may be vefted in them, and alfo for all and every Company of Undertakers or Proprietors of any other Canal or Inland Navigation in Ireland, with refpect to fuch Canals or Navigations refpectively as are not or fhall not be vefted in the faid Directors, to fue for and recover Satisfaction and Amends for the Injury, Lofs or Damage fo done as aforefaid, at the next Affizes to be held for the County where fuch Offence was committed, by prefenting a Petition to the Grand Jury impannelled and fworn at fuch Affizes, praying fuch Satisfaction and Amends, and fetting forth the Extent and Amount of the Injury, Lofs and Damage done as aforefaid, and proving to the Satisfaction of the faid Grand Jury, that fuch Injuries and Damages were maliciously, wantonly or intentionally done as aforefaid, and the Extent and Amount thereof; and thereupon the faid Grand Jury Prefentment by fhall, and they are hereby required to prefent fuch Sum or Sums of Grand Jury. Money as shall be sufficient to repair and make good the Lofs, Injury and Damage fo done as aforefaid, to be raised either on the County at large or on the Barony or Baronies, Town or Towns in or near to which fuch Injury or Damage fhall have been committed, or any of them, and in fuch Proportions as they shall think fit; which How levied. Sums, fo prefented as aforefaid, fhall be applotted, levied, and raifed, by fuch Ways and Means, and in fuch Manner and Form as Money prefented at the Affizes fhall be applotted, levied, and raised within fuch County, pursuant to the Laws now in force, and fhall be paid over to the faid Directors.

XI. Provided always, and be it further enacted, That the faid Directors or the Company of Undertakers or Proprietors of any Canal or Navigation not vefted in the faid Directors, or fome Perfon or Perfons on their Behalf respectively, shall within Ten Days next after fuch Injury and Damage done and committed as aforefaid, give Notice of fuch Injury and Damage to the High Conftable of the Barony, and to the Churchwardens of the Parish where fuch Fact fhall be alledged to have been committed, if fuch High Conftable and Churchwardens fhall refpectively refide in fuch Barony and Parish; and if no High Conftable or Churchwardens fhall refide in fuch Barony or Parish respectively, then to Two or more Inhabitants of fuch Barony or Parish: Provided also, that if fuch Fact fhall be committed fo near the time of holding the next Affizes, that Notice cannot be given before the First Day of fuch Affizes, according to the Direction of this Act, it fhall and may be lawful for the faid Directors or Company, or Proprietors, as the cafe may be, to prefer their Petition, and obtain fuch Prefentment at the next enfuing Affizes after fuch due Notice fhall be given as aforefaid.

XII. XIII. Provided alfo, and be it enacted, That the Sum or Sums of Money fo prefented as aforefaid, fhall not be raised or levied until after the Affizes next enfuing the Affizes at which the same shall be prefented as aforefaid; and that in cafe the Perfon or Persons who fhall have committed any fuch Injury or Damage, or any of them, shall be convicted of fuch Offence, then and in such case no Sum of Money fhall be raised or levied in purfuance of any fuch Prefentment; any thing herein contained to the contrary in any wife notwithftanding.

XIV. And be it further enacted, That it fhall and may be lawful to and for all and every Body and Bodies Politic, Corporate or Collegiate, Corporations Aggregate or Sole, Ecclefiaftical Perfons, Tenants in Tail, Tenants for Life, Hufbands feized in Right of their Wives, Married Women, Guardians, Trustees and Feoffees in Truft, Committees of Lunatics and Infane Perfons, Executors and Adminiftrators, and all other Perfons whomfoever, not only on Behalf of themselves, their Heirs and Succeffors, but also for and on Behalf of thofe for whom they are Trustees or Guardians, whether Infants, Iffue unborn, Lunatics, Idiots, Married Women or other Perfon or Perfons, and to and for all Married Women who are or fhall be feized, poffeffed of, or interested, in their own Right, or entitled to Dower or other Intereft, and for every Perfon and Perfons who is, are or shall be in any Way seised, poffeffed of, or interefted in any Lands, Houses, Tenements or Hereditaments, which the faid Directors fhall at any time think neceffary to occupy, ufe or take in, for the Purpose of making, enlarging, altering, widening or extending any Canal or Navigation, or any Off Branch or Supply Cut, or any Works thereunto belonging, to contract and agree for, fell and convey the fame, and every Part thereof, unto the faid Directors; and all Bodies Politic, Corporate or Collegiate, and all Ecclefiaftical and other Perfons aforefaid, fo conveying as aforefaid, are hereby indemnified for fuch Acts as they fhall refpectively do in relation to any fuch Sale which he, fhe or they, or any of them, shall make by virtue and in pursuance of this Act; and all fuch Contracts, Sales, Conveyances, and Affurances of any Lands, Houfes, Tenements or Hereditaments, fhall be made to the said Directors according to the form following; (videlicet)

XV. And be it further enacted, That the Registrar or Deputy Registrar of the faid Registry Office fhall, from time to time when required, deliver an attefted Copy or Copies of fuch Memorial or Memorials to any Perfon or Perfons requiring the fame; which said attefted Copy or Copies fhall be admitted and received as Evidence in all Courts of Law and Equity in Ireland.

XVI. And be it further enacted, That if any Money fhall be paid or agreed to be paid for the Purchase of any Lands, Tenements or Hereditaments, purchased, taken or used by virtue of the Powers of this A&t for the Purposes thereof, which shall belong to any Body Politic, Corporate or Collegiate, or to any Feoffee in Truft, Executor, Adminiftrator, Hufband, Guardian, Committee or other Trustee, for or on Behalf of any Infant, Lunatic, Idiot, Feme Covert, or other Ceftuique Truft, or to any Person whose Lands, Tenements or Hereditaments are limited in ftrict or other Settlement, or to any Perfon under any other Difability or Incapacity whatsoever, fuch Money fhall, in cafe the fame fhall amount to the Sum of Two hundred Pounds, with all convenient Speed be paid into the Bank of Ireland, in the Name and with the Privity of the Accountant General of the High Court of Chancery in Ireland, to be placed to his Account there "Ex parte the Directors of In"land Navigation in Ireland," to the Intent that fuch Money fhall be applied, under the Direction and with the Approbation of the faid Court, to be fignified by an Order made upon a Petition to be preferred in a fummary Way, by the Perfon or Perfons who would have been entitled to the Rents and Profits of the faid Lands, Tenements and Hereditaments, in Discharge of any Debt or Debts or fuch other Incumbrances or Part thereof, as the faid Court fhall authorize to be paid affecting the fame Lands, Tenements or Hereditaments, or affecting other Lands, Tenements or Hereditaments ftanding fettled therewith, to the fame or the like Ufes, Intents or Purpofes; or where fuch Money fhall not be fo applied, then the In what cafe laid fame fhall be laid out and invefted, under the like Direction and out in Purchase Approbation of the faid Court, in the Purchase of other Lands, of Lands, &c. and in the fame manner as the Lands, Tenements or Hereditaments, which fhall be fo purchased, taken or used as aforefaid, stood fettled or limited, or fuch of them as at the time of making fuch Conveyance and Settlement shall be exifting, undetermined, and capable of taking Effect; and in the mean time and until fuch Purchase shall be made, the faid Money fhall by Order of the faid Court, upon Application thereto, be invested by the faid Accountant General in his Name, in the Purchase of Government Securities; and in the mean time, and until the faid Government Securities fhall be ordered by the faid Court to be fold for the Purposes aforesaid, the Dividends and annual Produce of fuch Government Securities fhall from time to time be paid by Order of the faid Court, to the Perfon or Perfons who would for the time being have been entitled to the Rents and Profits of the faid Lands, Tenements and Hereditaments, fo directed to be purchased by virtue of this Act, in cafe fuch Purchafe or Settlement were made.

XVII. Provided always, and be it further enacted, That if any Money so agreed to be paid for any Lands, Tenements or Hereditaments, purchased, taken or used for the Purposes aforefaid, and belonging to any Corporation, or to any Perfon or Perfons under any Difability or Incapacity as aforefaid, fhall be less than the Sum of Two hundred Pounds, and fhall exceed or be equal to the Sum of Twenty Pounds, then and in all fuch cafes the fame fhall, at the Option of the Perfon or Perfons for the time being entitled to the Rents and Profits of the Lands, Tenements or Hereditaments fo purchased, taken or used, or of his, her or their Guardian or Guardians, Committee or Committees, in cafe of Infancy, Idiotcy or Lunacy, to be fignified in Writing under their respective Hands, be paid into the Bank of Ireland, in the Name and with the Privity of the Accountant General of the High Court of Chancery in Ireland, and be placed to his Account as aforefaid, in order to be applied in manner hereinbefore directed, or otherwise the same shall be paid, at the like Option, to Two Trustees to be nominated by the Perfon or Perfons making fuch Option, and approved of by the faid Directors of Inland Navigation in Ireland (fuch Nomination and Approbation to be fignified in Writing under the Hands of the nominating and approving Parties) in order that fuch Principal Money, and the Dividends arifing thereon, may be applied in any manner hereinbefore directed, fo far as the cafe may be applicable, without obtaining or being required to obtain the Direction or Approbation of the Court of Chancery.

XVIII. Provided always, and be it further enacted, That where fuch Money fo agreed to be paid as next before mentioned fhall be lefs than Twenty Pounds, then and in all fuch cases the fame shall be applied to the Ufe of the Person or Perfons who would for the time being have been entitled to the Rents and Profits of the Lands, Tenements or Hereditaments fo purchased, taken or used for the Purposes of this Act; or in cafe of Infancy, Idiotcy or Lunacy, then fuch Money fhall be paid to his, her or their Guardian or Guardians, Committee or Committees, to and for the Ufe and Benefit of fuch Perfon or Perfons fo entitled refpectively.

XIX. And be it further enacted, That in cafe any Perfon or Perfons who fhall have agreed to receive any Sum or Sums of Money for the Purchafe of any Lands, Tenements or Heredita

High Court of Chancery, to be placed to his Account to the Credit
of the Parties interested in the faid Lands, Tenements or Heredit-
aments [deferibing them], fubject to the Order, Controul and Dif- fubject to Order

Chancery, on the Application of any Perfon or Perfons making Chancery on
Claim to fuch Sum or Sums of Money, or any Part thereof, by
Motion or Petition, fhall be and is hereby empowered in a fummary
way of Proceeding, or otherwife, as to the fame Court fhall seem
meet, to order the fame to be laid out and invefted in the Public
Funds, and to order Diftribution thereof, or Payment of the Divi-
dends thereof, according to the respective Eftate or Estates, Title
or Interest of the Perfon or Perfons making claim thereunto, and to
make fuch other Order in the Premises as to the faid Court fhall
feem juft and reasonable; and the Cafhier or Cafhiers of the Bank
of Ireland, who fhall receive fuch Sum or Sums of Money, is and
are hereby required to give a Receipt or Receipts for fuch Sum or
Sums of Money, mentioning and fpecifying for what and for whofe
Use the fame is or are received, to fuch Perfon or Perfons as fhall
pay any fuch Sum or Sums of Money into the Bank as aforefaid.

XX. Provided always, and be it further enacted, That where any Question fhall arife touching the Title of any Perfon to any Money to be paid into the Bank of Ireland, in the Name and with the Privity of the Accountant General of the Court of Chancery, in purfuance of this Act, for the Purchase of any Lands, Tenements, or Hereditaments, or of any Eftate, Right, or Intereft in any Lands, Tenements, or Hereditaments, to be purchafed in purfuance of this Act, or to any Government Securities to be purchafed with any fuch Money, or the Dividends or Intereft of any fuch Government Securities, the Perfon or Perfons who fhall have been in Poffeffion of fuch Lands, Tenements or Hereditaments at the time of fuch Purchase, and all Perfons claiming under fuch Perfon or Perfons, or under the Poffeffion of fuch Perfon or Perfons, fhall be deemed and taken to have been lawfully entitled to fuch Lands, Tenements, or Hereditaments, according to fuch Poffeffion, until the contrary fhall be fhewn to the Satisfaction of the faid High Court of Chancery; and the Dividends and Interest of such Government Securities, and alfo the Capital of fuch Government Securities, fhall be paid, applied, and difpofed of accordingly; unlefs it fhall be made appear to the faid Court that fuch Poffeffion was a wrongful Poffeffion, and that fome other Perfon or Perfons was or were lawfully entitled to fuch Lands, Tenements, or Hereditaments, or to fome Eftate or Intereft therein.

XXI.
