 'depofiting Goods in Warehouses and thereafter taken out for Ex'portation;' Be it therefore enacted, That from and after the paffing Duty of 21. on of this Act, the faid Duty of Two Pounds upon every Hundred every tool. Pounds Value of fuch Goods, Wares and Merchandize, fhall not warehoufed for be raised, levied, collected or paid for or in refpect of any fuch Goods, Exportation, nct Wares or Merchandize depofited under the Provifions of the Acts to be levied in of Parliament for depofiting Goods in Warehouses, and which shall future: thereafter be taken out of the Warehoufes for Exportation, and duly exported according to Law, and under fuch Regulations and Reftrictions as are applicable to like Goods taken out of Warehouses for Exportation; any thing in the faid recited A&t to the contrary. notwithstanding.
