more, and fhall thereupon without farther Charge give a Certificate of fuch Appearance, which Certificate shall be annexed to and filed, together with the First Anfwer, Plea, Demurrer or other Pleading of what nature or kind foever, which fhall be thereafter put in fuch Caufe by or on behalf of the Party fo appearing; and if any fuch Anfwer, Plea, Demurrer or other Pleading fhall be filed without having fuch Certificate annexed thereto, then any Officer receiving or filing the fame fhall forfeit and pay the Sum of Ten Pounds.

LXXII. And be it further enacted, That every Person who fhall, for or in Expectation of any Fee, Gain or Reward, directly or indirectly, draw or prepare any Conveyance of or Deed relating to any Real or Perfonal Eftate, or any Proceedings in Law or Equity, other than and except Serjeants at Law and Barristers, and alfo Solicitors, Attornies, Notaries, Proctors or Procurators, having obtained regular Certificates as fuch, and Perfons having taken out the Certificates mentioned in the Schedule to this Act, for drawing or preparing any of the faid matters in Expectation of any Fee or Reward, and other than and except Perfons folely employed to engrofs any Deed, Inftrument or other Proceedings not drawn or prepared by themfelves and for their own Account refpectively, and other than and except public Officers drawing or preparing Official Inftruments applicable to their respective Offices and in the course of their Duty, fhall forfeit and pay for every fuch Offence the Sum of Fifty Pounds: Provided always, that nothing herein contained shall extend or be conftrued to extend to prevent any Perfon or Perfons drawing or preparing any Will or other Teftamentary Paper, or any Agreement not under Seal, or any Letter of Attorney.

LXXIII. And be it further enacted, That a Memorandum of every Petition to or in the Court of Chancery, or to the Lord Chancellor, or Lords Commiffioners of the Great Seal in Ireland, in any Caufe or matter whatsoever, fhall, before delivering the fame to the Secretary of the Lord Chancellor or Lords Commiffioners of the Great Seal, or to the Perfon then acting as fuch Secretary, or on his behalf, be entered in the Office of the Registrar of the said Court in a Book to be by him kept for that Purpose, for which Entry fuch Regiftrar fhall receive a Fee of One Shilling, and no more; and fuch Regiftrar fhall thereupon certify at the Foot of fuch Petition that the fame is fo entered; and if fuch Secretary, or any Person acting as or on behalf of fuch Secretary, fhall receive any fuch Petition without fuch Certificate at the Foot thereof, he shall for every such Offence forfeit the Sum of Five Pounds, and any Order made on fuch Petition fhall be null and void to all Intents and Purposes whatsoever.

LXXIV. And be it further enacted, That a Memorandum of any Petition in or to the Court of Exchequer in Ireland shall, before delivering the fame to the proper Officer of the faid Court, be entered in the Office of the Philazer in a Book to be by him kept for that Purpose, for which Entry fuch Philazer fhall receive a Fee of One Shilling and no more; and fuch Philazer shall thereupon certify at the Foot of fuch Petition that the fame is fo entered; and if fuch Officer, or any Person acting as or on behalf of fuch Officer, shall receive any fuch

LXXV. And be it further enacted, That for the entering of any fuch Petition in either of the faid Courts of Chancery and Exchequer, or for any Attendance for the Purpose of fuch Entry, no Charge whatsoever shall be made by any Six Clerk, Attorney or Solicitor, nor fhall any Sum be received for the fame, save only the Amount of the Duty actually paid thereon.

LXXVI. And be it further enacted, That if any Six Clerk in the Court of Chancery, or any Attorney or Solicitor, or any Proctor in any Ecclefiaftical or Admiralty Court in Ireland, or any other Perfon whatfoever, fhall charge to or receive from the Plaintiff or Defendant, Promovant or Impugnant in any Suit, or to or from any other Perfon whatfoever on any Occafion, the Amount of any Stamp Duty, and fhall not have actually made use of, or iffued, or filed the Warrant, Writ, Monition, Procefs, Pleading, Rule, Order, Record, Inftru ment or Proceeding for which fuch Charge fhall be made or fuch Amount fhall be received duly ftamped with the Duty which shall be payable thereon at the time of fo ufing, iffuing or filing the fame, fuch Six Clerk, Attorney, Solicitor, Proctor or other Perfon, fhall for every fuch Offence forfeit the Sum of One hundred Pounds; and Penalty. if any Six Clerk, Attorney, Solicitor, Proctor or other Person shall charge to or receive from any Plaintiff or Defendant, Promovant or Impugnant or other Perfon, any Sum as and for the Coft, Expence or Charge of or for any Warrant, Writ, Monition, Procefs, Pleading, Rule, Order, Record, Inftrument or Proceeding, every fuch Six Clerk, Attorney, Solicitor, Proctor or other Perfon, fhall be deemed and taken to have included in fuch Charge, and to have thereby charged to or received from fuch Perfon the Amount of the proper Stamp Duty on fuch Warrant, Writ, Monition, Procefs, Pleading, Rule, Order, Record, Inftrument or Proceeding.

Taxing of Bills

of Cofts, how to be proceeded in.

LXXVII. And be it further enacted, That where any Bill of Cofts fhall be taxed in any of His Majefty's Courts of Chancery or Exchequer in Ireland, in which there fhall be any Charge or Charges for drawing or for ingroffing on Parchment any Bills, Anfwers or other Equity Pleadings in the faid Courts refpectively, which shall be engroffed or written or filed in either of the faid Courts, the Officer who fhall tax fuch Bill of Costs shall tax the Charges for drawing and engroffing fuch Bills, Anfwers and other Pleadings refpectively, fo as not to exceed the ufual Charge by the Skin, according to the Number and Amount of the Stamps actually appearing on fuch Pleadings refpectively; and fuch Officer, if the Bill of Cofts to be taxed be in a Caufe in the Court of Chancery, fhall fignify at the Foot of fuch Bill of Cofts that the Number and Amount of the Stamps appearing on the Pleadings mentioned therein hath been certified to him by the Mafter or Keeper of the Rolls of the Court of Chancery, or his Deputy; and if fuch Bill of Cofts be in a Caufe in the Court of Exchequer, the Officer who fhall tax the fame fhall fignify at the Foot of fuch Bill that he hath infpected the Engroffments of the Pleadings mentioned in fuch Bill of Cofts; and in cafe fuch Officer offendOfficer refpectively who fhall tax fuch Bill of Cofts as aforefaid, fhall ing. neglect or refufe to apply to the Clerk of the Rolls for fuch Certifi

cate as aforefaid, or to infpect the Engroffments of the Pleadings mentioned in fuch Bill of Cofts, or fhall neglect or refuse to tax the Charges for drawing or engroffing fuch Bills, Anfwers or other Pleadings in manner hereinbefore directed refpectively, every fuch Officer fo neglecting or refufing refpectively as aforefaid fhall forfeit for every fuch Neglect or Refufal the Sum of Ten Pounds; and in case the Mafter or Keeper of the Rolls of the Court of Chancery, or his Deputy, shall neglect or refuse to inspect the Number and Amount of Stamps appearing on every fuch Pleading as aforefaid, or to certify the fame to the proper Officer of fuch Court, upon being applied to by him for that Purpose, or if any of the Officers aforefaid fhall certify any thing falfe, fuch Mafter or Keeper of the Rolls, or his Deputy or other Officer, shall for every fuch Neglect or Refufal, or Falfehood, forfeit in like manner the Sum of Ten Pounds; which faid feveral Forfeitures, together with the Cofts of recovering the fame, shall be enforced in a fummary way upon Motion by Order of the faid Courts of Chancery or Exchequer, upon Complaint made to them refpectively against any Officer who fhall be guilty of any fuch Neglect, Refufal or Mifconduct, and fhall enure to His Majefty, his Heirs and Succeffors.

LXXVIII. And be it further enacted, That all and every the Stamp Duties and Duty which shall be payable for and in refpect of any Office Copy of any Private Act of Parliament, or of any Bill, Anfwer or other Pleading, Depofition or Depofitions, Interrogatory or Interrogatories, or Decree in any Court of Equity in Ireland, or of any Inrolment of any Letters Patent, Grant, Deed or other matter whatsoever, which is or shall be inrolled in the Rolls Office in Ireland, which shall be issued after the Commencement of this A&t, shall be paid and payable in manner hereinafter mentioned, and no other; that is to fay, fuch Office Copy shall be written on Paper not ftamped with any Stamp whatfoever, and when and as foon as the fame shall be ready for Atteftation or Delivery refpectively, the proper Officer for attefting or delivering out the fame refpectively fhall cause the fame refpectively to be carried to the Stamp Office, and there delivered to fuch Perfon as fhall be appointed for that Purpose by the Commif. fioners of Stamps; and thereupon fuch Perfon fhall carefully examine every fuch Office Copy refpectively, and fhall certify on the Back thereof respectively the Amount of the Stamp Duty then payable by Law thereon refpectively, and the Double Stamp Duty fo payable in the cafe of Office Copies of any Depofition or Depofitions if the fame fhall be required, and alfo the Number of Skins, Sheets or Words in every fuch Office Copy refpectively, and in refpect whereof fuch Stamp or Stamps or Double Stamps fhall be fo marked, and fhall, in a Book or Books to be kept for that Purpose, make Entry thereof to remain in the faid Stamp Office, and the Amount of fuch Stamp Duty fhall and may be thereupon paid to the Receiver General of Stamp Duties by the Officer or Perfon producing fuch Office Copy at the Stamp Office, and the said Receiver General fhall give a Certificate of fuch Payment, and upon the Delivery of fuch Certificate to the Perfon fo appointed by the Commiffioners of Stamps as aforefaid, he fhall caufe fome Part or Parts of fuch Office Copy to be famped with One or more Stamps, expreffive of the Amount of the Duty fo paid, and fhall then fend the faid Office Copy fo ftamped

back to the proper Officer for attefting or delivering out any fuch Office Copy or Copies refpectively.

LXXIX. And be it further enacted, That if any fuch Officer of Officers not any fuch Court of Equity in Ireland fhall omit or neglect to fend or fending fuch carry any fuch Copy to the faid Stamp Office, or to deliver or caufe Office Copies to be stamped. to be delivered the fame to the Perfon who fhall be fo then appointed for that Purpose by the faid Commiffioners of Stamps, or if any such Officer of fuch Court of Equity fhall atteft or permit to be attefted or delivered out, or permit to be delivered out any fuch Office Copy of any fuch Private Act of Parliament, Bill, Anfwer, Pleading, Depofition or Depofitions, Interrogatory or Interrogatories, Decree or Inrolment, which fhall not have been fo duly ftamped, every fuch Officer fhall for every such Offence forfeit the Sum of Fifty Pounds. LXXX. And be it further enacted, That every fuch Officer of every Court of Equity in Ireland acting in pursuance of this Act, fhall be entitled to an Allowance at the Rate of One Pound Ten Shillings for every One hundred Pounds out of the Duty fo paid by him; and it fhall not be lawful for any fuch Officer, or any Perfon employed by him, to afk, demand or receive any Fee, Profit or Reward, for or in confideration of any of the said matters so required by this Act to be done by him, or any other Benefit thereon whatfoever, fave only the faid Per Centage; and if any fuch Officer or any Perfon employed by him or acting on his behalf, in any of the faid matters, fhall offend herein, he shall for every fuch Offence forfeit the Sum of Fifty Pounds.

LXXXI. And be it further enacted, That any Charge in any In taxing Bills of Bill of Cofts for drawing, copying or engroffing any Deed or Deeds, Cofts Deeds to executed after the Commencement of this Act, fhall be taxed and al- be inspected by the proper Offlowed fo as not to exceed the ufual Charge by the Skin, calculated according to the Number and Amount of the Stamps actually appearing on the Vellum, Parchment or Paper on which the whole of fuch Deed or Deeds fhall be refpectively engroffed; and in order to enable the taxing Officer fo to tax any fuch Charge, there fhall be produced to him, at the time of fuch Taxation, each and every such original Deed, or a Certificate of fuch Officer as shall be appointed Certificate of for that Purpose, by the faid Commiffioners at the Stamp Office in Officer. Dublin, or of the Distributor of Stamps of the District in which such Deed fhall have been executed, certifying that fuch Officer or Diftributor hath infpected fuch Deed, and ftating the Number and Amount of the Stamp or Stamps actually appearing theron, and giving in fuch Certificate fuch Defcription of fuch Deed as fhall be fufficient to identify the fame, for which Certificate every fuch Officer or Distri

butor fhall be entitled to the Sum of Sixpence and no more; and Officer neglectif any fuch Officer or Distributor respectively shall refufe or neglect ing to grant Certo grant fuch Certificate on Demand and Production of fuch Ďeed tificate.

LXXXIII. And be it further enacted, That the Copy of any Affidavit which fhall be read in any Court whatever in Ireland shall be engroffed or written in fuch manner as that the Quantity of Writing contained in any One Sheet or Piece of Paper shall not be deemed more than One Sheet, according to the manner in which the Officers of the Courts in which fuch Affidavit fhall be refpectively filed charge by the Sheet for fuch Affidavit; and if any Officer of any Court shall charge or demand for the Quantity of Writing contained in any One Sheet or Piece of Paper on which any Copy of fuch Affidavit shall be written, more than the Fees to which he would be entitled for One Sheet, according to the Courfe of the Court in which fuch Affidavit fhall be filed, he shall for every fuch Charge fo made or demanded forfeit and pay the Sum of Ten Pounds, with Treble Cofts of Suit.

LXXXIV. And be it further enacted, That where more than One Side or Page of any Sheet of Paper fhall be ftamped or marked with the Duties which shall then be by Law charged on the Paper on which fuch Copy of an Affidavit fhall be written, each Side or Page fo marked or stamped fhall be deemed a feparate Sheet or Piece of Paper within the Intent and meaning of this Act, and of every A& in force from time to time for the Impofing, Collection or Management of any Stamp Duty, unless the contrary fhall be exprefsly

declared.

LXXXV. And be it further enacted, That all Records, Writs, Pleadings and other Proceedings in the Courts of Law and Equity, and Ecclefiaftical Courts, Courts of Admiralty, and all other Courts in Ireland, and all Office Copies thereof refpectively, which fhall from time to time be charged with any Stamp Duty, fhall be engroffed or written in fuch manner as they ufually have been accuftomed to be written, fave as is or may be otherwife provided by Law. LXXXVI. And be it further enacted, That every attefted Copy of any Interrogatory or Interrogatories, or Depofition or Depofitions in the Court of Chancery or in the Equity Side of the Court of Exchequer, fhall be figned by the Examiners of the said Courts refpe&tively, and every fuch Examiner fhall ftate and appoint in Writing at the Foot of every fuch attefted Copy, whether the fame is to be read by or on the Part of the Plaintiff or Plaintiffs, or by or on the Part of the Defendant or Defendants in the Suit in which fuch Interrogatories or Depofitions fhall have been taken; and it fhall not be lawful for any fuch Plaintiff to read or give in Evidence any Copy of fuch Interrogatories or Depofitions which fhall be fo appointed to be read on behalf of any Defendant in fuch Suit, nor for any Defendant to read or give in Evidence any fuch Copy which fhall be appointed to be fo read on behalf of any Plaintiff or Complainant, unless the fame refpectively fhall be ftamped with a Second Set of Stamps equal to the First Stamps impofed thereon, any Law, Ufage or Cuftom to the contrary notwithstanding; and every fuch Examiner fhall give fuch attefted Copy, doubly ftamped, to any Party requiring the fame, and offering to pay for the fame the Amount of fuch Second Set of Stamps in addition to the ufual Charge. LXXXVII. And be it further enacted, That no Depofition fhall ing Infpection of be entered as read on behalf of any Plaintiff or Defendant refpectfuch Copies.
