XLIX. And be it further enacted, That no Conviction made or Convictions not alleged to be made by any Juftice, or before any Juftices of the Peace at the Quarter Seffions, nor any Sentence or Order given or made, or alleged to have been given or made by any fuch Juftice or Juftices under or by virtue of this A&t, fhall be removed by Writ of Certiorari out of the County, City, Town or Place wherein fuch Conviction or Proceeding fhall have been had or made, and that no Writ of Certiorari fhall fuperfede Execution or other Proceedings upon any Conviction, Order or Sentence made or given in pursuance of this Act, but that Execution and other Proceedings fhall be had and made thereupon; any fuch Writ of Certiorari or Allowance thereof notwithstanding.

L. And be it further enacted, That it shall not be necessary in Perfonal Service any Proceeding for the Recovery of any Penalty under this Act, or of Process not under any Act or Acts in force from time to time, for the Payment neceffary. of the faid Rates, Duties and Taxes, or any of them, or for regulating any fuch Rates, Duties or Taxes, or any of them, or the Collection thereof, whether the fame shall be by Action of Debt, Bill, Plaint or Information, or by Civil Bill, or by any Proceeding before a Magiftrate or Magiftrates, or on any Writ of Error or Appeal from any Decifion, that the Original or any other Procefs or Summons, or any Notice or Order whatsoever fhould be perfonally ferved on the Defendant or Defendants, or any of them; but it fhall in all such cases be fufficient, that the fame or a Copy thereof be served or posted, as the cafe may be, at his, her or their then Place or Places of Abode.

LI. And be it further enacted, That if any Perfon or Perfons Witneffes nefhall be fummoned as a Witness or Witneffes to give Evidence in glecting their any cafe under this A&t before any Juftice or Juftices of the Peace, Duty. or before any Justice or Juftices at the Seffions, and fhall neglect or refufe to appear, the Expence of fuch Witnefs or Witneffes, if he, The or they fhall be required to go to a greater Distance than Five Miles from Home, being first paid or tendered without a reasonable Excufe to be allowed by fuch Juftice or Juftices of the Peace, or Juftice or Juftices refpectively, or upon appearing fhall refufe to be Refufing to be examined upon Oath, or to give Evidence before fuch Juftice or examined. Juftices of the Peace, or Juftice or Juftices at Seffions refpectively, and fhall not make reasonable Excufe for fuch Refufal, to be allowed by fuch Juftice or Juftices of the Peace, or Juftice or Juftices at Seffions refpectively, then fuch Perfon or Perfons fhall for every fuch Offence forfeit the Sum of Twenty Pounds. LII. And be it further enacted, That on any Trial or other Proceeding for Recovery of any Penalty under this Act or under any Act relating to the faid Rates, Duties and Taxes, any Informer or other Perfon who in the Event of a Conviction would be entitled to the Penalty to be recovered thereon, or to any Part, Share or Proportion thereof, or to any Fee, Profit, Reward or Emolument whatfoever, fhall nevertheless be received, and admitted as a Witness on fuch Trial or other Proceeding, and fuch Teftimony fhall, if believed, be fufficient thereon, to all Intents and Purposes, fo far as the fame Teftimony could be if given by any indifferent Perfon.

LVI. And be it further enacted, That every Clerk of the Peace in Ireland fhall within One Calendar Month after any fuch Conviction fhall have been returned to his Office, furnifh to the Collector of Excife, or other Officer in charge of the District in and for the County in which fuch Conviction fhall have been made, a Copy of fuch Conviction figned by himself, for which he fhall receive from fuch Collector or other Officer in charge as aforefaid, the Sum of One Shilling and no more; and every fuch Collector or other Officer in charge fhall forthwith tranfmit fuch Copy fo figned to the faid Commiffioners of Inland Excife and Taxes; and if any fuch Clerk of the Peace or Collector or other Officer in charge as aforefaid, fhall neglect or omit fo to do refpectively, every Perfon fo offending fhall for every fuch Offence forfeit the Sum of Ten Pounds. the Offence was committed; and if any fuch Juftice of the Peace fhall Juftice not payneglect or omit fo to pay over the fame, he shall for every fuch Offence ing fame. forfeit the Sum of Twenty Pounds. Penalty.

LVIII. And be it further enacted, That if any Juftice of the Juftices neglectPeace, Magiftrate or Peace Officer in Ireland, fhall neglect or refuse ing their Duty. in any Inftance to carry into Execution this Act, or any Act or Acts which is or fhall be in force in Ireland, relating in anywife to the Payment, Regulation or Collection of the faid Rates, Duties and Taxes, or any of them, or any of the Provifions of any fuch Act or Acts, upon proper Application made to him, fuch Juftice of the Peace, Magiftrate or Peace Officer fhall forfeit the Sum of Forty Penalty. Pounds for every fuch Neglect or Refufal.

LIX. And be it further enacted, That it fhall and may be lawful Commissioners for the Commiffioners of Inland Excife and Taxes in Ireland, or any may mitigate Three of them, to abate, reduce or mitigate any Fine or Penalty Penalties. which shall at any time be impofed under the Authority of this Act, or under any Act or Acts which shall from time to time be in force in Ireland, relating in anywife to the Payment, Regulation or Collection of the faid Rates, Duties and Taxes, or any of them; provided that every fuch Abatement, Reduction and Mitigation, fhall be under and fubject to all fuch Rules and Regulation as by any A& or Acts now or hereafter to be in force in Ireland, any Fine or Pemalty incurred for any Offence against any A&t or Acts relating to the Revenue of Excife, fhall or may be abated, reduced or mitigated.

LX. And be it further enacted, That all and every the Fines or Penalties paid in Penalties which shall be incurred under this Act, or under any Act or Britith CurActs which is, are or shall be in force in Ireland, in any wife relating rency. to the Payment, Regulation or Collection of the faid Rates, Duties
